This solicitation is for maintenance dredging at the Naval Weapons Station Earle in New Jersey. The project involves dredging nine areas totaling approximately 2.26 million cubic yards of material to a depth of -45 feet MLLW plus two feet of overdepth allowance. Dredging will occur in two phases, with phase one dredging 1.18 million cubic yards in summer 2022 and phase two dredging 1.04 million cubic yards in summer 2023. Dredged material will be transported via tug and scow and placed at the Historic Area Remediation Site for remediation purposes. The daily production rate must be at least 7,500 cubic yards. The awarded contract is estimated to be between $25-100 million and notice to proceed will be issued within 180 days of award.

10. Delivery of Bid Bid Submission

(p. 11)

Please clarify delivery of bid language. Bid submission states " The offeror shall submit one (1) CD-ROM electronic copy, one (1) hard copy marked “Original" and one (1) hard copy marked “Copy,” in a three ring binder.

In the event of a discrepancy between the electronic copy and the hard copies, the “original” hard copy shall govern." It continues that "For electronic copy shall be labeled “BID SUBMISSION FOR IFB N4008521B0055, and email shall be sent to georgia.a.scott.civ@us.navy.m il and philip.j.cole.civ@us.navy.mil".

Seeing as a CD cannot be e-mailed, we request that the language be modified so as to accept a PDF as the electronic form allowed for bid submission via email.

Bid Submission sent by (mail courier) shall include one (1) CD-ROM, one (1) hard copy of bid marked “Original" and one

(1) hard copy of bid marked “Copy,” in a three ring binder.

A copy of your bid shall also be emailed to:

02 Section 00 10 00 – Solicitation Attachment 8: Bid Schedule Document

(p. 3-6) There are inconsistencies in the description of what should be included in the price in Section 00 10 00 - Solicitation and the Attachment 8, Schedule. Please update the descriptions to the correct applicable language, so that they reflect the same description.

Please review and use the attached updated bid schedule under Amendment 0001.

The EPA will designate the disposal sub-area within HARS.

GOV will provide coordinates to the contractor once received from the EPA.

Note

Please clarify the differing completion dates for the Phases 1 & 2 Works: 01 11 00

– required completion November 2022 & November 2023, while Price Proposal Form Notes indicate December 2022 & December

Phase 1 work shall be completed by December 31, 2022. Phase 2 work shall be completed by December 31, 2023.

06 01 11 00 1.2.1 p1 Please clarify if hopper dredges are allowed to perform the project or portion thereof under this contract.

Hopper dredges are NOT allowed. This project is only permitted for bucket dredging, 07 1.8 p5 “Dredging of side slopes shall follow, as closely as practicable, the lines indicated or specified”. Offeror respectfully requests NAVFAC to consider adding language to the specification common to other dredging contracts procured by the Federal Government that allow box cutting, and payment for the dredged material, as follows:

“Side slopes may be formed by box cutting, step cutting, or dredging along the side slope.

No language change(s) will be incorporated. Payable volume shall be determined pursuant to applicable specifications sections.

Material actually removed, within the limits approved the CO, to provide for final side slopes not flatter than shown on the contract, but not in excess of the amount originally lying above this limiting side slope, will be measure and paid for in accordance with the provisions contained…Such amount will be estimated and paid for whether dredged in original position or by box cut dredging whereby space is dredged below the allowable side slope plane on the bottom of the slope for upslope material capable of falling into the cut.”

Description

Option 3 Disposal Area C2, D, D1, E, F, G, & H

Please clarify if Area C2 is correct to be included in the Phase 2 Work (placement into the SBOBA), which will happen in 2023. However, this area is already part of the Base – Phase 1 work that will happen in 2022 that will go to HARS.

Presently there is uncertainty regarding the time-line associated with obtaining approval from regulatory agencies for use of SBOBA. It is most likely that material from Area C2 will go to the HARS.

However, should the government obtain the required SBOBA approvals prior to the completion of the AREA C2 dredging then it is possible that the government could exercise Bid Option #4 in time for the material to be placed in SBOBA in lieu of the

HARS.

Q: To which areas does this requirement pertain? It is not possible to surround the dredging areas in the Federal Channels.

Determine requirements based on any current installation permits and the impacts of the project.”

Q: Does this requirement include waterborne equipment or does it only apply to land-based equipment?

Applies to land based equipment only.

Pg.54/3169 of Appendix A Sediment Data states, “The maintenance sediments from the NWS Earle Areas C2, D, E, F, G, and H have been sampled and tested for physical constituents. Results of the testing indicate that the materials are comprised primarily of sand (>88 percent) with small proportions of gravel. In addition, these sediments are located in a coastal area with shifting bars and channels. Based on the results of the physical testing and based on the location of the material, the maintenance sediments from Areas C2, D, E, F, G, and H meet exclusionary criteria (1) for placement at the HARS and meet the physical requirements for placement at SBOBA…”

Closed clamshell environmental buckets are designed to dig soft (usually contaminated) silt and mud, and are not capable of digging sand or gravel. Considering the material sampled on this project is not contaminated and cannot be dredged by a closed clamshell environmental bucket, please confirm that the permit will be amended to modify requirement #5 prior to the first dredging window.

Otherwise, this project cannot be performed in compliance with the permits.

Considering this material is not contaminated as illustrated in the results of Pg.54/3169 Appendix A- Sediment Data, this requirement seems particularly onerous and will add additional cost and time (lower production) to the project. We request the permit is amended to remove this requirement.

Pg. 9/49, “H” “The permittee shall request and obtain approvals from the U.S. Fish & Wildlife Service and National Park Service prior to conducting all dredging activities within Dredging Area D between March 1 and August 31 of any calendar year.”

A) Does the Navy submit this request on behalf on the contractor?

B) How far in advance of anticipated dredging does the request for approval need to be submitted?

Under this contract dredging within Area D shall not be permitted to occur between March 1 and August 31 of any calendar year. Should the GOV determine that dredging within Area “D” during the exclusion period is necessary then the GOV will obtain any required permits from the U.S.

Fish & Wildlife Service and National Park Service.

024 Will contractors be allowed to tie-up barges at the facility? If so, please state where it will be allowed.

Tugs may tie up at the facility for short periods of time, such as for crew changes and for emergency repairs.

Barges/scows are not authorized to tie up at NWS Earle.

025 Will contractor’s tugs have access to potable water at the facility?

Potable water is available to contractor’s tugs at the pier complex and the contractor will be billed for any water used. The current rate for water is $45.82 per KGAL; this price is subject to change throughout the year.

1.2.c(1) (1) No work is allowed around the Piers during loading operations. The contracting officer will provide a loading schedule. An approximate number of loading events for the contract period will be provided by the Contracting Office. The Contractor shall conduct his operations so as to cause the least possible interference with normal operations of the activity.

Can the government provide an example of previous loading schedules?

Previous loading schedules cannot be provided to the contractor. Ample notice will be provided and contractor shall relocate equipment and dredge elsewhere within the project area as long the required minimum separation distance from loading operations is maintained as directed by the GOV.

027 Section 00 21 13 - Instructions to Bidders & Government website

The Government’s website solicitation (Notice ID:

N4008521B0055) notates that “The project schedule will allow for dredging work to be performed 24 hours/7 days per week and will require a minimum daily production rate of 7,500 CY per day.”

Please confirm if this requirement is to be required in the specs. If so, is 7,500 CY per day on average for the project over a given period or actual yards per day on project?

An average of 7500 CY per 24 hour working day is required.
