AMENDMENT 0003

The purpose of this amendment is to provide the following:

1. Phase II Determination

2. Phase II Instructions to Offerors

3. Site Visit Information

4. Attachments

5. Wage Determination

1. PHASE II DETERMINATION

The short-list determination has been made and the purpose of this amendment is to begin Phase II of the procurement. In accordance with Naval Facilities Acquisition Supplement 36.303-1-100 the number and identity of the most highly qualified offerors selected to submit Phase II proposals is not releasable. Phase II proposals will only be accepted from those offerors determined the most highly qualified and invited to submit Phase II proposals.

2. PHASE II INSTRUCTIONS TO OFFERORS

The primary point of contact for this project is Lindsay Brown at lindsay.naill@navy.mil. The secondary point of contact is Janine Queen at Janine.queen@navy.mil.

The subject project is Design-Build. Award will be based on best value in accordance with Evaluation Factors for Award for Phase I and Phase II.

The relative order of importance of the non-cost/price evaluation factors is the technical factors 1, 2, 4, 5, and 6 are of equal importance to each other and, when combined are equal in importance to the past performance evaluation/performance confidence assessment factor, Factor 3. When the proposal is evaluated as a whole, the technical factors and past performance/performance confidence assessment factor combined (i.e., the non-cost/price evaluation factors) are approximately equal to price.

The importance of price will increase if the Offerors’ non-cost/price proposals are considered essentially equal in terms of overall quality, or if price is so high as to significantly diminish the value of a noncost/ price proposal’s superiority to the Government. Award will be made to the responsible Offeror(s) whose offer conforms to the solicitation and represents the best value to the Government, price and nonprice factors considered.

The Design Build Budget Amount has been revised to $63,919,870. This is for the base and all options.

Offer guarantees are required to be provided for Phase II.

Request for Information (RFI) must be submitted in a MS- WORD document and submitted by the Prime Contractor only. Subcontractors with questions must submit them through the Prime Contractor. The RFI cut-off date is 20 July 2018 No Later Than 2:00 PM (EST). RFIs during the proposal preparation period shall be submitted by email to Contracting Officer Lindsay Brown at

Lindsay.naill@navy.mil.

PROPOSAL DELIVERY INFORMATION

All Phase II proposals must be received prior to 7 August 2018 at 2:00 PM EST.

Proposals may be sent via express mail carriers or hand-carried to the following address:

NAVFAC Washington Attn: Lindsay Brown 1314 Harwood Street SE, Bldg. 212, First Floor Mail Room Washington Navy Yard Washington, DC 20374

INSTRUCTIONS FOR HAND DELIVERY OF PROPOSALS:

The current security condition at the Washington Navy Yard requires escorts for entry to the base by individuals not possessing a U.S. Government DoD Common Access Card (CAC) identification card.

Individuals without a DoD CAC will not be permitted to enter the Navy Yard.

NAVFAC Washington will NOT be able to provide escorts for Navy Yard entry of hand delivered proposals. NAVFAC Washington will NOT receive hand delivered proposals at the Base Pass Office or any location other than that identified for receipt in the solicitation.

The Government considers use of a courier service, such as FedEx or UPS, as hand delivery of proposals and the responsibility for timely delivery resides with the offeror. Offerors are notified that the entry point for proposals submitted through the U.S. Postal Service is at Joint Base Anacosta-Bolling and NOT at the Washington Navy Yard. Proposals must be received by NAVFAC Washington at the Navy Yard by the due date and delivery time from the Joint Base Anacosta-Bolling to the Navy Yard cannot be predicted nor guaranteed. Offerors should take this into consideration when determining delivery method.

Please note offerors have the option to deliver the PRICE SCHEDULE AND SMALL BUSINESS SUBCONTRACTING PLAN via the Safe Access File Exchange (SAFE) website at https://safe.amrdec.army.mil/SAFE/Welcome.aspx. Instructions on how to use SAFE can be found on this website. Please note ONLY THE PRICE SCHEDULE AND SMALL BUSINESS SUBCONTRACTING PLAN is allowed to be delivered via this website. Other information submitted via this website WILL NOT BE ACCEPTED. Submissions via this method are subject to the same proposals due date and time as listed above.

Facsimile copies or email copies will NOT be accepted.

Please allow SUFFICIENT TIME for your proposal to be received prior to the proposed closing date/time.

Proposals shall be submitted in sealed envelopes/boxes marked in the bottom right corner “Solicitation

N40080-18-R-1175, DO NOT OPEN.”

Any proposals submitted after the time set for receipt will be stamped with the date and hour of receipt and held unopened until after award. The file shall be documented in accordance with

FAR 14.304-4.

