About this file
This document is an amendment to Solicitation N3904023R0008 for Touch Labor Production Support for Portsmouth Naval Shipyard. The purpose of the amendment is to make several changes to the solicitation, including replacing FAR 52.212-14 with 52.219-14, inserting additional FAR clauses, modifying the evaluation factors, and updating the delivery schedule.
The solicitation is for the award of multiple Cost-Plus-Fixed-Fee Indefinite Delivery, Indefinite Quantity (IDIQ) contracts to provide production support using qualified personnel across 15 trade skills. The contracts will have a 5-year period of performance. A portion of the task orders will be set aside for small businesses. The solicitation will be issued using full and open competition, with the Government evaluating technical approach, management approach, past performance, and small business participation. Pricing will be considered at the task order level, but not as an evaluation factor at the contract level.

(a) The due date for the order proposals will be set forth in each solicitation.
(b) Proposals received from IDIQ MAC holders not eligible to participate in the competition for the specific order will not be considered.
(2) Evaluation. The Government will evaluate proposals against the selection criteria contained in the order solicitation. At a minimum, evaluation criteria will include:

Organizational Conflict of Interest Mitigation Plan (if applicable)
Due to the nature and scope of the work encompassed by this solicitation, the Government requires that there be no conflict which would preclude the prime contractor from performing any portion of the Performance Work Statement, regardless of whether it intends to subcontract that portion. Due to the nature of the work outlined in Section C, the Government anticipates that organizational conflicts of interest (OCIs), including impaired objectivity OCIs, will arise for Offerors that perform under other contracts within the cognizance of PNS as prime contractor or subcontractor for touch labor that will be covered by this solicitation.
If any Offeror may have an OCI the Offeror must notify the Government and must submit an OCI mitigation plan with its proposal. Failure by an Offeror that has identified a potential OCI or an eliminated OCI to submit an OCI mitigation plan with its proposal shall be considered grounds for disqualification from award. The Government will not accept mitigation measures for impaired objectivity OCIs. For any OCI, the Government will not accept mitigation or elimination measures:
(1) That creates an additional burden on the Government to implement;
(2) That involve directed subcontractors or creating separate lines of reporting or any modification to the
Government/prime contractor relationship; or
(3) That is deemed in the sole discretion of the contracting officer to provide insufficient organizational independence between the prime contractor or a subcontractor under this contract and a prime contractor or subcontractor for touch labor that will be covered by this solicitation.
This is not an exhaustive list of measures that will be considered inadequate to protect the Government. It is an illustrative list provided in an effort to ensure that all Offerors understand the Government’s expectations and intent to avoid OCIs. The Government reserves the right to determine whether or not any mitigation plan provided by an Offeror is sufficient to protect the Government. The Government also does not intend to accept any mitigation measures that involve additional oversight or commitment of resources by the Government, such as agency review of contractor deliverables, internal review of task assignments for OCI before issuance, or formalized monthly reviews of work performed and projected. All Offerors are directed to review and comply fully with the OCI clauses included in Section L of this solicitation.
**NOTE: If an OCI is applicable, include it in Volume I, Non-Price Proposal with Factor II, Management Approach under a separate tab.
OFFER
The completion and submission to the Government of an offer shall indicate the Offeror’s unconditional agreement to the terms and conditions in this solicitation, concurrence with the Performance Work Statement, and the proposed contract type. In evaluating an Offeror’s capability, the Government shall consider how well the Offeror complied with the instructions in the solicitation.
III. PROPOSAL CONTENT
1. Volume I Non-Price Proposal
The Non-price Proposal evaluation factors are listed below:
Factor I: Technical Approach. Offerors shall provide a detailed Technical Approach in their proposal. The Technical Approach shall demonstrate the Offerors’ ability to provide an adequate number of personnel with the qualifications and experience necessary to perform and manage all tasks described in the Statement of Work (SOW) throughout contract performance. The Offerors’ approach shall include the following information:
Demonstrate a sound process to hire, train, and retain an adequate number of personnel (Tradesman, Key Personnel, Others) with the applicable qualifications and experience required for their designated positions.
