About this file

This Justification and Approval (J&A) document supports a Navy contract for fire alarm panel replacements at Naval Station Norfolk. The project involves renovating annexes in buildings LP-21, LP-33, and LP-34, with each annex approximately 3,438-5,970 square feet, to meet current ICD/ICS 705 technical specifications. Specific upgrades include wall partition modifications, sound attenuation, RF shielding, and IT network security improvements.

The solicitation (N4008525R0147) will be issued as a Multiple Award Construction Contract (MACC) Task Order for the Hampton Roads Area, using Small Business General Construction MACC. The contract requires brand name Fire Alarm Panels from Silent Knight and Mircom, which are the only products compatible with existing hangar systems. The project is funded by FY25 O&M, N funds, must be completed within 546 days after award, and was preceded by a sources sought notice on 22 August 2025 that received two responses. The Navy is invoking a statutory authority that allows non-competitive procurement when no alternative products will satisfy agency requirements.

DEPARTMENT OF THE NAVY

NAVAL FACILITIES ENGINEERING SYSTEMS COMMAND, MID-ATLANTIC

9324 VIRGINIA AVENUE

NORFOLK, VIRGINIA 23511-3095

J&A No. ML-25-77

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

The contracting activity is Naval Facilities Engineering Systems Command, Mid-Atlantic (NAVFAC ML) Public Works Department Norfolk, Building A-81, 9742 Maryland Avenue, Norfolk, Virginia 23511.

2. Description of the Action Being Approved.

This Justification and Approval (J&A) authorizes and approves the use of brand name Fire Alarm Panels from Silent Knight and Mircom, for the renovation of buildings LP-21, 33, 34 Annex 705 Compliance at Naval Station Norfolk, Norfolk, Virginia. This project will require the Fire Alarm Panels replacement in accordance with the required specifications detailed in the attachment for LP-21, 33, 34 Renovate Annex to Secure Area project at Naval Station Norfolk (NSN).

3. Description of Supplies/Services.

The intent of solicitation N4008525R0147 for LP 21,33,34 Renovate Annex 705 Compliance located in Norfolk, Virginia is to renovate annex area of each hangar at existing buildings LP21 (approx. 4,122SF), LP33 (approx. 5,970SF), and LP34 (approx. 3,438SF). Each annex consists of existing offices, workshops, large and small brief / debrief assembly space, storage room, electrical rooms, and telecom rooms. Each annex will be modified to meet the design and construction criteria of current ICD/ICS 705 Tech Spec. These upgrades include changes to wall partition type, sound attenuation between spaces, RF shielding, security of IT networks, and allowed penetrations through the secure area boundary.

This acquisition will solicit proposals as a Multiple Award Construction Contract (MACC) Task Order on the Small Business General Construction MACC for the Hampton Roads Area of Responsibility (AOR), as authorized by the approved DD2579 on 04 September 2025. The estimated value of the work included in this construction solicitation is and the estimated value of the brand name materials subject to this J&A is . The project will be funded by FY25 O&M, N funds. The work under this contract is required to be completed within 546 days after award.

These brand name Fire Alarm Panels are the only products that will effectively transmit and communicate with the existing system in each main hangar and allow for a complete system for the building as a whole (hangar and annex).

4. Statutory Authority Permitting Other Than Full and Open Competition.

Pursuant to FAR 6.302-1, this acquisition will be acquired under the authority of 10 U.S.C. 04( )(1), No other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

This Justification and Approval seeks to require inclusion of brand names in the above referenced solicitation. It is necessary for the government to include brand names or proprietary specifications for Fire Alarm Panels and Components that will effectively transmit and communicate with the existing system in each main hangar in order to have a complete system for the building as a whole (hangar and annex) that can be properly conveyed to the construction contractor for bidding. There is no alternative to provide a complete fire alarm system for this design-bid-build contract and ensure compatibility with the existing hangar system.

Applicable United States Government Accountability Office (GAO) Comptroller General decisions have acknowledged the authority of a federal agency to use other than competitive procedures when there is a reasonable need for standardization or interoperability with existing agency equipment or software. GAO has concluded that the government may use other than competitive procedures when there is a reasonable need for standardization or interoperability with existing equipment or software, and when it is likely that award to other sources would result in substantial duplication of cost to the government that is not expected to be recovered through competition.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

NAVFAC MIDLANT issued a sources sought notice on 22 August 2025 seeking qualified vendors to provide the product referenced within this J&A meeting the characteristics as described above. The sources sought notice closed on 02 September 2025 and two (2) responses were received. Both contractors provided panels of different manufacturers than existing. Because the entire systems are not being upgraded but instead, existing panels are being replaced and new ones provided in the secure areas, the new panels must be compatible with not only the existing devices (detectors, manual pull stations, switches, appliances, etc.) but also the panels themselves, must be compatible with each other within each individual building to function as one system. Pertaining to complete system functionality and maintenance & sustainment, it cannot be adequately accomplished while using multiple panel manufacturers in the same facility.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer will determine if the price for this acquisition is fair and reasonable in accordance with FAR Part 15 prior to contract award. Analysis will be performed by one or more of the following techniques: (1) Comparison of proposed prices received in response to the RFP and (2) Comparison of proposed prices with the Independent Government Cost Estimate (IGCE)

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, NAVFAC Mid-Atlantic has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NAVFAC Mid-Atlantic will assess whether competition for future requirements is feasible.
