INDUSTRY QUESTIONS & ANSWERS

Question 1:

Section L, Part B, Para 3.5.2 Labor Hours, Page 101: States that “A work-year is defined as 1920 hours exclusive of holidays and leave. For evaluation purposes, the Offeror shall propose the labor categories/hours as outlined in NAVAIR clause 5252.211-9503.” However, that NAVAIR clause 5252.211-9503 chart, found on pages 14 – 16 appears to be using 2016 hours for its work-year calculation, possibly as an artifact from a prior solicitation where deviation from the Government hour estimates was permitted. By using 2016 hours as the divisor in the in NAVAIR clause 5252.211-9503 chart, we see work-years that are either whole numbers or exactly one-half of a work-year, totaling 47 work-years in the first year and 437 work-years total. Then multiplying these seemingly reasonable work-year calculations by 1920 produces an alternative labor hours estimate totaling 90240 in the first year and 839,040 total, exactly 5 percent less than the hours shown under NAVAIR clause 5252.211-9503. However, when 1920 hours is used as the divisor for the NAVAIR clause 5252.211-9503 chart, each labor category has wide-ranging fractions of odd work-years, ranging from .05 to .1 to .15, to .525, to .575, with each of these fractions requiring another person to bid in that labor category for that year. It is difficult to imagine the Government desiring those wide ranges of odd fractional work-years proposed by a small business and it would appear more likely that the hours contained under the NAVAIR clause 5252.211-9503 chart were an artifact from a prior solicitation where offeror’s had the flexibility to deviate from the published hours by claiming their unique company practices and/or leave packages, allowed them to bid a lower price by converting a Government estimate of 2016 hours per work-year to 1920 or 1880 hours per work-year. Could the Government reexamine the hours contained in the NAVAIR clause 5252.211-9503 chart with an eye to converting to realistic work-year estimates in each labor category in each year, and consider an alternative labor hour estimate under NAVAIR clause 5252.211-9503 that more closely aligns with whole (or half) work-years per year per labor category?

Answer 1:

You are correct Section L, Part B, paragraph 3.5.2 states, “A work-year is defined as 1920 hours exclusive of holidays and leave. For evaluation purposes, the Offeror shall propose the labor categories/hours as outlined in NAVAIR clause 5252.211-9503”. NAVAIR clause 5252.211-9503 specifically solicits man-hours of direct labor thus the hours reflected are accurate and shall be proposed to in accordance with the RFP.

Question 2:

Can you please confirm the full time equivalent for the referenced RFP? Is it 1,920 or 2,016?

Answer 2:

While a full time equivalent is not explicitly addressed or defined within the RFP, Section L, Part B, paragraph 3.5.2 states, “A work-year is defined as 1920 hours exclusive of holidays and leave. For evaluation purposes, the Offeror shall propose the labor categories/hours as outlined in NAVAIR clause 5252.211-9503”. NAVAIR clause 5252.211-9503 refers to the level of effort estimated in man-hours of direct labor by labor category anticipated to be ordered during the performance of the contract.

Question 3:

Will the government allow a continuation page for the Past Performance contract description? The P.4 template does not allow enough space to describe the contract in any detail.

Answer 3:

Yes. Section L, Part A, paragraph 3.0 in the RFP indicates there is no page limitation set for Past Performance.
