Section M - Evaluation Factors for Award

SECTION M

EVALUATION FACTORS FOR AWARD

M.1 Basis for Award

M.1.1 This procurement will be conducted in accordance with RFO 12. The award resulting from this solicitation will be a Firm Fixed Price (FFP) purchase order.

M.1.2 The Government will award a purchase order resulting from this solicitation to the responsible offeror whose quote, conforming to the solicitation, will be most advantageous to the Government, based on the lowest evaluated price of quotation meeting or exceeding the acceptability standards for the non-cost factor.

M.1.3 The Government intends to award this purchase order without discussions. Therefore, the Offeror's initial quote should contain the Offeror's best terms from a cost or price and technical standpoint. Notwithstanding this intent, the Contracting Officer reserves the right to conduct discussions, a matter within his/her discretion. Should discussions be necessary, the competitive range will be established based on the evaluation process described in Section

M.1.4. The competitive range will comprise the lowest-priced quotations that are the most likely to be made acceptable and be selected for award. The Government may limit the number of quotations in the competitive range to the greatest number that will permit an efficient competition.

M.1.5 To streamline the evaluation process, the Government will first rank all timely received quotes by total evaluated price, from lowest to highest.

Only the three lowest-priced quotes will be evaluated for technical and past performance acceptability. If the lowest-priced quote among these three is determined to be technically acceptable, it will be considered for award, and no other quotes will be evaluated.

M.1.6 If the lowest-priced quote is found to be technically unacceptable, the Government will then evaluate the next lowest-priced quote for technical acceptability. This process will continue with the remaining quotes in the competitive range (the three lowest-priced) until a quote is judged technically acceptable and eligible for award. The Government reserves the right to evaluate more than the three lowest-priced quotes if it is determined to be in the Government's best interest.

M.2 Evaluation Factors

M.2.1 Quotations will be evaluated under the following factors:

a. Factor I - Technical

b. Factor II - Past Performance

c. Factor III - Price

M.2.2 The Government will evaluate the technical proposals of the three lowest-priced offerors on a pass/fail basis. To be rated "Technically Acceptable," the proposal must show a clear understanding of and compliance with all requirements in Section C, Attachment 1, and Attachment 2.

Proposals that fail to demonstrate understanding and compliance with any material requirement will be rated "Unacceptable."

M.3 Factor I - Technical

M.3.1 The Government will evaluate the technical proposals of the three lowest-priced offerors on a pass/fail basis. To be rated "Technically Acceptable," the proposal must show a clear understanding of and compliance with all requirements in Section C, Attachment 1, and Attachment 2.

The Government will evaluate the extent to which the quotation demonstrates the ability to furnish supplies conforming to Section C, Attachment 1, and Attachment 2.

M.3.2 Technical evaluation areas will include:

a. Product conformance

b. Artwork/customization conformance

c. Quality assurance

d. Delivery capability

M.3.3 Product Conformance The Government will evaluate whether the quotation demonstrates compliance with Section C and Attachment 1, including required item type, size, color, sleeve length, quantity, fabric requirements, and item descriptions.

For chef coats and chef cargo trousers, the Government will evaluate whether the quotation identifies an acceptable FR fabric and demonstrates conformance with the applicable chef-coat and cargo-trouser salient characteristics.

For T-shirts, the Government will evaluate conformance with the specified cotton composition, weight, collar, sleeve-length, color, and customization requirements.

M.3.3.1 FR Fabric Compliance

The Government will evaluate whether the Offeror identified the specific proposed FR fabric for each applicable item and provided supporting documentation sufficient to demonstrate compliance with Section C. Failure to identify the proposed FR fabric or provide required supporting documentation may result in a rating of Unacceptable.

M.3.3.2 Domestic-Source Documentation

The Government will evaluate whether the Offeror submitted the required domestic-source certifications and documentation identified in Section L.

The Contracting Officer will determine compliance with applicable domestic-source requirements.

M.3.4 Artwork/Customization Conformance The Government will evaluate whether the quotation demonstrates the ability to apply required artwork and text using authorized methods, including direct embroidery, sewn embroidered patches, or screen printing, as applicable. Direct-to-film heat-applied transfers are not acceptable.

M.3.5 Quality Assurance The Government will evaluate the adequacy of the Offeror's approach for ensuring defect-free and conforming delivered items. The quality assurance approach shall address inspection for fabric conformance, garment size and color, chef-coat and cargo-trouser salient characteristics, artwork/text accuracy, placement, application quality, workmanship, and packaging protection.

M.3.6 Delivery Capability The Government will evaluate whether the Offeror's delivery approach demonstrates the ability to meet the solicitation's required delivery schedule. If partial deliveries are proposed, the Government will evaluate whether the proposed schedule satisfies the required initial-delivery and final-delivery milestones.

