About this file
This amendment to the solicitation extends the proposal due date to June 24, 2021 for a design-bid-build project to construct a new Air Traffic Control Tower at Webster Outlying Field in Maryland and demolish the existing tower. The Navy's Naval Facilities Engineering Command seeks a contractor to design and build the new tower to allow continued operations of the existing tower until the new one is operational. The amendment provides responses to contractor questions that clarify the project includes associated roads, parking and utilities; confirm timelines for transition to the new tower; and define certification requirements. It also revises evaluation criteria for relevant experience and allows additional project types to qualify.

RFI responses
1. Section Factor 1 Experience, Para (a), Pg. 8-10 of 63. The relevant experience standard in Factor 1 appears very narrow, and might greatly limit offeror interest, including interest from offerors who are very qualified to perform this scope. Would the government consider amending its submission requirements and scoring standard to the following, in order to encourage participation from well-qualified firms who might not otherwise participate, while still requiring offerors to demonstrate the key relevancy criteria noted in the solicitation: (1) remove the complexity requirement that each project include crane work or boring near an active runway, specifically, and require offerors to show this experience at least once instead; (2) remove the requirement to show at least one ATCT new construction and allow offerors to submit multi-story new constructions in addition to or in lieu of a new ATCT, as construction requirements— especially the structural elements—would be very similar or the same; and (3) remove the scope requirement that each project include demolition of existing facilities, specifically, and require offerors to show this experience at least once instead (this is a non-specialty scope item, and should not be tied to a tower or other new construction)? These adjustments would help offerors include projects that demonstrate many relevant features, if not all such features at once, demonstrate all relevancy criteria at least once, and likely yield the government with additional qualified proposals to evaluate.
GOVERNMENT RESPONSE: Factor 1 Experience has been revised to read see revision in bold.
Factor 1- Experience:
(a) Solicitation Submittal Requirements:
The Offeror shall submit the following information:
Submit a minimum of three (3) maximum of five (5) relevant construction projects for the Offeror that best demonstrates your experience on relevant projects that are similar in size, scope, and complexity to the RFP. A minimum of one (1) of the submitted (relevant) projects must be an Air Traffic Control Tower like the one that is proposed with this Request for Proposal (RFP).
For purposes of this evaluation, a relevant project is further defined as:
Size: 3,500 square feet or larger and cost of $9,000,000 or more.
Scope: New construction of an Air Traffic Control Tower (ATCT), AND/OR a new construction of multistory administrative facility (e.g. offices, conference rooms, warehouse, fire station).
Complexity: New construction of one of the facilities indicated in Scope above. In addition, the projects submitted must collectively demonstrate experience with:
a. Crane operations while working near an adjacent active runway.
b. Directional boring while working near or under an active runway;
and
c. Demolition of existing facilities.
Projects submitted for the Offeror shall be completed within the past ten (10) years of the date of issuance of this RFP.
A project is defined as a construction project performed under a single task order or contract. For multiple award and indefinite delivery/indefinite quantity type contracts, the contract as a whole shall not be submitted as a project; rather Offerors shall submit the work performed under a task order as a project.
The attached Experience Project Data Sheet (Attachment A) is MANDATORY and SHALL be used to submit project information. Except as specifically requested, the Government will not consider information submitted in addition to this form. Individual blocks on this form may be expanded; however, total length for each project data sheet shall not exceed one (1) double-sided page (or two (2) single-sided pages) 8 ½” x 11”.
For all submitted projects, the description of the project shall clearly describe the scope of work performed and the relevancy to the project requirements of this RFP (i.e., unique features, area, construction methods). In addition, the description should also address any sustainable features for the project, including specific descriptions of those features. Provide applicable documentation on projects that were validated and/or certified through U.S. Green Building Council (USGBC) or the equivalent organization or process.
