SUMMARY OF CHANGES

SECTION SF 30 - BLOCK 14 CONTINUATION PAGE (SF 30)

The following have been added by full text:

AMENDMENT 0007

1. Extend the proposal due date.

2. Incorporate FAR clause 52.219-14-Limitations on Subcontracting. See continuation pages.

3. Continuation sheet to update specifications and include drawings in a separate attachment as “Drawing and

Specification Updates”.

4. The purpose of this amendment is to provide responses to pre-proposal inquiries.

1. The proposal due date has been extended:

FROM: 16 October 2023, 2:00 PM EST

TO: 20 October 2023, 2:00 PM EST

2. As prescribed in 19.507(e), insert the following clause:

LIMITATIONS ON SUBCONTRACTING (OCT 2022)

(a) This clause does not apply to the unrestricted portion of a partial set-aside.

(b) Definition. Similarly situated entity, as used in this clause, means a first-tier subcontractor, including an independent contractor, that—

(1) Has the same small business program status as that which qualified the prime contractor for the award (e.g., for a small business set-aside contract, any small business concern, without regard to its socioeconomic status);

and

(2) Is considered small for the size standard under the North American Industry Classification System (NAICS) code the prime contractor assigned to the subcontract.

(c) Applicability. This clause applies only to—

(1) Contracts that have been set aside for any of the small business concerns identified in 19.000(a)(3);

(2) Part or parts of a multiple-award contract that have been set aside for any of the small business concerns identified in 19.000(a)(3);

(3) Contracts that have been awarded on a sole-source basis in accordance with subparts 19.8, 19.13, 19.14, and 19.15;

(4) Orders expected to exceed the simplified acquisition threshold and that are—

(i) Set aside for small business concerns under multiple-award contracts, as described in 8.405- 5 and 16.505(b)(2)(i)(F); or

(ii) Issued directly to small business concerns under multiple-award contracts as described in 19.504(c)(1)(ii);

(5) Orders, regardless of dollar value, that are—

(i) Set aside in accordance with subparts 19.8, 19.13, 19.14, or 19.15 under multiple-award contracts, as described in 8.405-5 and 16.505(b)(2)(i)(F); or

(ii) Issued directly to concerns that qualify for the programs described in subparts 19.8, 19.13, 19.14, or 19.15 under multiple-award contracts, as described in 19.504(c)(1)(ii); and

(6) Contracts using the HUBZone price evaluation preference to award to a HUBZone small business concern unless the concern waived the evaluation preference.

(d) Independent contractors. An independent contractor shall be considered a subcontractor.

(e) Limitations on subcontracting. By submission of an offer and execution of a contract, the Contractor agrees that in performance of a contract assigned a North American Industry Classification System (NAICS) code for—

(1) Services (except construction), it will not pay more than 50 percent of the amount paid by the Government for contract performance to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count towards the prime contractor's 50 percent subcontract amount that cannot be exceeded. When a contract includes both services and supplies, the 50 percent limitation shall apply only to the service portion of the contract;

(2) Supplies (other than procurement from a nonmanufacturer of such supplies), it will not pay more than 50 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count towards the prime contractor's 50 percent subcontract amount that cannot be exceeded. When a contract includes both supplies and services, the 50 percent limitation shall apply only to the supply portion of the contract;

(3) General construction, it will not pay more than 85 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count towards the prime contractor's 85 percent subcontract amount that cannot be exceeded; or

(4) Construction by special trade contractors, it will not pay more than 75 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count towards the prime contractor's 75 percent subcontract amount that cannot be exceeded.

(f) The Contractor shall comply with the limitations on subcontracting as follows:

(1) For contracts, in accordance with paragraphs (c)(1), (2), (3) and (6) of this clause—

[Contracting Officer check as appropriate.]

□ By the end of the base term of the contract and then by the end of each subsequent option period; or

□ By the end of the performance period for each order issued under the contract.

(2) For orders, in accordance with paragraphs (c)(4) and (5) of this clause, by the end of the performance period for the order.

(g) A joint venture agrees that, in the performance of the contract, the applicable percentage specified in paragraph (e) of this clause will be performed by the aggregate of the joint venture participants.

(1) In a joint venture comprised of a small business protégé and its mentor approved by the Small Business Administration, the small business protégé shall perform at least 40 percent of the work performed by the joint venture. Work performed by the small business protégé in the joint venture must be more than administrative functions.

(2) In an 8(a) joint venture, the 8(a) participant(s) shall perform at least 40 percent of the work performed by the joint venture. Work performed by the 8(a) participants in the joint venture must be more than administrative functions.

(End of clause)

3. PROJECT SPECIFICATIONS

The following Specifications edits are incorporated:

Section 02 82 00

3.3.4 ANCHORAGE

Added the following new sub paragraphs:

“3.3.4.2 Roof Duct Supports:

Three sets of duct supports are located between the return duct roof penetration and the connection of the return duct to the existing roof-top air conditioning unit. Current plans/specs calls for the supports to be left in place for re-use to support the new ductwork.

A drawing of the actual construction of the support, Figure 1, is shown below and it lacks a physical connection between the sleeper and the only structural component of the roof, the steel deck which is not sufficient. Please see following figure 2 for an acceptable assembly.

