AMENDMENT 0003

CONTINUATION OF BLOCK 14

AMENDMENT 0003

The purpose of this Amendment 0003 is to convey and updated ELIN file for pricing, and to provide responses to additional RFI’s. The proposal due date remains 11 March 2021 at 10:00 am.

57. Question: "Question 52 correctly states there is not a “Roofer” wage decision in the Saint Mary’s County Davis Bacon Wage rates for “Building” Construction and asks for clarification on what rate to use. I have attached this document (Davis Bacon General Decision #MD20210008) for record to prove the Roofer rate does NOT exist. The Government’s response to this question appears to be incorrect, it appears whoever answered this question used the DB “Residential” wage rate (claiming the rate was supposed to be $19.40 base plus $4.28 fringe). We believe this is incorrect. DB Residential wage rates should not to be used on Building Construction Contracts such as this one. I am fairly confident that the DOL would not agree with the response to this question and perhaps the DOL should answer this question so that everyone is on the same page. The adjacent county (Charles County) where Indian Head is located has a Roofer rate of $30.25 base plus $13.24 fringe (for a total of $43.49/hr). That is $19.81 per hour higher than what the suggested rate was in this RFI answer (which was $23.68/hr). The Charles County wage rate would be more in line with the correct amount for Saint Mary’s County. In addition, our firm recently bid on solicitation # N40080-20-R-3239 and the same question came up and we were provided with the following response: “For Bidding Purposes, utilize a wage rate of $30.25 and fringe benefits of $13.24 for a total of $43.49. Upon receipt of award, the awardee shall submit a Standard Form 1444 Request for Authorization of Additional Classification and Rate.”

Based on this information, if bidders use the $19.40 base plus $4.28 fringe numbers provided in answer #52 under this Amendment, their costs will be severely under estimated (which would give them an unfair competitive advantage). This could also lead to possible issues with the DOL down the road (requiring back pay and adjustment to future labor costs) and a potential monetary modification to compensate the Contractor for additional labor costs. In addition, this issue could ultimately be grounds for a bid protest. It is very important that this question be answered as correctly as possible to provide fair competition for all bidders.

Answer: There is no “Building” Roofer within the wage determination site, with the only Roofer being the residential roofer. Please note that only one set of rates and costs are being requested and the ELINS and coefficients should apply to all locations under the contract and should meet all minimum applicable regulations for all sites.

58. Question: Please clarify how we are to price the seed project? Can the Government provide a bid form for the seed price submission? All bidders will need to understand how to utilize coefficients, line item pricing (CLINS), and RS Means data in pricing the seed.

Answer: The Seed Project should utilize the appropriate ELINs, multiplied by the given quantities, and with the applicable coefficient applied to the cost. The contractor can present the costs in whichever way you feel properly best presents the information, as long as that format allows for the comparison of quantities and line items.

59. Question: Are we to insert pre-priced RS Means unit prices into the excel CLIN spreadsheet where Means Item #’s are included in the Means Item # column? Just as an example (if we were to use the 2011 Version of RS Means Data) - the Facilities and Commercial Renovation, Waldorf bare cost for 070505.10 Selective Demolition of Built-Up, no gravel 3-ply is $38.79 per square. With this being said, would all bidders be expected/required to insert a price of $0.3879 for CLIN 001AA? If this is the case, shouldn’t all RS Means data be pre-filled by the Government to avoid confusion with the bidders?

Answer: This is not a JOC contract with mandatory use of R. S. Means estimating data. In situations where an ELIN exists that corresponds to a required task, the firm should utilize R.S. Means as the original basis of the rate and then use the ELIN schedule for subsequent years. If new work is required that is outside the ELIN Schedule, a firm will be expected to verify whether the work item is in R.S. Means first and will use that rate, with the applicable coefficient, unless the decision is made to add the work item to the contract.

60. Question: Are we to plug in our own CLIN pricing where RS Means Item #’s are not included on the excel spreadsheet? Are CLINS to include the indirect costs references under paragraph B.4?

Answer: Yes. Indirect costs and profits are to be incorporated in the coefficients.

61. Question: Are all bid option prices supposed to be filled out in the excel file under the “Base Year” Tab (as there are currently columns in the Base Year for the Option Years), or are we to fill out the pricing for each Option Year under the applicable “Option Year” tabs? Depending on the response, please clarify the “Labor Mark Up”, “Material Mark Up”, “Composite” columns under the Base Year tab and where we are to include these percentages on the “Option Year” tabs.

Answer: Use the base year. Populate the unit cost. The Spreadsheet has escalation factors that will auto-populate the unit costs on K through AG. These unit costs should be used, in turn, to populate the unit costs in the option 1 through 4 tabs.

