Question #Question Source: (RFP, attachment #,
GFI title, etc.)Page number and paragraph header from
source:QuestionAnswer
1--Will the Government provide an extension to the proposal due date of June 15, 2022?The Government does not anticipate providing an extension to the proposal due date.
2Attachment 2, TDPN/AIndustry cannot develop a complete bill of materials or kick off supply chain quoting efforts until additional GFI is provided and understood. As an example, NAVSEA 8652163, Rev C, NOR 004 is lacking the following information, which is needed to respond to this RFP:

• Mk 41 Mod 37 VLS definition for CLINs 0005AA, 0006AA, 0104-0105AA, 0204-0205AA, 0304-0305AA, 0404-0405AA

• Mk 41 Mod 49 VLS definition for CLINs 0040AA, AB & AC

• Mk 41 Mod 48 VLS definition for CLINs 0130AA, AB, AC & AD

As stated in Section C of the RFP, the MK 41 MOD 37, 48, and 49 deliverables consist of the parts listed in NAVSEA Parts List 8652163 and the parts listed in Attachment 1, Appendix A. The contractor will not assemble the MK 41 MOD 37, 48, or 49 into the final form that it will have aboard ship, but will instead deliver the listed parts. Thus, there is no need for a higher level drawing of how those parts will be connected together at the shipyard because that is not the responsibility of the contractor for this procurement. The TDP includes all data necessary for industry to propose, assemble, test, and deliver those parts listed in NAVSEA Parts List 8652163 and the parts listed in Attachment 1, Appendix A. However, if an offeror finds that there are any missing drawings related to the parts, please notify the Government as soon as possible during the question period of this solicitation.
3Attachment 1, SOW VLSPage 30, paragraph 21.1Will the Government consider updating the language within the RFP to eliminate or reduce the ISO 14000 requirements in the Environmental Regulations section of the SOW?Yes. Amendment 0001 updates Attachment 1, paragraph 21.1. to delete the requirement for contractors and subcontractors to comply with ISO 14000 requirements.
4RFP, Section IPage 192, DFARS Clause 252.225-7019 Restriction on Acquisition of Anchor and Mooring ChainDoes this contract require welded shipboard anchor or mooring chain four inches or less in diameter as prescribed in 225.7007-3?No. Amendment 0001 updates the RFP to delete clause 252.225-7019.
5RFP, Section IPage 192, DFARS Clause 252.225-7026 Acquisition Restricted to Products or Services from AfghanistanDoes DFARS clause 252.225-7026 apply to this contract? No. Amendment 0001 updates the RFP to delete clause 252.225-7026.
6RFP, Section CPage 126The Section C description for Item 0130 lists SLIN 0130AD but this SLIN is not identified anywhere else in the RFP or attachments (Section B, Section F, Attachment J-S6).Amendment 0001 deletes the Section C reference to SLIN 0130AD.
7RFP, Section F and Attachment J-S6Section F, Page 153-260There are discrepancies between Section F and Attachment J-S6.Amendment 0001 updates Section F to eliminate the discrepancies.
8RFP-Will the Government consider adding an Economic Price Adjustment (EPA) clause for labor and/or material (such as steel)? The Government is considering this question.
9Attachment 1, SOW VLSPages 4-5, pragraph 4.2Why is the Spectrum 9100 included as GFE?Amendment 0002 updates the SOW and the GFP list to remove references to the Spectrum 9100.
10Attachment 1, SOW VLSPage 23, paragraph 18.3The statement of work requires weekly management meetings via teleconference regarding production status and delivery. Would the Government consider changing the frequency of these meetings and related CDRL (A014) from weekly to as required? No, the Government does not intend to change the weekly management meeting requirement.
11Attachment 1, SOW VLSPage 4, paragraph 4.0The Statement of Work states "Installation Assembly, MK 41 MOD 36 VLS parts list PL8407395 indicates the quantity for several parts as AR (as required)". The contractor is not required to procure or deliver any part that has an AR quantity designation". Does this statement apply to the quantities for several parts outlined in the FMS configuration drawing 8652163?Yes. Amendment 0002 has been updates the SOW to reference NAVSEA Parts PL 8652163.

Attachment 5 - Production Readiness Review Plan Page 122 Section C - (Item 0011 - Production Readiness Review)

Pages 2-18 Attachment 5

Within Section C of the RFP, the Production Readiness Review Plan is called out as Attachment 5, however, the headers in attachment 5 (Pages 2 through End) refer to it as Attachment 6. Will the Government clarify which Attachment identification is correct?Amendment 0002 corrects the headers of Attachment 5.
12RFP, Section LPage 237, paragraph 2.3The RFP states that text will be 12-point Times New Roman font and graphics will be no smaller than 8 point font, without specifying the font type. Would the Government allow art and tables for this proposal with the font size 8pt and variable font type? There is no font type requirement for graphics, just the font size minimum of 8 points.

