Proposal Due Date: Tuesday, 06 February 2024 at 02:00PM EST. LATE PROPOSALS WILL NOT

BE ACCEPTED.

Proposal Submission Instructions: In response to this request for proposal, the complete proposal shall include the Price Proposal and the Non-Price Factors Proposal, submitted in accordance with the Basis of

Evaluation and Submittal Requirements for Each Factor. The Offeror shall submit an electronic copy of the proposal in accordance with the instructions below by the proposal due date.

Electronic Copies

Only the PIEE Solicitation Module is authorized for the submission of electronic proposals in response to this solicitation. Electronic proposal submissions should be no larger than 1.9 GB per file. Offerors shall ensure that the Government has received the electronic proposal prior to the date and time specified. PIEE

Solicitation Vendor Access Instructions are provided via Attachment E. EMAILED SUBMISSIONS

WILL NOT BE ACCEPTED.

Offerors are also responsible for submitting files in the format specified and consistent with requirements stated elsewhere in this solicitation. Files that cannot be opened, or are otherwise missing the required content are the responsibility of the Offeror.

The PIEE system will record the date and time of package submittal. The date and time of package submittal recorded in PIEE shall govern the timeliness of any proposal submission. LATE PROPOSALS

WILL NOT BE CONSIDERED.

Basis for Award:

This task order will be awarded on a fair opportunity basis pursuant to FAR 16.505 ordering procedures.

The proposed task order will be awarded to the responsible offeror offering the best value to the

Government. To make a determination of best value, the LPTA process is selected as appropriate for this acquisition because the best value is expected to result from selection of the technically acceptable proposal with the lowest evaluated price.

The Government reserves the right to eliminate from consideration for award any or all offers at any time prior to award of the contract; to negotiate with offerors in the competitive range; and to award the contract to the offeror submitting the lowest price technically acceptable offer.

The Government intends to evaluate proposals and award a contract without discussions with offerors

(except clarifications as described in FAR 15.306(a)). The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. In addition, if the

Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.

mailto:hilario.s.cortado.civ@us.navy.mil mailto:john.w.trueblood6.civ@us.navy.mil

In order to permit efficient competition, the Navy will utilize the following methodology. Proposals will initially be screened for price and placed in order (lowest price to highest price). The Navy will then evaluate the technical factors of the lowest priced proposal. In the event the proposal is deemed

Unacceptable, the process described will be conducted again as many times as necessary, until such time as the Government identifies a technical acceptable proposal. The Navy will make award to the lowest priced technically acceptable proposal from among the lowest priced proposals. However, the Navy, at its sole discretion, reserves the right to increase the number of proposals it will review under this methodology. Accordingly, under this methodology, the technical factors of some proposals may not be evaluated by the Navy. If discussions are deemed necessary by the Contracting Officer, all proposals will be evaluated (both technical and price) for the purpose of establishing a competitive range.

An overall non-price factors rating must be at least “ACCEPTABLE” in order to be eligible for award.

An “UNACCEPTABLE” rating in any factor results in the overall non-price factors proposal being rated

“UNACCEPTABLE” unless corrected through discussions. An overall non-price factors rating of

“UNACCEPTABLE” makes a proposal ineligible for award.

Evaluation Factors for Award

The Proposed Task Order will be awarded to the responsible offeror offering the best value to the

Government. To make a determination of best value, the Government shall evaluate each offeror on the following criteria:

Factor 1 – Technical Solution

Factor 2 – Past Performance

Non-Cost/Price Evaluation Factors

The offeror shall submit one (1) electronic copy via PIEE, with the following:

Text pages 8 ½ x 11 format

Minimum 10-point font, Times New Roman

Cover page with solicitation number, solicitation title, offeror name, address, phone number, fax number, Unique Entity Identifier in SAM, CAGE code, Point of Contact (POC), POC phone number, and POC email address.

Price information contained in the technical proposal will not be considered. Likewise, technical information contained in the price proposal will not be considered.

Factor 1 – Technical Solution:

(i) Solicitation Submittal Requirements:

Submit a narrative work plan and summary level schedule to describe your approach to managing the project and ensuring adherence to the project schedule. Both the schedule and narrative must address the execution of the base work and options as identified in the RFP. The narrative shall not exceed four (4) double-sided pages (or eight (8) single-sided pages). Up to four (4) drawings on 11”x17” paper can be provided to supplement the narrative and will not count towards the page limit. There is no page limit on the summary level schedule, but must be printable on 11”x17” paper.

a) The narrative work plan shall address major elements of work and demonstrate understanding of the scope, all major milestones, technical complexities, and construction schedule required to achieve the work as identified in the solicitation. Identify activities that may affect the project timeline, including other/off site work activities. In addition, the plan shall address the following technical complexities:

Major subcontractors for Design and Construction (structural, civil, mechanical and electrical) and ability to provide skilled labor;

Overall management of various building sites within the requirements of the RFP if any of the options are exercised;

Overall management and coordination of simultaneous construction activities; and

Approach to avoid project schedule slippage due to material/equipment procurement and delivery delays.

b) The summary level schedule shall illustrate the offeror’s ability to achieve or improve on the contract completion date (CCD) as indicated in the RFP (548 calendar days, including 15 days for bond approval). If the CCD cannot be met or improved upon, and is longer than what is indicated in the RFP due to current industry equipment procurement and delivery delays, propose an alternate CCD in total calendar days, and clearly indicate reasons to justify the proposed alternate

CCD. Identify the overall completion time for this project, as well as interim completion times

(including each sequence of work as identified in the RFP) and key milestones for sequences as required to complete construction. The schedule shall demonstrate an understanding of the work, a logical sequence of events to accomplish the work, and contain enough information to identify all of the major milestones, as defined in the RFP.

