SECTION SF 30 BLOCK 14 CONTINUATION PAGE

The following items are applicable to this modification:

1) The proposal closing date is 13 November 2014 at 1:00 p.m. local time.

2) Offerors are reminded that Bidders’ Questions (Attachment J-15) and Past Performance Information (Attachments J-13 and J-14) were due 1:00 p.m. on November 5, 2014 and are no longer being accepted.

3) Only authorized representatives may deliver and submit proposals. Allow adequate time to gain access to the Norfolk Naval Shipyard prior to proposal closing time and date (See RMC L-2-0019). Refer to RMC L-2-0020 for postal and express delivery.

4) Please use the following group email address to request information as it pertains to the solicitation:

MARMC_NRFK_411_PROCUREMENT@navy.mil

5) Offerors are reminded that the latest and most up-to-date conformed copy of the solicitation is to be submitted with their proposal.

6) The following bidder’s question and answer shall be considered when submitting a proposal on the subject solicitation.

Q.1 Page 91 of the RFP lists the type of contract as FFP. The solicitation reads, “The Government contemplates award of a Firm Fixed Price, Indefinite Delivery/Indefinite Quantity contract resulting from this solicitation.”

Per FAR 16.202-1, the definition of a FFP contract is as follows: “A firm-fixed-price contract provides for a price that is not subject to any adjustment on the basis of the contractor’s cost experience in performing the contract. This contract type places upon the contractor maximum risk and full responsibility for all costs and resulting profit or loss. It provides maximum incentive for the contractor to control costs and perform effectively and imposes a minimum administrative burden upon the contracting parties” (emphasis added).

Page 12 and page 18 of the RFP both state that “The Government shall be entitled to a credit at the end of the task order for hours ordered and not used as determined by the weekly requirements list at the price quoted and incorporated into the task order...”

This statement appears to be at odds with the definition of a FFP contract. Will the Government please advise offerors of the actual type of contract contemplated?

A.1 The referenced statements within the solicitation have been removed. The contract type for this requirement will be Firm-Fixed-Priced.

Q.2 The due date of Proposals is Wednesday 12 November, the day after the Veteran’s Day Federal Holiday. Please consider changing the due date to Friday 14 November so that offerors may observe the Holiday. Thank you in advance for your consideration.

A.2 The subject solicitation’s proposal submission due date was extended from 12 November 2014 to Thursday, 13 November 2014 in Amendment 0004 due to the original proposal submission due date falling the day after Veteran’s Day. Therefore, the proposal submission date remains 13 November 2014 at 1:00 p.m.

Q.3 Security Clearance – Will the government assist a Teaming partner to obtain a clearance?

A.3 The prime contractor shall be responsible for an approved facility security clearance in accordance with the solicitation. The Government will sponsor if assistance is required.

Q.4 Technology – any restrictions on using Wireless, Android OS assuming there is no camera function on the ship for key personnel.

A.4 Phones with no camera capability are allowed for usage as long as the cell phone user is using the data plan that accompanies the cell phone. Access to WIFI is not available. For phones with the camera removed and other general camera cell phone questions, please see below.

Camera Cell Phone Information

A change in camera cell phone policy will now allow personal camera cell phones in some general areas outside the Controlled Industrial Area (CIA) such as parking lots, eating establishments, gym, barracks, chapel, etc. Therefore personnel can leave a camera cell phone in their vehicles. Camera cell phones are still prohibited for all areas inside the CIA. Additionally, they are prohibited from office/work spaces where NAVSEA business is conducted outside of the CIA. Unofficial photography of any type remains prohibited (except in authorized locations outside the CIA such as Trophy Park, barracks, inside the chapel, etc.).

NNSY will continue to enforce the prohibition of camera cell phones in the unauthorized areas. NNSY will continue to issue security violations for violators, and as with all security violations, evaluate possibly downgrading the violator's access to classified materials until completion of re-investigation by DONCAF (i.e., determine if violator should remain red-badged). Limitations or complete denial of access will also be evaluated for contractors or military personnel who may only possess a green badge. Work areas or offices used by tenant commands outside the CIA that do not perform work for the shipyard will follow their own internal policy inside those spaces for camera cell phones."

Camera cell phones that have had their camera lenses drilled out and filled with epoxy are no longer considered camera cell phones and will be treated just like a non-camera cell phone.

To report a camera cell phone in an unauthorized area you should contact shipyard police.

