SUMMARY OF CHANGES

SECTION C - DESCRIPTIONS AND SPECIFICATIONS

The following have been modified:

STATEMENT OF WORK

C.1. SCOPE OF WORK – GENERAL INFORMATION

C.1.1 The contractor shall provide trained and qualified fire and tank watch personnel that can obtain the appropriate security or have the necessary security clearance to be eligible to obtain a red or green badge from Norfolk Naval Shipyard (NNSY), Portsmouth, Virginia as may be ordered by task orders placed by the Ordering Officer under this contract for items listed in Section B. Fire and tank watch personnel will primarily support maintenance and overhaul work being performed onboard U.S. Naval vessels, including submarines, located at the NNSY. Fire watch and tank watch personnel may occasionally be called upon to support maintenance and overhaul work being performed onboard U.S. Naval vessels located outside NNSY, within a 50 mile radius of NNSY. When ordered, the services shall be in accordance with the requirements outlined in this contract. Personnel assigned to tank watch or fire watch are not authorized to perform these duties concurrently. Duty assignment changes shall not occur until the Onsite Supervisor verifies qualifications are met for the assigned watch.

C.1.2 The contractor shall be responsible for the employment of trained and technically qualified personnel to perform Task Orders. At times work will be required onboard vessels within nuclear spaces that require personnel to have a red badge. In addition, the contractor is responsible for employing and maintaining the personnel, organizational and administrative control necessary to ensure the performance meets all contract specification requirements hereunder and set forth in each individual Task Order.

C.1.3 Contractor personnel will be provided company I.D. (contractor badges) by the contractor, for identification to be used for comparison to visit authorization list. All subcontractor employees must be able to be identified back to both the prime contractor and contract number. If an individual is not listed as "official personnel," he or she will not be authorized to board any vessel.

C.1.4 All red badge contractor personnel working at NNSY and within the 50 mile radius in support of this contract shall have a minimum of a DOD Confidential clearance.

C.1.5 Contractor personnel shall be available for meetings at the Government and/or contractor’s facilities, as required, throughout the performance of this Statement of Work. The MARMC COR shall give notice before meetings. The contractor may also request a meeting by arrangement through the MARMC COR.

C.1.6 On-site supervisor shall attend all morning briefs and any meeting where personnel are in attendance.

C.2 SCOPE OF WORK - FIRE WATCH

C.2.1 The contractor shall provide fire watch support to complete hot work operations in a safe manner and assist shipyard workers in "hot work”.

a. This assistance is provided to enhance the safety of the shipyard worker and the ship. Hot work is defined as all flame heating, welding, torch cutting, brazing, carbon arc gouging, or any work which produces heat, by any means, of 400 degrees Fahrenheit (204 degrees C) or more. NOTE: In the presence of flammables or flammable atmospheres, hot work includes other ignition sources such as spark or arc producing tools or equipment, static discharges, friction, impact, open flames or embers, and non-explosion proof lights, fixtures, motors or equipment. Fire watches are required to be qualified to National Institute of Occupational Safety and Health (NIOSH) and Mine Safety and Health (MSHA) regarding approved respiratory protection and to be equipped with appropriate selected respirator as dictated by the work as previously identified by the ordering authority.

b. "Bag and Drag/General Housecleaning" and "Spotter" duties shall be assigned by the on-site supervisor to fire watches that are released by the government hot work operator to be on standby. The Government hot work operator will release fire watch personnel to standby when hot work is finished and the fire watch is not needed for another fire watch location. The standby status shall go into effect one half hour after hot work is completed. Bag and Drag/General Housecleaning duties are the removal of industrial debris such as sheet metal, steel plate, structured shapes, piping, cable ends, nuts and bolts, spent welding wire, hardware and/or trash from overhead to deck. Spotter duties are coordinating pedestrian traffic with vehicular traffic to maintain pedestrian safety, typically performed at the head or foot of the ship's ramp.

c. The Government will provide a matrix for labor needed by clearance level in the form of quantity and duration so an independent government estimate can be generated for each task order. A task order typically consists of one availability, on a vessel by NNSY lasting as long as twelve months. The matrix will identify the projected number of hours required by type: first shift, second shift, or third shift. The matrix will also identify the projected location of work and number of red and green badge hours needed.

For reporting purposes shifts shall be defined as:

1st shift is typically an 8 hour workday between the hours of 0500 to 1600.

2nd shift is an 8 hour workday between the hours of 1300 and 2400.