14Attachment 10, GFP List-The USE AS-IS column has "true" marked in every cell for every item of GFP being provided. Request all "true" markings be changed to "false" markings or remove the USE AS-IS column.Amendment 0002 updates the GFP list so that the USE AS-IS column is "false" marked in every cell. It is the Government's intention to provide functioning GFP, not GFP in "use as-is" condition.
15Attachment 17, Step Ladder Pricing-In Attachment 17 Step Ladder Pricing, how will the upper quantity (Column G) be used to evaluate proposed pricing?Column G - Upper Quantity is not used to evaluate proposal pricing. See Section M, 2.3.1.1, which describes how FFP Stepladder CLINs are evaluated using random quantities.
16Attachment 17, Step Ladder Pricing-Will the government clarify what amount totals should go into Column H of the Attachment?Amendment 0002 updates Attachment 17 to include a description of how Column H is calculated. Columns G and H exist for the convenience of the Government during contract execution. Taken together, they show the upper quantity and maximum price if the stepladder CLIN is fully exercised. However, as stated in Section M, 2.3.1.1, proposal evaluation is conducted using random quantities.
17RFP, Section LPage 238, paragraph 2.3Section L restricts the proposal response to 25 total foldouts. Does the 25 page total foldout restriction apply to the non-price volumes only? If not, would the Government be willing to amend Section L instruction as to allow the Price volume to contain unlimited foldout pages?Yes. Amendment 0002 updates Section L to permit unlimited foldout pages in the price volume.
18RFP, Attachment J-S3Page 117 Section B; Page 244 Section L
Para 3.4.2.3; Attachment J-S3Section B, Page 117 and Section L, Paragraph 3.4.2.3 lists 2,500 hours for CLIN 0014, whereas Attachment J-S3 CLIN Pricing shows 25,000. Would the Government confirm the correct amount of hours for CLIN 0014?Amendment 0002 updates Attachment J-S3 to correct the hours for CLIN 0014 from 25,000 to 2,500.
19Attachment 2, TDP-Please clarify or provide the missing data. NAVSEA 8652163, Rev E, NOR 9 has been provided, and this data has defined the list of parts required for Mk 41 Mod 37 and Mk 41 Mod 49 Launches. However, this data does not include the Mk 41 Mod 48 Launcher, so it is not clear what 8652163 parts are required to comply with Section C. Is there a missing NOR for drawing 8652163 or can the Government confirm which 8652163 dash number kit is required for the Mk 41 Mod 48 Launcher?Amendment 0003 provides NOR 10 for NAVSEA 8652163, which specifies the configuration for MK 41 MOD 48.
20RFP-Will the Navy provide a 4 week extension to the response period?Amendment 0003 extends the proposal due date to 1 July 2022.
21Exhibit A-B CDRLs-Various CDRLs DID numbers seem to be outdated. Can the Navy provide updated DID numbers?Yes. Amendment 0003 updates Exhibits A-B to provide new DID numbers for A001, A006, A008, A010, A011, A012, A016, B001, and B002.
22RFPPage 226As prescribed in 34.203 (a) solicitations for contracts that require the contractor to use an Earned Value Management System (EVMS) and for which the Government requires an Integrated Baseline Review (IBR) prior to award shall include a provision substantially the same as the provision at FAR Clause 52.243-2, Notice of Earned Value Management System-Pre-award Integrated Baseline Review. Is it the Government's intention to require the contractor to use an EVMS on this program and does the Government intend to require an IBR prior to award? The Government does not intend for EVMS to apply to this contract. Therefore, clause 52.234-2 , Notice of Earned Value Management System-Pre-Award Integrated Baseline review, has been deleted from N0002422R5325.
23RFPPage 239
3.2 VOLUME II: FACTOR 1: TECHNICAL APPROACH AND CAPABILITY, Element 1: Production in Accordance with the TDPSection L state that schedules shall be provided in MS Project (Native format). Would the Government create a separate Supplemental Volume in which to place the IMP, IMS, WBS in their native format, and referenced by the technical proposal, rather then embedding the image into the technical volume?Amendment 0004 updates Section L to add an Appendix A to Vol II for these items. It will be excluded from the page count.