62. Question: Please confirm what version of RS Means (JOC or RS Means Data Online) and the Year, Title, and Location we are to use for bidding purposes. Specifications state to use CCI for Patuxent River, MD without reference to version. FYI, “Patuxent River” does not exist as a location. Please confirm the “Cost Data” type (i.e. Commercial New Construction, Facilities and Commercial Renovation), and “Location” (i.e. National Average, or Waldorf, MD).

Answer: CCI for Patuxent River is 1.10. Use the latest version of RS Means.

63. Question: Where does the pre-priced breakdown for enhanced oversight get entered? Please provide a blank form of Exhibit K (also referenced as ELIN Schedule (Attachment 4) Coefficient Breakdown Form) so we can provide the breakdowns in our proposal.

Answer: The form will be provided under amendment.

64. Question: Is the pre-priced coefficient only to be used with RS means cost data? And will the non-pre-priced coefficient only be used for the CLINS?

Answer: The pre-price and enhanced coefficients will be used in conjunction with the RS Means rates, while the non-pre-priced coefficient will be used for the ELINs not based on RS Means and other work.

65. Question: Is the profit fixed at 6% per tab “Base Year” on the Excel pricing spreadsheet or is this to be manually adjusted as desired by the Offeror?

Answer: "Profit will be included in the coefficient only and will be consistent throughout the life of the contract. The Government will not negotiate profit again, once the coefficients have been accepted. The 6% will be removed from the ELIN schedule. All profit will be in the coefficient.

66. Question: How do we to adjust line items within different DB regions? Are we supposed to have separate line items for each base? Example – Two bases are located in two different states. How do we handle travel and lodging? (i.e. The Indian Head Roofer Rate is $30.25 base + $13.24 fringe, the Dahlgren Roofer Rate is $15.56 base + $3.06 fringe)

Answer: The Government does not intend to have multiple ELIN schedules or coefficients to account for the different locations where work is being performed.

67. Question: The St Mary’s County Wage Determination does not have a “roofer” classification listed. Please confirm what rate we are to utilize for the roofer classification for work completed at Patuxent River Naval Air Station.

Answer: See answer to question 1 above. Please note that there are no ‘Building’ roofers for St Mary’s County and only ‘Residential’ roofers were included.

68. Question: Are we to include the cost of an Industrial Hygienist and air sampling as part of the abatement line item? Line Item A014AM states “Labor Industrial Hygienist” with a MAX unit of measure. Please clarify.

Line Item Description Tab states “Materials for Related Work Not Covered Elsewhere”.

Answer: The rate should be for the labor of the Industrial Hygienist only. If significant air sampling is required, the details will be negotiated at the task order level.

69. Question: How are we to incorporate the cost of normal sized cranes if required? (There is an 80 ton crane line item – A014AR)

Answer: This will be negotiated at task order level.

70. Question: Will scaffold stair towers be required by the Government and who decides when/if a scaffold system shall be erected?

Answer: Government does not specify ways and means of construction.

71. Question: Lightning protection line item – does this include upgrading to provide UL cert (upgrading surge protection to obtain UL certification) if so, how do we incorporate the many components of this cost?

Answer: If upgrading is required, it will be negotiated at task order level.

72. Question: Are there any requirements on warranty response times?

Answer: Warranties will be in accordance with Government Regulations and will be handled at a task order level. There may be occasions where non-standard warranties may be required.

73. Question: Will there be bid documents for each proposed task order or is the contractor required to provide guidance on final design to develop the SOW? If so, what credentials are required?

Answer: You will receive bid documents from the government, however, you may be asked to provide guidance on developing SOWs through joint scoping. No credential requirements are envisioned.

74. Question: Will certain projects require US citizen only workforce (i.e. highly restricted jobsite access on the flight line, or behind secondary security gates)? And if so, how do we include proper costs between us citizen and non-US Citizens?

Answer: Based on available information, the Webster Outlying Field (WOLF) is U.S. Citizens only. Please note that base access may become restricted in the future and the contractor should be prepared for that eventuality. If such a project is required, it will not fall under the current ELIN structure.

75. Question: Will escorts be provided for material/equipment deliveries in secured areas? How are we to price this item?

Answer: This will have to be handled at the task order level.

76. Question: How will the government handle shutdowns and temporary relocation of utilities impacted by the roofing work including high voltage lines that would endanger workers? Is the contractor expected to coordinate this work? Are any associated costs to be accounted for in our line item pricing?

Answer: This would be handled at the task order level. The government and contractor will coordinate on utility relocation and temporary shut downs.

