REQUEST FOR PROPOSALS

1. Introduction This is a solicitation for an Indefinite Delivery Indefinite Quantity (IDIQ) Multiple Award Construction Contract (MACC). The purpose of the Souda Bay MACC is to execute sustainment, restoration, and modernization (SRM) projects, alteration, demolition, repair, and new construction or expansion of any type of facilities or real property assets, including waterfront or airfields facilities. Projects will be executed through firm-fixed price (FFP) Design- Bid-Build or Design-Build task orders, or even a combination of both. Work will be performed at Naval Support Activity Souda Bay, Malaxa Communication Site, Marathi Greek Navy Base, North Atlantic Treaty Organization (NATO) Hellenic Navy Ammunition Command Sites, and NATO POL Depot Marathi, Island of Crete, Greece.

2. Competitive Procedures This solicitation seeks competitive proposals utilizing full and open competition, utilizing the two-phase, design-build selection procedures discussed at FAR subpart 36.3. This single solicitation covers both phases with the intent to award approximately five MACCs.

3. NAICS Code 236220 – Commercial and Institutional Building Construction. Size Standard: $45 million.

4. Inquiries Inquiries regarding this Request for Proposal (RFP) shall be submitted electronically to the contract specialist, virginia.ryerson.civ@us.navy.mil and contracting officer myangela.h.buescher.civ@us.navy.mil utilizing the Pre-Proposal Inquiry (PPI) form (Attachment E). PPIs shall be received no later than ten (10) calendar days prior to the solicitation close date. PPIs submitted after this date may not be answered. Responses to PPIs will be answered via Amendment to this solicitation which will be posted in the Procurement Integrated Enterprise Environment (PIEE) https://piee.eb.mil/ which will update the solicitation notice in the Contract Opportunities module located at System for Award Management (SAM) https://sam.gov/.

The name of offerors submitting questions will not be identified in the amendment, and questions may be redacted if the name of the offeror’s firm, or other identifying information, is embedded in the text of the PPI.

5. Incurred Expenses The Government is not responsible for any costs incurred or associated with the preparation and submission of a proposal in response to this solicitation.

6. Historical Data

A list of all task orders issued under the previous MACC prior to the posting of this RFP is provided in Attachment G.

7. Definitions

7.1 ALTERATION: The work required for interior or exterior rearrangement of an existing real property facility, or part thereof, to improve the use of the facility for its current purpose.

7.2 BUILDING SYSTEMS: Critical systems of the facility such as Mechanical, Electrical, Plumbing, Heating Ventilating and Air Conditioning, Fire Suppression, Communications, etc.

7.3 CONCURRENT TASK ORDERS: Projects with multiple starting and ending points, performed under separate task orders, and/or contracts where the period of performance occurred simultaneously for a substantial (two months or more) period of time.

7.4 DEFICIENCY: A material failure of a proposal to meet a Government requirement or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level.

7.5 DEMOLITION: Dismantling, disposal, and removal of a real property facility (partially or completely) and securing of utilities.

7.6 DESIGN-BID-BUILD: Refers to the traditional delivery method where design and construction are sequential and contracted for separately with two contracts and two contractors.

7.7 DESIGN-BUILD: Refers to combining design and construction in a single contract with one contractor. Design-build projects require design of the project by a licensed professional (i.e.

engineer, architect). Projects that only require shop drawing level effort are not design-build projects.

7.8 DESIGN DISCIPLINES: Includes: Architecture, Architectural Programming, Civil Engineering, Commissioning Authority, Cost Estimating, Electrical Engineering, Fire Protection Engineering, HVAC and Refrigeration Engineering, Information Technologies Engineering, Interior Design, Landscape Architecture, Lighting Design, Planning, Plumbing Engineering, and Structural Engineering.

7.9 LEAD DESIGN FIRM: Applies to any outside Lead Design Firm and any in-house Lead Designer(s).

7.10 MODERNIZATION: Includes alteration or replacement of non-degraded facility components solely to implement new or higher standards, to accommodate new functions, or to replace building functions that typically last more than 50 years.

7.11 NEW CONSTRUCTION: Construction of new facilities or expansion of existing facilities.

7.12 OFFEROR: Refers to the contractor submitting the proposal as offeror, including joint ventures, whose name appears in Block 14 of Standard Form 1442 (Solicitation, Offer and Award).

7.13 PROJECT: A design-build or a fully designed construction activity or task, with a single starting point and a single ending point.

