ROUND 3 Q&A
N32205-16-R-0001 – QUESTIONS AND ANSWERS – ROUND 3
QUESTION: Is it acceptable if the Prime Contractor has an established Quality Control System that meets the standard for ISO 9000:2000 but is not officially certified for ISO 9000:2000?
ANSWER: No. The Prime Contractor must be certified for ISO 9000:2000.
QUESTION: Would it be acceptable if a subcontractor is ISO 9000:2000 certified in lieu of the
Prime Contractor?
ANSWER: No. The Prime Contractor will be managing the work and the Government requires a certified quality control system to manage the work.
QUESTION: On Page 32 of 63, Section 5.1.1a, the Total Hours add up to 20,800 vice 20,000 as shown. Is this a typo, or are certain hours not to be priced?
ANSWER: It was a type and has been corrected in Amendment 2.
QUESTION: Would this be a single award or a multiple IDIQ contract award?
ANSWER: Single Award ID/IQ contract.
QUESTION: The contractor requests an extension of the proposal due date to 16 November in order to: Complete the PMP certification process stated above as this a changed requirement
Initiate the secret clearance process for personnel whom we estimate may be assigned to work on this contract effort. Initiate NACLC for all personnel involved in scheduling shipchecks, if required at the time of bid submittal.
Initiate Facility Clearance for our Virginia Beach office if separately required (see question 10)
ANSWER: Approved – bid submission deadline extended to 16 Nov 15 at 10 AM Norfolk, VA time (Eastern)
QUESTION: Paragraph 4.3. Drawing Conversions. The Contractor shall provide services for conversion of drawings from hard copy to electronic AutoCAD format and/or PDF format as required by the TO. Drawing conversion shall also include conversion from raster drawings to vector drawings as well as other document formats (for example PDF to Excel, PDF to Word).
Specifically, the Contractor shall have the capability to electronically convert PDF drawings to
AutoCAD or a hybrid of the two formats as required by the TO. The Contractor shall accurately produce, reproduce, or modify for production the drawings to scale. It is our understanding that, although it is possible to convert PDF's to Word files (depending on the quality of the source file), converting PDF's to Excel files is often problematic (due to cell addressing and attributes) and requires manual intervention. Additionally, there is no known software/hardware product capable of 100% "electronically converting" and producing a drawing acceptable under MSC
CAD standards without sometimes extensive manual intervention. We have explored every known source and find that the products advertised cannot differentiate line types (backgrounds, piping, callout leaders are all the same), text, random markings, etc. The only way to take an old drawing and produce an editable, vectorized, clean autocad file is by re-drawing it. Such programs as do currently exist are inordinately expensive (on the order of $20,000 per license) and still will not achieve the desired result, nor will it ever provide a conversion that is 100% accurate. Manual manipulation will always be required and may frequently far exceed the cost of drawing from a blank palette. Our usual approach is to review each document/drawing to be converted and determine the most cost-effective approach (scanning/editing/manual redraw, or a combination of methods) based on the required schedule, cost, and efficient manpower utilization. Is this approach acceptable?
ANSWER: Yes. The requirements are to convert from one format to the specified format and to eliminate any conversation issues created from the conversion software. Seamless conversion electronically is not a requirement. The intent is to convert into a specified format and that the final has no errors. Contractor can provide any method they need to convert the files as long as the converted files meet MSC standards. Converted files shall not have errors and it is upon the contractor to QA their products prior to submitting to MSC for review. The conversion file in addition can be put in the bid as an alternative to save contractor time in conversions.
QUESTION: Paragraph 5.1.2 requires “A copy of the current financial statement and annual report for the company and its parent company (if applicable), or furnish evidence of adequate financial resources to perform the contract…”. We have not previously been required to provide this information on relatively small contracts such as is anticipated. Further, our local
DCMA has routinely performed financial responsibility reviews for larger contract awards. As this contractor is a privately held company, we consider our Financial Statements proprietary. Will of listing of all current active contracts, ceilings and performance periods provide the evidence MSC requires?
ANSWER: Yes. The intent is that the Contractor has the ability to perform the work on the contract.