77. Question: How do we include ground restoration in our line item pricing? There is a line item – 014AQ for sod restoration for laydown areas, however, no line item for grading/earth work. Are we to incorporate all grading/earth work with the line item 014AQ?

Answer: Yes, incorporate grading/earth work as noted.

78. Question: Please confirm that the cost of developing AHA’s and APP’s are to be included in our line item pricing.

Answer: These items will not be separately priced and are considered part of the coefficient.

79. Question: How many task orders are expected to be awarded simultaneously? Will the Government provide enough work on this contract for the Contractor to be able to schedule crews to work continuously or will numerous mobilizations and demobilizations be required? If so, how are mobilizations and demobilizations to be accounted for with the contractual pricing platform?

Answer: This is a new contract type with new requirements. Only the first task order is guaranteed. It is not known how work will be distributed. Mobilization and Demobilization should be accounted as part of the ELIN work.

80. Question: Based on the UFGS, please confirm the minimum wind design speed will be 115mph

Answer: Design will be based on UFC criteria. The task order will specify the requirement.

81. Question: How will the government evaluate if an Offeror is certified to install a broad range of roof systems?

Should the Offeror provide documentation that they are certified to install the systems specified in the line items? (i.e. – provide documentation that we are certified to install Firestone, Tremco, Soprema, etc. Should the Offeror provide documentation the installer is factory-trained and is authorized by the manufacturer to install the products specified with our bid package? (i.e. a letter from the various manufacturers stating we can obtain the warranties specified in each specification section?)

Answer: Evaluation will be based on Section L and Section M of the solicitation.

82. Question: Please confirm the Superintendent, SSHO, and QCM shall be non-working personnel and required to be onsite at all times.

Answer: Positions can be working but cannot overlap responsibilities.

83. Question: How does the Government intend to utilize this IDIQ in relation to the ongoing NAVFAC Washington Roofing MACC contract?

Answer: This solicitation has no relation to a MACC contract.

84. Question: Please clarify line item A001AP.1 “Demolition of plywood or board sheathing”. There is no description under the Line Item Description tab.

Answer: Line item description added.

85. Question: Please confirm line item A001AV is not used. The Line Item Description tab states “Demolition of Cement Asbestos Board Siding”.

Answer: Confirmed. Line item A001AV is not used.

86. Question: Please provide line item description for line items A004AG, A004AH, A004AI, A004AJ, A004K, and A004AL. The Line Item Description tab states “Not Used”.

Answer: Already provided.

87. Question: Please correct line item A006AC.1 – Buckingham (A006AC is currently listed twice).

Answer: Fixed. Buckingham listed as AC.1 and not AC.

88. Question: Please provide unit of measure for A008AJ “30" x 30", roof drain flashing at existing roof drain including removals.”

Answer: Unit is "EA" or Each.

89. Question: Please provide line item descriptions for A010AH.1, A010AH.2, and A010AH.3.

Answer: Line item description added.

90. Question: Please provide line item descriptions for A010AI.1, A010AI.2, A010AI.3, A010AI.4, A010AI.5, A010AI.6, A010AI.7, A010AI.8, and A010AI.9.

Answer: Line item description added.

91. Question: A011AP – Please clarify requirements. Cages are no longer OSHA compliant. Ladders 24’ and high need personal fall arrest system or a ladder safety system (not a cage).

Answer: Please follow the OSHA requirements.

92. Question: A012AA.1 – Needs to be added to 22 GA 50 to 500 squares.

Answer: Noted.

93. Question: A012AB.1 – Needs to be added to 20 GA 50 to 500 squares.

Answer: Noted.

94. Question: Please provide line item descriptions for A013AO, A013AP, A013AQ, A013AR, A013AS, A013AT, A013AU, A013AV, A013AW, A013AX, and A013AY.

Answer: Line item description added. Description should read "Fork Lift."

99. Question: Please provide line item description for A014AU “30-yard dumpster”.

Answer: Line item description added.

100. Question: A Major formula error we just noticed in the excel file tab “Base Year”. The summation formulas used in the “Extended” column to total up A010AA thru A010AR (A010 Grouping) and A013AA thru A013AY (A013 Grouping) do not include all CLIN extensions. If you look at the “Extended” column and click on cell I215, you’ll see the formula misses the last 4 CLINS in this group of unit prices. It only includes I183 thru I209 and leaves out I210 thru I214. And, if you look at the “Extended” column and click on cell I270 you’ll see the last 10 unit price extensions are missed. This formula only includes I245 thru I259 and leaves out I260 thru I269.

Answer: Noted and corrected.

101. Question: Will the RFI due date and proposal due date be extended since we just performed the site visit 2 days ago (2/23/21)?