7.14 RESTORATION: Includes repair and replacement work to restore facilities damaged as a result of inadequate sustainment, excessive age, natural disaster or other causes to such a condition that it may be used for its designated purpose.

7.15 SELF-PERFORM: Refers to performing work in-house without subcontractors.

7.16 SIGNIFICANT STRENGTH: An aspect of an Offeror’s proposal with appreciable merit or will exceed specified performance or capability requirements to the considerable advantage of the Government during contract performance.

7.17 SIGNIFICANT WEAKNESS: A flaw that appreciably increases the risk of unsuccessful contract performance.

7.18 STRENGTH: An aspect of an offeror's proposal with merit or will exceed specified performance or capability requirements to the advantage of the Government during contract performance.

7.19 TOTAL VALUE: The final value of the award, including the initial award price and any and all modifications that increased or decreased the price.

7.20 UNCERTAINTY: Any aspect of a non-cost/price factor proposal for which the intent of the offer is unclear (e.g., more than one way to interpret the offer or inconsistencies in the proposal indicating that there may have been an error, omission, or mistake).

7.21 WEAKNESS: A flaw in the proposal that increases the risk of unsuccessful contract performance.

7.22 100% COMPLETE:

7.22.1 For construction projects: The facility is completely constructed and ready for the intended use.

7.22.2 For design projects: 100% plans and specifications signed off by an Architect- Engineer and ready for construction with final cost estimate. Does not include any Post Construction Award Support (PCAS).

INSTRUCTIONS TO PROPOSERS

1. Proposal Due Date:

Proposals are due at the date and time specified in Block 13 A, on page #1 of the Standard Form 1442. If the due date is extended, it will be extended by Amendment.

2. Transmittal of Proposals:

2.1 Electronic copies of each volume shall be submitted through the Solicitation Module of the Procurement Integrated Enterprise Environment (PIEE) suite at https://piee.eb.mil/. Proposals submitted by mail or hand-carried will not be evaluated. Proposals sent through proprietary or third party File Transfer Protocol (FTP) sites or DoD SAFE will not be retrieved. It is the responsibility of the Offeror to confirm receipt of proposals. All proposals received after the exact time specified for receipt shall be treated as late submissions and will not be considered except under facts and circumstances allowed by the Federal Acquisition Regulation (FAR). For instructions on how to post an offer, please refer to the Posting Offer demo:

https://pieetraining.eb.mil/wbt/sol/Posting_Offer.pdf. Offerors must be registered with PIEE as a Proposal Manager in order to submit a proposal. Offerors are highly encouraged to complete the registration process in PIEE immediately if the Offeror does not currently have access.

2.2 It is the Offeror’s responsibility to obtain written confirmation of receipt of all electronic files of the full proposal by the Contracting office. In the event that the Solicitation Module is down, the alternate method for proposal submission is via email to: virginia.ryerson.civ@us.navy.mil and myangela.h.buescher.civ@us.navy.mil ONLY. Offerors are responsible for ensuring electronic copies are virus-free and shall run an anti-virus scan before submission.

2.3 Electronic copies of each volume shall be compatible with the following software products:

Adobe Acrobat Reader 2017 and Microsoft Office Suite 2016. Narrative portions of the proposal shall be in Adobe Acrobat portable document file (pdf) searchable text format. The Offeror shall not embed sound or video (e.g., MPEG) files into the proposal files.

2.4 Electronic files shall be clearly identified for each volume, section, and item.

3. System for Award Management:

Offerors, including joint ventures, must be registered in the System for Award Management and have an active registration at the time of proposal submission. Any offeror whose registration is not active in SAM at the time of proposal submission (either Phase One or Phase Two) will be excluded from the process and their proposal will not be evaluated.

4. Format of Proposals, Phase One:

4.1 Volume 1: Non-Price Proposal

4.1.1 Cover Letter. The cover letter shall be submitted in 12pt font and include—

4.1.1.1 The solicitation number;

4.1.1.2 The name, address, telephone and facsimile numbers, and e-mail addresses of the

Offeror;

4.1.1.3 The Unique Entity ID and CAGE Code of the Offeror;

4.1.1.4 A statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation.

4.1.1.5 Names, titles, and phone and email addresses of persons authorized to negotiate on the Offeror’s behalf with the Government in connection with this solicitation;

4.1.1.6 Name, title, and signature of person authorized to sign the proposal. Proposals signed by an agent shall be accompanied by evidence of that agent’s authority;

4.1.1.7 Identification of any potential organizational conflicts of interest; and

4.1.1.8 DFARS Clause 252.229-7001 Tax Relief does not have a corresponding provision. Therefore Offerors must state the Name of the Tax and Rate (percentage) that have been excluded from the contract price. This clause will be filled in by the Government upon award.