QUESTION: Paragraph 5.4 The Contractor shall be responsible for pick-up and delivery of documentation and technical references at MSC N7 offices at Camp Pendleton, Virginia Beach, VA and Naval Station Norfolk, VA at the Contractor’s expense. Please provide the location/address of the MSC N7 offices, and confirm whether meetings and deliveries would typically be made to N7’s offices or to the Tech Library (COR’s office).
ANSWER: The Contractor shall be responsible for pick-up and delivery of documentation and technical references at MSC N7 offices at the Naval Station Norfolk, VA at the Contractor’s expense.
QUESTION: Paragraph 5.3 States “Certain TO’s will require the contractor to work at MSC facilities….The contractor shall provide necessary computers, accessories and WIFI capability...”Request clarification as to what WIFI capability is required? Does MSC have WIFI at their offices, or is this a reference to having computers with “air cards” for data service or the provision by the contractor of a WIFI hot spot? Should a cost for such additional equipment be factored into our pricing or will this be a reimbursable ODC included in the ODC amounts provided should such a requirement exist?
ANSWER: MSC does not have WIFI capabilities and uses MIFI or personnel Hot Spots. The
Contractor will have to factor the requirement for the connectivity onto their proposal. MSC cannot provide outside access or NMCI accounts. Certain TO’s will require the contractor to work at MSC facilities and work in conjunction with the TPOC. The Contractor shall provide all necessary computers/accessories/WIFI/MIFI/Mobile Hot capability to perform in accordance with the PWS under each TO.
QUESTION: Paragraph 8.1 States “This will be a firm fixed-price, indefinite delivery/indefinite quantity type contract with reimbursable cost for actual travel and ODC expenses.”Why can’t we burden ODC’s with general and administrative (G&A) costs, which is presently authorized by the Navy and DCAA on other contracts we have worked?
ANSWER: This solicitation is requiring the breakdown of ODC, Travel and Labor into separate
CLINS.
QUESTION: Paragraph 13.1 Contractor Request and Approval of Travel. Does this paragraph apply to travel other than travel associated with an individual task order? Paragraph 5.2 state
“Contractor travel for shipchecks must be approved by the MSC TPOC”. Please clarify whether this is the case, or if both TPOC (for a given task) and COR must both approve any travel.
ANSWER: Yes. The Contractor needs to submit the travel request to the COR for all travel.
The TPOC shall be the person approving travel as contractor will be working with them. Travel has to be in accordance with JTR.
QUESTION: Paragraph 14.2 Discussion of “Actual Price”The third sentence states:“The parties expressly agree that the offered and accepted daily rate includes all costs incurred or paid by the Contractor…” Please clarify the “offered and accepted daily rate”.
ANSWER: The Contractor will provide information on costs offered by a vendor and the final accepted rate charged to the Government.
QUESTION: Paragraph 16.1.1 “The program manager shall meet the following minimum qualifications :…(3) Project Management Professional (PMP) certification. Paragraph 16.1.4 further states “Key personnel shall be employed by the contractor and not be a subcontractor.”
Although the PMP requirement was identified on the sources sought and the previous solicitation the restriction to contractor personnel only and not a subcontractor with the PMP certification is a new requirement. This contractor has personnel that meet the PMP requirements except for taking the PMP test. Scheduling the test is difficult given the short duration between when the solicitation was issued and the anticipated award date. The earliest PMP test date available is in early November; therefore this contractor is requesting an extension to the proposal due date of
16 November in order to meet this requirement or at the least an extension of the qualification date for the PMP certification until contract award. While this contractor understands the value of project management training and procedure implementation and uses such tools every day, we believe the requirement for the Program Manager to hold the Project Management Professional
(PMP) certification is an unnecessarily restrictive requirement, considering the potential scope of work under this solicitation. We feel that this requirements may restrict otherwise qualified bidders and result in higher management costs for this contract effort.Request MSC consider eliminating the PMP certification from the Program Manager qualifications.
ANSWER: No. MSC requires a PMP certification for the PM qualifications.
QUESTION: Paragraph 17.2.2 Please confirm that “All personnel performing work under this contract must be able to maintain a SECRET clearance.” In the past this was not required and the nature of the task orders under the previous solicitation did not necessitate a SECRET clearance. This requirement limits otherwise qualified personnel from working on a task since we expect the great majority of tasks to be unclassified. Are clearances required at time of bid submittal, at the time of contract award or within some specified time frame after contract award?