If the Offeror is a Joint Venture (JV), relevant project experience should be submitted for projects completed by the Joint Venture entity. If the Joint Venture does not have shared experience, projects may be submitted for the JV members. If a project was performed by a JV, and not all partners from that JV are on the JV proposed for this contract, the offeror shall clearly demonstrate what portion of the work was performed by the JV partner offering on this contract and shall not include work performed by the JV as a whole. The JV member proposed for this contract shall specifically address field work performed by that JV member including field staffing and direct field work oversight. The JV member proposed for this contract shall also address home office management performed by that JV member including the number/percent of employees provided for the overall contract by the JV member as well as the overall percentage of work performed by the JV member. This same information shall also be provided for the task orders listed under IDIO contracts on Attachment C. If the Offeror does not specifically address what portion of the work under the submitted project was performed by the JV member offering on this contract, the project will not be evaluated. Offerors are still limited to a total of five (5) projects combined.
If an Offeror is utilizing experience information of affiliates/subsidiaries/parent/LLC/LTD member companies (name is not exactly as stated on the SF1442), the proposal shall clearly demonstrate that the affiliate/subsidiary/parent firm will have meaningful involvement in the performance of the contract in order for the past performance information of the affiliate/subsidiary/parent/LLC/LTD member companies to be considered. The proposal shall state specific commitments of technical resources (e.g. personnel, equipment) that the affiliate/subsidiary/parent/LLC/LTD member companies commit to the performance of this contract. In particular, the proposal will clearly state the specific commitments of resources of the affiliate/subsidiary/parent/LLC/LTD member that will be located at the worksites and company offices in the city/area of the project. The proposal shall also describe specific roles of the affiliate/subsidiary/ parent/LLC/LTD member companies in terms of the work it will either self-perform or manage on behalf of the Offeror in performance of the contract. Failure to provide this information may result in a lower rating.
Any projects submitted in excess of the five (5) will not be considered.
The Offeror may utilize experience of a subcontractor that will perform major or critical aspects of the requirement to demonstrate construction experience under this evaluation factor. The Offer must provide the supporting subcontractor agreement or letter of commitment and an explanation of the meaningful involvement that the subcontractor will have in performance of this contract. The agreement or letter of commitment must be signed by officers with authority to bind the companies, and should clearly identify the company names, DUNS numbers, and point of contact information (address, email, phone, and fax).
The proposal must state specific commitments of resources (e.g. personnel, equipment) that the subcontractor commits to the performance of this contract. The proposal shall also describe specific roles of the subcontractor in terms of the work it will either self-perform or manage on behalf of the Offeror in performance of the contract. Failure to submit this information may result in a lower rating. More weight may be given to the Offeror’s projects than to those submitted for subcontractors.
(2) Basis of Evaluation:
The basis of evaluation will include the Offeror’s demonstrated experience and depth of experience in performing relevant construction projects as defined in the solicitation submittal requirements. The assessment of the Offeror’s aggregate experience will be used as a means of evaluating of evaluating the relevancy of the submitted experience and the capability of the Offeror to successfully meet the requirements of the RFP. A minimum of three (3) construction projects must be submitted, but the Government will only review a maximum of five (5) projects. Any projects submitted in excess of the five
(5) will not be considered.
Proposals may be strengthened if submitted projects possess:
a. Experience with new construction projects requiring compliance with the requirements of the Maryland Department of the Environment (MDE).
b. Experience with the new construction of Air Traffic Control
Towers on military installations.
c. Relevant projects that demonstrate design-bid-build experience may be considered more favorably than those that demonstrate design-build experience.
d. Relevant projects that demonstrate experience with sustainable features may be considered more favorably than those that do not demonstrate experience with sustainable features.
e. Offerors who submit relevant projects that demonstrate experience self-performing relevant features of work may receive a higher rating than those who do not demonstrate self-performance.
f. Relevant projects that demonstrate experience with the demolition of facilities in military installations.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.
Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of ""identifiers"" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than ""SU"" or ""UAVG"" denotes that the union classification and rate were prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the ""SU"" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)
and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:
Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:
Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
4.) All decisions by the Administrative Review Board are final.
