SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS

The following have been added by full text:

INDUSTRY QUESTIONS & ANSWERS 2

N00164-15-R-WM61 Questions – Amendment 3

1. Wirth respect to the Cost worksheet "Att3 - Prime_Cost_Summary_Format" has a worksheet titled "LOE Breakdown". Assuming and recognizing the hours for each fiscal year not level spread across the five years, will a "LOE Breakdown" worksheet be required for each fiscal year or are offerors to use one "LOE Breakdown" spread sheet which would represent the total contract LOE for all five fiscal years?

Response: Offerors are required to submitt an LOE Breakdown workshet for each fiscal year and on LOE Breakdown summary worksheet.

2. With respect to the Cost worksheet "Att3 - Prime_Cost_Summary_Format" which requires calculations for Overtime burdened to populate the worksheet "Overtime". LOE tables on page 6 of the RFP don't address overtime hours. Please advise which hours should be bid as Overtime.

Response: For the purposes of submitting proposals for this solicitation, the number of overtime hours shall be zero (0). Overtime will be addressed at the task order level.

3. With respect to Lot 1 and Lot 2, how is the $25M in ODCs cited on page 128 of the solicitation spread across the Lots?

Response: CNIN-M-0002 – Standards for Evaluation, Factor 5 – Cost, (d) and (f) have been amended to include the breakdown of estimated costs for Lot 1 and Lot 2 over the Fiscal Years.

4. With respect to Lot 1 and Lot 2, how is the $25M in ODCs cited on page 128 of the solicitation spread across the fiscal years?

Response: CNIN-M-0002 – Standards for Evaluation, Factor 5 – Cost, (d) and (f) have been amended to include the breakdown of estimated costs for Lot 1 and Lot 2 over the Fiscal Years.

5. What is the composition of the $25M in ODC cited on page 128 of the solicitation (i.e., will the government define the value of material and travel, etc.; does the government expect offerors to define the value of material and travel)? If the government expects offerors to define travel costs, the offeror's bid would be most accurate if OCONUS locations were defined and clarified by the government.

Response: CNIN-M-0002 has been amended to include the breakdown of the estimated costs of ODC’s between Travel and Incidental Materials.

6. Is the government aware that ~ 28% of the labor hours are set aside for AIT work and ~ 72% of the labor hours have been set aside for Engineering? The statement of work reads as if the majority of the work is AIT, thus, the labor hours set aside in the solicitation for AIT work should be a higher percentage of the overall solicitation labor hours?

Response: The Government has re-evaluated the estimated allocation of labor hours for the LOE tables located in Section B for Lot 1 and Lot 2. Refer to Section B for the Government response.

7. In Section M, l) Summary of Factors and Subfactors are: “FACTOR 1 - QUALITY PLANS AND

INSPECTION PROCEDURES, APPROVED NAVSEA 04 QUALITY MANAGEMENT SYSTEM,

ENVIRONMENTAL PROTECTION PROCEDURES.” Request that the words “ENVIRONMENTAL PROTECTION PROCEDURES” be removed from the FACTOR 1 title, as there is no requirement for separate ENVIRONMENTAL PROTECTION PROCEDURES within the RFP.

Response: “ENVIRONMENTAL PROTECTION PROCEDURES” has been removed from Section M, 1) Summary of Factors, FACTOR 1.

8. In Section L, Factor 4 – Management Approach, Subfactor D Personnel, it states that offerors submitting proposals for both the unrestricted LOE and the SBSA LOE will need to submit separate resumes in support of each LOE. Please confirm that if the LOE for both LOTS does not equate to a full time equivalent, that the resume provided can be for the same person and it will not result in a reduced evaluation rating. For example, the Site Foreman has 450 hours in the FY16 Unrestricted and 150 hours in the SBSA.

Response: Each proposal submission will stand alone. Vendors will not be penalized for using the same resume for each submission.

9. Please provide the anticipated award date for pricing consistency purposes.

Response: See Section L(I)(a)

10. Please provide the qualifications/description for the Electronic Technician labor category.

Response: Qualifications/description for the Electronic Technician labor category have been added to Section C..

11. The HVAC Technician was referred to under Trade Personnel labor categories, but does not have any LOE in Section B. Please clarify.

Response: The HVAC labor category has been deleted from the Trade Personnel labor category in Section C.

12. Offeror requests that Laborer is added to the list of Trade Personnel, along with corresponding LOE.

Response: The Government has added the labor category of “Laborer” to the Trade Personnel section of Key – Non-Key personnel in Section C.

13. Please confirm, per Section M, that the ODC amount to bid is $25,440,000? Is this amount the same for each LOT, i.e., Unrestricted and SBSA? Should the offeror divide this amount equally amongst each of the option years?

Response: ODC’s have been broken down into more detail within this amendment.

14. Please clarify the percentage of LOE to be proposed per location (Norfolk, VA and San Diego, CA) for pricing consistency purposes.

Response: For proposal purposes with regard to this solicitation, contractors shall assume the ShipAlt services will be performed at Norfolk, VA.

15. Due to several clarifying questions that affect the offerors pricing, proposal writing efforts, and then time for mailing the proposals, an extension of the due date to 16 April 2015 is respectfully requested.

Response: RFP will be extended to 16-APR-2015.

16. The Senior Engineering Tech and QA Technician are provided in the LOE tables in Section B; however, there is no description provided in Section C. Please clarify.

Response: Qualifications/description for the Senior Engineering Tech and QA Technician labor categories have been added to Section C.

17. The CAD Designer description is provided in Section C; however, there is not any LOE in the Section B tables. Please clarify.

