Amendment 0001 Industry Questions and Government Answers to MDC5ISR RFP N00421-16-R-0026 as of 11/9/2018:

1.)Reference(s):(1)Section C, PWS/SOW, Paragraph 6.1.2
(2)Section E, FAR Clause 52.246-11

Question: Do you have to be currently ASO9100 certified or will a letter from the auditor that states our process is almost completed be acceptable?

Government Response: There is no requirement for AS9100 certification. AS9100D has been deleted from Section E, Clause 52.246-11 HIGHER-LEVEL CONTRACT QUALITY REQUIREMENT (DEC 2014), and the clause now reflects ISO 9001:2015 only.

2.)Reference(s):(1)Section B, NAVAIR Clause 5252.211-9503
(2)Section L, Part B, Paragraph 3.5.2

Question: Clause 5252.211-9503 Level of Effort (Cost Reimbursement) (NAVAIR) (DEC 2012) defines the level of effort estimated to be ordered during the term of this contract is 743,260 man-hours of Cost Plus Fixed Fee (CPFF) Labor. Section L 3.5.2 Labor Hours says the Government estimates 1,008,710 hours for the CPFF term and completion work effort inclusive of out years. Can the Government confirm the correct estimate of hours to be used for the CPFF labor hours?

Government Response: Section B, NAVAIR Clause 5252.211-9503 Level of Effort (Cost Reimbursement) (NAVAIR) (DEC 2012) does not apply to any FFP orders or CPFF Completion orders that are issued. The level of effort estimated to be ordered during the term of this contract is 743,260 man-hours of CPFF LOE hours. Section L, Paragraph 3.5.2 provides that the Government estimate is 1,008,710 hours for the Cost Plus Fixed Fee (CPFF) term and completion work effort inclusive of outyears. Section J, Attachment P8 provides FTEs and Labor Hours by Location.

3.) Reference(s): (1) Section C, PWS/SOW, Paragraphs 3.2.4, 3.2.6, 6.2, and 12.1 Table 1

Question: Paragraphs 3.2.4, 3.2.6, and 6.2 identify tasking that is associated with that of a Quality Assurance Inspector/Supervisor. This labor category is also NOT listed in the Professional Labor Category chart on pages 24-25. We request that the Government consider the addition of the Quality Assurance Inspector/Supervisor labor category within section 12.0 Personnel Requirements and associated sections of the RFP.

Government Response: The Labor Categories provided in Section C, PWS/SOW, Paragraph 12.1, Table 1 are sufficient for the Government’s MDC5ISR requirements as outlined in the PWS/SOW. No other labor categories are required.

4.) Reference(s): (1) Section C, PWS/SOW, Paragraphs 3.2.5, 3.4.3, and 12.1 Table 1

Question: The referenced paragraphs identify tasking that is associated with that of a Technical Writer I, II, and/or III. This labor category is also NOT listed in the Professional Labor Category chart on pages 24-25. We request that the Government consider the addition of Technical Writer I, II, and/or III labor categories within section 12.0 Personnel Requirements and associated sections of the RFP.

Government Response: The Labor Categories provided in Section C, PWS/SOW, Paragraph 12.1, Table 1 are sufficient for the Government’s MDC5ISR requirements as outlined in the PWS/SOW. No other labor categories are required.

5.) Reference(s): (1) Section C, PWS/SOW, Paragraph 9.2.4

Question: The requirement states "Overtime will be authorized in accordance with FAR clause 52.222-2 Payment for Overtime Premiums". Will the Government include Overtime into the Labor Hours Matrix or Attachment P6?

Government Response: Section L, Part B, Paragraph 3.5.2 states “for proposal purposes, the Offeror shall propose the labor categories/hours by location as outlined in Section J, Attachment P8.” Attachment P8 includes Overtime hours that should be included in Offeror’s P6 Prime and Subcontractor Cost Summary Sheet.

6.) Reference(s): (1) Section C, PWS/SOW, Paragraph 12.1, Table 1

Question: There are numerous paragraphs throughout the SOW that identify administrative tasking that would normally be assigned to different administrative levels. The only administrative labor categories listed in the RFP are Management Analyst and General Clerk II. The current contract also has Project Analyst and Administrative Assistant labor categories. These categories typically are mid-level positions. Without these or similar labor categories, there is a gap in levels of qualification and experience. We request that the Government consider the addition of the Project Analyst and Administrative Assistant labor categories within section 12.0 Personnel Requirements and associated sections of the RFP.

Government Response: The Labor Categories provided in Section C, PWS/SOW, Paragraph 12.1, Table 1 are sufficient for the Government’s MDC5ISR requirements as outlined in the PWS/SOW. No other labor categories are required. This is not the same requirement as the current contract.

7.) Reference(s): (1) Section C, PWS/SOW, Paragraph 12.1, Table 1

Question: Paragraph 12.1 lists the following specific labor categories: Drafter/CAD Operator II and General Clerk II. There are no levels I or III listed for either labor category. The current contract has these labor categories with levels ranging from I-III. We request that the Government consider adding the additional levels in the aforementioned labor categories in order to continue to provide contract support at least at current operational levels.