In the sketch below, Figure 2, the sleeper is connected directly to the roof deck. Typical roofing components are shown to ensure a watertight assembly. An arrangement to connect the sleeper to vertical and horizontal steel (galvanized) members firmly affixed to the ductwork can be similar to the existing assembly. The intent is to have the ducts supported but also held down to resist wind loads. This work will require cutting into the existing roof which includes remnants of the built-up roof that may be under the more recently installed (approximately 10 years ago) membrane roof. The older built-up roof that was installed during the original construction of the building tested positive for asbestos containing material (ACM), please see the building hazardous material documents included with the solicitation documents.”

“3.3.4.3 Supply and Return Ducts New Curbs of a size compatible with the dimensions of the specified supply and return ducts will be provided. Connection to the roof deck and required roofing components to accommodate the new curb will be as in Figure 2 above with the dimensions of the curb to be of sufficient strength to support the duct, but at least 4” thick. Curb heights will be sufficient to clear the final roof elevation by an amount recommended by the Curb manufacturer and adjusted to meet the configuration of the ductwork shown on the drawings to connect to the AHU supply and return outlets. Roofing will seal the curb assembly with kant strips, flashing, membrane plys, etc., in accordance with generally accepted roofing practice and recognized standards. This work will likely result in disturbing remnants of the old built-up roof with similar results in that encountering ACM should be expected and be addressed with the proper mitigations.”

“3.3.4.4 Curbs and Associated Materials

Curb materials and installations will comply with the guidance that is already a part of this specification.

Curbing that would comply with Roof Curb Cap Assembly (RPA-1) of this specification is expected to be in compliance with the requirements of the roof curbs above. Other guidance for curbing and associated materials is found in this specification, sections 05 50 13, 07 22 00, 07 42 13, 07 53 23, and 07 60 00.

Further guidance for Roof Curbs is provided below:

Roof Curb: Provide a roof curb that mates with the ductwork to provide support and be completely weather tight. Provide curb with sealing strips to ensure a weather-tight seal between the duct and mounting supports elements. Mount curb to allow ductwork to be directly connected to the curb. The Roof Curb must be of sufficient height so that standard roofing methods to seal against weather elements may be executed in full.”

In the event that furniture is in the way of the contractor’s work area, it will be moved by the government.

5 2 01 11 00 1.2.2 &

1.4 (a)

Please clarify what furniture will remain in perimeter offices that will require covering/protection by contractor.

A detailed room by room account of the furniture to remain is not available.

6 Add #3

In various pictures provided under Addendum #3, it appears that there is possible Asbestos Coated

Material (ACM) in the supply and return air duct connections. Please advise if these areas are suspected ACM and should be included in the abatement tasks of this project.

See continuation pages and refer to Amendment 0003.

Note R2

Please provide manufacturer, model, size, color, texture, etc. of existing ceiling tiles to determine if selective tiles can be matched for replacement or if entire ceiling has to be replaced due to non-matching tiles. Please also provide a color picture of an existing tile for reference for what is acceptable for final left in place.

Manufacturer, model, size, color, texture of tiles is unavailable.

Contractor should count on buying between 10% to 20% of the tiles due to condition and breakage

9 Cover

The title of project references “RCx” (retro commissioning). There does not appear to be anything in specification or project drawings describing any RCx activities. Please verify if RCx is required, and if so, what RCx tasks are needed?

This is a complete building HVAC renovation and as such will require the full range of commissioning. The plans and specs lay out in great detail with mechanical schedule, TAB directions and equipment controls sequencing exactly how this system will work to guide the commissioning agent in this vital task. Perhaps the title of the project is not the best so if it helps, please think of it as the “Commissioning” (versus a retro-commissioning) of the new system, which is something required for a complete HVAC renovation.

Are there any foreseen blackout periods that will impact the work schedule or period of performance for this project?

No

Should the prime contractor include more than one mobilization/demobilization in the proposal due to blackout periods which will impact the project progress schedule? If so, how many mobilizations/demobilizations should be included in this proposed task order for purposes of estimating?

No

(End of Summary of Changes)

Would the Government accept the Site

Superintendent and CQC/SSHO to triple hat the project as a one-person position for the entire proposed task order for a cost savings?

No

13 Please verify the solicitation is not a ‘Design/Build’ requirement?

Confirming. Not a Design-Build project.

Will the contractor be permitted daily vehicle parking directly at Building 990? How many designated parking spaces will be issued?

This will be discussed at the pre-construction meeting.

Please verify that no long-term maintenance contracts on physically installed products are to be provided? The contractor assumes any maintenance contract(s) on all equipment is handled separately by the Government from this task order and statement of work.

Confirmed

16 Does contractor furnished temporary construction fencing need to be electrically grounded?

No

Is the Contractor responsible to provide ADA compliant temporary sanitary facilities while the building is undergoing renovations?

No

Request to add NAICS Code 236220 Commercial and Institutional Building Construction to the procurement solication to provide more competition from prime contractors and subcontract bidders.

Bid per RFP.

The drawings and specifications were prepared and certified by the DOR (SMMA). As this RFP is solicited as a design build project, what are the requirements for design since a DOR is already onboard?

This RFP is not solicited as a Design Build.

Will the current DOR be answering questions and providing details throughout the project or is the bidder required to carry costs for replacing the DOR services?

The government is the DOR and will be answering questions so the bidder need not account costs for this.

File details come from the government source that posted it. Updated .