M.4 Factor II - Past Performance

M.4.1 The Government will evaluate the offeror's past performance to determine if it meets the acceptability standards outlined below. Past performance will be evaluated on an Acceptable / Unacceptable (Pass/Fail) basis. The Government's evaluation will focus on the degree to which the offeror's past performance record demonstrates its capability to successfully perform the purchase order requirements.

M.4.2 Evaluation Aspects

The past performance evaluation will assess two aspects of the offeror's history:

Recency and Relevance: To be evaluated, an offeror's past performance must be recent (performed within the last three [3] years from the solicitation release date) and relevant (similar in scope, magnitude, and complexity to the requirement for manufacturing, customizing, and delivering textiles or military/crew uniforms).

Quality of Performance: The Government will evaluate the quality of the offeror's performance on those recent and relevant contracts, focusing on areas such as:

Conformity to technical specifications and quality standards.

Adherence to delivery schedules and timelines.

Business relations and customer satisfaction.

M 4.3 Past Performance Ratings

Proposals will be evaluated and assigned one of the following ratings for the Past Performance factor:

- Acceptable (Pass) - Based on the offeror's performance record, the Government h as a reasonable expectation that the offeror will successfully perform the required effort, or the offeror lacks a record of relevant past performance.

- Unacceptable (Fail) - Based on the offeror's performance record, the Government does not have a reasonable expectation that the offeror will successfully perform the required effort due to documented problem with quality, delivery, or business relations.

M.4.4 Offerors with No Past Performance (Neutral Rating)

In the Case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror will not be evaluated favorably or unfavorably on past performance.

- An offeror with no past performance will receive a rating of "Neutral."

- For the purpose of this LPTA evaluation, a Neutral rating is deemed Acceptable and represents a Pass

3.

4.

M 4.5 Sources of Information

The Government reserves the right to obtain past performance information from any source available, including but not limited to:

- The supplier Performance Risk System (SPRS)

- The Contractor Performance Assessment Reporting System (CPARS)

- Other federal, state, or local government agencies, and commercial sources

M.5 Factor III - Price

M.5.1 The Government will evaluate price for completeness, reasonableness, and balance.

M.5.2 The Government will evaluate the total quoted price for all CLINs. The total evaluated price will be the sum of all CLIN lot prices.

M.5.3 The Government may also consider whether the quotation adequately prices the full scope of Attachment 1 and Attachment 2 requirements.

M.6 Award Decision

M.6.1 Basis for Contract Award

This is a Lowest Price Technically Acceptable (LPTA) source selection. Award will be made to the responsible offeror whose proposal represents the lowest evaluated price, is rated Acceptable (Pass) in both Factor 1 (Technical) and Factor 2 (Past Performance), and whose price is determined to be fair and reasonable.

To be eligible for award, a proposal must receive a rating of Acceptable (Pass) in both non-price factors. Proposals rated Unacceptable in either Technical or Past Performance will not be considered for award.

M.6.2 Evaluation Process (Evaluation of Lowest Three Quotes)

The Government will evaluate proposals using the following phased procedure:

Step 1: Price Ranking. The Government will rank all received proposals from lowest to highest based on Total Evaluated Price (inclusive of all CLINs).

Step 2: Non-Price Evaluation (Lowest Three Quotes). The Government will evaluate the non-price proposals (Factor 1 - Technical and Factor 2 - Past Performance) of the three (3) lowest-priced offerors first:

Factor 1 (Technical): Evaluated on an Acceptable / Unacceptable basis against the standards defined in Section M.3.

Factor 2 (Past Performance): Evaluated on an Acceptable / Unacceptable basis (with a Neutral rating deemed Acceptable) against the standards defined in Section M.4.

Step 3: Fair and Reasonable Price Determination. Following the non-price evaluation, the Contracting Officer will evaluate the proposed prices of the technically/past performance acceptable offerors to determine price reasonableness pursuant to FAR 15.404-1. Adequate price competition among the acceptable offerors will serve as the primary basis for establishing a fair and reasonable price.

Step 4: Award Selection.

Award will be made to the offeror with the lowest evaluated price among those found Acceptable in both Technical and Past Performance, provided their price is determined to be fair and reasonable.

If none of the initial three lowest-priced offerors are found Acceptable in both factors, or if their prices cannot be determined fair and reasonable, the Government reserves the right to evaluate the next lowest-priced proposal(s) sequentially (for Technical, Past Performance, and Price Reasonableness) until an awardable quote is identified.

M.6.3 No Tradeoffs

Award will be made strictly on the basis of the lowest evaluated price meeting the acceptability standards for Technical and Past Performance and being determined fair and reasonable. No tradeoffs will be made. The Government will not pay a price premium or select a higher-priced offeror for exceeding the minimum acceptability standards.
