Response to Questions Submitted (#20-#36)
QUESTION 20: Reference is made to Section 00100 – Bidding Schedule/Instructions to Bidders, PART II EVALUATION FACTORS/RATING SCHEME, Page no. 18, paragraph 2.4, letter a) item 3 Letter from the offeror’s surety and ANSWER 5 of Amendment 1
Please, note that the United States Treasury Department Circular 570 lists only US Companies. Considering the aforesaid circumstance and the fact that also Italian companies, which hold business relationships with Italian financial institutions, are participating in this solicitation, we kindly ask you to confirm that a letter issued by one of the following reputable Italian banks is acceptable as letter required under paragraph 2.4, letter a) item 3 of this Solicitation:
- UNICREDIT, or
- Cassa di Risparmio di Bolzano (Sparkasse), or
- Intesa Sanpaolo.
ANSWER 20: Yes. A letter from a financial institution licensed by Banca d’Italia or Istituto per la Vigilanza sulle Assicurazioni (IVASS) is acceptable.
QUESTION 21: Concerning the Amendment 0001, answer 9, please confirm that if we do not own one or more SOA categories, we could attach the SOA certificate of a subcontractor given that in the RFP page 7, point b. (1) –
1.2 SOCIETA’ ORGANISMI
D’ATTESTAZIONE (SOA) CERTIFICATION: refers to the chance to use subcontractors to meet the qualification standard.
ANSWER 21: Amendment language will reflect the following revision: The offeror may use a subcontractor's unexpired SOA Certificate, but only with the submission of a proper avvalimento establishing that the offeror will have full access to and disposal of the subcontractor’s resources, and that the subcontractor is responsible. A subcontractor's SOA Certificate is acceptable only if the work covered by that category is all performed by the same subcontractor that furnished the SOA.
QUESTION 22: Reference is made to Factor 2 - Management Approach:
Please confirm that eventual subcontractors' letters of commitment are not part of the page count.
ANSWER 22: No. Subcontractors' letters of commitment are not part of the page count.
QUESTION 23: Reference is made to NON PRICE-PROPOSAL – Factor 01 Experience.
In order to provide the Government with the requested information and solicitation requirements, in terms of relevancy, detailed project information, description and to reflect and fulfill the evaluation criteria in a 2 (two) page limit we kindly request that the total length of each project data sheet be of maximum 3 pages.
ANSWER 23: Concurrence provided. The total length of each project data sheet shall be a maximum of 3 pages.
QUESTION 24: Section 00100 - Bidding Schedule/Instructions to Bidders, Paragraph 1.10
With reference to clause 1.10 Performance Guarantee whereas “The Contractor shall provide a notarized Performance Guarantee letter within ten (10) days after issuance of each task order greater than $ 150,000 or as required by the Contracting Officer.” We kindly ask you to confirm whether it is possible to submit the aforementioned guarantee signed by a Primary Italian Insurance Company (such as UnipolSai, Generali and Reale Mutua).
ANSWER 24: Yes. A guarantee from a financial institution licensed by Banca d’Italia or Istituto per la Vigilanza sulle Assicurazioni (IVASS) is acceptable.
QUESTION 25: Reference is made to page 18 of 112 PART II Evaluation Factors / Rating Scheme which states:
For the purposes of establishing coefficients for this contract, the offeror shall provide a proposed Coefficient for Contract Line Item Numbers (CLIN) 0001 through 0004 on the Coefficient Schedule, provided in Section 00010 – Solicitation Contract Form. Failure to offer a coefficient for CLINs 0001 through 0004 will result in the offeror being ineligible for award. CLIN 0005 will be a placeholder for the design price for task orders requiring the need for a professional engineer’s stamp. The Coefficient Schedule will always include a coefficient of 1.0 for this CLIN.
For projects that require a professional engineer’s stamp, these costs will be negotiated at the time of each task order. The coefficients will become a part of the contract upon award and will be effective for the base period and all option periods. On the Coefficient Schedule, the offeror is to multiply the proposed coefficients by their associated multiplier to arrive at an Estimated Amount for CLINs 0001 through 0004.
Since in the Coefficient Schedule Attachment#01 there is no CLIN 0005 we understood that CLIN 0005 is de facto included but not listed in the attachment#01 since the coefficient is 1.0 for all the offerors. Please confirm.
ANSWER 25: Confirmed. Offeror is not required to provide coefficient for CLIN 0005. The coefficient for CLIN 0005 will be 1.0 for all the offerors.
QUESTION 26: Reference is made to Subcontract Teaming Agreements.
Please indicate where in the proposal package the Offeror should insert eventual Subcontractor Teaming Agreements / Letters of Commitment regarding the approach to the Solicitation.
Are eventual Letters of Commitment to be included in the PRICE PROPOSAL?
Are eventual Letters of Commitment to be included in the NON - PRICE PROPOSAL?
ANSWER 26: Letters of Commitment shall be included in the NON - PRICE PROPOSAL.
QUESTION 27: With reference to paragraph C.4.2 of the Solicitation Offer and Award document.
Since in the Pre-priced Gazzetta Ufficiale Regione Sicilia book, the listed prices are already included of O&P Costs.
Since these O&P cost value is the 26.5% (as indicated in the preface of the book), please confirm that the coefficient that to be proposed will be multiplied to the pre-prices deducted of the O&P cost value (26.5%).