8.) Reference(s): (1) Section C, PWS/SOW, Paragraph 12.3, Experience and Education Level Definitions

Question: In the table in Paragraph 12.3, there is a qualification substitution chart for professional labor categories. While this chart states that “an Associate’s Degree plus 4 additional years of experience can be substituted for a Bachelor’s Degree,” there is no mention of substituting a High School Diploma plus 4-6 years of additional experience. The current contract allows for the High School Diploma substitution plus the additional years of experience. We request that the Government consider the addition of High School Diploma substitution plus years of experience.

Government Response: That is correct. There is no substitution allowed for High School Diploma plus the additional years of experience for Professional Labor Categories. That substitution only applies to Non-Professional/Non-SCA Labor Categories and SCA Labor Categories identified in the PWS/SOW, Paragraphs 12.3 and 12.4.

9.) Reference(s): (1) Section C, PWS/SOW, Paragraph 12.3, Experience and Education Level Definitions

Question: Current Junior and Journeyman levels indicate that a minimum of an Associate’s Degree is required. For the more administratively based positions, can years of service substitute for education requirements, specifically for the following positions: Management Analyst BLS SOC 13-1111, Operations Research Analyst BLS SOC 15-2031, and Acquisition Logistics Analyst BLS SOC 13-1081?

Government Response: No. The Personnel Requirements identified in Section C, PWS/SOW, Paragraphs 12.1 – 12.6 identify the experience and education levels required for the Government’s MDC5ISR requirements.

10.) Reference(s): (1) Section C, PWS/SOW, Paragraph 12.6, Functional Descriptions: Technical Instructor/Course Developer

Question: In the current contract, the Trainer II category is a non-SCA position. Will the Government consider making the Technical Instructor a non-SCA position for this contract?

Government Response: No. The Personnel Requirements identified in Section C, PWS/SOW, Paragraphs 12.1 – 12.6 identify the experience and education levels required for the Government’s MDC5ISR requirements.

11.) Reference(s): (1) Section L, Part A, Paragraph 3.0, Proposal Content and Volumes, Table of Proposal Organization and Page Count

Question: Please confirm if the Past Performance page limit of 3 pages per reference is in addition to the 2-page PPIF.

Government Response: The Past Performance page limit of 3 pages per reference includes the Past Performance Information Form.

12.) Reference(s): (1) Section L, Paragraph 3.0, Proposal Content and Volumes, Table of Proposal Organization and Page Count

Question: The Proposal Organization and Page Count Table in RFP Section L, Paragraph 3.0, page 123 indicates a limit of 15 pages for the Sample Task response. Given the scope and subject matter of the Sample Task, which includes a complete technical approach, detailed Integrated Master Schedule, summary of required resources, and an outline of hours by labor category for a complex development, design, integration, and delivery of a completely new mobile C4ISR system, would the Government consider increasing the page limit for the sample task to 20 pages?

Government Response: Yes. The Government has revised Section L, Paragraph 3.0 Proposal Content and Volumes, Table of Proposal Organization and Page Count, 1.1 Sample Task to a 20-page limit.

13.) Reference(s): (1) Section L, Part B, Paragraph 1.1, Sample Task, Sample Task Scenario Background

Question: The Sample Task Scenario Background on page 126 states: “The NAWCAD, SCMS Division provides quick reaction support to design, integrate and deliver a mobile deployable Incident Response Vehicle (IRV) with C5ISR communication systems.” The Sample Task Scenario Background also states: “The offeror shall respond to this scenario as if the SCMS Division has issued a task order to provide a technical approach, schedule, resources (including people, tools, and any other resources deemed necessary) and a spending plan to support the complete turnkey system.” Can the Government clarify whether the Sample Task response required from offerors should address design, integration and delivery of the IRV, or does it address only delivery of a technical approach, schedule, resources and spending plan for the IRV?

Government Response: Offerors are only required to provide a technical approach, schedule, resources (including people, tools, and any other resources deemed necessary) and a spending plan to support the complete turnkey system.

14.) Reference(s): (1) Section L, Part B, Paragraph 1.1, Sample Task, Sample Task Scenario Background

Question: The requirement states that a “spending plan” is required in the response. Is this spending plan the same as the “outline of hours by labor category” required in Section 1.1 page 128 under the sub-paragraph (9) Level of Effort requirement?

Government Response: No. The spending plan should provide the Offeror’s methodology on how costs would be expended during the effort in the sample task.

15.) Reference(s): (1) Section L, Part B, Paragraphs 1.3.2 and 3.5.5

Question: The RFP states this contract is for a new requirement, therefore, there is no incumbent contractor; however, the RFP requires a Transition Plan. Please clarify how offerors are to respond to this requirement if there is no incumbent contractor.

Government Response: Although this effort is considered a new requirement, it is still expected that there are transition activities that will need to take place.