3rd shift is an 8 hour workday between the hours of 2100 and 0740.

This schedule covers time to get work assignments and to report to the actual work site with equipment prior to start of the hot work. It also covers the fire watch to continue fire watch one half hour after hot work is completed, in order to comply with the safety requirement to do so. If the stated shifts do not cover the time period required to fully comply with the requirement to fire watch for one half hour after hot work, then the fire watch must stay for the entire one half hour period after hot work is completed.

d. Based on the matrix of projected fire watches for each availability, awardees will provide proposals for each availability. However, the matrix only represents a reservation of fire watch hours. Exact scheduling of how the reserved hours will be utilized will be accomplished weekly during the performance of the task order.

e. Once a task order is awarded, a detailed requirement for the next week period will be given to the contractor by 1200 hours on the Thursday preceding each week of performance covered by the task order (Saturday 1st shift through Friday 3rd shift). The contractor is obligated to provide the number and type of fire watches as specified in the weekly detailed listing of requirements.

f. If the contractor fails to provide the appropriate personnel required to cover the hours listed in the detailed weekly requirements listing, then the contractor shall not receive payment for hours not provided. This is in addition to any other remedy the Government has under the terms of the contract for failure to perform. Otherwise, the contractor will receive payment based on the hours specified in the detailed weekly requirements listing, unless a modification to the task order is issued in advance, which deletes requirements within the detailed weekly requirements list.

g. By 1200 on Tuesdays following each week of performance, the contractor shall submit a report of actual Fire Watches provided. The report shall consist of muster or time sheets showing employee name, NNSY badge number, hours worked, date and shift.

h. The MARMC COR will track hours used under the total task order based on the weekly requirements list. The Government shall be entitled to a credit at the end of the task order for hours ordered and not used as determined by the weekly requirements list at the price quoted and incorporated into the task order. The contractor will be entitled to an upward adjustment if additional hours are required beyond those ordered in the task order, at the prices quoted and incorporated into the task order for each type of hour.

C.2.2 Responsibility for hot work being performed is that of the Government hot work operator on the assigned ship. Hot work operator shall ensure that hot work can be performed in a safe manner.

k. Blind side bulkhead inspection will be performed by the hot work operator and fire watches.

l. The fire watch must understand how to enter a confined or enclosed space safely and what to do in an emergency.

(1) The fire watch has received confined space entry awareness training in accordance with 29 CFR 1915.12(d). A Confined Space is a space which by design has limited and restricted openings for entry and exit, lacks natural ventilation and which could contain or produce hazardous contaminants or oxygen deficiencies or enrichment. Confined spaces are not intended for normal continuous personnel occupancy. All of these factors must be met for a space to be considered a confined space. Some examples of non-shipboard confined spaces are: fuel storage tanks, process vessels, boilers, furnaces, sewers, utility tunnels, vaults, etc. Shipboard confined spaces include: all tanks/voids, cofferdams, double bottoms, etc.

(2) An Enclosed Space is a space which by its nature or design is of such a shape, depth or other feature that natural ventilation or the natural movement of air is restricted. Such spaces include open top storage tanks, pits, machinery spaces, pump rooms, trenches and similar spaces. Personnel working in confined or poorly ventilated enclosed spaces may encounter a number of potentially serious hazards. Such hazards may include a lack of sufficient oxygen to support life with symptoms such as lightheadedness and shortness of breath or excessive oxygen levels, which increase the danger of fire or explosion. Other hazards include the presence of flammable, explosive, or toxic atmosphere indicated by difficulty breathing, unpleasant smell or irritating odor, stinging eyes, etc. These hazards, which are not always obvious by use of your senses (sight or small), can present life-threatening dangers for personnel entering confined or enclosed spaces. Some key things to remember when engaged in confined or enclosed space work is:

(a) Do not enter tanks, voids, and similar confined or poorly ventilated enclosed spaces unless a current gas free certificate is posted.

(b) Fire Watch personnel will be allowed to enter tanks, voids, and similar confined or poorly ventilated enclosed spaces under a current NNSY gas free certificate in accordance with the Competent Person Services Memorandum of Agreement (MOA) between NNSY and the contractor.

(c) Observe all special requirements/precautions that are listed on the gas free certificate and use specific Personal Protective Equipment (PPE) when required.

(d) At least two people shall be involved in all confined space work. In other words, if you have to work alone in a confined space, some other contractor person outside the space must perform frequent checks on you.

