text: Technical papers, briefings, presentations, either classified or unclassified to be presented at classified symposia must be submitted to the Specification Security Office (SSO) for approval prior to presentation. Unclassified material submitted for public release (that is not to be presented at classified symposia) shall be forwarded for review prior to release as stated in item 12 above. All controlled unclassified and classified technical information shall be appropriately marked with distribution statements as specified in DoDI 5230.24 (Distribution Statements on Technical Documents) http://www.dtic.mil/whs/directives/corres/pdf/523024p.pdf.

Determination of need-to-know in connection with a classified visit is the responsibility of the individual/host who will disclose the classified information.

All contracts with non-Sensitive Compartmented Information and Non-Compartmented work that may reveal mission-related information of a sensitive activity or sensitive operation should be routed to the NAVAIR Scientific and Technical Intelligence Liaison Office (STILO) for approval.

All instances of loss, compromise and electronic spillage of classified or controlled unclassified information shall be reported to the COR, TPOC, and Government Security Office within 24 hours of the incident occurring.

10.a – Classified COMSEC material is not releasable to contractor employees who have not received a final security clearance at the appropriate level. Cryptologic keying materials and Controlled Cryptographic Items (CCI) are controlled by Department of the Navy, NISPOM, and National Security Agency (NSA) guidelines. The contractor shall be guided by NSA/CSS Policy Manual 3-16 in the control and protection of COMSEC material/information at their facilities. When access is required at Government facilities, contractor personnel will adhere to COMSEC rules and regulations as mandated by DoD 5520.22-M, EKMS 1 (series) and Command policy and procedures. Written concurrence of the Technical Point of Contact identified in Block 16, or Contracting Officer Representative/Contracting Officer Representative for Security (as applicable) is required prior to subcontracting.

10.b –“RD is not releasable to contractor employees who have not received a final security clearance at the appropriate level. Written concurrence of the Technical Point of Contact identified in Block 16, or Contracting Officer Representative/Contracting Officer Security Representative (as applicable) is required prior to subcontracting.”

10.c –Critical Nuclear Weapon Design Information (CNWDI) is not releasable to contractor employees who have not received a final security clearance at the appropriate level. Written concurrence of the Technical Point of Contact identified in Block 16, or Contracting Officer Representative/Contracting Officer Representative for Security (as applicable) is required prior to subcontracting.

10.e. - National Intelligence Information: The Command Senior Intelligence Officer (SIO) as defined in DoDM 5105.21, Volume 1, 19 October 2012 is the official approving authority for all releases of intelligence information pertaining to NAVAIR contracts and all affiliated sub-contracts.

Per Intelligence Community Standard (ICD) 703-01, 10 September 2015, contractors are not authorized to disclose further or release intelligence to any of their components or employees or to another contractor (including sub-contractors) without the prior written notification and approval of the SIO unless such disclosure or release is authorized in writing at the initiation of the contract as an operational requirement.

In accordance with Department of Defense (DoD) Directive 5148.13, contractor personnel involved in intelligence and intelligence related activities are required to report any significant, highly sensitive matter, or questionable intelligence activities to appropriate government officials.

10.e.(1) - Sensitive Compartmented Information - Contractor will require access to Sensitive Compartmented Information (SCI) in performance of this contract and requires a final Top Secret US. Government Personnel Security clearance based upon a Tier 5 background investigation, T5R or equivalent investigation and SCI Indoctrination. Contractor must provide individuals who are able to achieve and maintain the adjudicative standards set forth in the Intelligence Community Directive (ICD) 704 “Personnel Security Standards and Procedures Governing Eligibility for Access to Sensitive Compartmented Information and Other Controlled Access Program Information,” for continued employment. Contractors will not be allowed SCI access until the NAVAIR SSO has received final approval.

Access, processing, and storage of SCI information shall be conducted within a SCI accredited government facility only. Naval Air Systems Command (NAVAIR) has exclusive security responsibility for all SCI material under this contract. NAVAIR STILO Office is responsible for the release of and access to all Intelligence information/materials under this contract. Further disclosure, to include subcontracting, of SCI is prohibited until receipt of approval from the SCI cleared COR and NAVAIR SIO.

In compliance with DoDD 5148.13 paragraph 4.1.e and SECNAVINST 3820.3F, all contractor personnel conducting Intelligence or Intelligence-related activities or supporting those efforts under Department of Defense authorities shall report any Questionable Intelligence Activity (QIA) or Significant or Highly Sensitive Matter (S/HSM) to the Naval Information Warfare Systems Command Intelligence Oversight Program Manager or Senior Intelligence Officer.

