BIDDERS’ QUESTIONS

PRODUCTION SUPPORT

N42158-17-R-0001

General Solicitation Questions

Q1. Because of the large number of questions, specifically those that are related to pricing, request the Government extend the proposal due date a minimum of two weeks to June 13, 2017, or later, to allow adequate time following receipt of answers for proposal preparation.

A1. See Amendment 0004 dated June 15, 2017. The purpose of this amendment is to extend the solicitation closing date for submission of proposals from 13 July 2017 to 14 July

2017 3:00 p.m. local time and to answer bidders’ previously submitted questions.

Q2. What is the basis of award of individual task orders?

A2. The basis of award of individual task orders is that task orders with an estimated value of $1,000,000.00 or less are set-aside exclusively for competition among small businesses contract awardees and task orders with an estimated value over $1,000,000.00 will be awarded using full and open competition among contract awardees. Task orders will be evaluated by Lowest Price Technically Acceptable (LPTA).

Q3. The RFP states the government intends to award a CPFF IDIQ MAC with competition among awardees for individual task orders. How many awards does the government anticipate making in response to this RFP?

A3. The Government intends to award a contract or contracts resulting from this solicitation to the responsible offeror(s) whose proposal(s) represents the best value after evaluation in accordance with the factors and subfactors in the solicitation

Q4. In order to develop accurate labor rates and a start-up plan; what is the anticipated contract award date?

A4. The anticipated contract award date is to be determined.

Q5. Answers to several questions are required to develop a fully compliant proposal in response to this RFP. If answers are received by the end of the week that allows only two weeks to write and produce the proposal which includes hard copy production. Currently responses are due the day after the holiday weekend. Will the Government consider a two-week extension to allow the government adequate time to provide responses to submitted questions and enable to the contractor to incorporate these into the final proposal?

A5. See Amendment 0004 dated June 15, 2017. The purpose of this amendment is to

Q6. Please describe how the scope of work of this solicitation engages with and impacts the work performed under the CVN Private Sector Maintenance (PSM) contract (N00024-16-C-

4306). Please also describe how the scope of work assigned to this contract is determined in conjunction with the Carrier Team One desk guide (Integrated Project Teams for Aircraft Carrier

Maintenance (IPT4ACM) desk guide) which identifies the process for assignment of work to the

PSM contract.

A6. Not applicable – this contract is intended to be independent of the CVN Private Sector

Maintenance contract as it will encompass Task Orders for services in support of submarine maintenance and repair, as well as carrier maintenance and repair.

Q7. How many awards are being contemplated for this contract and how many of those will be for small businesses?

A7. The Government intends to award a contract or contracts resulting from this solicitation to the responsible offeror(s) whose proposal(s) represents the best value after evaluation in accordance with the factors and subfactors in the solicitation

Q8. The solicitation posting on FBO states that this opportunity is a partial small business set aside and describes how Task Orders will be designated for small business or full and open based on the estimated Task Order value. However, none of this information is included in the solicitation. Is the information posted on FBO designating this opportunity as a partial small business set aside correct and accurate, and will it be incorporated into the solicitation?

A8. The FBO designation of partial small business set aside is incorrect. The requirement will instead have a small business reserve, which will consist of the following:

The Government intends to procure this requirement by reserving a portion of the multiple awards for small businesses based on the anticipated monetary thresholds as follows:

o Task orders with an estimated value of $1,000,000.00 or less are set-aside exclusively for competition among small businesses contract awardees o Task orders with an estimated value over $1,000,000.00 will be awarded using full and open competition among contract awardees.

Q9. In the final pre-solicitation FBO announcement of 2 May 2017, the following was included:

“The Government intends to procure this requirement by reserving a portion of the multiple awards for small businesses based on the anticipated monetary thresholds as follows:

Task orders with an estimated value of $1,000,000.00 or less are set-aside exclusively for competition among small businesses contract awardees

Task orders with an estimated value over $1,000,000.00 will be awarded using full and open competition among contract awardees”

This advertised information is not included in the RFP document. Is this still the

Government’s intent. If yes, please include in the RFP document.

A9. See Revised Section B Supplies or Services in the NOTES section.

Q10. There is not a proposed labor category for either Fire Watch or General Laborer. Will the contractor be responsible to provide Fire Watch support to their welders? Please advise.

A10. No, the contractor will not be responsible to provide Fire Watch support to their welders, however, all trades must be Fire Watch/Tank Watch qualified.

Q11. Due to the extensive quantity of information required for submittal, will the government extend the submittal due date to June 30, 2017?

A11. See Amendment 0004 dated June 15, 2017. The purpose of this amendment is to

Section A-Solicitation/Contract Form

Q12. Block 9 on the SF-33 specifies proposals are to be submitted by 3:00 PM local time.

That would be 3:00 PM Eastern Daylight Time. Section L specifies proposals are to be submitted by 3:00 PM Eastern Standard Time. Request the government correct the RFP accordingly.

A12. See Amendment 0004 dated June 15, 2017. The purpose of this amendment is to

Section B-Supplies or Services and Prices/Costs

Q13. The RFP requires offerors to price the CDRLs, however, no labor categories or hours have been provided for each of the CDRLs to allow for an equitable evaluation of proposals.

Please provide this information.