24Exhibit A-B CDRLsPage 21 (A017)CDRL A017, Integrated Master Schedule directs the use of DID DI-MGMT-81650. This DID was superseded by DID DI-MGMT-81861, released June 2012, which requires the application of Earned Value Management. As the preponderance of this program is FFP, Earned Value Management will provide little benefit to the Government, but drives substantial costs in to the program. Is it the Government's intention to require Earned Value Management on this program? The Government intends to use DID DI-MGMT-80507C for CDRL A017. Amendment 0004 revises Exhibit_A_B_CDRLs to reflect this.
25Attachment 17, Step Ladder Pricing-There is a difference in quantities between Attachment 17 Step Ladder Pricing and the quantities for the same CLINs in Section B and Section F. For CLINs 0128, 1029, 0228, 0229, 0328, 0329 and 0428, 0429 Section B and Section F identify 24 as the max quantities while Attachment 17 has 32 at the top end of step ladder quantities. Section B Note C states that “Option CLINs with stepladder pricing may be exercised until the total quantity purchased equals the maximum quantity listed for that option CLIN in Section B.” What is the correct max quantity for the CLINs identified herein? The maximum quantities for the subject CLINs are 24, not 32. Amendment 0004 updates Attachment 17 to correct the discrepancy.
26RFPSection C page 123, Item 0014 NOTECLIN 0014 is a CPFF CLIN, the NOTE on this CLIN says "Any additional work is the responsibility of the Contractor". This note contradicts the standard operation for CPFF LOE efforts. Is the Government's Note suggesting that a Contractor should work beyond the bound of the LOE CLIN? Based on the anticipation that the hours only covered a portion of the work specified, is the CPFF LOE CLIN appropriate or should this work consumed under the normal FFP work scope? The scope of the CPFF-LOE CLIN will not be increased beyond the number of hours specified in the solicitation. The note clearly states that any such work beyond those hours is the responsibility of the contractor, and that the Government does not intend to provide additional hours beyond those specified in Section B and is out of scope of the CPFF-LOE CLIN.
27RFPSection C page 123 , Items 0013, 0113, 0213, 0313, 0413, 0014The introduction of CPFF CLINs introduces specific delientiaton of work scope between CPFF CLINs and FFP. The SOW is silent regarding fixed price CLINs having any scope overlap with LOE CLINs. How will offerors execute the CPFF scope if CPFF is never awarded or insufficiently funded? The contractor is responsible for integration of the GFP under the FFP CLINs. Integration of GFP will NOT be chargeable to the CPFF LOE XX13 CLINs. The Government is responsible for providing working GFP as specified in Attachment 10 - Government Furnished Property. The purpose of CPFF LOE XX13 series CLINs is to allow the Government, via a TI, to enable the resolution of GFP issues.
28RFPSection C page 123 , Items 0013, 0113, 0213, 0313, 0413, 0014Please confirm scope under CPFF LOE CLINs 0013, 0113, 0213, 0313, 0413 and 0014 are considered complete when the hours are completed. As CPFF LOE CLINs controlled via Technical Instructions, the deliverables are hours, as well as any work specified in the TIs. Offerors are reminded that the Government is under no obligation to exercise the XX13 series CLINs.
29RFPSection B, Section FThere is ambiguity on option exercise ability and delivery dates for the step ladder CLINs. Note C states that the Government may unilaterally exercise a given line item more than once prior to the latest option exercise date. If additional quantities are exercised via new SLINs does each new SLIN with additional quantities receive new delivery dates (ex., 24, 12, or 15 mths AOE) from the date that the SLIN was awarded?Yes. A new SLIN will a receive new delivery date that is calculated based on the exercise date of the new SLIN, NOT on the exercise date of any previous SLIN.
30RFPSection L, paragraph 2.2 Labeling and Packing (Page 234)

