Section Paragraph
8 9 Factor 1 -
Experience
(1) Construction Experience
The minimum $4M project requirement seems unreasonable for a Small Business Set Aside procurement and will limit the level of competition as it will disqualify many Small Businesses in the area. Lowering this minimum requirement to $3M will ensure a higher level of competition.
Bid per the RFP
12 9 of 59 Factor 1 (i), (1)
Regarding Page 9 of 59 – Factor 1 – Experience, (1) Construction Experience, the requirement for “At least one (1) project must have a final construction cost of $10,000,000 or greater” is discriminatory against true Small Businesses that possess both the resources and capability to service the requirements contemplated for this solicitation. As a small business that has been regularly engaged in both IDIQ and MACC contracting for the government for the last ten years we can count on one hand the number of Small Business MACC Task Order awards that exceeded $10M. Awarded Task Orders exceeding $10M represent less than five percent of the total number of Task Orders awarded on the last three NAVFAC Hampton Roads Small Business MACCs. These high value projects are rare opportunities for small business and to exclude small businesses that cannot provide a project of a randomly chosen dollar value is discriminatory. It is important to note that there is no difference between the successful implementation of a $5M project and a $15M project, the specifications read the same, the risk management and construction management processes and staffing requirements are the same. The major difference between a $5M and $15M project is larger two and three dimensional unitary requirements and/or advanced technology requirements for the larger valued project.
A better gage of a Small Business contractors’ strength and capability would be by it’s bonding capacity, both single project and aggregate. This is a true measure of risk for the government that has been established by risk management professionals.
The $10M project restriction forces a Joint Venture relationship between the capable Small Business and a Large or other Small Business in order to compete for the MACC.
The structure of the Joint Venture inherently inhibits the ability of both entities to compete effectively as one for Task Orders in the size range contemplated for this solicitation. The result is a business arrangement that benefits no one including the government.
We are respectfully requesting reconsideration of the solicitation requirement for At least one
(1) project must have a final construction cost of $10,000,000 or greater. In order to provide equitable parameters for Factor 1 that will be inclusive for capable small business Offerors having the desire to compete for this solicitation, we suggest the following:
Substitute $5M or $7.5M (at the governments’ discretion) for the $10M requirement. With respect to bonding capacity, we suggest on page 7 of 59 – 4.2, (a), (1), (iii) delete $10,000,000 and the ability to bond multiple projects, Insert $15,000,000 and an aggregate bonding capacity of $60,000,000 or $20,000,000 and an aggregate bonding capacity of $80,000,000 (at the governments discretion).
These minor changes are consistent with NAVFAC MACC requirements in other Areas of Responsibility (AOR) and will broaden the field for competition without compromising the quality of the Small Business Offerors participating in the proposal process.

We intend to use two design firms to create a turnkey team. One will act as architect/lead designer while the other will provide engineering for mechanical, electrical, and plumbing. Are we allowed three to five projects for each designer or is that a combined total for the design team?
Bid per the RFP
17 9 Factor 1 – Experience
For Factor 1, may we submit projects that are ‘substantially complete’ (70% or more)? We have a very relevant project that is 97% complete that we would like to include in our proposal.

Have any required US Army Corps or other permits been secured by the Navy in advance of this project? CS101 shows a 10" force main discharging directly into a waterway. Is the finish floor of the East side of the building 2' lower or is the entire first floor at "8.96' " Bid per RFP
56 01 11 00 1.2.1 this para indicates the existing crawl space to be a "Permitted Confined Space" During the site visit we were only allowed to look down into the crawl space thru the floor hatch door at one small area of the crawl space. It was noted that just in that small space several various obstructions, i.e. unistrut, conduit, hangers, steel beams, ect with low clearances occupied the space. Since we were not allowed to enter the crawl space during the site visit and view the area in it's entirety, the development of pricing for what it will take to include in a plan and put it into action that will comply with all the "Permitted Confined Space" requirements is not possible. The pictures provided in the drawings are not adequate to make this determination either.
One example of the difficulty in determining requirements would be the type of retrieval system necessary in the event of a rescue considering all of the possible obstructions and or low clearances in place. Assuming that the govt from time to time has entered into this area, is there any existing retrieval system in place or what type of retrieval system has the govt implemented when they have had cause to enter into this space? Please advise. Bid per RFP