A13. There will be no labor categories or hours provided to price CDRLs. Please reference DD FORM 1423-1, FEB 2001 top section.

Q14. Should the pricing for CLINs 0002, 1002, 2002, 3002, and 4002 reflect the cost for single submission of each individual CDRL (i.e. one-time submission of CDRL A001 through A009) or the total cost for all CDRLs estimated to be submitted during the period of performance?

A14. CLINs 0002, 1002, 2002, 3002, and 4002 are Not Separately Priced (NSP) items.

Q15. Section B – all CPFF CLINs use unit of “JOB” vice man-hours, man-days, or another more definitive identifier. Please clarify the meaning of “JOB”.

A15. See revised Section B Supplies or Services. “JOB” should encompass all direct labor rates fully burdened of the Labor Categories listed in the solicitation.

Q16. Section B and C page 14 Labor Categories Paragraph 3.16 of Section C states only labor categories listed can be invoiced, but there are no administrative labor categories listed in table 1.2 which will be needed to produce the CDRLs. Should table 1.2 be revised or should the labor for administration be priced in section B under the CDRL item (0002, 1002, etc.)

A16. Table 1.2 will not be revised to include administrative labor categories. Fully burdened, administrative cost should be included within the project manager (A114B) cost.

Q17. RFP, Section B, CPFF Labor CLINs (0001, 1001, 2001, 3001, and 4001). The maximum number of hours should be included in Section B, for each applicable CLIN to set the ceiling.

Unit should be “Hours”. Quantity should be Maximum Level of Effort (Term) hours to set ceiling for all contractors, but must be bid at the labor mix by CLIN the government provides in table 1.2 in Section C. Unit Price should be “UNDEFINED”.

A17. See Revised Section B Supplies or Services.

Q18. RFP, Section B, CDRL CLINs 0002, 1002, 2002, 3002, and 4002. Please change Unit to

“Lot”, Quantity “UNDEFINED”, Unit Price “UNDEFINED”. Please add plug number for

“Estimated Cost” and each contractor adds their fixed fee to same, due to this being an IDIQ contract. Due to Basic and Task Order level CDRLs, it is not possible to set the Unit by Job, EA, etc. and could only be “UNDEFINED” or “Lot”, but government to provide plug numbers.

A18. See revised Section B. which changes Unit to “Lot”; Quantity to read “UNDEFINED”;

and Unit Price to read “UNDEFINED”. There will be no “plug numbers”.

Q19. Will the government allow for travel charges if personnel are brought in from outside of the area? If so, will an ODC CLIN be added?

A19. No, the government will not allow for travel charges if personnel are brought in from outside of the area, thus no ODC CLINs will be added.

Q20. The RFP mentions “Exhibit” in several sections:

CDRL 0002/1002/2002/3002/4002, page 2, Exhibit 1 through Exhibit 9, Section J

Paragraph 3.10 page 14, Exhibit Line Items (ELINs)…no ELINs listed on Attachment 3

Paragraph 3.18 page 15, “Green badge workers are estimated to complete approximately four percent (4%) of the total labor hours in any given labor category in Exhibits A-E.

Yellow badge workers are estimated to complete approximately five percent (5%) of the total labor hours in Exhibits A-E. Red badge workers are estimated to complete approximately ninety-one percent (91%) of the total labor hours in Exhibits A-E. The man-hours provided in Exhibits A-E for Green, Yellow and Red badge hours are based on current estimated projections and are subject to change. What are Exhibits A-E?

A20. Remove Exhibits A-E wording. See revised Section C Description and

Specifications.

Q21. Section B, pages 2 – 5, CLINs 0002, 1002, 2002, 3002, 4002: Normally CLINs for

CDRLs are identified as NSP, Not Separately Priced. Please advise.

A21. CLINS 0002, 1002, 2002, 3002, 4002 for CDRLs are identified as “Not Separately

Priced, (NSP)”.

Section C-Description/ Specifications/Statement of Work

Q22. RFP page 38 contains clause HQ C-2-0025 Facilities Not To Be Government-

Furnished. RFP page 61 includes clause 5252.245-9106 Facilities To Be Government-

Furnished. Please clarify the apparent conflict between these two clauses.

A22. NAVSEA clause 5252.245-9106 Facilities To Be Government-Furnished has been removed. See revised Section C-Description/Specifications.

Q23. The second table in paragraph C-1.2 lists Site Foreman under ELIN A114C, A114D, A114E, A114F, A114G, and A114H. The term supervisor (supvs) is included in A114D, A114F, and A114H. The number of personnel filling each of the ELINs is not clear. Request the government clarify.

A23. Change Site Foreman to Supervisor on the table in paragraph C-1.2. See revised

Section C-Description/Specifications.

Q24. The second table in paragraph C-1.2 lists Site Foreman. Site Foreman is not listed as a labor category in paragraph C-9.1.3. Does the government intend to include Site Foreman as a key labor category?

A24. No, the government does not intend to include Site Foreman as a key labor category.

Site Foreman should be listed as Supervisor. See revised Section C-

Description/Specifications.

Q25. Attachment 3 includes line item pricing for Site Foreman. Paragraph C-9.1 refers to this labor category as Supervisor. Request the government clarify the requirement.

