NOTE F.2
With respect to clause 52.211-9, Desired and Required Time of Delivery, paragraph (b), the Government will notify the Contractor of award via email.
52.211-9 DESIRED AND REQUIRED TIME OF DELIVERY (JUN 1997)
(a) The Government desires delivery to be made according to the following schedule:
DESIRED DELIVERY SCHEDULE
Item No. Quantity Within Days
0001 3 each 120 days after delivery order award 0002 Per Order each 90 days after first article acceptance 0003 Per Order each 90 days after first article acceptance 0004 1 Lot Per Exhibit A
If the offeror is unable to meet the desired delivery schedule, it may, without prejudicing evaluation of its offer, propose a delivery schedule below. However, the offeror's proposed delivery schedule must not extend the delivery period beyond the time for delivery in the Government's required delivery schedule as follows:
REQUIRED DELIVERY SCHEDULE
0001 3 each 180 days after delivery order award 0002 Per Order each 120 days after first article acceptance 0003 Per Order each 120 days after first article acceptance 0004 1 Lot Per Exhibit A
Offers that propose delivery of a quantity under such terms or conditions that delivery will not clearly fall within the applicable required delivery period specified above, will be considered nonresponsive and rejected. If the offeror proposes no other delivery schedule, the desired delivery schedule above will apply.
OFFEROR'S PROPOSED DELIVERY SCHEDULE
0001 3 each
0002 Per Order each
0003 Per Order each 0004 1 Lot
(b) Attention is directed to the Contract Award provision of the solicitation that provides that a written award or acceptance of offer mailed or otherwise furnished to the successful offeror results in a binding contract. The Government will mail or otherwise furnish to the offeror an award or notice of award not later than the day the award is dated. Therefore, the offeror shall compute the time available for performance beginning with the actual date of award, rather than the date the written notice of award is received from the Contracting Officer through the ordinary mails. However, the Government will evaluate an offer that proposes delivery based on the Contractor's date of receipt of the contract or notice of award by adding (1) five calendar days for delivery of the award through the ordinary mails, or (2) one working day if the solicitation states that the contract or notice of award will be transmitted electronically. (The term "working day" excludes weekends and U.S. Federal holidays.) If, as so computed, the offered delivery date is later than the required delivery date, the offer will be considered nonresponsive and rejected.
(End of clause)
NOTE F.1
The Delivery Date periods identified in “Delivery Information” will be adjusted based on the actual date of contract award. The intent is to include a 2-year ordering period.

SECTION M - EVALUATION FACTORS FOR AWARD
EVALUATION CRITERIA
1 GENERAL INFORMATION
A. The Small Business Subcontracting Plan shall be reviewed for compliance and adequacy for purposes of making a responsibility determination.
B. Lowest Price Technically Acceptable (LPTA) source selection procedures will be used for the evaluation of proposals received in response to this solicitation.
C. The Government may award to other than the Offeror with the lowest total price iststef the lowest price Offeror is found to be “Unacceptable” in any of the non-price factors.
D. Each factor will be evaluated on a stand-alone basis. However, information contained in one factor of the proposal may be used to assist the Government in evaluating the other factors of the proposal. Inconsistencies or disparities between the factors within a proposal may be considered an indication that the Offeror does not understand the requirements.
E. If it is determined that a proposal exceeds a Factor’s page limit identified in Section L, pages in excess of the specified page limit will be removed from the end of the submittal and will not be evaluated.
F. The Government intends to make award based on initial proposals without discussions, but reserves the right to conduct discussions if determined necessary (see FAR 52.215-1). Accordingly, Offeror is advised to submit its most favorable terms and conditions in its initial proposal. If unexplained discrepancies are identified, the proposal may not be considered for award.
G. It is the Offeror’s responsibility to provide clear indications of how its proposal meets the requirements of the
Statement of Work in Section C. If the proposal is not clear, it may be an indication that the Offeror does not understand the requirements.
H. Proposals may be evaluated without consideration of any proposed subcontractor that is deemed to have an organizational conflict of interest.
2 EVALUATION FACTORS FOR AWARD
The Government intends to award a contract resulting from this solicitation to the responsible Offeror whose proposal, conforming to the solicitation, will be most advantageous to the Government, price and other factors considered. Proposals are evaluated for acceptability, but not ranked, using the non-price factors. The Offeror must be determined to have an “Acceptable” rating for all non-price factors before further consideration will be given.
