BESS have to be installed per code for safety reasons. Has the installation of this system already been approved by the Authority of Local Jurisdiction (AHJ)?

The installation will be performed in-house and approved by the Public Works Department at NBVC. We have already obtained Site Approval and CATEX for the installation. The design shall comply with all applicable local and national codes.

Q32 3-5 Section C - Descriptions and Specifications

The Navy complies with local and national codes.

Q33 3-5 Section C - Descriptions and Specifications

Will this installation comply with

NFPA855?

Yes.

Q34 3-5 Section C - Descriptions and Specifications

Is there a UL requirement? Comply with UL requirements if applicable.

Q35 33 Section M.3 Basis of Evaluation and Attachment J-3 Pricing Sheet

The price evaluation is clear in stating that price will be evaluated rather than cost, and the referenced FAR clause, 15.404-1(a)(3) refers to cost analysis when certified cost and pricing data is required, which is not the case for this RFQ. As such, it appears that the evaluation criteria is inconsistent with the request for cost detail as shown in Attachment J-3. Will the Government please clarify its evaluation criteria?

RFQ Section L.6 and Section M.3 were revised as a result of the response to this RFI.

The Government will perform price analysis based on the total proposed price in accordance with FAR 15.404-1(a)(2) to verify that the overall price offered is fair and reasonable. In accordance with FAR 15.404-1(b)(1), price analysis may include evaluating data other than certified cost or pricing data obtained from the offeror or contractor when there is no other means for determining a fair and reasonable price.

The requested detail in the pricing sheet will help facilitate the determination of fair and reasonableness.

Q36 30 Section L.4.5.a Do you require a hard copy of the sealed envelope containing the completed

Attachment J-2 Financial Institution/Bank Information for the questionnaire? Or may an offeror send the completed questionnaire electronically with its submission?

Prospective Contractor Form shall be submitted electronically with the offeror’s submission. Attachment J- 2 is revised to reflect this requirement.

Q37 30 Section L.4.5.a Since this is an electronic submission, will the Government please confirm the J-2 Financial Institution Bank Information Form will need to be submitted as a sealed package directly from the bank to the Government as stated in the J-2 attachment?

Attachment J-2 Financial Institution/Bank Information for the Prospective Contractor Form shall be submitted electronically with the offeror’s submission. Attachment J- 2 is revised to reflect this requirement.

SECTION M - EVALUATION FACTORS FOR AWARD

The following have been modified:

BASIS FOR EVALUATION

M.1 BASIS FOR AWARD

1. The Government reserves the right to eliminate from consideration for award any or all offers at any time prior to award of the contract; to negotiate with offerors in the competitive range; and to award the contract to the offeror submitting the offer determined to represent the best value—the offer most advantageous to the Government, price and other factors considered.

2. The Government intends to evaluate offers and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. In addition, if the Contracting Officer determines that the number of offers that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of offers in the competitive range to the greatest number that will permit an efficient competition among the most highly rated offers.

3. The tradeoff process is selected as appropriate for this acquisition. The Government considers it to be in its best interest to allow consideration of award to other than the lowest priced offeror or other than the highest technically rated offeror.

4. All technical factors when combined are approximately equal to price.

5. Any offer found to have a deficiency in meeting the stated solicitation requirements or performance objectives will be considered ineligible for award, unless the deficiency is corrected through discussions. Offers may be found to have either a significant weakness or multiple weaknesses that impact either the individual factor rating or the overall rating for the proposal.

6. The Government will evaluate the offeror’s past performance by using data available on the Contractor Performance Assessment Reporting System (CPARS). In the case of an offeror without a record of relevant past performance history in CPARS, the offeror may not be evaluated favorably or unfavorably for its past performance history.

7. Offerors are required to meet all solicitation requirements, such as terms and conditions, representations and certifications, technical requirements, and the responsibility determination, in addition to those identified as areas to be eligible for award. Failure to comply with solicitation requirements may result in an Offeror being removed from consideration for award. Any exceptions to solicitation requirements must be fully explained and justified.

M.2 ADJECTIVAL RATINGS/DESCRIPTIONS

1. Technical Factors will be rated using the following adjectival rating scheme:

Combined Technical/Risk Ratings

Rating Description

Outstanding (O)

Offer meets requirements and indicates an exceptional approach and understanding of the requirements. Strengths far outweigh any weaknesses. Risk of unsuccessful performance is very low.

Good (G)

Offer meets requirements and indicates a thorough approach and understanding of the requirements. Offer contains strengths which outweigh any weaknesses. Risk of unsuccessful performance is low.

Acceptable (A)

Offer meets requirements and indicates an adequate approach and understanding of the requirements. Strengths and weaknesses are offsetting or will have little or no impact on contract performance. Risk of unsuccessful performance is no worse than moderate.

Marginal (M) Offer does not clearly meet requirements and has not demonstrated an adequate approach and understanding of the requirements. The offer has one or more weaknesses which are not offset by strengths. Risk of unsuccessful performance is high.

Unacceptable (U)

Offer does not meet requirements and contains one or more deficiencies. Offer is unawardable.

2. Definitions: The following definitions are provided to assist evaluators in the evaluation of each technical factor.

a. Strength: An aspect of the offer has merit or exceeds specified performance or capability requirements in a way that will be advantageous to the Government during contract performance.

b. Weakness: A flaw in the offer that increases the risk of unsuccessful contract performance.

c. Significant Weakness: A flaw that appreciably increases the risk of unsuccessful contract performance.

d. Deficiency: A material failure of an offer to meet a Government requirement or a combination of significant weaknesses in an offer that increases the risk of unsuccessful contract performance to an unacceptable level.

M.3 BASIS OF EVALUATION

1. Factor 1: Technical Merits

Basis of Evaluation: The Government will evaluate the technical merits of the offer to determine if the proposed system has proven operational performance in similar unit size and at several locations. Cycle life and capacity loss based on operational and/or empirical data rather than design are preferable.

2. Factor 2: Schedule

Basis of Evaluation: The Government will evaluate the offeror’s proposed schedule to determine if it supports the Government’s scheduled milestones as indicated in the scope.

3. Factor 3: Price

The Government will evaluate offers by conducting price analysis.

Analysis will be performed by one or more of the following techniques listed below and in FAR 15.404-1(b)(2) to ensure a fair and reasonable price:

A. Comparison of proposed prices received in response to the solicitation.

B. Comparison of proposed prices to historical prices paid, whether by the Government or other than the

Government, for the same or similar services.

C. Comparison of proposed prices with Government cost estimates.

D. Analysis of pricing information provided by the offeror.

The Government will also evaluate the price volume for unbalanced pricing. Unbalanced pricing may be determined to exist when, despite an acceptable total evaluated price. The price of one or more of the contract exhibit line items is significantly over or understated as may be indicated by the application of the price techniques specified above. An offer may be rejected if the government determines that the lack of balance poses an unacceptable risk to the government.
