N00024-15-R-4406

QUESTIONS AND ANSWERS

The following are answers to questions received from potential offerors. The answers provide clarification only and DO NOT constitute an amendment to the solicitation.

91. Regarding 865-91-001, Hygienist / Marine Chemist / Competent Person:

Item 865-91-001 requires the Contractor to provide the following:

3.1 Provide the services of a qualified and certified Industrial Hygienist/Marine Chemist/Competent Person (Qualified Person) to support production needs from the start of the availability through end of contract period, during any operation related to ALL Industrial Work, as determined by the SUPERVISOR.

QUESTION - What is the intent for the Prime to furnish a dedicated Industrial Hygienist / Marine Chemist /Competent Person to support “ALL Industrial Work” as noted in para 3.1? Is this for the Prime Contractor’s use only or does the Government intend to task this IH/MC/CP with any other responsibilities other than specific services in direct support of prime contractor work efforts and safety of personnel?

3.1.2.1 The Contractor shall maintain at the work site a copy of the credentials of the Competent/Qualified Person who will primarily monitor atmosphere, inspect and certify spaces are safe to enter, and who will supervise all associated activities to include AIT production work

QUESTION - What is the intent in stating “Competent/Qualified Person . . . . . who will supervise all associated activities to include AIT production work”? The Prime contractor has no contractual relationship or direct control over AIT/3rd Party contractors and therefore cannot “supervise” their activities.

FOR 3.2 thru 3.2.8 - Please confirm: That the functions set forth in paragraph 3.2 are understood to be in direct support of Prime Contractor production effort only and NOT to perform these services in support of AIT/3rd Parties, other than to validate or confirm conditions when specifically requested by Prime or SUPERVISOR. Only Prime and Government personnel may enter locations of work, tanks, voids, confined spaces under Prime Gas Free Certs.

Concerns-

Neither the Prime’s subcontractors nor Government AITs/3rd Parties should operate under the Prime’s Gas Free Certs. Each entity should obtain their own Gas Free Certs, have posted and maintained with daily inspections by their own Competent Persons.

ANSWER:

The offeror shall include in its proposed price the cost of supporting one or more third parties (including Government employees and/or other Government Contractors' workers) at the overhaul site in performance of Government work. The Contractor shall price anticipated added expenses associated with third party presence into the fixed price offered for performance of the specified work package. The Government’s intent is that the Prime provide All Industrial/Environmental/Safety Services for Government employees and/or other Government Contractors performing Government work.

Officers, employees and associates of other prime Contractors with the Government and their subcontractors, shall, as authorized by the Supervisor, have, at all reasonable times, admission to the plant, access to the vessel(s) where and as required, and be permitted, within the plant and on the vessel(s) required, to perform and fulfill their respective obligations to the Government. The Contractor shall make reasonable arrangements with the Government or Contractors of the Government, as shall have been identified and authorized by the Supervisor to be given admission to the plant and access to the vessel(s) for office space, work areas, storage or shop areas, or other facilities and services, necessary for the performance of the respective responsibilities involved, and reasonable to their performance.

92. Regarding 865-91-001, Hygienist / Marine Chemist / Competent Person:

Item 865-91-001 requires the Contractor to provide the following:

It goes on to require that:

Many standards promulgated by the Occupational Safety and Health Administration (OSHA) explicitly require the employer to train employees in the safety and health aspects of their jobs.

Other OSHA standards make it the employer's responsibility to limit certain job assignments to employees who are "certified," "competent," or "qualified" - meaning that they have had special previous training, in or out of the workplace. The term "designated" personnel means selected or assigned by the employer or the employer's representative as being qualified to perform specific duties. These requirements reflect OSHA's belief that training is an essential part of every employer's safety and health program for protecting workers from injuries and illnesses. Many researchers conclude that those who are new on the job have a higher rate of accidents and injuries than more experienced workers.

Because certain Items in the USS MITSCHER ESRA(d) state that AITs will be doing their own hot work, please confirm that:

1) Each AIT has an OSHA approved Training Program compliant with the requirements of

3.2.1.1.

2) All personnel working for and with these AITs have been trained.