RFP Section L, para 2.3 Page Size and Format

(Page 235)For the Price Proposal is it acceptable to provide files and documents in their native format so long as they are readable? Examples include: RFP based documents, Company Small Business Plan, Forward Pricing Rate Proposals and Letters submitted previously to DCMA, DCMA approvals all of which support Cost Realism.Yes. Section L, article 2.3, has been updated to reflect this.
31RFP
Section L, paragraph 1.4With the proposal due date being extended in Amendment 003, will the Government extend the due date for when questions are due?Yes, the due date for questions has been extended to 60 days after the date of the original solicitation.

Requirements for Welding & Brazing, Procedure & Perfromance, Qualification & WS19181 - Process Specification for Fusion Welding of Aluminum Alloys - S9074-AQ-GIB-010/248 and WS19181 list NAVSEA weld certification requirements for fabrication of assemblies. Can Government clarify at what point in time is the NAVSEA welding certifications are required to be 100% met for this Solicitation (i.e. at time of bid submission, at time of award, prior to

any production, or other)? The welders must be properly certified to perform the work. There is no specified requirement for certification before contract award or at time of contract award, but offerors should show how they will achieve certification in time to meet their production schedule.

Attachment 10 GFP correctly lists the PPS as 7104312-39 for CLINs 0003, 0004, 0005, 0006, 0030, 0040, and all applicable Option Items. The applicable PPS will be provided as GFP for all modules.
36RFP, conformed copypage 232, Section L, Article 2.1

PROPOSAL STRUCTURE,

FORMAT, AND PAGE COUNTSPer the RFP the List of Tables and Figures are not exempted from page count. Will the Government
please consider excluding these items from the required page count?Yes. Amendment 0004 revises Section L, article 2.1, has been updated to reflect this.
37RFPSection I Contract ClausesThe RFP includes Foreign Military Sale (FMS) requirements but Section I does not include DFARS 252.215-7014, Exception from Certified Cost or Pricing Data Requirements for Foreign Military Sales Indirect Offsets (JUN 2018), which is necessary due to the inclusion of (Cost / pricing – mod clause). - Paragraph 3.4.2.3.1 appears to be numbered out of sequence and should be listed under Paragraph 3.4.2.3 instead of 3.4.2.4

- Page 246: Paragraph "e" to be moved into 3.4.2.4 and labeled as Paragraph "a"

- Page 246: Paragraph "f" to be relabeled as paragraph "e"

Paragraph 3.4.2.3.2 RATES has been renumbered to be 3.4.2.4.1 RATES. Paragrpahs are now numbered in sequence.
44Attachment J-S3 CLIN Pricing

Attachment J-S6 Attachment 2 - TDP (Drawing: 8652163)

RFP - Section B Various In Attachment J-S3 CLIN Pricing, DDG CLINs show the quantity column in terms of number of modules; however in FFG CLINs for example, the quantity column appears to be in terms of number of launchers (4 modules per Launcher). This could create confusion among the Offerors; where the Government intends for Offerors to supply a price for 4 modules, an Offeror could mistakenly provide a price for 1 module. For example, CLIN 0004AA calls for 10 each, where each refers to a module per the TDP, and CLIN 0040AA requires 1 each, where each refers to a launcher consisting of 4 modules per the TDP. Would the Government please update the quantity column to use a consistent unit of measure, e.g. the “number of modules” per CLIN (listed below) for consistency and to ensure all 234 modules are included in pricing? With modules being the unit of measure, then quantities in Section B and Attachment J-S6 would require updating as well.

FFG: CLIN 0005,0006,0104,0105,0204,0205,0304,0305,0306,0404,0405

Australia: CLIN 0030AA, AB

CSC: CLIN 0040AA, AB, AC

Netherlands/Belgium: CLIN 0130AA, AB, AC No. the quantities are correct. Launchers and modules are different deliverables on their respective CLINs. Even though launchers include modules in them, they are a separate deliverable from individual modules.

45RFPSection L, paragraph 1.0 General InformationPlease confirm that the "fixed" delivery dates in Section F will be modified on a day for day basis (earlier or later) based on the actual award date for any variances from 31 Jan 2023Offerors shall propose in accordance with the assumed award date of 31 Jan 2023 and the delivery dates specified in Section F of the solicitation.

47RFP Section CRFP Section C
Pages 121-141The Government identified Latest Option Exercise dates for the Option CLINs, the latest CLIN exercise dates do not provide unique Period of Performance starting dates for Option CLINs . This implies the Government could execute any number of these option CLINs at the same time for CLINs with similar deliverables with fixed RDDs and "x" months AOE (for example MK 9 MOD 7 SYSTEM MODULE). a) Will the Government identify monthly production requirements for similar CLIN deliveries if all are awarded at the same time? Will the Government consider providing a minimum number of incremental monthly deliverables or a minimum delivery rate beginning with the CLINs with fixed delivery dates first? Can the Government add language to create a time phased, serial delivery approach for all CLINs (for example: 0X07 Series, 0021-0029,0121-0129,0221-0229,0321-0329,0421-0429)?If an interested party has a specific concern about executability of the schedule based on option exercise dates, please provide further information for the Government to consider. The Government reviewed its schedule and confirmed it is executable.
48RFP, Section G176, 179For small business conerns, will the Government include the Advance Payment Provision, FAR Clause 52.232-14, in the Solicitation. Contracting officers are required to “give special attention to meeting the contractor’s contract financing needs” “if the contractor is a small business concern.” For this procurement, substantial cash flow will be required to purchase material in order to meet the contract production needs and small business concerns will only be able to compete with large businesses with the benefit of Advance Payments. No, FAR 52.232-14 will not be included in the solictiation as the soliciation includes FAR 52.232-16. See response to question 49 regarding advanced payments.
49RFP, Section G176, 179For small business concerns, will the Government allow Advance Payments in addition to progress payments pursuant to FAR 32.402(d)?No, FAR 52.232-12 will not be included in the solicitation or any resulting contract.