4.1.2 Signed SF 1442 with blocks 14 though 20c completed;

4.1.3 A 12 pt font single file in PDF format including the organization chart, narrative describing the organization chart (two (2) page limitation), letters of commitment, and Joint Venture agreement (if applicable) for Factor 1- Technical Approach (letters of commitment and Joint Venture agreement are not included in page limitation);

4.1.4 A single file in PDF format containing a maximum of five (5) completed Attachments A for construction and a maximum of five (5) completed Attachments A for design that are required for Factor 2, Experience;

4.1.5 A single file containing the CPARS Assessment reports and/or the Attachment B Past Performance Questionnaires (PPQs) and the narrative addressing project complexities and/or adverse past performance.

5. Phase One Proposal Submission Requirements and Evaluation Factors:

5.1 FACTOR 1 – TECHNICAL APPROACH: FAR Part 9.6 defines Contractor team arrangements. Contractor team arrangement, as used in this subpart, means an arrangement in which -- (1) Two or more companies form a partnership or joint venture to act as a potential prime Contractor; or (2) A potential prime Contractor agrees with one or more other companies to have them act as its subcontractors under a specified Government contract or acquisition program.

If an Offeror is utilizing experience information of affiliates / subsidiaries / parent / LLC/ LTD member companies (name is not exactly as stated on the SF1442), the proposal shall clearly demonstrate how the affiliates / subsidiaries / parent / LLC/ LTD member companies will have involvement in the performance of the contract in order for the experience information of the affiliates / subsidiaries / parent / LLC/ LTD member companies to be considered. The proposal shall state specific commitments of technical resources (e.g., personnel, management, equipment that the affiliates / subsidiaries / parent / LLC/ LTD member companies shall commit to the performance of this contract). In particular, the proposal shall clearly state the specific commitments of resources of the affiliates / subsidiaries / parent / LLC/ LTD member companies in terms of the work it will either self-perform or manage on behalf of the Offeror in the performance of the contract

Vague commitments to support are likely insufficient; rather, they must demonstrate intent/manner of actual performance on the contract action being solicited.

5.1.1 Solicitation Submittal Requirements:

5.1.1.1 Submit a simple organizational chart that clearly identifies the lines of authority between the proposed primary construction firms and primary design firms for this contract. Include a brief description of the role and responsibility of each entity not to exceed (1) one single-sided page. If the experience of an entity is being claimed in Factor 2, that entity must be named in the organizational chart.

5.1.1.2 Submit a signed copy of a joint venture agreement, partnership agreement, teaming agreement, approved mentor protégé agreement (MPA), or letter of commitment signed by each member of the Offeror’s team identified above (e.g., joint venture member, partner, team member, subcontractor, parent company, subsidiary, or other affiliated company, etc.). Letters of commitment for the Designer of Record shall be addressed from the Designer of Record to the Offeror. The Designer of Record’s letter of commitment shall be signed by the Designer of Record’s signing authority. The Government will not consider any project submitted if it was performed by a firm other than the Offeror and there is no supporting partnership agreement, teaming agreement, or letter of commitment demonstrating the necessary level of meaningful involvement.

Note: See specific restrictions on the use of subcontractor experience under Factor 2.

5.1.2 Basis of Evaluation: The Government will evaluate the information provided to assess the Offeror’s proposed technical approach, including the Offeror’s organizational structure and roles and responsibilities proposed by the Offeror. The composition and management of the firms proposed as the design-build (DB) team for this contract will be evaluated in this factor. This factor will be rated on an Acceptable or Unacceptable basis.

5.2 FACTOR 2 - EXPERIENCE: Solicitation Submittal Requirements:

5.2.1 CONSTRUCTION EXPERIENCE: Submit a minimum of three (3) and a maximum of five (5) relevant construction projects for the Offeror that best demonstrates your experience on projects that are similar in size, scope, and complexity to the requirements under this RFP. For purposes of evaluation, a relevant project is further defined as:

5.2.1.1 Individual projects (Task Orders or Definitive Contracts) with a total value of $500,000 or greater. (If a project was awarded in a currency other than US dollars, the offeror must convert the non-US dollar currency into US dollars using the appropriate exchange rate as of the day the contract for the submitted project was awarded).

