About this file

This document is an amendment to the solicitation for an Indefinite Delivery Indefinite Quantity Job Order Contract for maintenance, repair, and minor construction services at the Naval Air Station Sigonella in Sicily, Italy. The Navy seeks these services through a single-award IDIQ contract with a one-year base period and four one-year options. The amendment provides responses to questions from potential offerors to clarify requirements, including how to calculate proposed pricing that accounts for overhead and profit using pre-priced items from the Gazzetta Ufficiale Sicilia. It also confirms page limits for the management approach and safety factors in proposals.

AMENDMENT 3.

Response to Questions Submitted (37-#40)

QUESTION 37: Since the Consortium and the Joint Venture (JV) are two types of agreement between different companies, we want to know if, for the purpose of producing the tender documentation, the JV and the Consortium are equated only and exclusively for what is established in point 1.2 b. (3) of the call: “If the potential offeror is a joint venture or a consortium, the offeror shall demonstrate how each member or partner meets the SOA certification requirements stated in paragraph (a) above. Include a description of the responsibilities in terms of work category for each member or partner (for example - Firm A performing 70% of OG-1 and Firm B performing 30% of OG-1) ". All other requests referring directly to the JV must not be considered also referring to the Consortium. Could you confirm this?

ANSWER 37: Correct, the JV and the Consortium are equated only and exclusively for what is established in point

1.2 b. (3).

QUESTION 38: Reference is made to Page 13 1.12 Provisions and also to question and answer No. 34.

Is the demonstration of an active SAM Registration and a complete and updated FAR& DFARS report and by applying to paragraph (d) of page 26 Section 00600 52.204-8 sufficient to comply to the provisions set by this solicitation? Or should the Contractor complete and enclose in the proposal package Complete Section 0600 page 26 through 70.

ANSWER 38: Contractors may submit complete/signed Standard Form 1442 to include all the required provisions.

Per Instructions for the submission of offerors, the contractor shall submit all completed provisions noted on this solicitation, such as:

52.204-8 ANNUAL REPRESENTATIONS AND CERTIFICATIONS

52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO

SURVEILLANCE SERVICES OR EQUIPMENT

52.209-11 REPRESENTATION BY CORPORATIONS REGARDING DELINQUENT TAX LIABILITY OR A

FELONY CONVICTION UNDER ANY FEDERAL LAW

252.204-7016 COVERED DEFENSE TELECOMMUNICATIONS EQUIPMENT OR SERVICES --

REPRESENTATION

252.204-7017 PROHIBITION ON THE ACQUISITON OF COVERED DEFENSE TELECOMMUNICATIONS

EQUIPMENT OR SERVICES--REPRESENTATION

52.209-5 CERTIFICATION REGARDING RESPONSIBILITY MATTERS

52.209-7 INFORMATION REGARDING RESPONSIBILITY MATTERS

252.229-7001 TAX RELIEF

252.247-7022 REPRESENTATION OF EXTENT OF TRANSPORTATION BY SEA

QUESTION 39: Reference is made to PPI Answer Nr 27.

Solicitation paragraph C.4.4 says that the Contractor’s Coefficient shall be the reflection of the Bare Costs plus the cost of doing business. See the formula below:

Contractor Price Offered = Coefficient x Bare Cost + Overhead and Profit Answer Nr. 27 contradicts paragraph C.4.4:

The Contractor, from the Price from Gazzetta Ufficiale Sicilia shall deduct the percentage of 26,5% recognized by Gazzetta Ufficiale for Contractor’s Overhead and Profit and on this Bare Cost should be applied the Discount Coefficient.

Answer of PPI Nr. 27 does not explain how to charge the Contractor’s Overhead and Profit at the Coefficient x Bare Cost calculated as above.

Example:

From Gazzetta Ufficiale: Pre-Priced Item 100,00 EUR (Direct+Site Cost+Overhead+Profit) Overhead and Profit: 26,5%=26,50 EUR Bare Cost: 100,00-26,50=73,50 EUR (Direct+Site Cost) Coefficient: 0,9 Offer: Coefficient x Bare Cost = 0,9x73,50 EUR = 66,15 EUR (NO Overhead and Profit allowed) Based on the above example as per answer Nr. 27 seems that there is no way to charge Contractor Overhead and Profit to the Bare Costs.

Even if the proposed Coefficient would be 1, the Contractor seems to be directed to offer maximum the Bare Costs without Overhead and Profit.

In addition, Gazzetta Ufficiale does not contain the typical US contract managing costs (QC, SSHO, PM, Compliance with US laws, Military Base restriction costs, Submittals, etc).

An alternate understanding to Answer to PPI Nr 27 is that the Contractor is required to calculate the Bare Cost from Gazzetta Pre- Priced Item and from this cost evaluate a Coefficient that takes into account costs of doing business as per Paragraph C.4.4.

Example:

From Gazzetta Ufficiale: Pre-Priced Item 100,00 EUR (Direct+Site Cost+Overhead+Profit) Overhead and Profit: 26,5%=26,50 EUR Bare Cost: 100,00-26,50=73,50 EUR (Direct+Site Cost) Coefficient: 1,20 Offer: Coefficient x Bare Cost = 1,20x73,50 EUR = 88,20 EUR Please clarify how to calculate the Bare Costs starting from Pre-Priced Items from Gazzetta Ufficiale.

Please clarify how the Overhead and Profit should be charged starting from the Bare Costs calculated from Gazzetta Ufficiale.

ANSWER 39: Per Solicitation C.1.2 Basic Principles of the JOC The total price is calculated by multiplying the total price proposal based on rates as identified in the Gazzetta Ufficiale and/ or DEI plus the Contractor’s applicable Coefficient factor (see C.4.2 for coefficient inclusions).

The Contractors coefficient factor shall not include any cost, overhead nor profit already included in Gazzetta Ufficiale.

QUESTION 40: 1) Reference is made to Section 00100 – Bidding Schedule/Instructions to Bidders, PART II EVALUATION FACTORS/RATING SCHEME, Page no. 22, paragraph 2.5, Factor 2 – Management Approach Please, kindly confirm that Offeror’s response to Factor 2 (Management Approach) can include a cover page and an index exceeding the 15 pages required for this factor.

2) Reference is made to Section 00100 – Bidding Schedule/Instructions to Bidders, PART II EVALUATION FACTORS/RATING SCHEME, Page no. 23, paragraph 2.5, Factor 3 – Safety Please, kindly confirm that Offeror’s response to Factor 3 (Safety) can include a cover page and an index exceeding the 2 pages required for this factor.

ANSWER 40: Offeror’s response to Factor 2 (Management Approach) and Factor 3 (Safety) cannot include a cover page and an index exceeding the page limits.

Per solicitation:

Offeror’s response shall not exceed fifteen (15) pages (8.5” x 11”; one inch margins; times new roman size 12 font) for this factor. If more than fifteen (15) pages are submitted, only the first fifteen (15) pages will be evaluated.

The Safety Narrative shall be limited to two (2) pages (8.5” x 11”; one inch margins; times new roman size 12 font). If more than two (2) pages are submitted, only the first two (2) pages will be reviewed in the evaluation.