51Attachment JS3, CLIN Pricing
RFP, Section MSection M, Total Evaluated Price (TEP)The RFP includes International VLS modules procured through Foreign Military Sales (FMS), which do or could have associated Offset obligations that would vary by Offeror. In order to maintain a fair and open competition, would the Government update the pricing worksheets to allow Offerors to separately price any Offset related costs associated with the FMS CLINs, and exclude any Offset related costs provided from the Total Evaluated Price (TEP)?NAVSEA has no privity into any potential offset agreement nor does it encourage firms to enter into, or commit U.S. firms to FMS offset arrangements. Since the United States Government has no obligation to satisfy or administer the offset agreement, amnedment 0005 establishes a separate CLIN to handle offsets that were not evaluated as part of this solicitation. This CLIN will be subject to the requirements of DFARS 225.7303-2(3) and contingent on FMS funding availability. Within 60 days of contract award/option exercise or the establishment of the offset agreement, whichever is later, the contractor shall provide evidence to the Contracting Officer that an offset arrangement exists. If funded, the offset CLIN will only cover the cost of the offset (no profit or fee will be provided). This CLIN is not anticipated to be used for any direct offset cost as the proposed unit prices must include all costs to produce the end items specified in this solicitation.
52RFPSection B Supplies or Services and Prices
Note DNote D indicates FMS Case Numbers will be provided at time of award or at time of option exercise. However, FMS Case Numbers support identification and pricing offset obligations with respective FMS Customers. a) Please provide FMS case numbers for CLINs 0030, 0040 and 0130. b) Where FMS cases are not currently in place or the end-customer has not been identified, will the Government “reserve” the FMS Country name in Section B? c) Please also clarify the approach for modifying the contract when FMS Case number(s) become available and results in offset obligation. For part a), FMS Case numbers are provided for base year CLINs 0030 and 0040 in section B of Amendment 0005. For part b), Note D specifies that the FMS case number will be provided at time of award or at time of option exercise. For part c) of the question, see answer above. The FMS case number identifies the FMS country.

Attachment 9 - MK 41 VLS Packaging and Transportation Plan Drawing 5599304 Drawing 5599305

Attachment 9 Paragraph 3.2.1 Module Assembly

The Government instituted a laser fit check tool which provides an additional option to the fit check of the canister which could alleviate the need for a tall building and crane requirements. Please confirm drawing 5599304 still requires "596.18 inches" of height from the forward fixture to eyehook required to lift the module, necessitating 50+ feet of building height and 2 lifting mechanisms for module laydown on lowboy per drawings 5599304 and 5599305.Amendment 0005 provides additional information regarding module laydown and how it should be proposed. See Section D, Section L, paragraph 3.2, Element 3 and Attachment 1, SOW, paragraph 13.0 to provide for alternate module laydown procedures. Note that there are no facility requirements in drawings 5599304 and 5599305.
58Attachment #1 Statement of WorkSection 4.4 Fit Check Tool

Refers to WS20350 for canister fit check alternative procedure NSCWPHD-A107-21-0013 The RFP references NSWCPHD-A107-21-0012 as an alternative to the fit check canister (5223702) for the verification that all tactical loaded canisters will fit in each cell with no interference with the deck opening and outboard structure and verify clearance for multiple module to canister interfaces.

Q1 - In order to verify canister fit, umbilical connector clearance, deluge connector clearance, CSES clearances, SM-3 Fiber Optic connector clearances and outboard clearances x,y,z coordinate ranges are needed. Will the customer provide these coordinates ?

Q2 - If the x,y, z coordinate ranges are inaccurate, false interferences could occur that could require rework and/or repair. What methods should the Offeror use to verify the accuracy of the coordinate ranges in order to avoid cost and schedule impacts due to rework?

Q3 - Does the 8 hour labor estimate provided include recalibration for each setup?

Q4 - Will the coordinate ranges take into account the differences in the outboard structures for each cell? Q1: X,Y,Z coordinates will be incorporated into the laser fit check tool software loaded in the tool. The coordinates are not necessary to develop a proposal.

Q2: The coordinate accuracy coded in the tool software will be validated for every cell location in a launcher, prior to delivery to the contractor. Any issues with GFP/GFI post-award will be resolved by the Government. The level of effort CLIN series XX13 may be used to assist in the resolution of GFP/GFI issues.