A25. Change Site Foreman to Supervisor in para. C-9.1. See revised Section C-

Description/Specifications and Attachment 3 Production Support Direct Rate Spreadsheet.

Q26. Paragraph 9.3, at the top of page 23, specifies “Contractor must be able to provide licensed asbestos workers in accordance with the Asbestos Abatement License from the “Board for Asbestos and Lead” (Virginia: Title 54.1, Chapter 5). In paragraph C-9.3.5, the requirements for Painter: Lead Paint Remover (ELIN A105G) (page 27) specify that the contractor employee shall be certified IAW SSPC C-3, C-5 or equivalent Lead and Asbestos Removal certification.

The table in paragraph C-1.2 does not provide any level of effort for ELIN A105G. Request the government clarify the need for licensed asbestos workers.

A26. Level of effort has been added in paragraph C-9.3.5, for the requirements for

Painter: Lead Paint Remover (Line Item A105G).

Q27. Are hours included in the RFP on page 9 to cover the Shipyard Annual Training provided by NNSY?

A27. Yes, hours are included in the RFP on page 9 to cover the Shipyard Annual

Training provided by NNSY.

Q28. Is it the intention for NNSY to have three Site Foremen (one per shift) with eleven supervisors reporting to those Site Foremen?

A28. One (1) on-site Project Manager, 1 to 10 ratio unless otherwise specified.

Q29. RFP page 9, Table 9, 1.2 Tasking includes Program Mgr., Project Mgr., Foremen labor categories, however no headings are included on the separate table at the bottom of page 9. Are the headers the same as those for the touch labor?

A29. Yes, the headers are the same as those for the touch labor. See revised Section C-

Description/Specifications.

Q30. RFP page 103, (b) states the number of man-days in the base year and option years, however the paragraph does not include the hours noted in the table under 1.2 tasking page 9 for

Program Mgr., Project Mgr., and Supvs. Request this paragraph be revised to capture the total level of effort identified in paragraph C-1.3.

A30. See Revised Section L.

Q31. RFP page 15, paragraph C-3.18 references “man-hours provided in Exhibits A-E for

Green, Yellow, and Red badge hours are based on current estimated projections and are subject to change.” Please provide Exhibits A-E.

A31. Remove Exhibits A-E wording. See revised Section C Description and

Q32. For estimating purposes, how should the man-days provided in RFP page 9 Table be broken out by shift and straight time versus overtime?

A32. Man-days will be broken out by straight time man-hours and overtime man-hours.

See revised Section C Description and Specifications.

Q33. RFP page 9 Table includes zero hours for labor categories A105A and A105G painters.

Should man-days be assigned to those labor categories? If not, should they be presented in the table and included on the proposal at zero man-days/man-hours?

A33. See revised Section C Description and Specifications Table 1.2.

Q34. The RFP requires offerors to submit a large number of training plans (e.g. see Paragraph

C-2.9.1.1.4) with their proposal referencing CDRL A001. The first submission of items per

CDRL A001 is fifteen days after contract award. Request the government resolve the conflicting requirements.

A34. Revised Paragraph C-2.9.1.1.4 will remove reference to CDRL A001. No CDRL needed at proposal. Please see revised Section C Description and Specifications.

Q35. Paragraph C-3.4 requires the contractor to provide a copy of a Touch Labor Resource

Management and Skills Tracker per CDRL A002. The paragraph states that the Touch Labor

Resource Management and Skills Tracker will be provided by NNSY at the time of solicitation.

This file was not included with the solicitation. Request it be provided as soon as possible.

A35. The Touch Labor Resource Management and Skills Tracker has been included as

Attachment 11.

Q36. Paragraph C-3.5 requires the contractor to provide certification of employee qualifications, both training and medical (baseline physical, hearing, etc.) no less than 2 weeks prior to personnel arrival on the shipyard and “on request” per CDRL A003. The periodicity listed on the CDRL is initially 7 days after contract award and bi-weekly thereafter. Request the government identify the specific information to be provided 7 days following contract award and bi-weekly thereafter.

A36. Initial contractor group qualifications are required 7 days after contract award. A qualification report (training & medical) should be issued bi-weekly to inform the shipyard for new personnel coming onboard after initial group. See revised Section C Description and Specifications.

Q37. Paragraph C-3.6 refers to Security Indoctrination Training and CDRL A004. There is no deliverable related to Security Indoctrination Training. Request the government clarify this requirement.

A37. Remove CDRL A004 from para C-3.6. New personnel will get Security

Indoctrination Training upon arrival to NNSY. See revised Section C Description and

Q38. Paragraph C-3.7.2.1 requires the contractor to provide daily onboard counts of mechanics per CDRL A005. The report is to be provided at least once per week. CDRL A005 is a monthly

“Funds and Man-Hours Expenditure Report” and, per the DID, not conducive to use as a “head count” report. It appears that CDRL A004 is more relevant to this requirement. Request the government identify the appropriate CDRL for this requirement.

A38. Change Para. C-3.7.2.1 to CDRL A004. See revised Section C Description and

Q39. Paragraph C-3.15 requires the contractor to acknowledge all the notes at the bottom of the Solicitation Exhibits. None of the Exhibits (Section J, Exhibits 1-9) includes notes. Request the government clarify this requirement and, as it refers to the contractor rather than the offeror, clarify that this is a post-award requirement.