3) It is not the responsibility of the Prime Contractor to train the employees of other companies.

ANSWER:

All Government Work shall be accomplished under the applicable NAVSEA technical standard and regulatory Safety and Environmental standards.

1. Each government contractor performing hotwork shall comply with 29 CFR 1915 Shipyard

Industry Standards (OSHA).

2. Each government contractor performing hotwork shall comply with 29 CFR 1915 Shipyard

Industry Standards (OSHA).

3. In accordance with the requirements of 865-91-001 paragraph 3.2.1, the awardee’s

Qualified/Competent person shall “assist with training on confined space entry, hazardous situations and OSHA related preventative measures.” Specific instances where this assistance is required will be incorporated via an RCC.

93. Regarding 512-90-001, 721-90-001, 411-90-001, 456-90-001, 456-90-002 and 468-90-001, Various Ship Alts:

The Contractor requested confirmation of the language written into these items in order to avoid confusion. After review of answers to Question 4, 5, 6, 7, and 8 the level of ambiguity has only increased.

1) In each of these items what is the intent of paragraphs 4.2, 4.4, 4.5 and 4.6 ?

2) Is the AIT accomplishing the electrical and other portions of these ShipAlts (including but not limited to bonding, grounding, shimming, bolting, rip-out, installation, termination, test, and hot work operations) as described in the Notes Section (4), or not ?

3) Is the AIT electrical modification limited to signal, data and fiber cable or does it include power and lighting?

4) If it is limited to signal, data, and fiber can the Government provide information to easily differentiate and definitize the Prime’s responsibilities?

5) What specific listed references are to be accomplished by the Prime for each item?

6) Paragraph 4.2 and 4.4 end with . . . . . “and is excluded from the requirements of this work

Spec.” What does that mean?

ANSWER:

The statements provided in Sections 4 are for informational purposes only and do not amend the scope of Sections 1-3 of the work items. Offerors are to price the requirements of Sections 1-3 in accordance with the applicable NAVSEA technical requirements contained therein.

94. Regarding 150-11-009, 04 Level Coaming and Bulwark; repair:

Para 1.2.1 identifies the location of work as 04 Level, Weather FR 143 to 158 PORT and STBD.

Para 1.2.2 states 04 Level, Weather FR 174 to 198, STBD

KTR needs clarification as to the level on which the weather deck is actually located. KTR believes it should be 03 Level vice 04.

Any deck (other than Flight Deck) outside the skin of the vessel is considered a “Weather Deck” for the purposes of pricing this item. The WI is correct in the nomenclature of 04 Level, Weather, Frame.

95. Regarding 655-80-001, SA 79196D Self Service Laundry Transition:

In reviewing answers to the questions from Amend 0001, No. 37 still remains unanswered.

When opening the File provided for 655-80-001 for RLAR 79196-DDG55-1126958, Ref. 2.6, it is actually RLAR 79196-DDG55-1135023. Which is Ref. 2.7?

RLAR 79196-DDG55-1126958 is missing from this package.

Please either provide this RLAR in 2.6 or delete it from the requirements of the specification.

RLAR 79196-DDG55-1135023 is the same document as RLAR 79196-DDG55-1126958 and shall be used to price this work item.

96. Regarding 512-90-001, 721-90-001, 411-90-001, 456-90-001, 456-90-002, and 468-90-001, Various Ship Alts:

1. Please confirm that the AIT will accomplish all NAVSEA Standard Items and interference removals related to 4.2, 4.4 and 4.5. Including Cableway and MCT rip-outs, reinstallations and testing.

2. Please confirm the AITs will accomplish structural or mechanical interferences not required by the successful offeror’s work package.

3. Please confirm the AIT will be responsible for closing any and all MCTs with Data, Signal or Fiber Cable.

4. Please confirm the AIT will be responsible for banding all cableways with Data, Signal or Fiber Cable.

The statements provided in Sections 4 are for informational purposes only and do not amend the scope of Sections 1-3 of the work items. Offerors are to price the requirements of Sections 1-3 in accordance with the applicable NAVSEA technical requirements contained therein.
