Block 10H: Foreign Government Information (FGI):
All United Kingdom (UK) foreign government information (FGI) shall be protected in accordance with US-UK Polaris Sales Agreement (PSA) security requirements {and the UK Security Classification Guide: “CSSE UK TRIDENT PROGRAMME CLASSIFICATIONS FOR U.S. USE,” signed in March 2018}. Classified UK FGI shall be protected in the same manner as US classified military information (CMI). In 2014, the UK modified its security classification markings. In accordance with "Information Security Oversight Office (ISOO) Notice 2014-03: Protection of Information Shared by the Government of the United Kingdom (August 27, 2014)," “UK Official” information will be protected in the same manner as U.S. controlled unclassified information (CUI). Until CUI is implemented in the U.S., such information shall be protected as For Official Use Only (FOUO). Therefore, legacy documents marked as "United Kingdom RESTRICTED," as well as new UK documents marked as "OFFICIAL - SENSITIVE" and/or "OFFICIAL-SENSITIVE PSA," shall be protected and safeguard as CUI/U.S. FOUO information. Note that this guidance does not require documents with these markings to be remarked as U.S. FOUO; the requirement is to protect and safeguard this UK information in the same manner that U.S. FOUO is protected. NOTE: ONLY USE BRACKETED LANGUAGE IF BRANCH HAS ALREADY CERTIFIED THE CONTRACTOR'S "NEED-TO-KNOW" for UK SCG.
BLOCK10.J. CONTROLLED UNCLASSIFIED INFORMATION (CUI) - The NISPOM does not currently address requirements for CUI. GCA guidance for handling/protecting CUI is as follows:
For Official Use Only (FOUO) information:
FOUO: Electronic Transmission of SSP Controlled Unclassified Information (CUI) will be protected and handled under SSPINST 5230.11.
FOUO only applies to UNCLASSIFIED information that may be exempt from mandatory release to the public under exemptions 2 through 9 of the Freedom of Information Act (FOIA). Only the originator or other competent authority shall determine if the information qualifies to be designated FOUO or not. DoD contractors are responsible for handling and protecting FOUO information per DoDM 5200.01, Vol. 4, DoD Information Security Program: Controlled Unclassified Information, of 24 Feb 2012.
Unclassified documents containing FOUO information shall be marked “FOR OFFICIAL USE ONLY” at the bottom, on the outside of the front cover (if any), and on each page containing FOUO information, on the back page, and on the outside of the back cover (if any). Individual paragraphs that contain FOUO information shall be marked “(FOUO)” at the beginning of the paragraph. Mark other records, such as computer printouts, photographs, films, tapes, slides, etc. “FOR OFFICIAL USE ONLY” or “FOUO” in a way that insures the recipient or viewer knows the records contain FOUO information.
FOUO information may be transmitted within and between DoD agencies, DoD contractors, consultants and grantees as necessary in the conduct of official business. FOUO documents and material may be transmitted via first class mail, parcel post or for bulk shipments, fourth class mail. Electronic transmission of FOUO information (voice, data, or facsimile) should be via approved secure communications systems whenever practical. Facsimile communications marked FOUO may be transmitted by nonsecure terminals, upon verifying the identity of the recipients, with the FOUO marking intact between U.S. DoD and other U.S. Government agencies, and U.S. Government support contractors for official purposes.
During working hours, reasonable steps should be taken to minimize risk of access by unauthorized personnel. After working hours, FOUO information shall be stored in unlocked containers, desks or cabinets if Government or Government-contract building security is provided or in locked desks, file cabinets, bookcases, locked rooms or similar items.
When no longer needed, FOUO documents may be destroyed by shredding or tearing into pieces to preclude reconstructing and placing in a regular trash container. The destruction of FOUO information related to this contract will be IAW with requirements established for destruction of sensitive, unclassified information.
Unauthorized disclosure of FOUO information does not constitute a security violation but the releasing agency shall be informed of any unauthorized disclosure. DoD contractor personnel have a duty to take reasonable actions to protect FOUO records under their control from unauthorized disclosure. Appropriate administrative actions should be taken to fix responsibility for such disclosures and disciplinary actions taken where appropriate. Unauthorized disclosure of FOUO information protected by the Privacy Act (PA) may result in civil or criminal sanctions.
BLOCK 11.L. RECEIVE, STORE, OR GENERATE CONTROLLED UNCLASSIFIED INFORMATION (CUI):
The NISPOM does not address requirements for CUI. SSP CUI material, including electric transmission thereof, will be protected and handled under SSPINST 5230.11. Protection of FOUO is covered under guidance provided in Block 10.J.
BLOCK 11.M. OTHER: Debriefing Before an employee departs, the contractor will ensure the employee is properly debriefed by the FSO or SSP Security Specialist, as appropriate, and returns all badges. Failure on the part of the contractor for not ensuring their employee is properly debriefed will result in a security violation against the company.
OTHER GUIDANCE FOR HANDLING AND PROTECTING:
Use of Couriers, Hand-Carriers. Per NISPOM 5-410, Contractors designating cleared employees as couriers or hand carriers must ensure:
a) They are briefed on their responsibility to safeguard information; b) They possess an identification card or badge which contains the contractor's name and the name and a photograph of the employee; c) Employee retains classified material in his or her possession at all times. Arrangements will be made in advance of departure for overnight storage at a U.S. Government installation or at a cleared contractor's facility that has appropriate storage capability, if needed; d) If the classified material is being hand-carried to a classified meeting or on a visit, an inventory of the material must be made prior to departure. A copy of the inventory will be carried by the employee. Upon the employee's return to the facility, an inventory shall be made of the material for which the employee was charged. SECRET is the highest level that can be carried OUTSIDE of the U.S. GCA can define, whether through SOP or codifying directive, the requirements for accomplishing the above.
DESIGNATION OF IT LEVELS - Contractor Information Technology (this typically applies to IT service contracts only): Personnel occupying Information Systems Positions designated IT-1, IT-2, and IT-3. DoD military, civilian personnel, consultants, and contractor personnel performing on government automated information systems may be assigned to one of three position sensitivity designations (in accordance with Appendix 10 of DoD 5200.2-R, Personnel Security Program) and MINIMALLY investigated as follows:
IT-1 In-scope T5/T5R IT-2 In-scope T3/T3R IT-3 In-scope T1
DISCLOSURE OF CLASSIFIED DATA CLAUSE (DISSEMINATION OF CLASSIFIED MATERIALS). Please note, disclosing classified information to other agencies/contractors is not an "automatic." There must be a need-to-know, and the agencies/contractors need to be vetted. Prior approval from GCA is required before this clause is added to any DD254.
a. The Contractor shall ensure that classified information is disclosed only to authorized persons in accordance with the National Industrial Security Program Operating Manual (NISPOM) dated February 28, 2006, Section 5, Disclosure, 5-500, 505, 506, 509.
b. Strategic Systems Programs (SSP), as the Government Contracting Activity (GCA), has authorized the following DoD contractors, DoD Activities, and Federal Agencies to receive SSP information from the Contractor's cleared facilities and cleared personnel (employees, contractors, subcontractors) as required for the performance of contracts or task orders issued by SSP. See list below.
c. Should it become necessary during the performance of this contract to release classified information to an entity other than those listed in this clause, the Contractor shall submit a written request to the Procuring Contracting Officer (PCO) explaining why access is necessary for the performance of task orders or services essential to the fulfillment of a contract. The PCO will confirm with the Contracting Officer's Representative (COR) or Task Order monitor and modify the contract/task order accordingly.