Q.5 We will be submitting our proposal in accordance with Regulations and respectfully request your guidance as to where (in what section of the solicitation proposal) may we submit Technology Based Solutions/Cost Savings Measures and Time Saving Nuances that may add Value to this Initiative.

A.5 Interested Offerors shall submit their proposal in accordance with the requirements of solicitation as detailed in sections L &M.

Q.6 Disclosure - Are we required to show our burdened rate breakup?

A.6 Interested Offerors shall submit their prices in accordance with the requirements of solicitation as detailed in sections L &M.

Q.7 Start Date – Does the government have an anticipated start date?

A.7 The Government anticipates a start date around January 2015 should an award be made in response to this solicitation.

Q.8 Note 7 page Exhibit A states paragraph C.1.4 contractor provided materials. Should read paragraph C.2.4. Please clarify.

A.8 Note 7 within the attached “Exhibits A-E” spreadsheet should read paragraph C.2.4, not C.1.4. This has been corrected and the updated Attachment “Exhibits A-E” has been uploaded with this Amendment. The corrected Attachment should be used when submitting proposals in response to this solicitation.

SUMMARY OF CHANGES

SECTION C - DESCRIPTIONS AND SPECIFICATIONS

The following have been modified:

STATEMENT OF WORK

C.1. SCOPE OF WORK – GENERAL INFORMATION

C.1.1 The contractor shall provide trained and qualified fire and tank watch personnel that can obtain the appropriate security or have the necessary security clearance to be eligible to obtain a red or green badge from Norfolk Naval Shipyard (NNSY), Portsmouth, Virginia as may be ordered by task orders placed by the Ordering Officer under this contract for items listed in Section B. Fire and tank watch personnel will primarily support maintenance and overhaul work being performed onboard U.S. Naval vessels, including submarines, located at the NNSY. Fire watch and tank watch personnel may occasionally be called upon to support maintenance and overhaul work being performed onboard U.S. Naval vessels located outside NNSY, within a 50 mile radius of NNSY. When ordered, the services shall be in accordance with the requirements outlined in this contract. Personnel assigned to tank watch or fire watch are not authorized to perform these duties concurrently. Duty assignment changes shall not occur until the Onsite Supervisor verifies qualifications are met for the assigned watch.

C.1.2 The contractor shall be responsible for the employment of trained and technically qualified personnel to perform Task Orders. At times work will be required onboard vessels within nuclear spaces that require personnel to have a red badge. In addition, the contractor is responsible for employing and maintaining the personnel, organizational and administrative control necessary to ensure the performance meets all contract specification requirements hereunder and set forth in each individual Task Order.

C.1.3 Contractor personnel will be provided company I.D. (contractor badges) by the contractor, for identification to be used for comparison to visit authorization list. All subcontractor employees must be able to be identified back to both the prime contractor and contract number. If an individual is not listed as "official personnel," he or she will not be authorized to board any vessel.

C.1.4 All red badge contractor personnel working at NNSY and within the 50 mile radius in support of this contract shall have a minimum of a DOD Confidential clearance.

C.1.5 Contractor personnel shall be available for meetings at the Government and/or contractor’s facilities, as required, throughout the performance of this Statement of Work. The MARMC COR shall give notice before meetings. The contractor may also request a meeting by arrangement through the MARMC COR.

C.1.6 On-site supervisor shall attend all morning briefs and any meeting where personnel are in attendance.

C.2 SCOPE OF WORK - FIRE WATCH

C.2.1 The contractor shall provide fire watch support to complete hot work operations in a safe manner and assist shipyard workers in "hot work”.

a. This assistance is provided to enhance the safety of the shipyard worker and the ship. Hot work is defined as all flame heating, welding, torch cutting, brazing, carbon arc gouging, or any work which produces heat, by any means, of 400 degrees Fahrenheit (204 degrees C) or more. NOTE: In the presence of flammables or flammable atmospheres, hot work includes other ignition sources such as spark or arc producing tools or equipment, static discharges, friction, impact, open flames or embers, and non-explosion proof lights, fixtures, motors or equipment. Fire watches are required to be qualified to National Institute of Occupational Safety and Health (NIOSH) and Mine Safety and Health (MSHA) regarding approved respiratory protection and to be equipped with appropriate selected respirator as dictated by the work as previously identified by the ordering authority.