Q3: Yes

Q4: Yes

Additionally, the Government is providing an updated draft of the laser fit check tool procedure via DoDSAFE; See answer to question 63.

59RFP Amendment 005, conformed copySF33, block 9In accordance with the Navy's goal to "Level the Playing Field", we respectfully request the Government extend the current due date (1 July 2022) by 60 days to allow fair competition for new Offerors to timely and adequately review the full TDP (including the supplemental TDP received on 5/5/2022) with associated kits drawings, to fully review and understand build assembly procedures, and to allow for timely responses from suppliers after all TDP updates have been conveyed.Yes. Amendment 0005 revises the solicitation to extend the proposal due date to 1 Sept 2022 and extends the deadline for offerors to submit questions to 90 days after initial RFP Posting.
60RFP Section C121+The government has taken a subdivided acquisition strategy with regard to the electrical functionality of the system in that sections of the system have been separately contracted by the government and will be delivered to the integrator as GFM. Will the government consider adapting to a similar strategy on this full system acquisition by separately contracting for the Deck and Hatch Assembly and for the Plenum and Uptakes and then providing these major subsystems to the overall integrator as GFM?No, the Government intends to maintain the current acquisition strategy.
61RFP Section FRFP Section F
If the Government exercises all option CLINs due "x" months AOE at the same time as well as the CLINs for the same deliverables with fixed RDDs (for example MK MOD 7 STANDARD MODULEs) then this could potentially create a situation where the total quantity due could exceed the Contractor’s and Subcontractor’s production output. Will the Government add language into the delivery schedule to indicate that the items required in these CLINs to be delivered in a waterfall manner, removing any potential issues with concurrent deliveries if all Option CLINs due "x" months AOE are exercised at the same time? The Amendment 0005 delivery dates mitigate this concern, if interested parties disagree please re-ask the question.
62RFP Amendment 4: Section B, Section F, Attachment 17, and Attachment J-S6Section B - Page 2-120

Section F - Page 153-172 Attachment 17 - Column D

Attachment J-S6Response to Question 25 in Amendment 04 partially addressed a similar question for Attachment 17. For CLINs 0128, 1029, 0228, 0229, 0328, 0329 and 0428, 0429 Section B and Section F identify 24 as the max quantities. Attachment 17 column "D", called Step Ladder Quantity, in 4 out of 5 worksheets (specifically worksheets "FY24 Step Ladder Prices", "FY25 Step Ladder Prices", "FY26 Step Ladder Prices", and "FY27 Step Ladder Prices") shows quantity 32 at the top end of step ladder quantities. Does column "D" need to be corrected to top-out at quantity 24? And, do the 3rd and 4th rung of those step ladders in column "D" need to be corrected to align to Attachment J-S6 where the ranges are 12-17 and 18-24, not 12-23 and 24-32 respectively? If yes, then Column "G", called Upper Quantity, also change to quantity 17, from 23, in the same 4 out of 5 worksheets in Attachment 17 for the 3rd rung of the aforementioned CLINs.Correct. See updated Attachment 17 revised in Amendment 0005.
63TDP (current)N/ADrawing for 7104799 is missing from the VLS Launcher TDP. Drawing 7104799 is required per altered item drawing 7105456 note 2. Will the Government provide this missing drawing.Confirmed that the drawing is missing from the TDP. Amendment 0005 provides the missing drawing and NOR via DoDSAFE to prospective offerors. Additionally, drawing 8652163 NOR 11 (adding a separate Belgium configuration) and drawing NSWCHPD-A107-21-0012 Rev A will be provided in the TDP update.

64 - - Will the Government provide a list of existing fixtures and tooling, or provide drawings and sources of Mk41 fixtures and tooling, to reduce the non-recurring engineering costs to the program and enable fair competition? Amendment 0006 revises the contract to provide relevant drawings in Attachment 13 - Government Furnished Information (GFI). The drawings will be provided via DoDSAFE to all potential offerors that have submitted a TOUA. The Government is providing the relevant drawings as GFI for informational purposes only. The Government does not represent that this is a complete list of fixtures and tooling.