The Government reserves the right to reject any or all proposals at any time prior to award, to negotiate with any or all Offerors, and to award to the Offeror submitting the proposal determined by the Government to be the most advantageous. OFFERORS ARE ADVISED THAT AN AWARD MAY BE MADE WITHOUT DISCUSSIONS. Therefore, proposals should be submitted initially on the most favorable terms. Offerors should not assume that they will be contacted or afforded an opportunity to qualify, discuss or revise their proposals prior to award.

The proposal submitted in response to this solicitation shall be clear, concise, and shall contain sufficient detail for effective evaluation and for substantiating the validity of stated claims. The proposals should not simply rephrase or restate the Government’s requirements, but rather should demonstrate convincing rationale to address how the offeror intends to meet these requirements. The offer shall be compliant with the requirements as stated in the RFP. Nonconformance with the solicitation requirements, specified organization and content may result in elimination or misevaluation of the proposal. All claimed technical capabilities to meet the requirements shall be realistic and are subject to verification by the Government. Offerors should assume that the Government has no prior knowledge of the offeror’s business and that the Government will base its evaluation on the information contained in the offeror’s proposals.

Amendments will be posted to the website Navy Electronic Commerce Online (NECO) https://www.neco.navy.mil/. Hard copies of the amendments will not be mailed. It is the Offerors responsibility to check the website periodically for any amendments to the solicitation.

All proposers: To demonstrate commitment in using small business concerns, the Small Business Subcontracting Plan or subcontracting participation breakdown may list all subcontractors by name. If the proposed Small Business Subcontracting goals do not meet the minimum NAVFAC Small Business Subcontracting Targets, include a detailed explanation describing the actions taken to arrive at that determination, along with an explanation for the goals that actually were proposed. For proposals submitted on design-build solicitations, the proposer must identify its designer/design team in its Subcontracting Plan or Small Business Participation Breakdown.

NAVFAC SB Goals:

SB: 46.25%

HUBZONE: 8.5%

SDB: 30.5%

WOSB: 9.5%

Offerors shall submit their Price proposal in accordance with the solicitation requirements. Offerors shall submit the Price Schedule (section 00100 – Solicitation Contract Form) for submission of their price with all the line items (CLINS) completed.

(b) Basis of Evaluation:

The Government will evaluate price based on the total price. Total price consists of Items 0001 through

0007. The Government intends to evaluate all options and has included the provision FAR 52.217-5, Evaluation of Options (JUL 1990) in Section 00100 of the solicitation. In accordance with FAR 52.217-5, evaluation of options will not obligate the Government to exercise the option(s). Analysis will be performed by one or more of the following techniques to ensure a fair and reasonable price:

(i) Comparison of proposed prices received in response to the RFP.

(ii) Comparison of proposed prices with the IGCE.

(iii) Comparison of proposed prices with available historical information.

(iv) Comparison of market survey results.

FACTOR 5 – ENERGY DESIGN REDUCTION

(a) Solicitation Submittal Requirements:

(1) Energy Efficiency Narrative:

Provide a detailed narrative describing how the proposed solution will meet baseline ASHRAE 90.1-2013.

Also describe how the solution will provide at least a 30% energy reduction below the baseline ASHRAE 90.1, based on life cycle cost effectiveness.

To determine solution, use the ASHRAE 90.1, Appendix G – Building Performance Rating Method, except replace the formula in G1.2 with the following:

Percentage improvement = 100 × ((Baseline building consumption − Receptacle and process loads) − (Proposed building consumption − Receptacle and process loads)) / (Baseline building consumption − Receptacle and process loads)

List assumptions used to obtain the percent energy reduction.

Organize narrative in four parts: 1) Orientation, Configuration, and Shape; 2) Envelope properties (fenestration, solar heat gain coefficients (SHGC), wall and roof insulation values (U-values), window Uvalues); 3) Mechanical (HVAC, plumbing, and domestic hot water heating systems, including any solar hot water systems); and 4) Electrical Systems (lighting and control systems, including any interior and exterior lighting systems, renewable energy and control systems).

Where 30% reduction is not lifecycle cost effective, provide highest percent energy reduction that is lifecycle cost effective.

Note: Building performance rating and percent energy reduction are calculated in terms of energy rather than energy cost.

Do not exceed two (2) double-sided pages (or four (4) single-sided pages).

(2) Whole Building Energy Simulation:

The Whole Building Energy Solution requires the use of the following documents included in Part 6 of this

RFP:

- Government Baseline Building Performance Rating

- Government Baseline Building Energy Model (input-output) schedules (If the process and receptacle loads are not given in the schedules, assume they are 25% of the total load.)