b. "Bag and Drag/General Housecleaning" and "Spotter" duties shall be assigned by the on-site supervisor to fire watches that are released by the government hot work operator to be on standby. The Government hot work operator will release fire watch personnel to standby when hot work is finished and the fire watch is not needed for another fire watch location. The standby status shall go into effect one half hour after hot work is completed. Bag and Drag/General Housecleaning duties are the removal of industrial debris such as sheet metal, steel plate, structured shapes, piping, cable ends, nuts and bolts, spent welding wire, hardware and/or trash from overhead to deck. Spotter duties are coordinating pedestrian traffic with vehicular traffic to maintain pedestrian safety, typically performed at the head or foot of the ship's ramp.

c. The Government will provide a matrix for labor needed by clearance level in the form of quantity and duration so an independent government estimate can be generated for each task order. A task order typically consists of one availability, on a vessel by NNSY lasting as long as twelve months. The matrix will identify the projected number of hours required by type: first shift, second shift, or third shift. The matrix will also identify the projected location of work and number of red and green badge hours needed.

For reporting purposes shifts shall be defined as:

1st shift is typically an 8 hour workday between the hours of 0500 to 1600.

2nd shift is an 8 hour workday between the hours of 1300 and 2400.

3rd shift is an 8 hour workday between the hours of 2100 and 0740.

This schedule covers time to get work assignments and to report to the actual work site with equipment prior to start of the hot work. It also covers the fire watch to continue fire watch one half hour after hot work is completed, in order to comply with the safety requirement to do so. If the stated shifts do not cover the time period required to fully comply with the requirement to fire watch for one half hour after hot work, then the fire watch must stay for the entire one half hour period after hot work is completed.

d. Based on the matrix of projected fire watches for each availability, awardees will provide proposals for each availability. However, the matrix only represents a reservation of fire watch hours. Exact scheduling of how the reserved hours will be utilized will be accomplished weekly during the performance of the task order.

e. Once a task order is awarded, a detailed requirement for the next week period will be given to the contractor by 1200 hours on the Thursday preceding each week of performance covered by the task order (Saturday 1st shift through Friday 3rd shift). The contractor is obligated to provide the number and type of fire watches as specified in the weekly detailed listing of requirements.

f. If the contractor fails to provide the appropriate personnel required to cover the hours listed in the detailed weekly requirements listing, then the contractor shall not receive payment for hours not provided. This is in addition to any other remedy the Government has under the terms of the contract for failure to perform. Otherwise, the contractor will receive payment based on the hours specified in the detailed weekly requirements listing, unless a modification to the task order is issued in advance, which deletes requirements within the detailed weekly requirements list.

g. By 1200 on Tuesdays following each week of performance, the contractor shall submit a report of actual Fire Watches provided. The report shall consist of muster or time sheets showing employee name, NNSY badge number, hours worked, date and shift.

h. The MARMC COR will track hours used under the total task order based on the weekly requirements list.

C.2.2 Responsibility for hot work being performed is that of the Government hot work operator on the assigned ship. Hot work operator shall ensure that hot work can be performed in a safe manner.

C.2.3 Government Provided Materials. The Government will furnish the following to each fire watch:

k. Blind side bulkhead inspection will be performed by the hot work operator and fire watches.

l. The fire watch must understand how to enter a confined or enclosed space safely and what to do in an emergency.

(1) The fire watch has received confined space entry awareness training in accordance with 29 CFR 1915.12(d). A Confined Space is a space which by design has limited and restricted openings for entry and exit, lacks natural ventilation and which could contain or produce hazardous contaminants or oxygen deficiencies or enrichment. Confined spaces are not intended for normal continuous personnel occupancy. All of these factors must be met for a space to be considered a confined space. Some examples of non-shipboard confined spaces are: fuel storage tanks, process vessels, boilers, furnaces, sewers, utility tunnels, vaults, etc. Shipboard confined spaces include: all tanks/voids, cofferdams, double bottoms, etc.

(2) An Enclosed Space is a space which by its nature or design is of such a shape, depth or other feature that natural ventilation or the natural movement of air is restricted. Such spaces include open top storage tanks, pits, machinery spaces, pump rooms, trenches and similar spaces. Personnel working in confined or poorly ventilated enclosed spaces may encounter a number of potentially serious hazards. Such hazards may include a lack of sufficient oxygen to support life with symptoms such as lightheadedness and shortness of breath or excessive oxygen levels, which increase the danger of fire or explosion. Other hazards include the presence of flammable, explosive, or toxic atmosphere indicated by difficulty breathing, unpleasant smell or irritating odor, stinging eyes, etc. These hazards, which are not always obvious by use of your senses (sight or small), can present life-threatening dangers for personnel entering confined or enclosed spaces. Some key things to remember when engaged in confined or enclosed space work is:

(a) Do not enter tanks, voids, and similar confined or poorly ventilated enclosed spaces unless a current gas free certificate is posted.