Questionable Intelligence Activity (QIA): Any Intelligence or Intelligence-related activity when there is reason to believe such activity may be unlawful or contrary to an Executive Order, Presidential Directive, Intelligence Community Directive, or applicable DoD policy governing that activity.

Significant or Highly Sensitive Matter (S/HSM): An Intelligence or Intelligence-related activity (regardless of whether the Intelligence or Intelligence-related activity is unlawful or contrary to an Executive Order, Presidential Directive, Intelligence Community Directive, or DoD policy), or serious criminal activity by Intelligence personnel, that could impugn the reputation or integrity of the Intelligence Community, or otherwise call into question the propriety of Intelligence activities. Such matters might involve actual or potential:

- Congressional inquiries or investigations.

- Adverse media coverage.

- Impact on foreign relations or foreign partners.

- Systemic compromise, loss, or unauthorized disclosure of protected information.

As a further enhancement to security measures, for the protection of classified information, the Contractor agrees to permit necessary polygraph interviews on Contractor personnel having access to National Security Information (NSI) under this contract. It is understood the polygraph interview shall be limited to counterintelligence (CI) and counterespionage (CE) issues.

10.e. (2) – The contractor is authorized access to Non-SCI National Intelligence Information and/or Foreign Intelligence Information on behalf of Rebecca Ahne, NAVAIR Senior Intelligence Officer. A final security clearance at the appropriate level is required for access to Non-SCI National Intelligence Information and/or Foreign Intelligence information. Further security guidance for reproduction, release, retention, return, and destruction of National Intelligence Information is stipulated in the attached NAVAIR Memorandum titled POLICY GOVERNING RELEASE OF INTELLIGENCE TO CONTRACTORS dated 01 MAR 2022. Written concurrence of the Technical Point of Contact/Contracting Officer Representative/Contracting Officer Representative for Security (as applicable) is required prior to subcontracting.

10f: Contractor is authorized to receive, process and generate up to Secret/Special Access Required (S//SAR) Information for programs as required by this contract in accordance with the policy and guidelines established in DoDM 5205.07 Volumes 1-4 and the Security Classification Guides associated with each program. Access to program information by the contractor is to perform work at the assigned government site listed on this DD 254. Access to Special Access Program information is at the discretion of the Program Manager under the requirements set forth in DoD Manuals 5205.7 Volumes 1-4 and all applicable adjudicative guidelines.

No SAP products/deliverables are authorized under this contract.

10.g – A final security clearance at the appropriate level is required for access to NATO information. Written concurrence of the Technical Point of Contact/Contracting Officer Representative/ Contracting Officer Representative for Security (as applicable) is required prior to subcontracting.

10.h – Foreign Government Information (FGI) is not releasable to contractor employees who have not received a final security clearance at the appropriate level. Written concurrence of the Technical Point of Contact/Contracting Officer Representative identified in Block 16, or Contracting Officer Representative for Security (as applicable) is required prior to subcontracting.

10.j/11.l – 10.j/11.l – Controlled Unclassified Information including Legacy For Official Use Only (FOUO) and Covered Defense Information (meeting the definition of 48 CFR 252.204–7012(a)) generated and/or provided under this contract shall be marked and safeguarded as specified in DoD Instruction 5200.48 (Controlled Unclassified Information) (CUI)) available at https://www.esd.whs.mil/Portals/54/Documents/DD/issuances/dodi/5200.48.PDF. Any product containing Covered Defense Information shall be assigned the appropriate distribution statement using the criteria set forth in DoDI 5230.24 (Distribution Statements on Technical Documents); and have this statement displayed per DoDI 5230.24, Enclosure 3-4.

All For Official Use Only (FOUO), Covered Defense Information (CDI), and program Controlled Unclassified Information (CUI) data transmitted and safeguarded via electronic means shall use approved encryption. The Contractor shall ensure that when transmitting FOUO/CDI, over non-secure e-mail (e.g. not connected to the Navy Marine Corps Intranet through Broadband Unclassified Remote Access System / Virtual Private network), those transmissions are encrypted using Department of Defense Public Key Infrastructure (PKI), or an approved DoD External Certificate Authority, in accordance with Public Key Infrastructure & Public Key Enabling, DoDI 8520.02, 24 May 2011.

10.k – Secret Internet Protocol Network (SIPRNet) and JWICSaccess authorized. The contractor shall not access, download, or further disseminate any information or data that falls outside the scope and execution of the defined contract requirements. In the event any additional access is required, the Technical Point of Contact/Contracting Officer Representative must modify the requirements for DD Form 254 revision. Contractor shall prepare and submit all required documentation as required by Command policy prior to receiving access. Written concurrence of the Technical Point of Contact/Contracting Officer Representative identified in Block 16, or Contracting Officer Representative for Security (as applicable) is required prior to subcontracting.

