About this file
This document consists of an approval letter and related federal contract opportunity notice. The approval letter from the New Jersey Department of Environmental Protection modifies a condition for the Naval Weapons Station Earle Pier/Turning Basin/Sandy Hook Channel Maintenance Dredging project. The modification allows the use of a traditional non-sealed clamshell bucket for dredging areas expected to contain over 90% sand.
The related federal contract opportunity is a solicitation for the maintenance dredging of areas surrounding piers at Naval Weapons Station Earle. The project will dredge approximately 2,261,170 cubic yards of material to depths of -45 to -47 feet MLLW over two phases in summer 2022 and summer 2023. Dredged materials will be placed into scows and transported to the Historic Area Remediation Site for remediation. The Navy is seeking dredging services for this project to be performed 24 hours a day, 7 days a week, with a minimum daily production rate of 7,500 cubic yards.

RE: Federal Consistency Determination/Water Quality Certification/Acceptable Use Determination
DLUR File: 0000-01-1008.2 CDT 210001
Project: Naval Weapon Station Earle Pier/Turning Basin/Sandy Hook Channel Maintenance
Dredging
Dear Mr. Callahan:
On April 28, 2021, the NJDEP issued a Federal Consistency (FC), as required by Section 307 of the federal
Coastal Zone Management Act (16 USC 1451 et seq.) and Water Quality Certification (WQC) as required by Section 401 of the federal Clean Water Act (33 USC 1251 et seq). On April 29, 2021, you requested a modification of Condition Number 5 to not require a closed clamshell environmental bucket for areas where material consisting of >90% sand (Areas C2, D, E, F, G, and H). The Department concurs with your comment and shall modify Condition Number 5 as follows:
5. All fine-grained sediments from this project shall be removed using a closed clamshell environmental bucket. Areas where material is expected to be >90% sand can be removed using a traditional non-sealed clamshell bucket (with teeth).
If you have any questions regarding this letter, please contact Jeff Thein by email at Jeff.Thein@dep.nj.gov or by phone at (609) 633-2211. Please reference the Division’s file number in all communication.