The LPTA non-price factors include Technical and Past Performance. The Contracting Officer will select the proposal, in conformance with the solicitation, which is determined “acceptable” for Technical and Past Performance, and offers the lowest evaluated price.
A proposal that is rated “Unacceptable” for any non-price factor is unawardable. Therefore, if any non-price factor is rated “Unacceptable”, the Government reserves the right to not evaluate the remaining factors.
2.1 EVALUATION CRITERIA
2.1.1 Factor l, Technical
The Government will evaluate each Offeror's technical capability to perform the requirements in the solicitation and any subsequent amendments. The proposal will be evaluated for completeness, accuracy, quality of detail, and degree of demonstration for the following:
Subfactor 1a – Technical Capability
1. The quality of detail and the degree to which the proposal demonstrates the Offeror's technical capabilities, approach, and unique skills or solutions possessed to provide the ability to manufacture from NAVSEA drawings, including each elements of the Statement of Work.
2. The feasibility and completeness of the Offeror's provided narrative in emphasis of:
a. Manufacturing process
b. Build to print accuracy
c. Facilities and equipment
d. Personnel expertise and work experience
3. The quality of detail and the degree to which the proposal demonstrated the Offeror's process to ensure the required pressure ranges and test data will be in accordance with the provided NAVSEA specifications.
The Offeror shall follow the requirements in accordance with the drawings.
Subfactor 1b - Technical Quality
The Offeror's capability to provide and apply successful implementation of quality management systems, management, and the applicable ISO requirements, as well as adequate subcontractor and material procurement oversight. Evidence of a current ISO 9001:2015, or comparable, certification was provided.
Subfactor 1c – Technical Risk
1. The quality of detail and the degree to which the Offeror provided an assessment of risk areas and risk mitigation plan.
2. The quality of detail and the degree to which the Offeror’s teaming experience with engineering communities via a request for variance process indicates an understanding of the process and communication necessary to achieve successful manufacturing of the required units.
3. The quality of detail and the degree to which the proposal addressed any constraints, anticipated problems, and/or assumptions that form the basis of its proposal.
Technical acceptability will be assessed according to Table M-1.
Table M-1: Technical Acceptable/Unacceptable Evaluation Ratings Rating Description Acceptable Proposal meets the minimum requirements of the solicitation.
Unacceptable Proposal does not meet the minimum requirements of the solicitation.
The Offeror’s technical proposal must be rated “Acceptable” to be further considered.
3.2 Factor 2, Past Performance
Past performance will be evaluated based on the Offeror’s demonstrated ability to satisfy its customers, deliver products and services of high quality, meet delivery schedules, and comply with applicable Federal, State, and local laws and regulations.
The Government may contact some or all of the Offeror’s references to ask questions such as: (1) was the Offeror is capable, efficient, and effective; (2) did the Offeror’s performance conformed to the terms and conditions of its contract; (3) was the Offeror was reasonable and cooperative during performance; (4) was the Offeror was committed to customer satisfaction; (5) did the Offeror meet proposed subcontracting goals, if applicable; and (6) did the Offeror hire and retain qualified personnel necessary for successful completion of the contract requirements.
The Government will evaluate up to three references for the Prime and up to two references for each proposed major subcontractor. References exceeding the quantity requested shall be removed from the end of the volume and will not be evaluated.
The Government may consider information obtained from sources other than those identified by the Offeror, including Federal, State and local Government agencies, better business bureaus, published media and any other sources available to the Government, to include, but not limited to, Contractor Performance Assessment Reporting System (CPARS), Supplier Performance Risk System (SPRS), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), Federal Subaward Reporting System (FSRS), or other databases; the Defense Contract Management Agency; and interviews with Program Managers, Contracting Officers, and Fee Determining Officials.
The Government will consider recent and relevant past performance information obtained in relation to the scope of this requirement. It is the Offeror’s responsibility to relate its past performance to the requirements of this solicitation. Past performance, either positive or negative, which is considered by the Government to be more closely related to the scope of this effort will be given higher consideration in determining the Offeror’s past performance acceptability/unacceptability.
The Government will consider the Offeror’s past performance in complying with requirements of the clauses at FAR 52.219-8, Utilization of Small Business Concerns, and 52.219-9, Small Business Subcontracting Plan.
Relevancy, as it pertains to past performance information, is a measure of the extent of similarity between the product, complexity, dollar value, contract type, and subcontract/teaming, or other comparable attributes of past performance examples and the solicitation requirements; and a measure of the likelihood that the past performance is an indicator of future performance.