(ii) Basis of Evaluation:

Offerors will be evaluated on the extent to which they demonstrate a clear understanding of the requirements of the RFP. A narrative work plan that identifies areas of risk in logistics, equipment procurement/delivery, resource management, and provides a comprehensive contingency plan that addresses mitigation of any identified risks with potential solutions may be considered more favorably. A summary level schedule that proposes a realistic contract duration that is shorter than the required duration indicated in the RFP may be considered more favorably.

NOTE: If a realistic contract duration that is shorter than specified in the RFP is proposed, the proposed duration would be incorporated into any resultant contract.

Factor 2 – Past Performance:

(a) Solicitation Submittal Requirements:

Offerors do not need to provide any information under this factor as the Government will base the evaluation on known past performance on task orders awarded under this Multiple Award Contract

(MAC). However, Offerors may provide any information on problems encountered and the corrective actions taken on task orders under this MAC. Offerors may also address any adverse past performance issues under this MAC. Explanations shall not exceed two (2) double-sided pages (or four (4) single-sided pages) in total.

(b) Basis of Evaluation:

This evaluation focuses on how well the Offeror performed on projects under this Multiple Award

Contract. More emphasis will be placed on task orders that are more similar to the RFP. The

Government reserves the right to obtain information for use in the evaluation of past performance other than projects performed under this Multiple Award Contract from any and all sources including sources outside of the Government. Other sources may include, but are not limited to, past performance information retrieved through the Contractor Performance Assessment Rating System (CPARS), inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the

Offeror.

The Government will consider the currency and relevance of the information, the source of the information, context of the data, and general trends in the Contractor’s performance. This evaluation is separate and distinct from the Contracting Officer’s responsibility determination. The assessment of the

Offeror’s past performance will be used as a means of evaluating the Offeror’s ability to successfully meet the requirements of the RFP.

Offerors lacking past performance information on other task orders under this Multiple Award Contract will not be evaluated favorably or unfavorably in past performance and will receive a Neutral Confidence rating.

Price

i) Solicitation Submittal Requirements:

Price shall be submitted on the Price Proposal Form included in the solicitation. The offeror shall submit one (1) electronic original copy with the following:

Cover page with solicitation number, solicitation title, offeror name, address, phone number, fax number, EIN, Unique Entity Identifier (UEI) in SAM, CAGE code, Point of Contact (POC), POC phone number, and POC email address;

All amendments acknowledged;

Price Proposal Form;

Copy of Representation and Certifications and proof of registration in System for Award

Management (SAM);

Confirmation of filing of Veterans’ Employment and Training (VETS) VETS-4212 for the

2022/2023 filing cycle;

Bid Guarantee in accordance with FAR Clause 52.228-1, Bid Guarantee. Amount shall be at least

20 percent of the proposed price, but shall not exceed $3 million;

The offeror is required to submit a complete Price Proposal Form that includes completion of all contract line items numbers (CLINs). All required proposal documents shall be submitted in accordance with FAR

15.208.

The price proposal shall be submitted separately, but at the same time as the technical proposal.

Furthermore, technical information contained in the price proposal will not be considered. Likewise, price information contained in the technical proposal will not be considered.

(ii) Basis of Evaluation: The Government will evaluate price based on the total lump sum price. Analysis will be performed by one or more of the following techniques to ensure a fair and reasonable price:

a. Comparison of proposed prices received in response to the RFP.

b. Comparison of proposed prices with the Independent Government Cost Estimate (IGCE).

c. Comparison of proposed prices with available historical information.

d. Comparison of market survey results.

** Workers in this classification may be entitled to a higher minimum wage under Executive Order 14026 ($16.20) or 13658

($12.15). Please see the Note at the top of the wage determination for more information.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the

Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.

Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at https://www.dol.gov/agencies/whd/government-contracts.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses

(29CFR 5.5 (a) (1) (ii)).

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of ""identifiers"" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate

(weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than ""SU"" or

""UAVG"" denotes that the union classification and rate were prevailing for that classification in the survey. Example:

PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the ""SU"" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.

Survey wage rates are not updated and remain in effect until a new survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010

08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour

National Office because National Office has responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.) and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the

Branch of Construction Wage Determinations. Write to:

Branch of Construction Wage Determinations

Wage and Hour Division

U.S. Department of Labor

200 Constitution Avenue, N.W.

Washington, DC 20210

2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator

(See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:

Wage and Hour Administrator

U.S. Department of Labor

The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.

3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative

Review Board (formerly the Wage Appeals Board). Write to:

Administrative Review Board

U.S. Department of Labor

4.) All decisions by the Administrative Review Board are final.