ANSWER: MSC requires that personnel that perform work on the contract must have a
SECRET clearance. Personnel need a clearance to work onboard our ships and enter certain spaces, i.e. Radio Space. They will not be able to board unless they possess a clearance.
QUESTION: Paragraph 17.2.3 Please confirm “All personnel working on any TO must have and maintain a CAC card.” Will the Contracting Officer /COR authorize CAC for all personnel at contract award? In the past the only personnel with a CAC was for access to government computers/NMCI/MSC’s Technical Library or does this CAC requirement apply only to personnel assigned on-site at MSC facilities? Most contractors currently use RapidGate for base access.
ANSWER: Yes. All personnel will have a CAC for the ability to access MSC Portal and other software system. The requirement for SECRET clearance provides the basis for issuing a CAC to the contractors personnel.
QUESTION: CAC CARD AND SECURITY CLEARANCE paragraphs on pages 21 & 22. This question expands on the previous question. Please clarify as it implies personnel only need a
CAC if accessing government computer networks/systems. Would recommend that the winning contractor identify one or two persons who may need access to government computer networks be granted a CAC versus the entire contractor organization, when many may only work on an occasional TO, based on the manning requirements of each TO.
ANSWER: All personnel that access Government data, network/systems, ships and offices shall have a CAC.
QUESTION: The DD254 states the facility clearance is SECRET with MSC Security conducting on-site inspections. This contractor currently has a TS facility clearance. Work will be performed at both our HQ office and our Virginia Beach office, all under the same CAGE.
Please confirm that this meets the requirement for an active Facility Clearance at the time of
Proposal submittal?
ANSWER: Yes – Facility Clearances are granted by CAGE Code.
QUESTION: Also please clarify DD254 Paragraph 13a that personnel involved with scheduling
Ship Visits must have a NACLC and attend Counterintelligence Awareness and Reporting training. Will the winning contractor have time to obtain this National Agency Check after award?
ANSWER: Yes - Prior to working on any Government data, ship access, and office access, personnel will have a NACLC and attend Counterintelligence Awareness and Reporting training.
QUESTION: The Quality Assurance Surveillance Plan. The last paragraph on page 6 states
“Final Drawings received that have more than five (5) errors per the drawing sheet will result in rejection….”Please confirm that this applies to Final Drawings only and does not apply to any
Preliminary Drawings/Deliverables that may be part of the overall TO Deliverables Schedule.
ANSWER: Preliminary and final drawings. Contractor should have QA’d the drawings prior to submittal to MSC.
QUESTION: Past Performance Questionnaire: The closing date and contracting officer name needs updating.
ANSWER: Correction made – attachment corrected.
QUESTION: PWS 16.1.4 - : The contract has only 5 key personnel resume’s and they are the only factor evaluated under factor 4 personnel. We believe that allowing Subcontractor personnel to fill key personnel positions on this contract would make the Prime Contractor unduly reliant on the subcontractor and would violate the Ostensible Contractor rule in several ways: The
Prime Contractor is unduly reliant on the Subcontractor in that they cannot meet the key personnel requirements and must rely on a Subcontractor Key personnel to meet the terms of the solicitation. The Prime Contractor is unduly reliant on the Subcontractor in that they cannot perform the duties of the contract without the Subcontractor Key personnel. Because of the small number of Key Personnel and the high level expertise provided by them, by having
Subcontractor Key personnel the subcontractor would be performing primary and vital requirements of the contract In order to provide a level playing field and ensure that this 100% small business set-aside contract is actually performed by small businesses without violating the
Ostensible Contractor Rule, will the government consider requiring that all key personnel be employees of the Prime as stated in the original solicitation?
ANSWER: The Government is aware that this is a 100% small business set-aside. As such, the small business prime contractor must perform IAW FAR Part 19.
QUESTION: RFP p. 18 – 16.1.1 Based on the answer provided above, the government is putting a high importance on the expertise of the Program Manager. While PMP certification is an indication that the Program Manager has some level of training, why is there no other educational requirements or certifications such as professional engineer for this position or any other key personnel positions? It is very unusual that the engineering personnel are not required to have Engineering Degrees or Professional Engineers licenses. If the Government is concerned about the qualification of the Program Manager why not require an engineering degree and advanced degree as well as PMP certification?
ANSWER: The requirement is that the Program Manager has a PMP certification.