A39. Remove Exhibits A-E wording. See revised Section C Description and

Q40. Paragraph C-4.2 requires a monthly/quarterly status report per CDRL A006. CDRL

A006 is not relevant to this report and should be listed as A005. Request the government correct the RFP.

A40. Change Paragraph C-4.2 to read CDRL A005. See revised Section C Description

Q41. Paragraph C-5.1.9.1 requires a report of completion of annual shipyard training prior to onboarding and annually thereafter per CDRL A009. CDRL A009 is not relevant to this report and should be listed as A006. Request the government correct the RFP.

A41. Change Paragraph C-5.1.9.1 to read CDRL A006. See revised Section C

Description and Specifications.

Q42. Paragraph C-6.2.4 requires security clearance validation per CDRL A004. There is no format provided for this report. Additionally, the paragraph refers to reporting via the Touch

Labor Resource Management and Skill Tracker, which is CDRL A002. Request the government clarify this requirement.

A42. Change Paragraph C-6.2.4 to read CDRL A002. Please see revised Section C

Q43. Paragraph C-6.2.5 refers to CDRL A005. The correct CDRL is A004. Request the government correct the RFP.

A43. Change Paragraph C-6.2.5 to read CDRL A004. Please see revised Section C

Q44. Paragraph C-6.2.6 refers to CDRL A006. The correct CDRL is A005. Request the

A44. Change Paragraph C-6.2.6 to CDRL A005. Please see revised Section C Description

Q45. Paragraph C-6.2.8 requires submission of a manning forecast report. The associated DID only requires submission of a personnel roster and does not support a manning forecast. Request the government provide a desired format for the manning forecast report.

A45. The government will provide a desired format for the manning forecast report at the task order level.

Q46. Paragraph C-6.2.9 refers to CDRL A009. The correct CDRL is A006. Request the

A46. Change Paragraph C-6.2.9 to read CDRL A006. Please see revised Section C

Q47. CDRL A009 is referenced in paragraphs C-5.1.9.1 and C-6.2.9. In both instances the actual CDRL is A006. CDRL A009 is not referenced in any other location in the RFP. Request the government determine the need for CDRL A009. If A009 is not required, request the government revise CLINs 0002, 1002, 2002, 3002, and 4002 to read “Exhibit 1 through Exhibit

8, Section J”.

A47. Change Paragraphs C-5.1.9.1 and C-6.2.9 to read CDRL A006. See revised Section

C Description and Specifications.

Q48. Paragraph C-9.1.7 requires certification of compliance with lead and cadmium personnel protection requirements, copies of records associated with those requirements, and a copy of the company Heavy Metal Plan. The CDRL listed is A001. The DID associated with A001 does not provide a format for the desired information. Request the government clarify this requirement.

A48. See revised Section C Description and Specifications Paragraph C-9.1.7.

Q49. Paragraph C-2.10, Place of Performance, identifies private shipyards in the Hampton

Roads, VA area. Many of these facilities charge contractors a fee for badging and/or parking when working in their facility. Request the Government include an ODC CLIN so that contractors can bill for this allowable cost on a cost reimbursable contract.

A49. There will not be an ODC CLIN provided.

Q50. (Ref Paragraph 1.2 and 3.13) Paragraph 1.2 provides labor hour man-days by trade, but does not distinguish between ST and OT hours/ days. As this is a tasking for touch labor support, the government will determine if, when and how much OT will be working for each tasking. Paragraph 3.13 indicates “up to 30% of the total work authorized by this contract is estimated to be accomplished outside of normal working hours.” For bidding purposes, will the government provide a breakdown between ST and OT hours for each labor category or is the contractor to propose 30% of the hours for each labor category as OT?

A50. Man-days will be broken out by straight time man-hours and overtime. See revised

Section C Description and Specifications.

Q51. (Ref Para 1.2 and 9.2 and 3.16.) Paragraph 1.2 and 9.2 and the attached Production

Support Labor Spreadsheet provides a list of labor categories to be included in the proposal and paragraph 3.16 states “No labor category, other than those appearing in the contract Bid schedule shall be invoices unless the contract is modified to cover the additional labor category.”

However, the tasking includes Quality Control, Administrative Reports, planning, scheduling, logistics control and training requirements. Since this is a CPFF contract, will the government modify Para 1.2 and 9.2 to include these additional labor categories and estimated level of effort for bidding purposes?

A51. No additional labor categories will be added.

Q52. (Ref Production Support Labor Spreadsheet) The attached spreadsheet does not include all labor categories required for this CPFF contract (e.g. Quality Control, administration, logistics) and uses the term “loaded rates” for each option year. It also provides for G&A/ Overhead/

Fringe separately but does not provide a place for proposal of fee, nor differentiation for ST/OT hours. Request the government clarify the term “loaded rate” and provide a revised format to account for ST/OT, additional required labor categories and fee percentages.

A52. See revised Attachment 3 Production Support Direct Rate Spreadsheet.

Q53. (Ref 2.8) Paragraph 2.8.2.1 and 2.8.2.2 required the contractor to provide employees PPE and other equipment (Respirators and fall protection devices ) normally associated with their trade - will the government provide a material estimate for use in bidding purposed to address these costs?

