NAVSEA REFERENCE NUMBER: NAVSEA-001

SHIP/PROGRAM: CVN Mid-Atlantic Private Sector Maintenance Contract - N00024-16-R-

SPECIFICATION NO: Draft RFP SF 33 PARAGRAPH NO. N/A

TITLE: Block 9 PAGE NO.: N/A

QUESTION:

Offeror notes a proposal due date of 18 Dec 2015. Understanding that this is probably a tentative date, when does the Navy anticipate releasing the RFP? Based on information disseminated at the August 2015 Industry Day, does the Navy still anticipate a 60-day proposal preparation period? Lastly, when does SEA 02 anticipate an award?

DO NOT WRITE BELOW THIS LINE ---- (SPACE BELOW FOR GOV'T USE ONLY)

ANSWER: Please see the final RFP for details on proposal due date and anticipated date of contract award.

TITLE: Award Fee CLINs PAGE NO.: 2 of 155

QUESTION:

1. How does the Navy plan to use the various Award Fee CLINs?

2. There is a typographical error on the CLIN 0004 line.

ANSWER:

1. In accordance with DFARS 204.7103-1(b), all subline items and exhibit line items under one contract line item shall be the same contract type as the contract line item." As a result, Award Fee CLINs have been isolated and will be paired with the associated CPIF CLIN. This CLIN will reflect the total award fee pool available to be earned and once earned will be funded based on the results of the award fee evaluation. Also, please note that the contract type “Cost” reflected under the Award Fee CLINs are simply for meeting the contract writing system requirements.

2. No typographical error was noted for CLIN 0004. This CLIN serves as the Award Fee for CLIN 0003.

TITLE: Payment of Fees PAGE NO.: 67 of 155

QUESTION:

The length of CVN availabilities seem to range from 12 to 18 months. Considering the value of aircraft carrier availabilities, and the potential for Government award fee boards to be delayed for many months, will the Navy permit incremental partial payment of incentive fees in parallel with normal availability progress, and subject to some percentage withholding pending final AFEB adjudication?

ANSWER: In accordance with DFARS 215.405-2, award fee payments prior to the end of an evaluation period and resulting evaluation board are prohibited. Therefore, incremental or partial payments of award fee pending an evaluation board are not permitted. Incentive fee, however, is paid upfront and adjusted accordingly, if necessary, based on contract performance.

TITLE: Award Fee Evaluation Board (AFEB) PAGE NO.: 50 of 155

QUESTION:

Instead of “…consisting of five voting members…” it is suggested that the sentence be changed to read, “…consisting of a minimum of five voting members…”.

ANSWER: This language remains unchanged. The AFEB will consist of between five and eight voting members. Please see final solicitation.

TITLE: Inconsistencies PAGE NO.: 63 of 155

This discussion of “spare parts or other supplies” is not related to the other paragraphs in this section, which all discuss schedule incentives. It is suggested that subparagraph F be removed.

ANSWER: Subparagraph F falls under the overall Phase I section for Award and Incentive Fee.

The head paragraphs are as follows:

A. Award Fee Evaluation Board B. In the event of discontinuance…… C. Award Fee Process D. Deviation E. Contract Modification F. Inconsistencies

In the final solicitation, some of the paragraphs in this section have been re-numbered to clear up any confusion.

TITLE: Calculating Direct Costs PAGE NO.: 64 of 155

The terms “direct costs” and “production work” have various connotations. They can therefore be ambiguous or confusing instruments. Please clarify the Navy’s use of the term in this paragraph, which discusses the use of direct costs related to production work and small business utilization fee calculations. It might help to specify what should be included in the calculation of direct costs and production work when performing the fee-dependent calculation.

ANSWER: Direct costs are considered to be direct labor and material costs (e.g. all work outside of planning efforts), performed by subcontractors, and utilized for the performance of scheduled availability and inter-availability work.

SPECIFICATION NO: Draft RFP Section H PARAGRAPH NO. 5252.227-9100

TITLE: Naval Nuclear Propulsion Information PAGE NO.: 137 of 155

Section C, Statement of Work (page 71/155), describes the scope of work for the anticipated CVN Repair and Modernization contract as limited to “non-nuclear work” on nuclear powered vessels. It specifically excludes from the scope of this contract “the propulsion plant” and “nuclear primary and secondary spaces and systems as defined in NAVSEAINST C9210.04 (series). Clause 5252.227-9100 (incorporated by full text) addresses the contractor’s responsibility to protect “Naval Nuclear Propulsion Information.”

Since nuclear work is outside the scope of this anticipated contract, it follows that the contractor will never be tasked to develop or use Naval Nuclear Propulsion Information (NNPI). It is therefore recommended that this clause does not apply, and all such language should be removed from the solicitation.

ANSWER: Section H clause 5252.227-9100 has been removed. See final solicitation.

TITLE: Fixed Fee PAGE NO.: 67 of 155

Since the anticipated contract is defined as a combination of CPIF, CPAF, and FFP, should the term “FIXED FEE” be removed from subparagraph (b)? There is no mention anywhere in the draft solicitation that there will be any Fixed Fee applicable work on the contract.

DO NOT WRITE BELOW THIS LINE ---- (SPACE BELOW FOR GOV'T USE ONLY)

ANSWER: The anticipated contract will be a combination of CPIF and CPAF. There will be no FFP CLINs. The payment of fee clause is a standard NAVSEA clause and is applicable to contracts that have “FIXED FEE” or “INCENTIVE FEE.” For the anticipated contract, the clause further describes the applicable fee structure related to incentive fee. Therefore, the term “FIXED FEE” remains unchanged.