(b) Fire Watch personnel will be allowed to enter tanks, voids, and similar confined or poorly ventilated enclosed spaces under a current NNSY gas free certificate in accordance with the Competent Person Services Memorandum of Agreement (MOA) between NNSY and the contractor.

(c) Observe all special requirements/precautions that are listed on the gas free certificate and use specific Personal Protective Equipment (PPE) when required.

(d) At least two people shall be involved in all confined space work. In other words, if you have to work alone in a confined space, some other contractor person outside the space must perform frequent checks on you.

(e) Anticipate and recognize hazards that can occur in a confined or enclosed space. Guides and barriers may be used in certain circumstances to protect entrants from hazards such as exposed rotating parts, electrical hazards, etc. Exit the space immediately if you perceive you are in any danger or when evacuation signal or order is given.

(f) If you see an unconscious or obviously disoriented person in a confined or poorly ventilated enclosed space DO NOT ENTER. IMMEDIATELY CALL THE SHIPYARD FIRE DEPARTMENT AT 911 OR 9911 USING SHIPYARD PHONES OR BY PULLING THE FIRE ALARM BOX. (FOR OFF BASE SHIPBOARD WORK, IMMEDIATELY NOTIFY THE QUARTER DECK). They have the proper equipment and training to accomplish a safe emergency rescue from these spaces. You do not know why the person went down. There may be a problem with the atmosphere in the space and if you attempt to enter you may also be overcome.

m. The fire watch will perform bag and drag/general housecleaning duties or spotter duties when on standby.

C.3 SCOPE OF WORK - TANK WATCH

C.3.1 Tank Watch shall include an individual stationed outside one or more confined and poorly ventilated enclosed spaces who monitors authorized entrants and is trained to perform all Confined and Poorly Ventilated Enclosed Space Watch duties. i. Be able to recognize a valid NNSY Confined Space Certificate (date posted, expiration date and time of expiration, Safe for Hot work, Safe for Entry and not safe for entry).

j. Know that entry into a confined or poorly ventilated enclosed space is not authorized without a posted Confined Space Certificate.

k. Continue to use updated versions of all references listed in section C.5 as they occur during the period of performance of this SOW.

l. “Bag and Drag/General Housecleaning” and “Spotter” duties shall be assigned by the On-Site Supervisor to a Tank Watch that has been released by the government’s Tank Area Manager (TAM) to a standby capacity. The government TAM will release Tank Watch personnel to standby when tank watch duties are finished and the Tank Watch is not needed in another location. The standby status goes into effect one half hour after tank watch duties are completed. Bag and Drag/General Housecleaning duties are the removal of industrial debris such as sheet metal, steel plate, structured shapes, piping, cable ends, nuts and bolts, spent welding wire, hardware and/or trash from overhead to deck. Spotter duties include coordinating pedestrian traffic with vehicular traffic to maintain pedestrian safety, typically performed at the head or foot of the ship’s ramp.

C.3.3 Detailed Weekly Requirements (DWR):

a. Once a task order is awarded, a detailed requirement for the next week period will be given to the contractor by 1200 hours on the Thursday preceding each week of performance covered by the task order (Saturday 1st shift through Friday 3rd shift). The contractor is obligated to provide the number and type of tank watches as specified in the weekly detailed listing of requirements.

b. By 1200 on Tuesdays following each week of performance, the contractor shall submit a report of actual Tank Watches provided. The report shall consist of muster or time sheets showing employee name, NNSY badge number, hours worked, date and shift.

c. The MARMC COR shall track hours based on the DWR.

d. Should the contractor fail to provide the appropriate personnel required to cover the hours listed in the DWR, the contractor shall not receive payment for those hours not provided. This is in addition to any other remedy the Government has under the terms of the contract for failure to perform. The contractor will receive payment based on the hours actually worked and verified by weekly timesheets.

C.3.4 Miscellaneous:

a. 1st Shift is defined as an 8-hour shift between 0500 hours and 1600 hours; 2nd Shift as an 8-hour shift between 1300 hours and 2400 hours; 3rd shift as an 8-hour shift between 2100 hours and 0740 hours.