16.) Reference(s): (1) Section L, Part B, Paragraph 1.3.3, Small Business (SB) Utilization Strategy, Item (1)

Question: This requirement includes that offeror's must list goals for several categories of small businesses but does not specify the percentages for each. Since we use DoD 2018 Small Business Subcontracting goals (statutory goals) of 5% WOSB, 5% SDB, and 3% SDVOSB based on total subcontract value (TSV), we request that the overarching small business participation goal remain based on TCV with the socio-economic goals based on TSV.

Government Response: Section L, Part B Specific Instructions, Paragraph 1.3.3 Small Business (SB) Utilization Strategy, Item (1) has been revised to reflect the on total subcontract value (TSV).

17.) Reference(s): (1) Section L, Part B, Paragraph 3.5.1, ODCs

Question: The table in this section highlights Hazard Pay, however section 3.5.2 Labor Hour Matrix does not identify Hazard Pay for the Labor Categories. Will the Government include Hazard/Danger Pay into the Labor Hours Matrix or Attachment P8?

Government Response: Offeror’s shall utilize the ODC estimates provided by the Government for ODCs which includes Hazard Duty Pay.

18.) Reference(s): (1) Section J, Attachment P8, FTEs and Labor Hours by Location

Question: In the P8_FTEs_and_Labor_Hours_by_Location table, the Government provided Overtime hours with no Regular hours associated with the following Labor Categories and Off-Site Contractor Locations: Electronics Technician Maintenance, II (SCA) / St. Inigoes, MD & Engineering Technician, II (SCA) / Fayetteville, NC.

Would the Government please clarify if they intend to provide Regular hours for LCATs Electronics Technician Maintenance, II (SCA) / St. Inigoes, MD & Engineering Technician, II (SCA) / Fayetteville, NC?

Government Response: In Section J, Attachment P8, Location: Within 50 Ground Transportation Miles of St. Inigoes, MD (Off-Site Contractor Facility), the overtime hours for Electronics Technician Maintenance, II (SCA) have been deleted and added to Electronics Technician Maintenance, III overtime hours, and also Location: Within 50 Ground Transportation Miles of Fort Bragg Fayetteville, NC (Off-Site Contractor Facility), the overtime hours for Engineering Technician, II (SCA) have been deleted and added to Engineering Technician, III overtime hours.

(3)Section C, PWS/SOW, Paragraph 10.3
(4)Section J, Attachment 01, DD254 Form
(5) Section L, Part B, Paragraph 1.3.2

Question: We’d like to know/confirm whether the N00421-16-R-0026 solicitation will allow for an SDVOSB HUB Zone the time to complete our FCL. Will NAVAIR endorse and support compelling need to DSS in order to ensure we have the necessary capabilities therein?

Government Response: The contractor shall have the appropriate facility security clearance as stated in the DD Form 254 within 60 days after contract award.

20.)Reference(s):(1)Section C, PWS/SOW, Paragraph 1.1
(2)Section C, PWS/SOW, Paragraphs 3.1 - 3.4

Question: With the small craft portion, will the opportunity allow for, or is the customer seeking small watercraft for NSW, or similar support?

Government Response: Please refer to the RFP PWS/SOW for the specific requirements.

B-1 ESTIMATED LABOR RATES FOR COST PLUS FIXED FEE (CPFF) TASK ORDERS

This language is designed for use in conjunction with H-2 Issuance of Orders Using Streamlined Procedures NAVAIR 5252.216-9540 (Variation)(Dec 2017). For purposes of estimating and establishing a labor cost ceiling for each task order, the following composite rates will be used by multiplying the composite rate for the labor category by the estimated hours for each labor category. These rates are estimates, and invoicing will be based on actual costs incurred. Ceiling for ODCs will be priced in accordance with the Government Estimate. Orders crossing multiple years will be estimated by the Government using the composite rates for each year in proportion to the period of performance of the order.

5252.211-9503LEVEL OF EFFORT (COST REIMBURSEMENT) (NAVAIR)(DEC 2012)
(a) The level of effort estimated to be ordered during the term of this contract is 743,260 man-hours of direct labor including authorized subcontract labor, if any. The contractor shall not, under any circumstances, exceed one hundred (100%) percent of the total level of effort specified in this basic contract. The estimated composition of the total man-hours of direct labor is as follows:
CLIN 0001
Total
Labor Hours (CPFF LOE)
743,260
(b) FAR Clause 52.232-20, "Limitation of Cost" applies to fully funded orders and FAR Clause 52.232-22, "Limitation of Funds" applies to incrementally funded orders. Nothing in this clause amends the rights or responsibilities of the parties hereto under either of those two clauses. In addition, the notifications required by this clause are separate and distinct from any specified in either FAR Clause 52.232-20 or FAR Clause 52.232-22.
(c) In the event that less than one hundred (100%) percent of the established level of effort of the contract/order is actually expended by the end of the performance period, the Government shall have the option of:
(1) Requiring the Contractor to continue performance, subject to the provisions of the FAR Clause 52.232-20 or 52.232-22, as applicable, until the effort expended equals 100% of the established Level of Effort; or
(2) Effecting a reduction in the fixed fee by the percentage by which the total expended man-hours is less than one hundred (100%) percent of the established Level of Effort.
