(1) The purpose of this amendment is to make changes to replace Section 00010 - Solicitation Contract

Form, and to answer some PPIs, and extend the proposal due date.

Replace page 10 of the RFP with the below

Factor 3, Small Business Utilization

This factor assesses both historical achievements in utilizing small business concerns as subcontractors and proposed small business participation and commitment strategies.

(i) Solicitation Submittal Requirements:

1. Achievements: All Offerors shall provide a narrative (limited to two pages, two

(2) double-sided pages) to describe their achievements in supporting the

Government’s policy to provide maximum practicable opportunities for small business (SB), veteran-owned small business (VOSB), service-disabled veteran-owned small business (SDVOSB), historically underutilized business zone

(HUBZone) small business, small disadvantaged business (SDB), and women-owned small business (WOSB) concerns to participate as subcontractors consistent with efficient contract performance. In support of narrative submissions:

a. All Offerors shall submit small business subcontracting information associated with each project cited under the Corporate Experience Factor in the format provided in Attachment F, Small Business Subcontracting Record.

b. Offerors representing as other than small businesses shall also provide copies of the most current individual subcontracting reports (ISRs) associated with each project cited under the Experience Factor if a small business subcontracting plan was required by the contract. If such projects were completed under specific task orders, provide ISRs for the overall contract.

For cited projects with state and local government agencies, provide similar subcontracting performance reports if required by the contracts. When not specifically addressed in the ISR or similar report, Offerors shall provide explanations for all instances of failures to meet dollar or percentage goals in individual subcontracting plans.

Notes: The Government reserves the right to consider achievements information on other recent, relevant projects from all available sources.

Offerors utilizing achievements information of team members or key subcontractors shall clearly demonstrate how these companies will have meaningful involvement in the management of the subcontracting program for this acquisition. If not, such achievement information will not be considered under this factor. If the Offeror is a new joint venture, partnership or other entity consisting of more than one company, provide achievements information for each individual business entity(ies) that will be responsible for managing the subcontracting program and clearly describe those responsibilities.

Failures to provide ISRs or any other requested information must be fully explained and may negatively impact your evaluation.

2. Small Business Participation and Commitment: All Offerors shall submit a small business participation and commitment strategy including all data elements shown in Attachment G, Small Business Participation and Commitment Strategy.

a. Identify in terms of dollar value and percentage of the total acquisition the extent of work the Offeror will self-perform as the prime contractor. If submitting an offer as a joint venture, identify the percentage of work each member will be responsible for and indicate the size status of each member

(e.g. small business, woman-owned small business, other than small business).

b. Include supplemental narratives (limited to five (5) single-sided pages) to address other elements of the Offeror’s strategy such as binding agreements covering post award roles for execution of the contract and specific initiatives and tools that will be employed under the contract to enhance small businesses opportunities to both participate in this acquisition and build capabilities to support future NAVFAC acquisitions.

c. The anticipated prime and first tier overall small business participation rate for this acquisition (i.e. work to be performed by small businesses as the prime and/or subcontractors) is 20% of the contract value. Offerors are encouraged to exceed this percentage and seek meaningful levels of participation in each of the small business socioeconomic programs listed in

Attachment G consistent with efficient contract performance. Offerors shall explain in their participation and commitment strategies how proposed participation rates were established. The small business participation and commitment strategy must be in agreement with any required small business subcontracting plan and will be made a part of the contract upon award.

Note: The small business participation and commitment strategies evaluated under this factor do not replace small business subcontracting plans. Offerors representing as other than small businesses must submit acceptable small business subcontracting plans using RFP Section 00100, Attachment B as a template in order to be eligible for award (FAR 19.702(a)(1)). See the SMALL

BUSINESS SUBCONTRACTING PLAN section of INSTRUCTIONS TO OFFERORS for subcontracting plan submission requirements.

(ii) Basis of Evaluation:

Offerors will be evaluated on the extent to which their proposals and other performance information available to the Government demonstrate a history of successfully supporting

Government policies concerning utilization of small business concerns as subcontractors including, when applicable, achievements against established small business subcontracting plan goals. Offerors will also be evaluated on the levels of small business participation proposed and the degree of commitment to use named sources. The anticipated benefits of proposed initiatives and tools to enhance small business participation and capabilities will be considered. The

Government will assess proposal realism and the likelihood of success in achieving the small business objectives of this acquisition.

