Any hazardous material, as defined in FED-STD- 313E, which may be used in, supplied with, or required in support, as it applies to end items procured herein, and not the manufacturing process, shall be approved by the Contracting Officer prior to the Contractor incorporating that material into the end item (e.g. hardware component). Prior to approval, the Contractor shall submit a Hazardous Materials Management Program (HMMP) Report (CDRL A001) to the Government, which identifies all hazardous material and written justification that shows the necessity for the type, container size, and quantity of hazardous material (or material that results in hazardous waste) together with a listing of less hazardous potential substitutes that were considered and the reasons why these substitutes cannot be used. The submittal shall also include a Material Safety Data Sheet (MSDS) (Occupational Safety and Health Act (OSHA) Form 174) for all material listed in the report, other than those items identified prior to contract award as required by FAR Clause 52.223-3 listed in Contract Section I.

Order of precedence for Contracting Officer approval is:

a. Non-hazardous material.

b. Material that is recyclable.

c. Material that results in hazardous waste that can be treated to reduce it to a non-hazardous state.

Pertinent data and precautions from the material safety sheets shall be provided in all associated manuals and documentation delivered with the components procured herein. All hazardous materials containers must be labeled in accordance with MIL-STD-129, the Occupational Safety and Health Administration Standard, Code of Federal Regulations Title 29 Part 1910.1200, and applicable Environmental Protection Agency and Department of Transportation requirements. The use of any hazardous material by the Contractor shall require Government approval prior to use through HAZMAT material Request for Variance (RFV).

In the event of the development of new LRUs that require NSN assignment and newly identified hazardous material, the Contractor shall provide an updated MSDS (OSHA Form 174) and written justification to the Government, for informational purposes only, describing the necessity for use internally or in association with the DMR Radio Set.