TITLE: Drydock Certification PAGE NO.: 67 of 155

The draft solicitation states that all drydock availabilities will be accomplished in Norfolk Naval Shipyard (NNSY) Portsmouth. It would therefore appear that the Contractor has no responsibility for maintaining a drydock. It is recommended that clause HQ C-2-0021 be removed from the solicitation.

SPECIFICATION NO: Draft RFP Section H PARAGRAPH NO. 5252.227-9101

TITLE: Technical Data Relating to Nuclear Propulsion PAGE NO.: 137-139 of 155

Section C, Statement of Work (page 71/155), describes the scope of work for the anticipated CVN Repair and Modernization contract as limited to “non-nuclear work” on nuclear powered vessels. It specifically excludes from the scope of this contract “the propulsion plant” and “nuclear primary and secondary spaces and systems as defined in NAVSEAINST C9210.04 (series). Clause 5252.227-9101 subparagraph (a) inaccurately states that “The supplies specified to be delivered under this contract relate to nuclear propulsion of naval ships.”

Since nuclear work is outside the scope of this anticipated contract, it follows that the contractor will never be tasked to develop or use Naval Nuclear Propulsion Information (NNPI). It is therefore recommended that this clause does not apply, and all such language should be removed from the solicitation.

For the same reason, it is further recommended that clause 5252.227-9114 on page 139/155 also be removed from the solicitation in advance of its release.

TITLE: Subcontracting of Nuclear Engineering Effort PAGE NO.: 143 of 155

CVN Repair and Modernization contract as limited to “non-nuclear work” on nuclear powered vessels. It specifically excludes from the scope of this contract “the propulsion plant” and “nuclear primary and secondary spaces and systems as defined in NAVSEAINST C9210.04 (series). Clause 5252.244-9102 pertains to the subcontracting of “all nuclear engineering effort under this contract.” Since nuclear engineering effort and similar work under the technical cognizance of NAVSEA 08 are clearly outside the scope of this anticipated contract, it is recommended that clause 5252.244-9102 should be removed from the solicitation.

TITLE: Protection of the Vessel In Contractor’s Plant PAGE NO.: 117 of 155

The draft solicitation (Note C on page 47 of 155) identifies the place of performance for “all work under this contract” to be at Norfolk Naval Shipyard (NNSY) and Naval Station Norfolk. It therefore follows that the contractor should never expect to host an in-plant availability for an aircraft carrier. It is suggested that paragraph (b) of HQ C -2-044 does not apply and should be removed from the solicitation.

TITLE: Management and Disposal of Hazardous Waste PAGE NO. 125-127 of 205

QUESTION:

If work for this anticipated contract is to be performed at NNSY and the Naval Station, then shouldn’t hazardous waste be disposed of in accordance with the Government facility’s policies and guidance? Furthermore, since contractors are not required to obtain an EPA ID for these bases, hazardous waste would be managed under the Generator ID of the host command.

Similarly, Hazardous Waste Manifests should not be applicable to the prime contractor, but to the host command.

DO NOT WRITE BELOW THIS LINE ---- (SPACE BELOW FOR GOV'T USE ONLY)

ANSWER: The Hazardous Waste and PCB Waste language below has been added to Section C of the solicitation. In addition, the specification for work item 077-11-001, as referenced in the language below, and also included under Attachment J-1 of the subject solicitation, provides further guidance on controlling hazardous waste produced on naval vessels. See Amendment 003:

HAZARDOUS WASTE AND PCB WASTE

A. Pursuant to 10 U.S.C. 7311, the Contractor is informed that the amount and types of Hazardous Waste expected to be generated during performance of the availability will be estimated as set forth in Work Item 077-11-001. In addition, the amount of polychlorinated biphenyl (PCB) Waste (including only nonradioactive PCB Waste) will be estimated as set forth in Work Item 077-11-001.

B. The amounts and types of Hazardous Waste set forth in Work Item 077-11-001 will be based on the best information available at the time of contract award. PCB Waste or Hazardous Waste generated during the actual performance of the work may vary in type or amount from that listed in Work Item 077-11-001, which may result in an equitable adjustment in accordance with the "Changes" clause as set forth in Section H - Special Contract Requirement NAVSEA 5252.223- 9114 "Management and Disposal of Hazardous Waste," and Section C clause “Non-Radioactive PCB Waste.” Some of the items listed in Work Item 077-11-001 may be neutralized, recycled, or otherwise removed from the requirements of the Resource Conservation and Recovery Act (RCRA). Inclusion of the items in Work Item 077-11-001 does not preclude the Contractor from taking action consistent with the RCRA or the Toxic Substances Control Act (TSCA) to reduce or eliminate the hazardous constituents of any waste required to be disposed of under this contract.

TITLE: Extension of Proposal Due Date PAGE NO. 1

The RFP was issued on October 30, 2015 with a January 6, 2016 proposal submittal due date.

This time period encompasses both the Thanksgiving and Christmas Holiday periods which limits the time for obtaining and analyzing information from prospective subcontractors, overall proposal development and the availability of key management for proposal reviews. Additional time will ensure that all offerors will be able to submit a fully compliant proposal that meets the solicitation requirements and provide the best value/pricing to the Government. Offeror recommends that the proposal due date be extended 2 weeks to January 20, 2016.

ANSWER: The Government extends the deadline for the proposal due date by one week to 13 January 2016. Please see Amendment 0003. The CVN Private Sector Maintenance contract award schedule is on an extremely tight timeline, therefore, submission of a qualified proposal is critical. It is the Government’s intent to award without entering into discussions.