65Attachment 1 - SOW rev3Page 30, Paragraph 20.5, Limited Shelf Life ComponentsLast sentence of paragraph states: “Controls shall allow complete traceability of limited shelf life components used in launcher products.” Please verify that traceability ends at the point the limited shelf life item is consumed/installed into its intended application (part of a subassembly, assembly, or system), as shelf life defined by MIL-HDBK-695. Traceability into each “assembly” is not maintained. The Government verifies that shelf life traceability ends at consumption. It is expected that the manufacturer has traceability showing that limited shelf life components were not exceeded at time of consumption.
66Attachment 1 - SOW rev3Page 29, Paragraph 20.2, Manufacturing Certifications and TraceabilityRequirement states “The Contractor shall submit a Certificate of Conformance (as defined in SAE AS5553)”. AS5553 does not contain any requirements for certificate of conformance. Please clarify.Paragraph 20.2, Manufacturing Certifications and Traceability, of the SOW is deleted in Amendment 0007.
67Attachment 1 - SOW rev3Page 11, Paragraph 6.3, MK 41 VLS System Module MK 9 MOD 7 First Article Tests - Bonded AblativeFrom WS20174A, para 3.2.2 it states: "CRACKING OR DELAMINATION. AFTER CURE, STRUCTURAL AND NON-STRUCTURAL BONDS SHALL BE FREE OF CRACKING OR DELAMINATION OF THE BOND LINE." Based on this requirement, what is the measurable size of a discontinuity which would constitute an unbonded area, void, or crack? There should not be any discontinuity resulting in a an un-bonded area, crack, or void. If industry encounters this issue during production, they would need to submit a waiver/deviation for this issue.
68RFP-In response to question 40 the Government stated that it does not intend to incorporate and EPA clause based on any cost index. However, in light of the memorandum issued by John M Tenaglia, Principal Director, Defense Pricing and Contracting, on 25 May 2022, regarding the subject of Guidance on Inflation and Economic Price Adjustments, will the Government reconsider this request from industry and provide for the inclusion of an Economic Price Adjustment clause in this contract?

As stated in the memo, an EPA clause may be an appropriate tool to equitably balance the risk of inflation between the Government and contractor for contracts being developed or negotiated during this period of unusually high inflation. Including an EPA clause may enable a contractor to accept a fixed-price contract without having to develop pricing based on worst case projections to cover the cost risk attributable to unstable market conditions because of the EPA clause’s built-in mechanism to mitigate such risk. This solicitation and resulting contract has a long period of performance of 7 years, with significant costs incurred after the first year of performance.

The Government has reviewed the memorandum and has carefully considered whether or not inclusion of an EPA is appropriate for this contract. While the memorandum does identify contract length as one of the primary considerations when contemplating to consider on whether to use of an EPA clause, there are many other items to consider. After taking all these items into consideration, an EPA clause will not be incorporated into this competitive solicitation.
69RFP, J-S6 CLIN MatrixFAR 52.217-7Is it the Government's intent for the contractor to deliver Option CLINs prior to the base award CLINs? As an example, CLIN 0024 has a delivery date of 30 June 2025 using latest Option exercise date of 30 June 2023 and 24 MAOE and CLIN 0001AA has a delivery date of 31 January 2026.Yes