Demonstrate the methods that will be used to reduce personnel turn-over and the timeline for hiring, training, and replacing personnel during contract performance. Identify the proposed staffing levels for each Trade the Offeror intends to perform by FTE and employer (offeror, subcontractor).
Provide the names and resumes of all Key Personnel who will perform under this contract. Letters of Commitment are required if an Offeror proposes an individual for a key position who is not a current employee of the Offeror or its subcontractors. Resumes shall clearly demonstrate that the Key Personnel possess all applicable qualifications and experience required for their designated positions and shall present dates using both Months and Years. Letters of Commitment shall be signed no earlier than 60 days before the due date for proposal submission and shall state that the individual intends to accept a reasonable offer of employment if the Offeror is awarded a contract. Offerors’ proposals shall clearly identify the specific Trades that each Supervisor will be assigned to supervise; and
Demonstrate the Offerors’ plan to provide a Formal Training Program that satisfies all requirements within the SOW, including Trade Training Plans, a Training Management System, Training Records and Continuing Training Plans. Discuss the degree to which the training program encompasses the competencies for each Trade (i.e., typical trade tasks; trade skill requirements) and ensures employees are capable of performing in their selected trades. Submit copies of the following: (i) Training Plans for the confined/enclosed space entry, personal fall arrest system, and respirator programs; (ii) Trade Training Plans for each Trade the Offeror intends to perform during contract performance; and (iii) Training Records for one (1) employee in each Trade.
Factor II: Management Approach. Offerors shall provide a detailed Management Approach in their proposal. The Management Approach shall demonstrate the Offerors’ ability to monitor and manage its workforce and the contract’s requirements and to ensure timely, quality performance in a cost effective manner. The Offerors’ approach shall include the following information:
General Management Approach. Describe the Offerors’ approach with respect to the following requirements:
-Procedures to monitor and adhere to performance requirements, including the quality control measures that will be used to identify and resolve problems early;
-Procedures used to plan, track and control multiple taskings;
-Factors considered in assigning individuals to tasks, methods for handling changing priorities and schedules and for transitioning employees from tasks during performance; and
-Procedures to track, control and adhere to manpower, schedule and cost limitations.
SOW Requirements. Describe the Offerors’ approach with respect to the following SOW requirements:
-Workforce Management Program (SOW 2.3);
-Emergency Reporting Protocol (SOW 2.8);
-Personnel Management Program (SOW 2.9);
-Equal Employment Opportunity Policy;
-Alcohol and Drug Prevention Policy;
-Contractor Furnished Material (SOW 2.10.1);
-On-Site Supervision (SOW 3.5);
-On Boarding (SOW 3.6);
-Security Clearances / Shipyard Access (SOW C-4.0);
-Technical Conferences / Review Meetings (SOW C-5.0) -Deliverables (CDRLs A001 - A0011)
Organizational Structure. Provide an organizational chart of the Offeror’s proposed management structure. Identify positions, titles, number of personnel by FTE, and their employers (prime or subcontractor, if applicable). Describe individuals’ responsibilities and authorities within the Offerors’ organization and when interacting/communicating with Government personnel (e.g., project and contracting personnel). Identify who bears ultimate responsibility for contract performance and authority to bind the Offeror. Explain relationships between the Offerors’ corporate entities and on-site organizational elements in performing the contract.
Subcontractors: Offerors that intend to use subcontractors, teaming partners or affiliates (hereafter subcontractors) shall identify those entities in their proposal (by name, size and socio-economic status), their roles under the contract (by SOW section where possible), their authorities within the Offerors’ organization and when interacting/communicating with Government personnel, and their relevant capabilities and experience. Describe how subcontractors will be integrated into the Offeror’s organization and managed.
Factor III- Past Performance. The offeror shall demonstrate relevant past performance or affirmatively state that it possesses no relevant past performance. Relevant past performance is performance under contracts or efforts within the past five (5) years that is the same as, or similar to, the scope, magnitude, and complexity of the work described by this solicitation.
To demonstrate its past performance, the offeror shall provide up to three (3) of its most relevant contracts or efforts within the past five (5) years, and provide any other information the offeror considers relevant to the requirements of the solicitation using the format as provided within Attachment 6 (Past Performance Information Form). Offerors should provide a detailed explanation demonstrating the relevance of the contracts or efforts to the requirements of the solicitation.