Response: CAD Designer labor description has been removed from Section C.

18. The level of effort specified in the table on page 6 of the RFP appears to be skewed toward engineering rather than the shipboard industrial work anticipated to be the focus of this contract. There are over 11,000 hours in the base year allocated to engineers and only 4,000 hours allocated for the 11 categories of industrial trades that will perform the installations. Only 450 hours are allocated for the site foreman who is required to be on site during each installation. Request the government redistribute the level of effort to provide sufficient trade labor to perform the work.

Response: The Government has re-evaluated the estimated LOE labor hours required for this solicitaion and has been updated in Section C by this amendendment (Amendment 3).

19. The level of effort specified in the table on page 6 of the RFP is heavily weighted toward expensive engineering disciplines as opposed to lower cost tradesmen. The resulting offers will be significantly more expensive than would be expected for a contract for this type of work. Recommend the government redistribute the level of effort to better reflect the type of work to be performed and the anticipated costs for that work.

Response: The Government has re-evaluated the estimated LOE labor hours required for this solicitaion and has been updated in Section C by this amendendment (Amendment 3).

20. In amendment 0002, response 9 states that the Government is requesting offerors submit other than certified cost or pricing data, but the solicitation still contains the requirement for the proposal adequacy checklist, DFARS 252.215-7009. DFARS 215.408 (5) states, “When the solicitation requires the submission of certified cost or pricing data, the contracting officer should include 252.215-7009, Proposal Adequacy Checklist, in the solicitation to facilitate submission of a thorough, accurate, and complete proposal.”

Since certified cost or pricing data is not requested, request that DFARS 252.215-7009 be removed from the solicitation. In order for us to provide a compliant proposal, request that the Government modify clause FAR 52.215-20 to FAR 52.215-20 Alt IV in order to clarify that the Government only requires other than cost or pricing data. Without the alternate form of this clause, we must comply with 52.215-20(b), which states, “The offeror shall prepare and submit certified cost or pricing data, data other than certified cost or pricing data, and supporting attachments…”

Response: The Government is not requesting certified cost and pricing data due to sufficient competition.

DFARS 252.215-7009 has been removed from the solicitation. FAR 52.215-20 has been updated to FAR 52.215-20 Alt IV.

21. Factor 3 – Past Performance. In Clause CNIN-L-0002, Proposal Requirements – Best Value, there is a requirement under Factor 3 – Past Performance, subparagraph (d), in the last paragraph on page 110:

“Offerors shall provide an outline of how the effort required by the solicitation will be assigned for performance within the contractor’s corporate entity and among proposed subcontractors.” It is not clear why this outline would be required in the writeup for each of up-to-five past performance references.

Should the sentence quoted above be part of Factor 4 – Management Approach, Subfactor E:

Subcontracting, rather than as part of the Past Performance requirements?

Response: “Offerors shall provide an outline of how the effort required by the solicitation will be assigned for performance within the contractor’s corporate entity and among proposed subcontractors” has been moved to CNIN-L-0002 – Factor 4 – Subfactor E - Management Approach.

22. Section M – Evaluation Factors for Award. In Clause CNIN-M-0002, Best Value Evaluation (Jun 2014), subparagraph (l), Summary of Factors and Subfactors on page 123, Factor 1 is described as “Quality Plans and Inspection Procedures, Approved NAVSEA 04 Quality Management System, Environmental Protection Procedures.” However on page 108 the title of Factor 1 and its following paragraph of requirements make no mention of addressing environmental protection procedures. Does the government intend for offerors to address environmental protection procedures in their response to Factor 1?

Response: No

23. The posting on FBO states that it is NAICS 541330. The RFP, page 80, Annual Reps and Certs, says the

NAICS is 334511 and also states that the size standard is 500

Response: The NAICS code for clause 52.204-8 is 541330. This amendment (Amendment 3) hereby changes the NAICS code for this solicitation to 541330.

24. Amendment 0002 revised Section M, Factor 5, paragraph (d) to read "(d) The Government estimates total

ODCs for this MAC are $712,500 for CLIN 0003 (Lot 1) and $237,500 for CLIN 0004 (Lot 2). ODCs should be proposed as prescribed in Section L. ODC estimates do include indirect burdens.” Section L, Factor 5, Other Direct Costs, paragraph 1. (page 117) specifies “The proposed amount for CLINs identified as Other Direct Cost (ODC) CLINs in Section B, shall include the estimated base amount and the offeror's proposed markup costs…” Is it the government’s intention that the offeror’s indirect burdens are to be added to the government’s estimated base amount?

Response: Yes

52.215-20 REQUIREMENTS FOR CERTIFIED COST OR PRICING DATA OR INFORMATION OTHER

THAN CERTIFIED COST OR PRICING DATA (OCT 2010)—ALTERNATE IV (OCT 2010)

(a) Submission of certified cost or pricing data is not required.

(b) Provide data described below:

1. Is there a Government forward pricing rate agreement (FPRA)? If so, the offeror shall identify the official submittal of such rate and factor data. If not, does the proposal include the basis for those rates and factors?

2. Is there a price/cost analysis establishing the reasonableness of each of the proposed subcontracts included with the proposal? If the offeror’s price/cost analyses are not provided with the proposal, does the proposal include a matrix identifying dates for receipt of subcontractor proposal, completion of fact finding for purposes of price/cost analysis, and submission of the price/cost analysis?

3. Does the proposal indicate the basis of estimate for proposed indirect costs and how they are applied? (Support for the indirect rates could consist of cost breakdowns, trends, and budgetary data.)