- Default simulation factors

- Utility Costs (energy rates) for project, based on local unburdened PWD rates

- “Whole Building Energy Simulation” templates

- “Performance Rating Method Compliance Reports”

Use the “Whole Building Energy Simulation” templates to demonstrate the percentage improvement over the “Proposed Building Performance Rating”. Receptacle and process loads are included in the “Whole Building Energy Simulation” as part of the building loads. Submit the Whole Building Energy Simulation in PDF electronic file format.

(b) Basis of Government Evaluation:

1) Energy Efficiency Narrative and Solution: The Government will evaluate the Offeror’s proposed energy efficiency narrative and solution.

2) Whole Building Energy Simulation: The Government will evaluate the Whole Building Energy Simulation to determine the validity of the design assumptions, thoroughness and accuracy of the Whole Building Energy Simulation, and the percent improvement of energy consumption reduction below the Government’s “Baseline Building Performance Rating”.

FACTOR 6 – SMALL BUSINESS UTILIZATION

This Factor assesses both the historical achievements in utilizing small business concerns as subcontractors and proposed small business participation and commitment strategies.

(a) Solicitation Submittal Requirements:

1. Achievements: All offerors shall provide a narrative (limited to two pages) to describe their achievements in supporting the Government’s policy to provide maximum practicable opportunities for small business (SB), veteran-owned small business (VOSB), service-disabled veteran-owned small business (SDVOSB), historically underutilized business zone (HUBZone) small business, small disadvantaged business (SDB), and women-owned small business (WOSB) concerns to participate as subcontractors consistent with efficient contract performance. In support of narrative submissions:

a. All offerors shall submit small business subcontracting information associated with each project cited under the Corporate Experience Factor in the format provided in Attachment D, Small Business Subcontracting Record.

b. Offerors representing as other than small businesses shall also provide copies of the most current individual subcontracting reports (ISRs) associated with each project cited under the Corporate Experience Factor if a small business subcontracting plan was required by the contract. If such projects were completed under specific task orders, provide ISRs for the overall contract. For cited projects with state and local government agencies, provide similar subcontracting performance reports if required by the contracts. When not specifically addressed in the ISR or similar report, offerors shall provide explanations for all instances of failures to meet dollar or percentage goals in individual subcontracting plans.

Notes:

The Government reserves the right to consider achievements information on other recent, relevant projects from all available sources.

Offerors utilizing achievements information of team members or key subcontractors shall clearly demonstrate how these companies will have meaningful involvement in the management of the subcontracting program for this acquisition. If not, such achievement information will not be considered under this factor. If the offeror is a new joint venture, partnership or other entity consisting of more than one company, provide achievements information for each individual business entity(ies) that will be responsible for managing the subcontracting program and clearly describe those responsibilities.

Failure to provide ISRs or any other requested information must be fully explained and may negatively impact your evaluation.

2. Small Business Participation and Commitment: All offerors shall submit a small business participation and commitment strategy including all data elements shown in Attachment E, Small Business Participation and Commitment Strategy.

a. Identify in terms of dollar value and percentage of the total acquisition the extent of work the offeror will self-perform as the prime contractor. If submitting an offer as a joint venture, identify the percentage of work each member will be responsible for and indicate the size status of each member (e.g. small business, woman-owned small business, other than small business).

b. Include supplemental narratives (limited to five pages) to address other elements of the offeror’s strategy such as binding agreements covering post award roles for execution of the contract and specific initiatives and tools that will be employed under the contract to enhance small businesses opportunities to both participate in this acquisition and build capabilities to support future NAVFAC acquisitions.

c. The anticipated prime and first tier overall small business participation rate for this acquisition (i.e. work to be performed by small businesses as the prime and/or subcontractors) is 20% of the contract value. Offerors are encouraged to exceed this percentage and seek meaningful levels of participation in each of the small business socioeconomic programs listed in Attachment E consistent with efficient contract performance. Offerors shall explain in their participation and commitment strategies how proposed participation rates were established. The small business participation and commitment strategy must be in agreement with any required small business subcontracting plan and will be made a part of the contract upon award.

(b) Basis of Evaluation:

Offerors will be evaluated on the extent to which their proposals and other performance information available to the Government demonstrate a history of successfully supporting Government policies concerning utilization of small business concerns as subcontractors including, when applicable, achievements against established small business subcontracting plan goals. Offerors will also be evaluated on the levels of small business participation proposed and the degree of commitment to use named sources. The anticipated benefits of proposed initiatives and tools to enhance small business participation and capabilities will be considered. The Government will assess proposal realism and the likelihood of success in achieving the small business objectives of this acquisition.

Forms to be used for offeror submission of Small Business Utilization Factor information are:

Attachment D – Small Business Subcontracting Record Attachment E – Small Business Participation and Commitment Strategy

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.

Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example:

PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.

Survey wage rates are not updated and remain in effect until a new survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)

and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:

Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:

Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.

3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:

Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

4.) All decisions by the Administrative Review Board are final.