5.2.1.2 Projects may be design-build or design-bid-build; however, a minimum of two (2) projects must have been for new construction, restoration, or modernization of commercial and institutional buildings involving three or more building systems.

The remaining projects may include new construction, restoration, modernization, alteration or demolition of other than commercial and institutional buildings.

5.2.2 Projects submitted for the Offeror shall have been completed within the past five (5) years of the date of issuance of this RFP.

5.2.3 A project is defined as a construction project performed under a single task order or contract. For multiple award and indefinite delivery/indefinite quantity type contracts, the contract as a whole should not be submitted as a project; rather Offerors should submit the work performed under a task order as a project.

5.2.4 The attached Construction & Design Experience Project Data Sheet (Attachment A) is

MANDATORY and SHALL be used to submit project information. If the same project is being used to demonstrate construction and design experience, submit separate Project Data Sheets for construction and design. Except as specifically requested, the Government will not consider information submitted in addition to this form. Individual blocks on this form may be expanded; however, total length for each project data sheet shall not exceed two (2) single-sided pages.

5.2.5 For all submitted projects, the description of the project shall clearly describe the scope of work performed and the relevancy to the project requirements of this RFP (i.e., unique features, area, construction methods). In addition, the description should also address any sustainable features for the project, including specific descriptions of those features. Provide applicable documentation on projects that were validated and/or certified through a Sustainable Third Party Certification program.

5.2.6 If the Offeror is a Joint Venture (JV), relevant project experience should be submitted for projects completed by the Joint Venture entity. If the Joint Venture does not have shared experience, projects may be submitted for the Joint Venture members. If a project was performed by a JV, and not all partners from that JV are on the JV proposed for this contract, the offeror shall clearly demonstrate what portion of the work was performed by the JV member offering on this contract and shall not include work performed by the JV as a whole. The JV member proposed for this contract shall specifically address field work performed by that JV member including field staffing and direct field work oversight. The JV member proposed for this contract shall also address home office management performed by that JV member including the number/percentage of employees provided for the overall contract by the JV members as well as the overall percentage of work performed by the JV member. The Offeror shall also submit a SIGNED copy of the Joint Venture agreement indicating the proposed participation of each Joint Venture member. Offerors are still limited to a total of five (5) projects combined.

5.2.7 If an Offeror is utilizing experience information of affiliates / subsidiaries / parent /

LLC/ LTD member companies (name is not exactly as stated on the SF1442), the proposal shall clearly demonstrate that the affiliate/subsidiary/parent firm will have meaningful involvement in the performance of the contract. The proposal shall state specific commitments of technical resources (e.g. personnel, equipment) that the affiliates / subsidiaries / parent / LLC/ LTD member companies commit to the performance of this contract. In particular, the proposal will clearly state the specific commitments of resources of the affiliates / subsidiaries / parent / LLC/ LTD member that will be located at the worksites and company offices in the city/area of the project.

The proposal shall also describe specific roles of affiliates / subsidiaries / parent / LLC/ LTD member companies in terms of the work it will either self-perform or manage on behalf of the Offeror in performance of the contract. The Offeror MAY NOT utilize experience of a subcontractor to demonstrate construction experience under this evaluation factor.

5.2.8 DESIGN EXPERIENCE: Submit a minimum of three (3) and a maximum of five (5) relevant design projects for the design team that best demonstrates design experience on projects that are similar in size, scope, and complexity to the RFP. The Government will only review five (5) projects for design. Any projects submitted in excess of five

(5) for Design Experience will not be considered.

5.2.9 For purposes of evaluation, a relevant project is further defined as:

5.2.9.1 Individual projects (Task Orders or Definitive Contracts) that were for the design with an initial construction value of $500,000 or greater. (If the construction project was awarded in a currency other than US dollars, the offeror must convert the non-US dollar currency into US dollars using the appropriate exchange rate as of the day the contract for the submitted project was awarded).

5.2.9.2 Projects that involved five (5) or more design disciplines.

5.2.10 A project submitted under design experience will meet the recency requirement if (a) the construction effort was completed within five (5) years immediately preceding the RFP issue date, regardless of the design completion date, OR (b) the construction effort is ongoing, but the design completion date was reached within the seven (7) years immediately preceding the RFP issue date. Each relevant completion date shall be clearly stated on the Construction & Design Experience Project Data Sheet.