Answer: The proposal due date has been extended to 1000, ET, on 11 March 2021.

102. Question: It states, in accordance with the provision at FAR 52.219-3 Notice of HUBZone Set-Aside or Sole Source Award, construction by special trade contractors, at least 25% of the cost of the contract performance to be incurred for personnel will be spent on the HUBZone prime contractor’s employees.

At least 50% of the cost of the contract performance to be incurred for personnel will be spent on the HUBZone prime contractor’s employees or on a combination of the HUBZone prime contractor’s employees and employees of HUBZone small business concern subcontractors.

These two statements seem to be the same but have different percentages (25% or 50%). What percentage are we to use to be incurred? What percentage are we to use under a SBA approved Mentor Protégé program?

Answer: Both percentages are accurate. At least 25% of the cost of contract performance incurred by personnel will be spent on the HUBZone prime contractor’s employees, while 50% of the cost of performance must be spent between HUBZone prime contractor and HUBZone subcontractor firms. No restrictions were noted regarding the SBA Mentor Protégé program.

103. Question: For each CLIN the quantity is listed as 10,000,000 and the unit is listed as “each”. Are we to leave the “Unit Price” and “Amount” blank and just put the total sum of all ELIN’s for that specific year in next to “Net Amount” since this is a IDIQ JOC?

Answer: The CLIN amounts are reflecting the yearly capacity restraints for which orders will be placed. The ELINs and coefficients will be added under this section as binding pricing, however, will not be directly reflected in the CLINS.

104. Question: Do we fill out and submit with our offer the chart for CLIN 0001? Do we create and submit a similar chart for each CLIN?

Answer: The Government is anticipating seeing a completed ELIN schedule and the three requested coefficients for use across the life of the contract. The intention is to have the three coefficients that can be applied against the orders over the life of the contract.

105. Question: If the task order is less than 150k, how many hats/roles can one individual fulfill? If the task order is less than 250k, how many hats/roles can one individual fulfill?

Answer: For the purposes of the enhanced coefficients, the dedicated staff will be one individual per required labor category.

106. Question: Will there be design build projects? Is there an estimated percentage of the total projects that would be design build?

Answer: The intention is to have minimal design-build type actions under the contract, however, the contract does not preclude the inclusion of these type actions. Please note that all work items will be based on the repair.

107. Question: When will Notice to Proceed be given? Upon award of a task order or after all preconstruction submittals have been approved?

Answer: Notice to Proceeds will be given on an individual task order basis and may fluctuate based on the preconstruction submittals required. For the SEED project, the notice to proceed will be provided once all preconstruction submittals have been received.

108. Question: Please confirm that no bonding requirements will be required for task order under $35,000. Upon acceptance of our task order bonds, will invoicing for the bonds cost be accepted?

Answer: All bonding requirements will done in accordance with Government Regulations and will done at an individual task order basis. Bonding costs will not be considered a direct cost in regards to this project.

109. Question: Please confirm that the bid bond amount is to be in the amount of $2,000. Or is the bid bond amount or be in the total amount of the seed project?

Answer: A general bid bond in the amount of $2,000 is required for the base contract and will be held throughout the life of the base contract. Additionally, a bond will be required for the Seed project, which will be held for that project only.

110. Question: What should we submit foe the HUBZone eligibility subfactor?

Answer: Submit any information that shows your company is a HUBZone, whether it be a determination with the SBA or self-reported to the SBA.

111. Question: Are we required to submit both the entire SBA Mentor Protégé agreement and joint venture agreement or just one of them?

Answer: There is n requirement to submit either of these, however, if a firm is entering into a Joint Venture or has an ongoing SBA Mentor-Protégé Agreement, they should submit the agreement for both of these.

112. Question: Is the entire agreements required or just the approval letter for the SBA Mentor Protégé agreement and joint venture agreement?

Answer: It is requested that the entire agreements be provided.

113. Question: Volume II has a page limit of 70 pages. One agreement is 15-25 pages alone. Will these pages be counted toward the total 70 page limit?

Answer: For the purposes of this action, the agreements are not considered part of the page limitations.

114. Question: Is the lowest price technically acceptable being based solely on the seed projects total price? Or, is the lowest price technically acceptable being based on the sum of all CLINS for year 1? Or, is the lowest price technically acceptable being based on the sum of all CLINS for all five years? If the lowest price technically acceptable is being based upon the sum of either year 1 or all 5-years, what is the purpose of the seed project's pricing?

Answer: The price determination will be based on the analysist of the ELIN schedule and the coefficients. The Seed project will act as the first action awarded under the contract, as well as serve the purposes of determining whether firms can provide a reasonable price proposal for the required roofing project.