(e) Anticipate and recognize hazards that can occur in a confined or enclosed space. Guides and barriers may be used in certain circumstances to protect entrants from hazards such as exposed rotating parts, electrical hazards, etc. Exit the space immediately if you perceive you are in any danger or when evacuation signal or order is given.

(f) If you see an unconscious or obviously disoriented person in a confined or poorly ventilated enclosed space DO NOT ENTER. IMMEDIATELY CALL THE SHIPYARD FIRE DEPARTMENT AT 911 OR 9911 USING SHIPYARD PHONES OR BY PULLING THE FIRE ALARM BOX. (FOR OFF BASE SHIPBOARD WORK, IMMEDIATELY NOTIFY THE QUARTER DECK). They have the proper equipment and training to accomplish a safe emergency rescue from these spaces. You do not know why the person went down. There may be a problem with the atmosphere in the space and if you attempt to enter you may also be overcome.

m. The fire watch will perform bag and drag/general housecleaning duties or spotter duties when on standby.

C.3 SCOPE OF WORK - TANK WATCH

C.3.1 Tank Watch shall include an individual stationed outside one or more confined and poorly ventilated enclosed spaces who monitors authorized entrants and is trained to perform all Confined and Poorly Ventilated Enclosed Space Watch duties. NOTE: The contractor shall comply with the latest revision of these documents in effect at solicitation closing and when each option year is invoked.

C.7 GENERAL REQUIREMENTS

The following are applicable to the extent they apply to taskings. Any cost to comply with these requirements shall be included in the price of the ELIN's listed in Exhibits A-E.

C.7.1 The contractor shall:

a. Exercise judgment and expertise to ensure the successful and timely completion of all task orders issued under this contract.

b. Designate the persons authorized to accept/reject verbal orders.

d. Forward all requests for changes in delivery schedules, funding requirements and scope of work in writing to the MARMC COR. These requests shall include specific details as to what changes are required and circumstances requiring such and shall be submitted to the MARMC COR for forwarding to the Administrative Contracting Officer (ACO) prior to 85% of the delivery availability being exceeded.

e. Not respond to new performance requirements until a task order or a modification has been signed or verbal authorization has been given by the ACO.

f. Not respond to any requests requiring deviations in technical performance as specified in the task order without obtaining prior written approval of the Contracting Officer.

g. Provide adequate on-site supervision to dispatch the fire watches, track time and provide support in the event personnel do not report as required. The on-site supervisors will also be responsible to:

(1) Provide on-site monitoring of assigned fire watches and submit a weekly usage report. The report shall be submitted by 1200 hours on the Monday following a week of performance. The report shall provide a list of actual hours worked on which shift (1st, 2nd, or 3rd shift.).

(2) Ensure that all safety equipment is in place and being properly used.

(3) Coordinate fire watch services with the authority for which the service is being provided.

(4) Coordinate with the hot worker's operator/supervisor as to the physical placement of fire watches.

i. Provide sufficient qualified personnel to successfully perform all tasks to be ordered hereunder.

j. Promptly notify the MARMC COR of any change or reassignment of on-site supervisors assigned to perform the work hereunder.

k. Coordinate schedules and affected work areas with the MARMC COR, prior to start of work to avoid unnecessary delays during performance period.

m. Provide the necessary equipment to perform fire watch duties.

C.7.2 Environmental and Safety Requirements. The contractor shall

a. Comply with all federal, state and local regulations in performing this contract, including but not limited to environmental laws, safety regulations, and OSHA requirements; including but not limited to 29 CFR, part 1915.

b. Ensure that contractor personnel wear mandatory Personnel Protection Equipment (PPE) in accordance with the appropriate Occupational Safety and Health Association (OSHA) Standards.

c. Ensure compliance with OSHA requirements for the services and personnel made available per this contract. The contractor must comply with all applicable federal occupational safety and health regulations and laws including, but not limited to, the following:

The contractor should pay particular attention, but not be limited to the following specific requirements:

(1) The contractor must provide employee training that gives the employee an understanding of use and the limitations of the respirator. This training must include an opportunity for the employee to handle the respirator, to have the respirator fitted properly, to test the seal, and to wear it in normal air and in a test atmosphere. The training must include the proper methods for storing and disposal. Respirator training will be conducted prior to assigning employees to work requiring use of the respirators.

(2) The contractor must complete a medical evaluation of employees using respirators prior to assigning them to work that requires the use of respirators.

(3) Respirators must be approved by NIOSH and MSHA.