5.2.11 A project is defined as a complete design effort performed under a single task order or contract/subcontract. For multiple award and indefinite delivery/indefinite quantity type contracts, the contract as a whole shall not be submitted as a project; rather Offerors shall submit the work performed under a task order as a project.

5.2.12 The attached Construction & Design Experience Project Data Sheet (Attachment A) is MANDATORY and SHALL be used to submit project information. If the same project is being used to demonstrate construction and design experience, submit separate Project Data Sheets for construction and design. Except as specifically requested, the Government will not consider information submitted in addition to this form. Individual blocks on this form may be expanded; however, total length for each project data sheet shall not exceed two (2) single-sided pages.

5.2.13 For all submitted projects, the description of the project shall clearly describe the scope of work performed and the relevancy to the project requirements of this RFP (i.e., unique features, area, construction methods). In addition, the description should also address any sustainable features for the project, including specific descriptions of those features. Provide applicable documentation on projects that were validated and/or certified through a Sustainable Third Party Certification program.

5.2.14 The proposal shall state specific commitments of technical resources (e.g. personnel, equipment) that the affiliates / subsidiaries / parent / LLC/ LTD member companies commit to the performance of this contract. In particular, the proposal will clearly state the specific commitments of resources of the affiliates / subsidiaries / parent / LLC/ LTD member that will be located at the worksites and company offices in the city/area of the project. The proposal shall also describe specific roles of the affiliates / subsidiaries / parent / LLC/ LTD member companies in terms of the work it will either self-perform or manage on behalf of the Offeror in performance of the contract. Failure to submit this information may result in a lower rating.

5.2.15 The Offeror may utilize experience of a design subcontractor to demonstrate design experience. The Offeror must provide a supporting joint venture agreement, partnership agreement, teaming agreement, or letter of commitment and an explanation of the involvement for the design subcontractor. Offerors proposing multiple design firms should submit relevant project experience for all design firms. Failure to do so may result in a lower rating. Offerors are still limited to a total of five (5) projects combined.

5.2.16 Basis of Evaluation: The Government will evaluate the information provided to assess the Offeror’s demonstrated experience and depth of experience in performing relevant construction and design projects as defined in the solicitation submittal requirements. The assessment of the Offeror’s relevant experience will be used as a means of evaluating the capability of the Offeror to successfully meet the requirements of the RFP. The Government will only review five (5) projects for construction and five

(5) for design. Any projects submitted in excess of the five (5) for Construction Experience and five (5) for Design Experience will not be considered.

5.2.16.1 Proposals demonstrating projects where the Offeror and the proposed lead design firm(s) have previously worked together may be considered more favorably than those that have not worked together.

5.2.16.2 Proposals demonstrating more design-build construction experience may be considered more favorably than design-bid-build construction experience.

5.2.16.3 Proposals demonstrating project experience performed by the JV entity may be considered more favorably than experience performed by the individual JV partners.

5.2.16.4 Construction projects completed by the Offeror as the prime contractor may be more favorably considered than construction projects completed by the Offeror as a subcontractor.

5.2.16.5 Construction projects with a greater percentage of work self-performed by the

Offeror may be more favorably considered than projects with a lower percentage of self-performed work.

5.2.16.6 Proposal demonstrating a wide range of construction building disciplines and / or design disciplines may be considered more favorably.

5.3 FACTOR 3 – PAST PERFORMANCE:

5.3.1 Solicitation Submittal Requirements: If a completed Contractor Performance Assessment Reporting System (CPARS) evaluation is available, it shall be submitted with the proposal for each project included in Factor 2 - Experience. If there is not a completed CPARS evaluation, or if the evaluation was performed on the basic contract (vice the specific task order) then submit Past Performance Questionnaires (PPQ) (Attachment B) for each project included in Factor 2 - Experience. Offerors may utilize PPQs previously submitted for other RFPs, provided that the PPQ form is substantially the same as Attachment B. The Offeror should provide completed PPQ(s) in the proposal. If the Offeror is unable to obtain a completed PPQ from a client for a project(s) before the proposal closing date, the Offeror shall complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the respective project(s). The Government may make reasonable attempts to contact the client noted for that project(s) to obtain the PPQ information.