A53. No, NNSY will not provide a material estimate for use in bidding purposed to address costs for employee PPE and other equipment normally associated with their trade.

Q54. (Ref 2.2 and 2.4) Paragraph 2.2 stated the contractor shall provide and is responsible for

“quality control, quality management,” but paragraph 2.4 states that “NNSY will provide all quality assurance and engineering support that may be required in the assigned tasking.”

Request the government clarify the contractor’s tasking and responsibility as it relates to quality control and management.

A54. Remove “quality control, quality management” from para 2.2. See revised Section

C Description and Specifications.

Q55. (Ref 2.8) Paragraph 2.8 states the contractor is to provide their own personal hand tools and other work apparel typically provided by their employee. Will the government provide a trade specific listing of personal hand tools required for each trade? Is the contractor expected to provide any equipment beyond personal protection equipment (PPE) and hand tools considered necessary for the trade? For example, will contractor be required to provide his own welding machines?

A55. Basic hand tooling will be called out at Task Order level. Specialty tooling and welding machines will be provided by shipyard.

Q56. (Ref 3.6) Para 3.6 uses the acronym ATMS without explanation. What is the contractor’s responsibility/ requirements as it relates to this tool?

A56. Automated Training Management System (ATMS) database. There is no contractor requirement for this tool.

Q57. (Ref 3.7 and 3.11) Para 3.7 states that work assignment will be delivered by the designated NNSY rep and/or COR. Para 3.11 states the NNSY shop supervisor will provided

TWDs, etc. to the Contractor Project Manager or Supervisor prior to each work assignment. IS the NNSY ship supervisor to be considered the NNSY “Designated Rep?” If not will the government clarify the role of the NNSY Ship supervisor as it relates to the technical performance of this work, and the interface with the contractor “supervisor”.

A57. Shipyard supervisor is “Designated Rep”.

Q58. (Para 5.1) Par 5.1 lists training to be completed prior to onboarding. While some of this training is standard training to be accomplished for all work and included in established training programs some is NNSY specific to this contractor. (e.g. 5.1.9.1 Shipyard Mandatory Training)

Will the contractor be allowed to charge contract specific required training as a direct labor charge for contract specific required training?

A58. Only shipyard provided training should be direct labor charged.

Q59. (Para 5.2) Para 5.2 identifies NNSY orientation and process instruction training requirements. Request the government provide an estimate of the amount of time required to conduct the training for each labor category. Additionally, will the contractor be allowed to charge this required training as a direct labor charge?

A59. Training will take approx. 10 business days. Direct Labor Charge is allowed for shipyard provided training.

Q60. (Paragraph 9.3.12) Under Forklift Required Trade Training it states “The required trade training for the Forklift Operator contractor employee will be provided by NNSY. All course shall be successfully accomplished within two attempts.” Will similar trade training be provided for the other trades listed in this section?

A60. In this Paragraph 9.3.12, it should read “The required trade training verification for the Forklift Operator contractor employee will be provided by NNSY. Statement “All courses shall be successfully accomplished within two attempts” has been removed from

SOW. No training for forklift operation will be provided by NNSY. A forklift safety brief and ramp driving verification test will be provided. See revised Section C Description and

Q61. (Paragraph 9.3) Para 9.3 identifies Required Trade Training for each trade. Is completion of this training required prior to assignment for each task order? If an individual has accomplished this training previously in support of a prior contract or task order does that support immediate assignment retesting?

A61. Completion is required before assignment. Retesting is required only if employee has been separated from shipyard for 1 year or more.

Q62. C-2.5 10 OF 122 Section C-2.5 states, when required, "NNSY will provide the

SUBSAFE and DSS-SOC Awareness training as required." Will the contractors employees be compensated for the time required to accomplish the training?

A62. Yes. Only shipyard provided training should be direct labor charged.

Q63. C-3.18 15 of 122 Paragraph C-3.18 states that, "Red Badge workers…… (91%) of the total labor hours in Exhibit A-E". There was no Attachment or Exhibit A-E provided in the solicitation posting, please provide.

A63. Remove Exhibits A-E wording. See revised Section C Description and

Q64. C-7.1 18 of 122 Paragraph C-7.1 states, "At a minimum, all contractor personnel shall be United States citizens and shall possess a Department of Defense Personal Security

Clearance at the Confidential level or higher for performance on this contract.", it states, " Later in the paragraph, it states, "No award will be made to any offeror that does not possess a facility security clearance issued by the Defense Security Service at the Secret level." Paragraph HQ L-

2-0003 states, No award will be made to any offeror which does not possess a facility security clearance issued by the Defense Security Service at the CONFIDENTIAL level." Attachment 1, DD-254, block 1a and 1b, indicate a security level requirement for the Facility to be

Confidential. Please clarify the security clearance requirements of the personnel and facility for this solicitation.

A64. The security clearance requirements of the personnel and facility for this solicitation listed in paragraph C-7.1 should be changed from Secret to Confidential.

Q65. C-9.3 22 of 122 Paragraph C-9.3 states that, "The contractor employee(s), prior to starting work, shall be required to successfully accomplish a trade specific proficiency demonstration with a passing score of 75% or greater. The assessment will be in the form of a written test and/or hands-on proficiency test." Will this testing be administered by NNSY using written tests and hands-on proficiency tests developed by NNSY in accordance with the job descriptions provided in paragraphs C-9.3.1 through C-9.3.13?

