About this file
This is a Questions and Answers document for solicitation N3220525Q2109 from Military Sealift Command regarding CIVMAR lodging in Guam. The Q&A addresses three main topics: clarification of option period dates (confirming 10-day periods with specific dates like March 28-April 7, 2025), location details for Naval Base Guam X-Ray Pier (provided as 3191 Sumay Drive Apra Harbor 96915 Guam), and tax exemption status (no tax exemption certificates will be provided, all fees and taxes must be included in unit price).
The document also clarifies subcontracting limitations, specifically addressing FAR 52.219-14 deviation 2021-O0008, which states that non-similarly situated subcontractors cannot receive more than 49% of the contract value for services, while work performed by similarly situated entities counts toward the prime contractor's 50% requirement. This applies to the hotel subcontracting arrangement being considered by potential offerors.

QUESTIONS AND ANSWERS-2
The following is an answers to a questions received from potential offeror. The answers provide clarification only and DO NOT constitute an amendment to the solicitation.
Question 1: Attached is the Attachment #2 of the solicitation package entitled “Price Quote,” there seems to be a problem with the dates as listed for Options 002-008. Although the total number of days (10) are correctly posted the actual dates do not equate to 10 days starting with Option 002, for example, it lists dates as 28 March 2025 thru 6 April 2025 with checkout on 7 April 2025, when actually those dates equate to 9 days and the checkout date of April 7 is the 10th day (see chart below). That continues through Options 002-008. Are the Option days intended to be 9 or 10 days? It is imperative that we are aware of the correct date and dates for accurate reservation of rooms.
Answer: The dates in the Options on Attachment 2 are correct. The Options are 10 days. 28 March 2025 thru 6 April 2025 with checkout on 7 April 2025 is ten physical nights at the hotels. There are 31 days in March and the chart you provided does not include 31 March.
Question 2: The Performance Work Statement (PWS) provides an address (NAVAL BASE GUAM, X-RAY PIER APRA HARBOR GUAM 96915) however it is difficult to locate on Google Maps, MapQuest and Bing Maps, can you please provide a better searchable address to assure the lodging facility is located within the proper mile radius?
Answer: A Google search shows the X-Ray Pier at 3191 Sumay Drive Apra Harbor 96915 Guam
Question 3: Will you provide a Tax Exemption Certificate to the awarded vendor for this project?
Answer: There will be no Tax Exemption Certificate awarded for this requirement. The RFQ states: All applicable fees, taxes, parking and charges must be included in the unit price.
1. Can you confirm our understanding of Attachment #1 entitled “Quote Cover Letter” which has a requirement that must be addressed relative to FAR 52.219-14 LIMITATIONS ON SUBCONTRACTING (DEVIATION 2021-O0008) (FEB 2023)). Upon reading the document, we interpreted it to indicate this limitation states if the prime contractor uses a subcontractor, which would probably be a hotel, the prime contractor can only pay the subcontractor 50% of the total awarded contract. For example, if a contractor proposes their lodging rate to be $100.00 daily, the subcontractor can only receive $50.00 from the prime contractor for the lodging. Is that correct?
Answer: When applying Deviation 2021-O0008; Services, it will not pay more than 50 percent of the amount paid by the Government for contract performance, excluding certain other direct costs and certain work performed outside the United States (see paragraph (e)(1)(i)), to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count towards the prime contractor’s 50 percent subcontract amount that cannot be exceeded. This will mean that a similarly situated entity, as defined by the Deviation, will count towards the prime contractor’s 50 percent. However, a non-similarly situated entity cannot receive more than 49 percent of the work.