71RFP Amendment 5
Section BSection B page 122Note C states "At time of award or option exercise, stepladder CLINs may be unilaterally broken out by the Government into sub-contract line items (SLINs) to accommodate funding or delivery requirements". Please revise to read as follows: "At time of award or option exercise, stepladder CLINs shall be unilaterally broken out by the Government into sub-contract line items (SLINs) to accommodate payment, funding or delivery requirements".No, because not every option exercise will require the creation of SLINs.
72RFP Amendment 5: Section B and Section L (paragraph 2.3.1.3.2)Section B pages 41-42 and Section L, Paragraph 2.3.1.3.2Please confirm that the title on paragraph 2.3.1.3.2 should read as "2.3.1.3.2 - FFP PIO CLIN 0099" instead of "2.3.1.3.2 - FFP Offsets CLIN 0099" since within section B CLIN 0098 is designated for offsets and CLIN 0099 is designated as the Provisioned Items Ordered CLIN.Concur. Paragraph 2.3.1.3.2 should read as "2.3.1.3.2 - FFP PIO CLIN 0099". The title is updated in Amendment 0007.
73RFP Amendment 5; Attachment J-S6, Section FSection F, page 169Please confirm that the CLIN 0136AA Delivery Date in Section F should be 10-OCT-2026 vs 01-OCT-2026 to align with Attachment J-S6.Section F SLIN 0136 AA delivery date is updated in Amendment 0007 to 31-OCT 2026.
74RFP Amendment 5; Section L, Para 1.0Section L, page 236, Para 1.0 General InformationPlease confirm the response to Question 45 remains unchanged given the change in proposal due date.Yes. The fixed delivery dates in section F will not be changed.
75RFP Amendment 5; Section I, FAR Clause 52.217-7 VAR I Option for Increased Quantity - Separately Priced Line Item (Mar 1989) (NAVSEA Variation 1) (Oct 2019)Section I, Pg 225-226, FAR Clause 52.217-7 VAR I Option for Increased Quantity - Separately Priced Line Item (Mar 1989) (NAVSEA Variation 1) (Oct 2019)The recently added option CLIN 0098 is missing from this section. Recommend adding 29 August 2024 as the latest option exercise which is 60 days following the latest option exercise date in the model contract. This date would be supported by Section "C" for CLIN 0098 which says "Within 60 days of contract award/option exercise or the establishment of the offset agreement, whichever is later, the contractor shall provide evidence to the Contracting Officer that an offset arrangement exists."CLIN 0098 is added to clause 52.217-7 VAR I in Amendment 0007 with a latest option exercise date of 29 AUG 2024.
76Section B and Attachment J-S6Attachment J-S6 CLIN Matrix identifies the CLINs listed below for each of the respective FMS Countries. Canada CLINs 0040 to 0046, Australia CLINs 0030 to 0032, Netherlands 0130 - 0136, and Belgium 0137. However, Section B only identifies one CLIN for each FMS Country. Canada 0040, Australia 0030 and Netherlands 0130. Would the Government please add the appropriate FMS Countries and Cases (where applicable) for all FMS CLINs in Section B?Concur. Section B of the solicitation is updated in Amendment 0007 to list FMS countries in CLIN title and decription.
77Section B and Attachment J-S6Section B lists CLIN 0130, followed by SLINs 0130AA, 0130AB, 0130AC and then 0131AD. Attachment J-S6 has SLIN 0131AD under CLIN 0131 in that table. Should SLIN 0131AD be under CLIN 0130 as 0130AD or should 0131AD actually be moved to CLIN 0131? Would the Government please correct CLINs 0130 and/or CLIN 0131 in Section B?CLIN 0131AD is moved to be under the 0131 parent CLIN.
78Section I and Section FSection I Contract Clause 52.217-7 VAR I OPTION FOR INCREASED QUANTITY, states that the Government has the right to unilaterally exercise any such option, in whole or in part up to the total quantity specified in the option item, whether or not it has exercised other options.

A possible situation that could arise is that the Government could exercise option CLINs 0125, 0225, 0325, 0425 for Plenum Cell Covers (PCCs) on the same exercise date rather than exercise the Option CLIN per the respective Option Year. For example, should the maximum stepladder quantity be exercised at the same time for each option CLIN mentioned above, all four PCC Option CLINS would be exercised together, with a potential of 768 plenum cell covers required to be delivered 12 Months After the same Option Exercise (AOE) Date for each CLIN. This scenario could occur for all repetitive Option Year CLINS (i.e., 0X07, 0X21, 0X22, 0X23, 0X24, 0X26, 0X27, 0X28, 0X29).This creates the potential for stacked quantities due on the same contract dates, and production/storage constraints within the supply chain and at Contractor/Government storage facilities. Therefore, would the Government consider:

a) Identifying specific Required Delivery Dates (RDDs) in Section F for these series of Option CLINs rather than MAOE dates?

b) Specifying required monthly delivery cadence rates for these hardware requirements after the first delivery? (Example: Using the PCCs scenario, first delivery of Qty 48 due 12 MAOE with a delivery requirement of 48 per month thereafter until the entire quantity is completed.)Section F is updated in Amendment 0007 to have additional language to address "Maximum Monthly Delivery Rates".
79Section B, Section C and Section LCLIN 0098 was added to the solicitation as a FFP CLIN for Offsets associated with FMS CLINs. However, the Section B, C, and L statement that “no profit or fee will be provided” for CLIN 0098 is not appropriate as there is no basis in regulation for the Government to dictate offsets are not fee bearing, and inconsistent with existing FMS contracts requiring offsets. It is also inconsistent with DFARS 225.7303-2 (3) which states “Indirect offset costs are deemed reasonable as proposed” and “FMS customers are placed on notice through the LOA that indirect offset costs are deemed reasonable”. Profit is an element of the total cost to FMS customer of indirect offsets paid under the LOA.

Because “The U.S. Government assumes no obligation to satisfy or administer the offset agreement or to bear any of the associated costs”, Contractors assume substantial financial risk and the complexity of satisfying Offset obligations to foreign customers which are a direct result of USG FMS sales. The FAR recognizes profit is appropriate as a motivator of contract performance as well as, in part, renumeration for risk due to factors such as performance, contract type, and allowability. Within DFARS Part 215.404-71, FMS program requirements are identified as result in increased risk and thus warrant increased profit over domestic USG programs, including the contractor need to manage complex international offset arrangements.