Forms to be used for Offeror submission of Small Business Utilization Factor information are:

Attachment F – Small Business Subcontracting Record

Attachment G – Small Business Participation and Commitment Strategy

(2) Replace with this Small Business Factor

Factor 3 – Small Business Participation

It is the policy of the Government to provide maximum practicable opportunities in its acquisitions to Small

Business (SB) concerns, including Historically Underutilized Business Zone SB (HUBZone SB), Woman-

Owned SB (WOSB), Small Disadvantaged Business (SDB), Veteran-Owned SB (VOSB), Service-

Disabled SB (SDVOSB), and other small business concerns. Further, it is the policy of the Government that such concerns will have the maximum practicable opportunity to participate in contract performance consistent with its efficient performance.

a. Solicitation Submittal Requirements:

1. All offerors (both large and small) shall use solicitation attachment titled “Small

Business Participation Plan” to submit the following requested information for evaluation of this factor:

To demonstrate commitment to use small business concerns in the performance of this contract, identify all planned subcontractors by name that will be used to support each specific small business category (i.e. work to be performed by small business as the prime contractor and/or work to be performed by small business subcontractors). Identify the type of product/service to be subcontracted, the estimated subcontract value, and the type of commitment (i.e. teaming agreement, letter of commitment, etc.) to each subcontractor.

To demonstrate maximum practicable participation of small businesses, identify (in terms of dollar value and percentage of the total contract value) the Offeror’s total proposed small business participation (the extent of work the offeror will self-perform as the prime contractor. If submitting an offer as a joint venture, identify the percentage of work each member will be responsible for and indicate the size status of each member (e.g. small business, woman-owned small business, other than small business). All Offerors who are not able to meet the minimum total small business participation rate of 20% of the total contract value shall provide a detailed explanation why the minimum total small business participation rate cannot be achieved. Offerors are encouraged to exceed the percentage and seek meaningful levels of participation in each of the small business categories (i.e. SB, HUBZone SB, WOSB, SDB, VOSB, SDVOSB) consistent with efficient contract performance.

If the Offeror does not intend to subcontract, provide a detailed explanation why subcontracting would not result in efficient contract performance.

2. Large Business Offerors shall submit an acceptable Small Business Subcontracting Plan with their proposal. The Small Business Subcontracting Plan shall incorporate the proposed subcontract values and small business concerns that are specifically identified in the Offeror’s Small Business Participation

Plan. The Small Business Subcontracting Plan shall also include small business subcontracting goals that meet or exceed the minimum small business subcontracting targets stated in the table below. The Small

Business Subcontracting Plan template will be provided as a solicitation attachment.

The minimum subcontracting targets for Fiscal Year (FY) 2020 are:

Small Business (SB) 45%

HUBZone Small Business (HUBZone) 3%

Service-Disabled Veteran-Owned Small Business (SDVOSB) 5%

Small Disadvantaged Business (SDB) 5%

Women Owned Small Business (WOSB) 15%

Veteran Owned Small Business 5%

(b) Basis of Evaluation:

The Government will evaluate the Offeror’s Small Business Participation Plan to determine that the Offeror has identified and demonstrated a commitment to small business concerns in each specific small business category (i.e. SB, HUBZone SB, WOSB, SDB, VOSB, SDVOSB) in the performance of the contract.

The Government will also evaluate the Offeror’s Small Business Participation Plan to determine that the

Offeror has demonstrated the maximum practicable participation of small businesses by meeting or exceeding the solicitation’s minimum total small business participation rate (i.e. work to be performed by small business as the prime contractor and/or work to be performed by small business subcontractors).

Large Business Offerors may achieve the minimum total small business participation through subcontracting to small businesses.

Small Business Offerors may achieve the minimum total small business participation through their own performance/participation as a prime and also through a joint venture, teaming arrangement, and/or subcontracting to other small businesses.

Proposals that fail to identify and commit to use small business concerns in the performance of this contract may be rated Unacceptable; however, the Government may take into account reasonable explanations why subcontracting would not result in efficient contract performance.

(3) Answers to PPIs.

Question 001 -Per page 1 of the solicitation, “BLOCK 13D, OFFERS SHALL BE VALID THROUGH

28 FEBRUARY 2021”. The proposal and pricing effort for this solicitation will take significant time and resources from the firms providing.