Prior Performance Information. Provide information substantiating the Offeror’s track record of utilizing small business on past contracts. For Large Businesses, include SF 294 and SF 295 (or Individual Subcontracting and Summary Subcontracting Reports in eSRS) information for government contracts with these reporting requirements for the last three years. If Offeror has had no contract in the last three years with these reporting requirements, a statement to that effect must be included. For Large and Small Businesses, provide descriptive information for all small business categories. Any information concerning long-term relationships with Small Business subcontractors, such as mentor-protégé relationships should also be provided.
Offerors may provide contracts describing their own experience as a subcontractor. Offerors shall describe the major or critical aspects of the work performed, as well as the dollar value of work performed, under the submitted contract. The offeror must also submit at least one (1) recent and relevant contract effort for each proposed subcontractor that performs more than 10% of the total contract effort in total man hours. The contracts identified should demonstrate in-depth knowledge and successful performance of contracts, or similar size, scope and technical complexity to this solicitation and the dollar value of work performed, under the contract.
Subcontractor performance (either the offeror's own subcontractor experience or proposed subcontractors experience) of major or critical aspects of this requirement will be considered as highly as prime contractor past performance information for the offeror. Failure of offerors to describe the required information will result in the contract reference not being evaluated.
The references will be evaluated in the aggregate in order to allow offerors who may not have the entire scope, magnitude, and complexity of the requirement under one individual contract to still be considered acceptable if past performance with the full scope, magnitude, and complexity of the requirement can be demonstrated within the allotted number of references as described above.
*NOTE: Offerors are advised that the Government may consider past performance information obtained from sources other than those identified by the Offeror, including Federal, State and local Government agencies, better business bureaus, published media and electronic databases including, but not limited to, Past Performance Information Retrieval System (PPIRS) and Contractor Performance Assessment Reporting System (CPARS). The Government may research Offeror performance on any Federal, State, local and non-commercial procurement that is known to the Government, but not included on a submitted reference.
Customer Assessments
Offerors shall submit the Past Performance Report Form provided as Attachment 7 with this solicitation to each of their customer POCs identified in Attachment 6 (Past Performance Information Form). In order to expedite the assessment process, the Offeror may complete the “Contract Information” portion of the Past Performance Questionnaire for the convenience of the customer POC. The Offeror shall not, however, complete any other section of the Customer Assessments. The questionnaire shall be provided to the customer POC with instruction to complete and submit it directly to the Contracting Officer on or before the proposal due date. Past Performance.
The following adjectival ratings/definitions shall be used for the Past Performance evaluation factor: There are two aspects to the past performance evaluation.
1) Relevancy of Past Performance.
The first aspect is to evaluate the Offeror’s past performance to determine how relevant a recent effort accomplished by the Offeror is to the effort to be acquired through the source selection.
More relevant past performance will typically be a stronger predictor of future success and have more influence on the past performance confidence assessment than past performance of lesser relevance. Sources of past performance information may include information provided by the Offeror, information obtained from questionnaires tailored to the circumstances of the acquisition, or any other sources available to the Government. Other sources include, but are not limited to: PPIRS, Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), or other databases; interviews with Program Managers, Contracting officers and Fee Determining Officials; and DCMA.
Rating Description Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort this solicitation requires.
Relevant Present/past performance effort involved similar scope and magnitude of effort this solicitation requires.
Somewhat Relevant Present/past performance effort involved some of the scope and magnitude of effort this solicitation requires.
Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort this solicitation requires.
2) Performance Confidence Assessment.
The second aspect of the past performance evaluation is to determine how well the contractor performed on the contacts. In conducting a performance confidence assessment, each Offeror shall be assigned one of the ratings below:
Substantial Confidence Based on the offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.
Satisfactory Confidence Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.
Limited Confidence Based on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.
No Confidence Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.
Unknown Confidence (Neutral)
No recent/relevant performance record is available or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.
Performance Confidence Assessment is an evaluation of the likelihood (or Government’s confidence) that the offeror will successfully perform the solicitation’s requirements; the evaluation is based upon past performance information.
