Description Option 3
Disposal Area C2, D, D1, E, F, G, & H
Please clarify if Area C2 is correct to be included in the Phase 2 Work (placement into the SBOBA), which will happen in 2023. However, this area is already part of the Base – Phase 1 work that will happen in 2022 that will go to HARS.
Presently there is uncertainty regarding the time‐line associated with obtaining approval from regulatory agencies for use of SBOBA. It is most likely that material from Area C2 will go to the HARS.
However, should the government obtain the required SBOBA approvals prior to the completion of the AREA C2 dredging then it is possible that the government could exercise Bid Option #4 in time for the material to be placed in SBOBA in lieu of the
HARS.

027 Section 00 21 13 ‐ Instructions to Bidders & Government website
The Government’s website solicitation (Notice ID:
N4008521B0055) notates that “The project schedule will allow for dredging work to be performed 24 hours/7 days per week and will require a minimum daily production rate of 7,500 CY per day.”
Please confirm if this requirement is to be required in the specs. If so, is 7,500 CY per day on average for the project over a given period or actual yards per day on project?
Government estimates have indicated that the awarded contractor will need a production rate of approximately 7,500 cubic yards per day in order to complete the work within the specified period of performance. There is no specific requirement to meet a minimum daily production rate or average daily production rate as long as the work is completed within the period of performance.
However, failure to complete the work within the period of performance may result in the assessment of liquidated damages against the contractor.

035 35 20 23 1.7 & 1.8 Paragraph 1.7 acknowledges the inaccuracies of the dredging process and allows for 2 feet of payable overdepth. However, paragraph 1.8 only allows for 1 foot of overdepth on the side slopes, which are inherently more difficult to dredge.
Additionally, the 1V:2H slopes are steeper than most other channels with similar material type and project depth. For instance, the USACE Sandy
Hook Channel maintenance dredging requires a 1V:3H slope and allows for 2ft of OD.
Please consider revising the language to match the 2 feet of overdepth allowed via paragraph 1.7 and/or flattening the slopes to 1V:3H or greater.

043 Specs ‐ Section 01 14
1.4.g The Contract Documents state “the entire construction area shall be marked with white quick flashing light buoys, attached to a chain sinker, every 25m to 30m, all around the dredging area.”
Given the “construction area” is essentially where the dredge is working, is marking the dredge with quick flashing lights sufficient?
“Spec Section 01 14 00 Para.
1.4 Avoiding Interference With
Waterfront Operations at NWS Earle” pertains only to the NWS Earle Waterfront (i.e.
Areas B1 and B2)
044 Due to high exposure to the open ocean and the presence of sand waves, dredging operations in areas D, D1, E, F, G, and H would be much safer if performed with a hopper dredge. The Offeror respectfully requests that the
Owner consider the use of a hopper dredge for performing work in these areas.
Use of a hopper dredge shall not be included in this contract. The referenced dredging areas have also been dredged via clamshell bucket in the past.
045 Specs ‐ Section 35 20
1.5 The Contract Documents state
“the Contractor shall immediately cease dredging operations” if Munitions of
Explosive Concern (MEC) are discovered and “dredging shall not re‐commence until such notification is given by the
Contracting Officer.”
Considering the uncertainty in the duration of such delay(s), will the Contractor be compensated for MEC‐related downtime?
It is not expected that the contractor will encounter Munitions of Explosive Concern (MEC) during the course of this contract. If MEC is encountered, the contractor will compensated in a fair and reasonable manner based on the duration of the delays.
046 Specs ‐ Section 35 20
1.5 The Contract Documents state
“prior to dredging, the
Contractor shall rake the dredge areas and shall remove debris encountered.” In lieu of raking the dredge areas, can the Contractor utilize grids over the dump barge that would collect debris during the dredging operation?
Raking prior to dredging would only collect debris on the surface and not any debris within the column of material being dredged.
All material shall be screened, while dredging, to separate debris using a “Grizzly” type screen with 12” x 12” grid size.
047 Appendix A Appendix A does not contain

at the piers or where government required minimum safe separation distance cannot be maintained.
049 RFP – Section 00 21 13
The Contract Documents state the project schedule “will require a minimum daily production rate of 7,500 CY per day.” Due to the schedule restraints that are already imposed by the completion dates for Phase I and Phase II, the Offeror respectfully requests that the Owner removes the daily production rate requirement.
050 RFP – Section 00 21 13
The Contract Documents state the project schedule “will require a minimum daily production rate of 7,500 CY per day.” If this requirement remains in place, what is the penalty for not achieving that rate?
Government estimates have indicated that the awarded contractor will need a production rate of approximately 7,500 cubic yards per day in order to complete the work within the specified period of performance. There is no specific requirement to meet a minimum daily production rate or average daily production rate as long as the work is completed within the period of performance.
However, failure to complete the work within the period of performance may result in the assessment of liquidated damages against the contractor.
051 RFP – Section 00 21 13
The Contract Documents state the project schedule “will require a minimum daily production rate of 7,500 CY per day.” If this requirement remains in place, how is that production rate calculated when considering delays due to weather, mechanical problems, and other incidental downtime that is common with dredging?
Government estimates have indicated that the awarded contractor will need a production rate of approximately 7,500 cubic yards per day in order to complete the work within the specified period of performance. There is no specific requirement to meet a minimum daily production rate or average daily production rate as long as the work is completed within the period of performance.
However, failure to complete the work within the period of performance may result in the assessment of liquidated damages against the contractor.