10k -Use of Secure Terminal Equipment (STE) for transmission of classified U. S. Government information is authorized. Secure Facsimile: Receipt and transmission of Classified Information authorized via Secure Facsimile. Written concurrence of the Contracting Officer Representative/Technical Point of Contact, identified in Block 16, or Contracting Officer Representative for Security (as applicable), is required prior to subcontracting.

Block 11.c- Information Systems (IS) shall be protected in accordance with DoDI 8510.01 and/or per guidance in the NISPOM 32 CFR, Part 117 24 Feb 21, National Industrial Security Operating Manual (NISPOM).

The following Security Classification Guide(s) apply to classified performance on this contract. Subsequent updates shall be provided by the Technical Point of Contact/Contracting Officer Representative/Contracting Officer Security Representative (as applicable) as Government Furnished Information (GFI) and shall be executed by the Contractor without obligation to modify this DD Form 254.

Specific Security Classification Guidance (SCGs), to include subsequent upgrades/revision(s), applying to classified performance on this contract, shall be provided by the Contracting officer Representative or Technical Point of Contact, identified in Blk 9, as Government Furnished Information (GFI); and shall be executed by the Contractor without obligation to modify this DD Form 254. If additional security classification is required, contact the COR identified in Blk 16.

11.d-Contractor shall provide adequate storage at their facility for classified hardware. Classified shipments are not to exceed two cubic feet. Larger size shipments require prior coordination with the Facility Security Officer (FSO) to confirm facility storage capacity. Preparation and transmission of material for shipment will be in accordance the NISPOM 32 CFR, Part 117 24 Feb 21 and the DoD 52001.01 V3, DoD Information Security Program Manual.

11.g – To use DTIC services, the contractor must register for an account at http://www.dtic.mil/dtic/registration/contractors/index.html.

11.j – Systems Engineering Department, the Requiring Organization, has made a determination that BASIC Operations Security (OPSEC) measures are sufficient to protect the contracted related Critical Information associated with this Contract. The NAVAIR DD254 OPSEC Annex, dated Sept 2017, shall be included as an attachment in the DD254. When basic OPSEC measures are prescribed, there shall be no required OPSEC CDRLs associated with this contract. However, the contractor will adhere to all OPSEC requirements specified in the OPSEC attachment. The Contractor shall be responsible for subcontractor implementation of the OPSEC Program requirements for this contract.

11m. – The contractor shall develop, implement, and maintain a facility level Program Protection Implementation Plan (PPIP) to protect Critical Program Information (CPI) and/or Critical Components to be handled, processed, transferred and/or safeguarded at the contractor facility during the performance of this contract. Program Protection Implementation Plan (PPIP) Contract data requirements list (CDRL) and data item description (DID-DI-MGMT-82144) are a component of the contract. The contractor shall establish a Program Protection Implementation Plan (PPIP), to be implemented and/or revised per GCA request, and shall be maintained throughout performance of this contract. The Contractor shall be responsible for subcontractor implementation of the PPIP requirements for this contract.

Public Release - No release of SCI is authorized.

Before an employee departs, the contractor will ensure the employee goes through NAVAIR Special Security Office (SSO) to be debriefed.

All SCI classified visit requests by contractors shall be forwarded to the COR for approval and NTK certification before being sent to the NAVAIR SSO for submittal to the facility to be visited.

Sub-contracting: The Prime FSO/CSSO is responsible for the execution of all DD 254s for subcontractors. Subcontracting must have prior approval of the PCO and the SSO when SCI access is required. Subcontractor DD 254s must be submitted to the PCO and SSO via the COR for approval prior to commencement of subcontractor work.

Handling and processing of SCI information at SCI accredited government facilities only.

Additional pages will include the SSO Navy SCI Security Requirements Addendum. The attached NAVY SCI Addendum provides the necessary guidance for physical, personnel, information, and information systems security measures, and is part of the SCI security specifications for the contract. Access to intelligence information requires a special briefing and a final U.S. Government clearance at the appropriate level for access.

Explain and identify specific areas and government activity responsible for inspections.: OSI PJ Executive Director will maintain inspection authority and security cognizance for all classified material and/or information within accredited Special Access Facilities (SAPF’s) used in support of this contract. F-35 JPO Arlington, VA will have security cognizance over collateral material classified by the JSF SCG located at 200 12th Street, Arlington VA. “US Army CUSR will maintain security cognizance over NATO material and NAVAIR SIO has exclusive security responsibility for SCI classified material under this contract.