Please confirm that the required funding is currently available for this solicitation, and provide reasoning why the proposals need to be valid through 28 February 2021.

Answer: P907 includes in-water construction, the project requires completion of an Environmental

Assessment (EA) and extensive permitting and consultations with a variety of federal and state agencies including Government-to-Government consultations with the tribes. The scheduled receipt of the section

10/401/404 permits from the U.S. Army Corps of Engineers and the Washington Department of Ecology is 21 February 2021. The anticipated FONSI on the EA is 25 February 2021. We can't award without both the permits and the FONSI

Question 002 - Please confirm that this project is not a small business set aside.

Answer: No this is not a small business set aside.

Question 003 - RFP Page 4 states Proposal Due Date, Submission, and format. The proposal due date is as stated in Block 13 of the Standard Form (SF) 1442, Solicitation, Offer and Award.

SF1442, Box 13, part A is not filled.

Answer: See this Amendment the proposal due date has been extended from September 7, 2020 due to a holiday to September 10, 2020.

Question 004 - Please clarify:

RFP Page 4 States:Pre-proposal inquiries during will be accepted up to 15 days prior to solicitation due date unless specified otherwise via amendment. However this Attachment A states up to 10 days prior to due date.

Answer: Inquiries will be accepted up to 10 days prior to due date.

Question – 005 On page 16 of the RFP, after the line that states: "The Offer’s price proposal shall be separate from the technical proposal. Complete and submit the following," the required contents of the Price

Proposal state no mention of the Surety Form (Attachment H). Where should this form be located within the Price Proposal package?

Answer: The Surety Form Attachment H should shall accompany the price proposal.

Question – 006 The RFP does not describe the Scope of Work to be performed. Please provide the description of the scope of work.

Answer: This is a Design Bid Build project Drawing and Specs are provided thru DoD Safe

Question – 007 On page 16 the RFP, the offeror is required to provide an Executed Bid Bond, but the

RFP does not state the amount that the bond should address. Please provide the percentage amount of the final price that the Bid Bond should represent.

Answer: The amount of the bid guarantee shall be 20 percent of the bid price or $3,000,000, whichever is less.

Question – 008 On page 5, the RFP states:

"Small Business Subcontracting Plan. In accordance with FAR 19.703, large businesses are required to submit an acceptable small business subcontracting plan that meets the requirements of FAR

19.704 prior to award utilizing the format provided in Attachment F."

Attachment F is the Small Business Subcontracting Record which would not address the small business plan as requested in the above statement. Please clarify.

Answer: The Small Business Factor has been revised

Question – 009 Please identify where in the proposal we should include Attachment H (Surety) and

Attachment K (Financial Responsibility).

Answer: Attachment H and Attachment K should go with the Price Proposal

Question - 010 - Block 11 of the SF-1442 Solicitation, Offer and Award states:

"The Contractor shall begin performance within 15 calendar days and complete it within 785 calendar days after receiving award".

Page 10/155 of the Solicitation states:

"...Higher ratings may be given for proposing a realistic period of performance that is less than the required 785 calendar days from contract award.”

Page 74/155 of the Solicitation

Section 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR

1984) states:

"The Contractor shall be required to (a) commence work under this contract within 15 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 785 days."

Please clarify if the Contract Completion is tied to NTP or Award.

Please also indicate the anticipated Award and/or NTP date.

Answer: It is not tied to NTP or Award .785 days is the Period of Performance but we add a separate + 15 days for bonds.

Question - 011 On page 12 the RFP, Section (4) Factor 4 - Safety, the requirements state that five years of safety data (EMR, DART, TRC) are to be given on Attachment E, but Attachment E only has three years

(2017, 2018, 2019) listed. Please clarify if three or five years of data is requested on Attachment E and provide an updated Attachment if necessary.

Answer:

Attachment E is correct should be from the three previous complete calendar years for the EMR, DART and TRC .

(4) Proposal due date is extended from September 7, 2020 due to holiday to September 10, 2020

(5). All other terms and conditions remain unchanged. Offerors are reminded to acknowledge receipt of this amendment in Block 19 of the SF 1442 submitted in response to the subject solicitation. The proposal due date is extended by one day.