However, Offerors should follow-up with clients/references to help ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government’s point of contact, virginia.ryerson.civ@us.navy.mil.

5.3.2 Offerors may provide any information on problems encountered and the corrective actions taken on projects submitted under Factor 2 – Experience. Offerors may also address any adverse past performance issues for other projects. Explanations shall not exceed four (4) pages total.

5.3.3 The Government reserves the right to contact references for verification or additional information and utilize other readily available sources for relevant past performance information of the Offeror. The Government’s inability to contact any of the Offeror’s references or the references’ unwillingness to provide the information requested may affect the Government’s evaluation of this factor.

5.3.4 Basis of Evaluation: The Government will assess how well the Offeror’s team performed on relevant projects submitted under Factor 2 – Experience and may also consider past performance on other projects currently documented in known sources.

5.3.4.1 The Government will consider the recency and relevance of the information (as defined in Factor 2 - Experience), the source of the information, context of the data, and general trends in the Contractor’s performance. This evaluation is separate and distinct from the Contracting Officer’s responsibility determination.

The assessment of the Offeror’s team’s past performance will be used as a means of evaluating the Offeror’s team’s probability to successfully meet the requirements of the RFP.

5.3.4.2 Offerors lacking relevant past performance history will receive a NEUTRAL

Confidence rating.

5.4 Relative Importance of Factors for Phase One: Factor 1 - Technical Approach will be evaluated on an Acceptable or Unacceptable basis. Any firm found Unacceptable for Technical Approach will not be considered further. Offerors that are considered Acceptable for Technical Approach will then be evaluated for Factor 2 – Experience and Factor 3 – Past Performance. For determining which Offerors will be invited to submit proposals for Phase Two, Factor 2 - Experience and Factor 3 - Past Performance are equal in importance to one another.

6. Selection of Offerors for Phase Two:

6.1 The Government does not intend to enter into discussions during evaluation of Phase One proposals, but reserves the right to do so if determined necessary. Any proposal found to have a deficiency in meeting the stated solicitation requirements or performance objectives will be considered ineligible for award, unless the deficiency is corrected through discussions. An Unacceptable rating in any of the non-price factors will result in the proposal being ineligible for award. Proposals may be found to have either a significant weakness or multiple weaknesses that impact either the individual factor rating or the overall rating for the proposal.

6.2 Phase One evaluation will result in a determination of the most highly qualified Offerors. No competitive range will be established for selection of offerors to advance to Phase Two. The actual number of firms selected to submit Phase Two proposals may be more or less than five (5), considering the number of most highly qualified proposal received and the number of proposals at which an efficient competition can be conducted. Offerors are advised that those Offerors who are selected to proceed to Phase Two are not guaranteed receipt of a contract award.

7. Format of Proposals, Phase Two:

7.1 VOLUME 1: NON-PRICE PROPOSAL

7.1.1 Cover Letter. The cover letter shall be in 12pt font and include—

7.1.1.1 The solicitation number;

7.1.1.2 The name, address, telephone and facsimile numbers, and e-mail addresses of the

Offeror;

7.1.1.3 The Unique Entity ID and CAGE Code of the Offeror;

7.1.1.4 A statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation at the price proposed;

7.1.1.5 Names, titles, and phone and email addresses of persons authorized to negotiate on the Offeror’s behalf with the Government in connection with this solicitation;

7.1.1.6 Name, title, and signature of person authorized to sign the proposal. Proposals signed by an agent shall be accompanied by evidence of that agent’s authority;

7.1.1.7 Identification of any potential organizational conflicts of interest.

7.1.2 Signed SF 1442 with blocks 14 though 20c completed.

7.1.3 A single file in PDF format containing Attachment C – Safety Data Sheet for Factor 4

– Safety.

7.1.4 A single file in PDF format containing the Offeror’s technical approach narrative, CPM Schedule, and schedule narrative for Factor 5 – Technical Solution.

7.2 VOLUME 2: PRICE PROPOSAL

7.2.1 A single file in PDF, and the native excel version of the completed Attachment D for

Price;

7.2.2 Provide Financial Statements for the previous three years, and if applicable, letters from lending institutions attesting to the line of credit;

7.2.3 Provide any missing or outdated Representations and Certifications;

7.2.4 Provide a completed version(s) of Attachment F, Offeror Certification that it Meets

Classification Requirements; and

7.2.5 Provide a letter (or letters) from the firm’s financial institution(s) or surety stating the firm’s maximum annual capacity and overall capacity to obtain performance guarantees.