A65. Yes, this testing will be administered by NNSY using written tests and hands-on proficiency tests developed by NNSY in accordance with the job descriptions provided in paragraphs C-9.3.1 through C-9.3.13.

Q66. Section C page 14 Overtime Paragraph 3.13.1 and Attachment 3 list overtime for the trades, but there is no level of effort provided in table 1.2 for overtime. Is there a percentage of the level of effort listed that will be overtime?

A66. Man-days will be broken out by straight time man-hours and overtime.

Q67. Section B, Attachment 3 and Section L, 4.6.2, Page 104 ODCs There does not appear to be a CLIN for ODCs in section B or Attachment 3. The elements of cost shows ODCs as “not applicable” for the purpose of the proposal. Where should the pricing for ODCs be?

A67. The government will not provide an ODC CLIN.

Q68. (Page 14, Paragraph 3.11 & Page 29, Paragraph 9.3.11) Section 3.11 states that “the

Contractor shall accomplish the work assignments using NNSY processes, technical work documents and equipment (except as identified in section C-2.8) and shall comply with all attached CDRLs” and 9.3.11 provides guidance for welder qualifications and testing. Will the welders be required to perform to NNSY welding procedures or the offerors procedures?

A68. Welders will be required to perform to NNSY welding procedures.

Q69. RFP, Section C, C-1.0, 1.2 Tasking. Did the government intend to state “Refer to Section

9.2 (Labor Categories) and 9.3 (Labor Categories Trade Skill Requirements) for specifics”?

A69. Yes.

Q70. CDRLs-General. In order for contractors to be able to estimate the level of effort and labor categories associated for each Task Order CDRL based on applicable frequencies, contractors will need a standard level of effort to propose to, to ensure an apples to apples evaluation. As an example, in CDRL A005, the contractors do not have a good estimate of what manpower will be involved in the actual TO that will be awarded (Order level) to be able to provide an accurate estimate of the level of effort to create the CDRL, without there being significant differences between contractors. As this is for an IDIQ contract, it is unknown what the estimated number of TOs will be and the corresponding level of effort thereunder or to know the number of CDRLs at the TO level to estimate same. Therefore, recommend the following options:

a. Government provide to all contractors the standard set number of hours and labor categories estimated to complete each CDRL, for each frequency required, with the understanding that at the Task Order (TO) level, same may be higher or lower depending on the requirements of said TO. ; or

b. Respectfully, highly recommend this option to avoid potential protest.

Government to include a “plug” or “set” number (includes burdens; contractors do not add burdens) that a contractor is not able to change in each CLIN (0002, 1002, 2002, 3002, and 4002) in Section B for CDRLs, to ensure apples to apples comparisons for all CDRLs, at the Basic and TO level. The only value not set would be the “fixed fee”, which contractors would include.

The recommended option is b., for the government to provide a “plug” or “set “ number/value as it is impossible for the government to evaluate from an apples to apples comparison. Again, respectfully, strongly recommend Option 2.

A70. Refer to the top of DD Form 1423 CDRL block for burden estimate.

Q71. Based on the information provided in the key personnel level of effort table at the bottom of page 9, it is unclear how many resumes are required for the Supervisor key position. What is the minimum number of resumes required to be submitted with the contract proposal for the

Supervisor key position?

A71. The number of key resumes required for proposal submission is one per key personnel and as requested and when there is a replacement of key personnel. After award, resumes must be provided upon request.

Q72. It has been our experience that the addition of a Project Coordinator on site significantly enhances contract performance. Would the Government consider the addition of Project

Coordinators as a key position on this contract?

A72. Contractor Project Manager is considered same as project coordinator.

Q73. In the table that shows the level of effort for key personnel at the bottom of page 9 of the solicitation, the second column has Site Foreman and Supervisors both listed together. Are these titles interchangeable? Site Foremen are not identified anywhere else in the solicitation.

A73. Yes, these titles are interchangeable.

Q74. Para 9.1.4 requires that Temporary Services Electricians and Temporary Services

Pipefitters have the same formal training requirements as Marine Electricians and Marine

Pipefitters. However the job descriptions and typical tasks for Temporary Services Electricians and Temporary Services Pipefitters in 9.3.9 and 9.3.10 do not indicate or typically require that these trades have the same level of experience or training as Marine Electricians and Marine

Pipefitters. The experience required in Para 9.1.5 should be sufficient. Would the government remove these two trades from the list in Para 9.1.4?

A74. No, the government will not remove these two trades from the list in Para 9.1.4.

Q75. For the trades listed in Para 9.1.4, would the government add an option of completing XX years of on the job experience as an alternative to formal course of study? As written, this eliminates a potential large pool of very experienced tradesmen that have more than five years of documented experience in the trade but received no formal education.

A75. Formal course of study will remain. Language already present for trade specific requirement for on the job experience.

Q76. How much time will a contractor have from issuance of a DO to onboarding date? It typically takes 45 days to recruit, certify, medically clear, and verify qualification of a candidate in order to meet the requirements of Para 6.2.3 to submit qualification records 2 weeks prior to onboarding. It typically takes 60 days for Welders due to the increased time to complete qualification welds. If the DO is awarded inside of 45 days, will the government accept qualification records “just in time” prior to onboarding?