If the Offeror does not provide past performance information with its proposal, the Contracting Officer need not pursue further information if it is clear that the Offeror’s price is not competitive.
NOTE: In the case of an Offeror without a record of relevant past performance, or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance (FAR 15.305(a)(2)(iv)). Therefore, the Offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral shall be considered “acceptable.”
Past Performance acceptability will be assessed according to Table M-2.
Table M-2: Past Performance Evaluation Ratings Rating Description Acceptable Based on the Offerors performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the Offeror’s performance record is unknown. (See NOTE above.)
Unacceptable Based on the Offerors performance record, the Government does not have a reasonable expectation that the Offeror will be able to perform successfully the required effort.
The Offeror’s past performance must be rated “Acceptable” to be further considered.
3.3 Factor 3, Total Evaluated Price
The prices proposed in Attachment 3, Pricing, are contractually binding.
The Government will evaluate the Offeror’s price proposal for the following:
A. Completeness. An Offeror’s price proposal may be deemed non-responsive if, in the judgment of the
Government, the price proposal is incomplete, erred, or does not accurately reflect the Offeror’s proposed effort in meeting the technical requirements, thereby indicating that the Offeror does not understand the scope of the technical requirements. Any inconsistency, whether real or apparent, between promised performance and price shall be explained in the price narrative. Failure to submit a price on an item may result in the proposal being deemed non-responsive.
B. Balanced Pricing. The Government may determine that a proposal is unacceptable if the prices proposed are materially unbalanced within the Ordering Periods and/or between line items. As defined in FAR 15.404, unbalanced pricing exists when, despite an acceptable total price, the price of one or more contract line items are significantly overstated or understated as indicated by the application of cost or price analysis techniques. A proposal may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.
C. Reasonableness. The Government anticipates making a determination of fair and reasonable pricing based on adequate competition. However, the Government may use any of the analysis techniques in FAR 15.404-1, either individually or in combination with each other, to determine that the final price is fair and reasonable.
D. Total Evaluated Price. The Government will evaluate proposals by determining the total evaluated price, calculated as follows:
1. First Article CLIN. The proposed unit price will be multiplied by the CLIN quantity, as identified in
Attachment 3, Tab 1-Section B, to derive the total amount per First Article CLIN.
2. All Production CLINs. For each Production CLIN, the proposed Year 1 Unit Price will be muliplied by a randomly selected Year 1 “Evaluated Quantity” (EQ). The proposed Year 2 Unit Price will be multiplied by the difference between the CLIN Maximum Quantity and the Year 1 EQ. The product of these two calculations will be added together to derive the Total Evaluated CLIN Amount.
3. Price Evaluation Preference for HUBZone Small Businesses per 52.219-4, Notice of Price Evaluation Preference for HUBZone Small Business Concerns (Deviation 2020-O0008)(MAR 2020) will be applied, when applicable, to the sum of D.1 and D.2. This step adds 10% to all offers except HUBZone Small Business concerns that have not waived the evaluation preference and otherwise successful offers from Small Business concerns.
4. The Total Evaluated Price will be the sum of all First Article CLIN total amounts (D.1) plus the sum of the total evaluated CLIN amount for all Production CLINs (D.2), plus the Price Evaluation Preference for HUBZone Small Businesses (D.3).
Evaluation of prices for Ordering Period 2 shall not obligate the Government to place orders in that ordering period.
The Government may determine that an offer is unacceptable if the prices in Ordering Period 2 are significantly unbalanced.
Example: Total Evaluated Price
CLIN Description Quantity* Unit Price Total Amount 4000 First Article, Unit A 3 $150.00 $450.00 5000 Production, Unit A 53 $126.33 $6,695.49 6000 First Article, Unit B 3 $150.00 $450.00 7000 Production, Unit B 350 $138.13 $48,345.50
Subtotal: $56,615.99 Price Evaluation Preference for HUBZone Small Businesses (10%) $5,561.60
Total Evaluated Price: $62,177.59
* Quantity is the quantity identified in Section B for First Article CLINs, and the EQs for the
Production CLINs.
The EQs in no way restrict the Government as to the number of units it may order under each line item. EQs are used solely for evaluation purposes. The Government reserves the right to order any quantity up to the maximum quantity per CLIN identified in Section B.
E. Proposed prices will be compared to the Government estimate, other offers received, and/or other independent price and cost information. No award will be made at other than fair and reasonable prices.