8. Phase Two Proposal Submission Requirements and Evaluation Factors:

8.1 FACTOR 4 - SAFETY

8.1.1 Solicitation Submittal Requirements:

8.1.1.1 The Offeror shall submit the following information utilizing Attachment C - Safety Data Sheet: The Days Away from Work, Restricted Duty, or Job Transfer (DART) Rate; and Total Case Rate (TCR) for the specified five (5) Calendar Years (CY), as well as a safety narrative, as described further below. For a partnership or joint venture, the Offeror shall submit separate DART rates and TCR for the specified five (5) CY for each contractor who is part of the partnership/joint venture; however, only one safety narrative is required. Any fatalities experienced within this 5-year timeframe must be explained in detail, to include root cause and corrective actions. There is no page limit for the DART or TCR information.

8.1.1.1.1 NOTE: DART and TCR shall not be submitted for subcontractors.

8.1.1.1.2 DART Rate: Submit five (5) previous complete calendar years’ [CY2018, CY2019, CY2020, CY2021, and CY2022] worth of data (not an overall average). If the Offeror has no DART rate, for any year, affirmatively state so and explain why. Should a negative trend occur above moderate risk levels, an acceptable/detailed explanation is required that includes any corrective actions taken for improvement.

8.1.1.1.3 DART cases include injuries or illnesses resulting in death, days away from work, and/or restricted work or transfer to another job days beyond the day of injury/illness.

8.1.1.1.4 Calculation of DART rate: Multiply the total number of DART cases by 200,000, and then divide by the number of employee labor hours worked.

8.1.2.1 TCR cases include injuries or illnesses resulting in death, days away from work, restricted work or transfer to another job days beyond the day of injury/illness, medical treatment beyond first aid, or loss of consciousness.

8.1.2.2 Calculation of TCR rate: Multiply the total number of TCR incidents by

200,000, and then divide by the number of employee labor hours worked.

8.1.3 Technical Approach to Safety: Submit a narrative that addresses the following:

8.1.3.1 Describe the Offeror’ s approach to implementing and executing a Safety

Management System (SMS) including Management / Leadership involvement, Employee involvement, Hazard prevention, Hazard control, Worksite analysis, and Safety and health training, to include the standard(s) used to benchmark the

SMS.

8.1.3.1 Describe the evaluation process used to select potential subcontractors.

8.1.3.2 Describe the processes of how the Offeror will oversee safety compliance of subcontractors at all levels throughout performance of the contract (to include the Offeror’s own in-house workforce).

8.1.3.3 The Technical Approach to Safety narrative shall be limited to three (3) pages overall, Times New Roman size 11 font.

8.1.3.4 The Government reserves the right to review other available sources

(public/Government internal) of information. These may include but are not limited to OSHA data, NAVFAC’s Contractor Incident Reporting System (CIRS), Contractor Performance Assessment Reporting System (CPARS), Electronic Contract Management System (eCMS), etc.

8.1.4 Basis of Evaluation: The Government is seeking to determine that the Offeror has consistently demonstrated a commitment to safety and that the Offeror plans to properly manage and implement safety procedures for itself and its subcontractors. The evaluation will collectively consider the DART rate, TCR, Technical Approach to Safety, and other sources of information available to the Government as part of such collective evaluation. The board will evaluate the DART rates and TCR to determine if the Offeror has demonstrated a history of safe work practices taking into account any negative trends and extenuating circumstances that impact the rating.

8.1.4.1 DART Rate: The board will evaluate trends over the last five years considering changes that take it from one risk level (or more) to the next up or down.

Negative trends occurring above moderate risk levels require the offeror to provide a detailed explanation that includes any corrective actions taken for improvement.

8.1.4.1.1 Missing data without an explanation may be considered a deficiency.

8.1.4.1.2 Declining trends that push the risk levels from Moderate Risk (MR) or higher to Low Risk (LR) or Very Low Risk (VLR) would indicate a strength.

8.1.4.1.3 An increasing DART rate trend could be considered a weakness (i.e. MR or better to High Risk (HR) or Extremely High Risk EHR)) if an acceptable explanation is not provided for any trends that rise above Moderate.