A76. 60 days to meet full onboard numbers from date of award.

Q77. There is currently no allowance for charging time for qualification tasks that must be completed between award of the DO and submission of training records. The contractor must provide the quality assurance of the tradesman candidates, certifying their knowledge, skills, abilities, experience, and medical clearance. Will the government add man-days to 1.2 Tasking for contractor QA, and the ability to charge man-hours to it starting at award of the DO?

A77. No, the government will not add man-days for company vetting.

Q78. For Para 3.5.3 and 3.5.4, will it be acceptable to state that a tradesman meets these requirements on the Qualification Record and not provide a copy of the actual medical report, which may contain personal information protected by Health Insurance Portability and

Accountability Act (HIPAA)?

A78. The contractor shall certify that the employee is medically qualified, and annotated in the certified Qualification Records. Actual medical reports must be provided upon request.

Q79. Para 3.5.2 and 6.2.3 allow the contractor to provide certification of employees that are not yet qualified two weeks prior, but “will be qualified upon start date at NNSY”. Does the government want that provided as an “Interim” training record, with “final” training record provided as soon as possible prior to onboarding date?

A79. Yes, the information should be provided as an “Interim” training record, with

“final” training record provided as soon as possible prior to onboarding date.

Q80. Paragraph 9.3 states the contractor must be able to provide licensed asbestos workers in accordance with the Asbestos Abatement License from the “Board for Asbestos and Lead”

(Virginia: Title 54.1. Chapter 5) However, Title 54.1, Chapter 5 (54.1-501.1) states Ҥ 54.1-

501.1. Applicability. The provisions of this chapter shall not apply to any employer, or any employees of such employer, regulated by the federal Occupational Safety and Health Act, and under the enforcement authority of the Occupational Safety and Health Administration.” Please advise.

A80. State Asbestos Abatement License is required for contractors. Contractors performing asbestos work are not employees of Norfolk Naval Shipyard so a license is required by law.

Q81. (Ref Paragraph 9.3) The contractor is tasked to provided licensed asbestos workers– is the contractor required to provide licenses asbestos supervisors, project managers etc. to support asbestos removal tasking(s)? Under who’s asbestos removal license will the worker perform their duties? Or is it acceptable for the offeror to propose use of an asbestos abatement contractor to perform asbestos removal tasking(s), when required.

A81. No. Shipyard will provide asbestos Supervisors to support asbestos removal tasking.

Q82. The labor category “Site Foreman” shows up on Attachment 3 and bottom of page 9. Is this the same as the Key Personnel labor category “Supervisor”?

A82. Yes, the labor category “Site Foreman” is the same as the Key Personnel labor category “Supervisor”.

Q83. Section C, C 1.2 Tasking, page 9: The Table on page 9 identifies man-days by Base and

Option Years. Attachment 3 Production Support Direct Rate Spreadsheet shows labor effort as straight time (ST) and overtime (OT) by Base and Option Years. Please provide methodology to convert man-days to ST/OT so that all offerors are bidding the same level of effort.

A83. See revised Section C Table 1.2 and Attachment 3 Production Support Direct Rate

Spreadsheet.

Q84. Section C, C 3.15, page 14: “3.15 Exhibit Notes: The Contractor shall acknowledge all the notes at the bottom of the Solicitation Exhibits. Specifically, Note 1, proposed prices for each line item are to be fully burdened, to include all travel and per diem cost, all direct and indirect costs, labor, material, services, overhead, profit, and to include work and costs to implement

NNSY Requirements and Contract Data Requirements Lists (CDRLs).” Travel and per diem costs are not included in direct labor rate development for cost plus fixed fee contracts. Suggest adding CLINs for Travel. Which exhibit(s) contain “Note 1”?

A84. The government will not add CLINs’ for Travel charges. Remove Exhibits A-E wording.

Q85. Section C, C 6.2.1, page 17: Requires that the Training Plans for each labor category listed in Section C-9.3 be submitted as part of the contract proposal. Later in the paragraph it requests that the training plan be delivered electronically in PDF format via email to the designated NNSY Designated Representative and/or COR. Please clarify how the Training

Plans are to be delivered?

A85. Remove Exhibits A-E wording See revised Section C. Descriptions and

Q86. Section C, C 7.2, page 18: NCACS is being replaced. Please provide an updated section

C 7.2.

A86. See revised Section C. Descriptions and Specifications.

Q87. Section C, C 8.0, pages 20-21, Key Personnel: What is the required number of resumes for Program Manager, Project Manager, and Supervisor.

A87. The number of key resumes required for proposal submission is one per key

Q88. Page 44, Paragraph HQ E-2-0015 Quality Management System Requirements states, “The Contractor shall provide and maintain a quality management system that, as a minimum adheres to the requirements of ANSI/ISO/ASQ 9001-2015…”

a. Is the Offeror to provide a copy of its QMS with its response to the solicitation or is the offeror to provide upon award?

A88. The Offeror is to provide a copy of its QMS upon award.

Q89. Paragraph C-6.1, page 16 invokes NAVSEA Standard Items. FY18 NSI 009-04 references both 9001-2008 and 9001-2015 in paragraph 3.1, “…maintain a Quality Management

System…The system may be written based on either 2.2 (9001-2008) or 2.3 (9001-2015)…”

a. Is an ISO 9001-2008 complaint Quality Management System acceptable?

