ADDENDUM TO 52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

The following factors shall be used to evaluate offers:

Factor 1 – Corporate Experience Factor 2 – Safety Factor 3 – Past Performance

As stated earlier in this RFP, offers will be evaluated using the Lowest Price Technically Acceptable (LPTA) selection process IAW FAR 15.101-2 and DFARS 215.101-2. The Government will evaluate the offers in accordance with the criteria described herin, and award a fixed price Delivery/Indefinite-Delivery/Indefinite- Quantity (IDIQ) with recurring and non-recurring Contract Line Item Numbers (CLIN) to the responsible Offeror, whose offer confirms to all the terms and conditions of the RFP and is technically acceptable with the lowest evaluated price. The term “technically acceptable” as used herein, is in reference to the non-price factors.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of provision)

EVALUATION

A. BASIS FOR AWARD

1. The Government reserves the right to eliminate from consideration for award any or all offers at any time prior to award of the contract; to negotiate with offerors in the competitive range; and to award the contract to the offeror submitting the lowest priced, technically acceptable offer.

2. As stated in the solicitation, the Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. In addition, if the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.

3. The LPTA process is selected as appropriate for this acquisition because the best value is expected to result from selection of the technically acceptable proposal with the lowest evaluated price.

4. An overall non-price factors rating must be at least “ACCEPTABLE” in order to be eligible for award.

An “UNACCEPTABLE” rating in any factor results in the overall non-price factors proposal being rated “UNACCEPTABLE” unless corrected through discussions. An overall non-price factors rating of “UNACCEPTABLE” makes a proposal ineligible for award.

B. EVALUATION FACTORS FOR AWARD

1. The solicitation requires the evaluation of price and the following non-price factors:

The distinction between corporate experience and past performance is corporate experience pertains to the types of work and volume of work completed by a contractor that are comparable to the types of work covered by this requirement, in terms of size, scope, and complexity. Past performance pertains to both the relevance of recent efforts and how well a contractor has performed on the contracts.

2. Basis of Evaluation and Submittal Requirements for Each Factor.

(a) Price:

(1) Solicitation Submittal Requirements:

(a) Standard Form (SF) 1449: Complete blocks 17a, 17b (if applicable) and 30a, 30b, 30c. Complete Contract Line Item Numbers (CLINs) 0001 through 0010 on the F1449 – Continuation Sheet and a total price for all CLINs. Prices shall be submitted in Japanese Yen only. CLIN prices are expressed in Japanese Yen. The contract will be awarded in a U.S. Dollar ($) amount value for the administrative convenience of the U.S. Government. Although the price of the contract will be expressed in U.S. Dollars, payments will be made in Japanese Yen. Acknowledge and sign all amendments. Failure to do so may cause rejection of proposal. Offers are solicited on an “all or none” basis. Failure to submit offers for all line items listed shall be cause for rejection of the offer.

(b) Completed Exhibit Line Item Numbers (ELINs) Spreadsheet as provided in Attachment (2) J-0200000-07 Exhibit Line Item Numbers (ELINs). Prices shall be stated in Japanese Yen only. In the event that there is a difference between a unit price and the extended total amount, the unit price will be held to be the intended bid/offer and the total of the CLINs or ELINs will be recomputed accordingly. The CLIN which includes recomputed contract ELINs will also be recomputed to take into account the change in the contract ELIN.

If the offeror provides a total amount for a CLIN or ELIN but fails to enter the unit price, the total amount divided by the CLIN or ELIN will be held to be the intended unit price. The Government reserves the right to award some or all of the ELINS in any order depending on availability of funds and operational requirements.

Although not part of the price evaluation, Offerors should also include the following items if available with their price proposal to assist the Government in validating eligibility to receive an award:

(c) An informational page that contains the following information:

The Government intends to evaluate all options and has included the provision FAR 52.217-5, Evaluation of Options (JUL 1990) in Section M of the solicitation. In accordance with FAR 52.217-5, Evaluation of Options will not obligate the Government to exercise the option(s). Analysis will be performed by one or more of the following techniques to ensure a fair and reasonable price:

The attached Experience Form, Attachment (5) Experience Project Data Sheet, is mandatory and shall be used to submit project information. The failure to utilize the attached Experience Form, Attachment (5) Experience Project Data Sheet, shall be cause for rejection of the proposal.