8.1.4.1.4 This chart correlates the DART rate to the level of risk:

8.1.4.3 The Technical Approach to Safety Narrative. To determine the degree to which the Offeror:

8.1.4.3.1 Describes a viable SMS that addresses elements; such as Management / Leadership involvement, Employee involvement, Hazard prevention, Hazard control, Worksite analysis, and Safety and health training, to include the standard(s) used to benchmark the SMS.

8.1.4.3.2 Describes a methodical process of evaluating subcontractor’s safety performance in their selection process.

8.1.4.3.3 Describes a logical management plan to hold themselves and their subcontractors accountable for adhering to the safety requirements of the contract.

8.1.4.3.4 The Technical Approach to Safety narrative shall be limited to three (3) pages overall. Information on pages beyond this will not be considered.

8.1.4.3.5 The Government reserves the right to review other available sources (public/Government internal) of information. These may include but are not limited to OSHA data, NAVFAC’s Contractor Incident Reporting System (CIRS), Contractor Performance Assessment Reporting System (CPARS), Electronic Contract Management System (eCMS), etc.

8.2 FACTOR 5 – TECHNICAL SOLUTION:

8.2.1 Solicitation Submittal Requirements:

8.2.1.1 Technical Approach: The Offeror shall submit a technical proposal for the seed task. The technical proposal shall provide a narrative that demonstrates an understanding of the scope and presents the proposed approach to accomplish the requirements of the seed task; including relevant subcontractors; proposed means and methods; identification of and plans to mitigate potential problem areas and logistical issues. Include a project organizational chart that lists Key Personnel (Program Manager, Project Manager, Site Manager, Site Safety, Design QCM, Construction QCM, Project Engineer(s), and the Designer of Record) and a summary of the qualifications and experience of core personnel and subcontractors. The Offeror’s technical approach shall be limited to a maximum of 20 pages.

8.2.1.2 Schedule: The Offeror shall provide a Critical Path Method (CPM) Schedule and a schedule narrative. The schedule shall identify: the award date, submission of bonds, Post Award Kickoff meeting (PAK), and Pre-Construction Meeting, submittals, government review periods, material and equipment delivery, utility outages, all onsite construction broken out by definable features of work, inspection, testing, weather days and other anticipated non-work days, and closeout activities. The narrative shall explain the logic and sequence of events necessary for the successful execution of the project. Submit the schedule on one or more 11x17 sheets, the schedule narrative shall be limited to one 8 ½ x 11 page.

8.2.2 Basis of Evaluation: The Offeror will be evaluated on the level of understanding of the requirements of the seed task; the technical merit of the proposed means and methods; the identification of potential problem areas and logistical issues, and the technical merit of any such mitigation plans. The Offeror will also be evaluated on the experience of the key personnel and subcontractors. The schedule, including the narrative, will be evaluated to determine whether the sequence of the schedule is logical, whether the required activities are provided; whether the duration of the activities are realistic given the Offeror’s proposed means and methods and resources to be utilized in accomplishing the work. Schedules that demonstrate completion before the task order period of performance completion date, while adhering to all requirements delineated in the RFP, may be rated higher. If an Offeror proposes a shorter period of performance, the completion date for the seed task order will be based on the duration submitted in the Offeror’s schedule.

8.3 Price: The Contracting Officer has determined that certified cost or pricing data is not required to be submitted for this solicitation because the “adequate price competition” exception applies (FAR 15.403-1(b)(1)). However, Offerors are required to submit other than certified cost or pricing data per the submittal requirements, below. Offerors are not required to submit a completed Section 00010 (Similar to Section B in the Uniform Contract Format). Section 00010 represents that total ordering capacity of the contract (shared capacity), not the Offeror’s pricing. Offerors consent to having the maximum labor rates and maximum indirect rates included in the contract award.

8.3.1 Solicitation Submittal Requirements: Schedule of Firm Fixed Price Rates: The Offeror will be required to complete the Schedule of Firm Fixed Price Rates included in Attachment D - Pricing. The Schedule of Firm Fixed Price Rates includes only key labor categories for the prime contractor, and is not intended to be all inclusive of the labor positions (home or field) that are needed to execute work under this contract. The Schedule of Firm Fixed Price Rates allows for annual escalation of labor rates at the time options are exercised. Instructions for completing attachment D are contained in the attachment itself.

8.3.2 Seed Project Pricing: Offerors shall submit the pricing for the seed task order by entering the total seed task order price (lump sum) in the space provided in attachment D - Pricing.