A89. No, an ISO 9001-2008 complaint Quality Management System is not acceptable.

ISO 9001-2015 takes precedence.

Q90. Page 18, Paragraph 6.2.7 states, “The Contractor shall provide resumes of the employees nominated as ‘Key Personnel’ as identified in section 9.1.3.”

a. The Government does not specify the number of resumes required. What is the minimum number of resumes that will be acceptable for award?

A90. The number of key resumes required for proposal submission is one per key

Q91. Page 18, Paragraph C-7.1 states, “At a minimum, all contractor personnel shall….possess a Department of Defense Personal Security Clearance at the Confidential level or higher…”

a. Must personnel already possess a confidential or higher clearance prior to award?

Will an employee “.. that is ‘Eligible for CONFIDENTIAL Clearance’ be acceptable?”

A91. No, an employee “…that is ‘Eligible for CONFIDENTIAL Clearance’ will not be acceptable. Personnel should possess a confidential security clearance upon award.

Q92. Page 21, Paragraph 9.1.4 states, “Additionally, contractor personnel assigned work in the following eight (8) trades listed in the table below shall have completed a formal course of study in the assigned trade through either a community college, technical or trade school, military training, formal company training program or an apprentice program.”

a. Will the government establish years of experience equivalency in lieu of “formal” training program?

A92. No, the government will not establish years of experience equivalency in lieu of

“formal” training program. A “Formal” training program is required.

Section G-Contract Administration Data

Q93. Section G of multiple award procurements normally includes the process by which Task

Order RFQs will be issued, evaluated, and awarded. Please advise.

Section I-Contract Clauses

Q94. The incumbent contracts currently supporting Norfolk Naval Shipyard, issued by

Norfolk Ship Support Activity, now Mid-Atlantic Regional Maintenance Center, for the same requirements contemplated under the subject RFP are not subject to the Service Contract

Act. Title 10 Code § 7299 authorizes exemption of “each contract for the construction, alteration, furnishing, or equipping of a naval vessel.” Request SCA be replaced by the Walsh-

Healey Act consistent with the incumbent contracts.

A94. The Government applied the "Primary Purpose" test under FAR 37.101 in determining that this particular procurement involves primarily services directly relating to naval vessel repair. In accordance with 10 U.S.C. Section 7299, a contract for the repair of a naval vessel is subject to 41 U.S.C. Chapter 65. Under 41 U.S.C. Section 6702(b)(2) and FAR 22.1003-3(b), the provisions of 41 U.S.C. Chapter 67, the Service Contract Labor Standards (formerly known as the Service Contract Act of 1965) do not apply to any work required to be done in accordance with 41 U.S.C. Chapter 65. Therefore, the wage determination process under the Service

Contract Labor Standards statute is not applicable, and the minimum wage specified in the Fair

Labor Standards Act (29 U.S.C. Section 206(e)(1)) is applicable. (See FAR 22.1002-4.)

Q95. RFP page 9 and 73 first paragraph notes DCA 1965, 52.222-41 Service Contract Labor

Standards (May 2014) is included but the SCA WD Schedule is not. If the Government does not replace Service Contract Act with the Walsh-Healey Act as requested in question 1, request the

Government attach the appropriate WD Schedule.

A95. Chapter 67, the Service Contract Labor

Therefore, the wage determination process under the Service Contract Labor Standards statute is not applicable, and the minimum wage specified in the Fair Labor Standards Act (29 U.S.C.

Section 206(e)(1)) is applicable. (See FAR 22.1002-4.)

Q96. Section C Paragraph 1.1 identifies the work as a “(CPFF) contract, under the Service

Contract Act….” Which Wage Determination revision is applicable for this procurement?

A96. The Government applied the "Primary Purpose" test under FAR 37.101 in to naval vessel repair. Q97. H pg 51 and 52 and I/Page 64 52-215-20 and 52.215-21 Per FAR 15.403-1,(b)(1), competitive bids shall not require certified cost and pricing. Please confirm and explain why clauses 52-215-20 and 21 and the Proposal Adequacy checklist would be appropriate for a competitive bid.

A97. FAR Clauses 52-215-20 and 52-215-21 and the Proposal Adequacy checklist will be removed.

Q98. RFP, Section I. Formally, Walsh-Healey Public Contracts Act, now referenced as

Contracts for Materials, Supplies, Articles, and Equipment Exceeding $15,000, is not included in the RFP; however, the type of work (repair, maintenance and alterations requirements for U.S.

Navy waterborne vessels, surface ships and submarines at any location under NNSY NSA/LMA cognizance) that is to be performed is applicable to same. Respectfully request FAR 52.222-20 be added and Service Contract Labor Standards references be removed (e.g. FAR 52.222-41, 52.222-42, etc.). Furthermore, the Service Contract Labor Standards do not apply to supply

NAICS codes, which NAICS code 336611 (Shipbuilding and Repairing-Sectors 31-33, Manufacturing (Supply)) is under supply/manufacturing and applicable for this work.

A98. The Government applied the "Primary Purpose" test under FAR 37.101 in to naval vessel repair.