C.8 FACILITY SECURITY CLEARANCE

The contractor shall be responsible for an approved facility security clearance required to access Confidential nuclear spaces (red badges) as issued by Defense Security Service (DSS). SECTION H - SPECIAL CONTRACT REQUIREMENTS

RMC H-2-0054 ORDERS ISSUED UNDER MULTIPLE DELIVERY TASK ORDER CONTRACTS

The award of any individual task order will consider factors such as past performance on earlier task orders under the multiple award contract, capacity and price.

Contractors competing for award of task orders may reduce prices by quoting lower prices than bid in Section (B).

Fair opportunity will be provided to all awardees to compete on individual task orders issued hereunder, except as noted at FAR 16.505(b)(2). When exempt from the obligation to provide fair opportunity to compete, the Government may unilaterally place orders based on set contract prices.

The Contracting Officer will place orders after all required negotiations with competing contractors have been completed based on the best value to the Government in terms of past performance, capacity and price.

In order to accurately assess a contractor’s capacity, the Contracting Officer will provide a capacity evaluation form (Attachment J-12) with the Request for Contractor Proposal (RCP) to assess a contractor’s capacity to perform future tasks. While not mandatory, IDIQ contractors that prefer that the Contracting Officer have additional information regarding their firm’s capacity that might not be readily available in MARMC records, may complete the capacity evaluation form and return it to the Contracting Officer. No other forms or format will be considered acceptable, e.g., letters, emails, or telephone calls. Failure to complete the capacity evaluation form may result in incomplete information regarding a firm’s capacity to perform future tasks which could result in a firm being awarded a task order during a time period in which it does not have the capacity to perform. The burden is on each awardee to keep the Contracting Officer informed of any changes to its capacity through the capacity evaluation form that could impact its ability to timely perform a task order.

Such orders may be issued from the effective date of award through the twelve (12) months thereafter, unless extended by the exercise of the option contained herein.

(b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control.

(c)(1) If issued electronically, the order is considered ``issued'' when a copy has been posted to the Electronic Document Access system, and notice has been sent to the Contractor.

(2) If mailed or transmitted by facsimile, a delivery order or task order is considered ``issued'' when the Government deposits the order in the mail or transmits by facsimile. Mailing includes transmittal by U.S. mail or private delivery services.

(3) Orders may be issued orally only if authorized in the schedule.

(End of Clause)

252.251-7000 ORDERING FROM GOVERNMENT SUPPLY SOURCES (AUG 2012)

(a) When placing orders under Federal Supply Schedules, Personal Property Rehabilitation Price Schedules, or Enterprise Software Agreements, the Contractor shall follow the terms of the applicable schedule or agreement and authorization. Include in each order:

(1) A copy of the authorization (unless a copy was previously furnished to the Federal Supply Schedule, Personal Property Rehabilitation Price Schedule, or Enterprise Software Agreement contractor).

(2) The following statement: Any price reductions negotiated as part of an Enterprise Software Agreement issued under a Federal Supply Schedule contract shall control. In the event of any other inconsistencies between an Enterprise Software Agreement, established as a Federal Supply Schedule blanket purchase agreement, and the Federal Supply Schedule contract, the latter shall govern.

(3) The completed address(es) to which the Contractor's mail, freight, and billing documents are to be directed.

(b) When placing orders under nonmandatory schedule contracts and requirements contracts, issued by the General Services Administration (GSA) Office of Information Resources Management, for automated data processing equipment, software and maintenance, communications equipment and supplies, and teleprocessing services, the Contractor shall follow the terms of the applicable contract and the procedures in paragraph (a) of this clause.

(4) Pay invoices from Government supply sources promptly. For purchases made from DoD supply sources, this means within 30 days of the date of a proper invoice (see also Defense Federal Acquisition Regulation Supplement (DFARS) 251.105). For purchases made from DoD supply sources, this means within 30 days of the date of a proper invoice. The Contractor shall annotate each invoice with the date of receipt. The Contractor's failure to pay may also result in the DoD supply source refusing to honor the requisition (see DFARS 251.102(f)) or in the Contracting Officer terminating the Contractor's authorization to use DoD supply sources. In the event the Contracting Officer decides to terminate the authorization due to the Contractor's failure to pay in a timely manner, the Contracting Officer shall provide the Contractor with prompt written notice of the intent to terminate the authorization and the basis for such action. The Contractor shall have 10 days after receipt of the Government's notice in which to provide additional information as to why the authorization should not be terminated.