Example:
- Pre-Prices Items in the Gazzetta ufficiale:€ 100.00;
- Deduct O&P Cost (26.5%) to obtain Bare Cost = € 100,00 – 26.5% = € 79,05
CLIN 0001 – Pre-Priced Work – Gazzetta Ufficiale = € 79,05 x (Proposed Coefficient)
ANSWER 27: Confirmed. Overhead and Profit (O&P) rates shall not be included as part of the Gazzetta Ufficiale Bare Cost and shall not be included as part of an offeror’s proposal. The Contractor’s Proposed Coefficient includes all Overhead and Profit costs as specified in paragraph C.4.2 of the Solicitation.
QUESTION 28: Request extension of the proposal due date.
ANSWER 28: The government will extend proposal due date to 16 April 2021.
QUESTION 29: Reference is made to page 24 Factor 4 Past Performance:
Are completed and signed DD Forms 2626 PERFORMANCE EVALUATION (CONSTRUCTION) accepted for this Factor?
ANSWER 29: Per solicitation Past Performance submittal requirements, “If a completed CPAR evaluation is available, it shall be submitted with the proposal. If there is not a completed CPAR evaluation, the PPQ, Attachment 3, is provided for the offeror or its team members to submit to their client(s) for each project the offeror includes in its proposal for Factor 1 – Experience”. “Performance award or additional information submitted will not be considered”.
QUESTION 30: The Contract Line Item Numbers (CLIN) referred to the point 2.4 "Price Evaluation Factor" ("Section 00010 - Solicitation Contract Form" (pages from 3 to 6) are not comparable with those indicated in Attachment 1. Does what stated in Attachment 1 prevail?
In addition, The "Section 00010 - Solicitation Contract Form" (pages from 3 to 6 of the tender notice) cannot be completed cause, due to the nature of the contract, it is not possible to establish the net amount. In any case, should it be included in the documentation in addition to the attachment 1, valuing it with the net amount obtained in the same attachment 1. If so, in the technical or administrative one?
ANSWER 30: Per Attachment 1 Coefficient Schedule, “The value of work estimated for CLINS 0001 through 0004 is for price evaluation purposes only. The actual distribution of work may differ significantly from that shown.
Therefore, the Contractor should ensure that the coefficient properly reflects its costs for each category”.
Section 00010 - Solicitation Contract Form is not included as part of price evaluation. Per Solicitation 2.4 Price Evaluation Factor, the Government will evaluate price based on the Total Evaluated Price (TEP) of all CLINs on the Coefficient Schedule (Attachment 1). The VALUE OF WORK (ESTIMATE) for CLINS 0001 through 0004 shall not be changed on submittal of Attachment 1.
QUESTION 31: With regard to the point “The Government intends to pay invoices in accordance with the clause for Wide Area Work Flow. To do this, your firm must have a U.S. bank or a U.S. bank affiliate associated with your local bank. With your proposal, identify the name of your U.S. bank or affiliate for purposes of paying invoices "-do payments with SWIFT and MT103 satisfy this banking requirement?
ANSWER 31: Payments will be made through WAWF and it is the Offeror’s responsibility to ensure their bank is able to receive payments through WAWF.
QUESTION 32: Should the required “provisions” be included in the administrative or technical documentation?
ANSWER 32: All required Provisions shall be submitted as part of the offeror’s price proposal.
QUESTION 33: What is meant by “Covered Defense Telecommunications Equipment or Services”?
ANSWER 33: “Covered Defense Telecommunications Equipment or Services” are defined in Clause 252.204-7018
PROHIBITION ON THE ACQUISITION OF COVERED DEFENSE TELECOMMUNICATIONS EQUIPMENT
OR SERVICES (DEC 2019).
QUESTION 34: On page 80 of the documentation it is stated that “The U.S. Government and contractors performing work for the U.S. Government are exempt from paying Imposta sul Valore Aggiunto (IVA). Your prices and invoices are to exclude IVA ". Is it still necessary to fill the two fields of the provision 252.229-7001 TAX RELIEF: “NAME OF TAX: (Offeror Insert) RATE (PERCENTAGE): (Offeror Insert)” with “IVA” and “IVA percentage applicable to the works in question”?
ANSWER 34: Yes. Offeror shall complete and include 252.229-7001 TAX RELIEF with price proposal.
QUESTION 35: Section 2.4 of the “Price Evaluation Factor” (a) Solicitation Submittal Requirements: the Acknowledgment of all amendments is already present in the “standard form 1442”. Should a further declaration still be inserted?
ANSWER 35: No further declaration required. Offeror shall complete Block 19 of standard form 1442 to acknowledge Amendments.
QUESTION 36: Could you give us a precise definition of working / operating capital? Is it necessary to "submit evidence of availability of working / operating capital from an independent financial institution which will be used for the performance of the resultant contract" even if there is a cash availability of $ 3 million?
ANSWER 36: Working/Operating Capital equates the total funds available for running daily operations to perform the contract. Per solicitation 1.9 Pre-Award Survey/Responsibility Determination, offerors shall “Submit evidence of availability of working/operating capital that will be used for the performance of the contract. If the offeror plans to rely on financial support from other sources, identify the maximum lines of credit that will be available to include documentation to support the amounts. The maximum lines of credit should be based upon the inclusion of this contract effort. For joint ventures, discuss the financial responsibilities among companies and provide the same information for each partner”. There is no dollar threshold exception noted.

(5) An offeror’s proposal will be rejected for failure to provide the current SOA certificates required under this solicitation.
