AMENDMENT 01
QUESTION:
Will the Navy extend the proposal submittal date from 20 October 2014 to 31 October 2014? (11 day extension)
ANSWER:
No. At this time, the Navy considers the 20 October 2014 sufficient time for proposal submission.
QUESTION:
To ensure the Offeror can meet the security requirements for this contract, will the Navy provide the Contract Security Classification Specification (DD Form 254) an any corresponding security guidance documents that may be referenced within the DD Form 254?
ANSWER:
As seen on page 97, paragraph 1.3, Solicitation Security Classification, this solicitation is unclassifed and therefore no DD Form 254 is required.
QUESTION:
Page 26; Section C Paragraph 2.7 states, “The Contractor shall provide all data defined in Exhibit A electronically via a designated Government secured website.” Exhibit A, CDRL A002, Blk 16 Remards states, “Deliverables are to be posted on a Government website as designated.” What is the designated Government website?
ANSWER:
The designated Government website is the Navy Maintenance Database (NMD). Section C, paragraph C.2.7 is revised to reflect this information
QUESTION:
Will the Navy consider increasing the page limit for Volume III Past Performance from 5 pages to 12 pages?
(Additional 7 pages)
ANSWER:
Yes. Section L, paragraph 3.1, Solicitation Response Requirements, has been modified to reflect a page limit of 12 pages for Volume III, Past Performance.
QUESTION:
Page 98; Section L Paragraph 2.0 states, Sections A through K “Solicitation, Offer and Award”: Offerors must fill in all areas of the solicitation listed as Offeror filli-ins, including proposed costs and fees for each CLIN in Section B.
Is the offeror expected to include any fill-in pages found in Sections A, C-K within Volume V Cost?
ANSWER:
Yes. Section L, Paragraph 2.0 has been modified to reflect Volume V, Cost, as the proposal location where any Offeror fill-in information found in Sections A through K shall be submitted.
QUESTION:
Page 110; Section L Paragraph 2.3 states “Offerors shall use the following unburdened amounts for travel and ODCs.” In lieu of the travel/ODC amounts provided, will the Navy allow the offeror to proposal travel and ODC amounts?
ANSWER:
No. Offerors shall propose the unburdened Travel/ODC amounts provided in Section L in accordance with paragraph 2.3, Travel and Other Direct Costs (ODCs).
QUESTION:
Would the Navy consider adding incentive fee to CLIN 0005 and options CLINs 5100, 5200, 5300, and 5400 in addition to the fixed fee?
ANSWER:
No. At this time, the incentive fee categories for the Base period will not be revised to incorporate CLIN 0005. As seen in Attachment J-9, paragraph 2.0, Scope, the government reserves the right to unilaterally make changes in evaluation categories, factors and weights prior to the start of any evaluation period. The contractor may also propose changes for any evaluation period. As a result, option CLINs 5100, 5200, 5300, and 5400 may be incorporated in future evaluation periods.
QUESTION:
Page 105; Section L Paragraph 4.3 states, “In addition to contracts and subcontracts performed by the Offeror, contracts and subcontracts of an acquired company, division, subsidiary shall be identified.” Did the Navy intend to state “may be identified” versus “shall be identified”? If the Navy did intend to state “shall be identified”, please clarify what the Navy is seeking and provide the minimum requirements.
ANSWER:
Yes. The Navy’s intent was to state “may be identified.” Section L, paragraph 4.3 has been modified to reflect this information.
QUESTION:
In Attachment S-7 Fee, did the Navy intend to include CLIN 0006 and option CLINs 6100, 6200, 6300, and 6400?
Also, does the Navy plan to address CLIN 0005, and option CLINs 5100, 5200, 5300, and 5400 in Attachment S-7?
ANSWER:
No. The Navy did not intend to include CLIN 0006 or option CLINs 6100, 6200, 6300, and 6400. The Navy’s intent was to include CLINs 0005, and option CLINs 5100, 5200, 5300, and 5400. As a result, Attachment S-7 Fee has been modified to reflect this information.
QUESTION:
In regards to Section L; Paragraph 4.4.4 Organizational Conflict of Interest (OCI), Will the Government accept “separate entity” arrangements, or other OCI mitigation or avoidance measures, with respect to future contracts for the execution of maintenance, repair or modernization of the ship classes that are covered by the Performance Work Statement of this solicitation?
ANSWER:
In accordance with Section L, paragraph 4.4.4, a “separate entity,” if properly documented, structured, and implemented, is considered a mitigation measure to avoid “impaired objectivity.” In regards to other OCI mitigation or avoidance measures, the government will evaluate each proposed measure on a case by case basis as part of the OCI mitigation plan required to be submitted as part of the proposal by any offerors who has an OCI or has taken any steps to avoid or mitigate an OCI.
QUESTION:
Section L Paragraph 4.4.4 references anticipated “impaired objectivity OCIs,” including “when a contractor’s work under this resulting Third Party Advanced Planning contract could entail evaluating itself or a related entity, either through an assessment of performance under another contract or an evaluation of proposals(.)” The only work scope that appears to implacate the impaired objectivity OCI concern is as follows: Page 29; Section C.3.1, subsections 14.b. and 14.c., which require the contractor to review Condition Found Reports (CFRs) and Requests for Contract Changes (RCCs); and Page 30; Section C.3.2, subsections 1.a., 1.b., and 1.e., which also require reviewing, processing, validating, etc. RCCs and CFRs. Is the Government aware of any other sections of the Performance Work Statement that might give rise to a potential impaired objectivity OCI?
ANSWER:
Yes. For example, page 20, Section C.3.1, subsections 14.a, 14.b, 14.c, 14.d, and 14.e, which require feedback analysis in support of availability planning program/processes including CFRs and RCCS, are other sections of the Performance Work Statement (PWS) that might give rise to a potential impaired objectivity OCI. In addition, during the peformance of this contract and as requirements begin to define, other areas of the PWS may also be subject to a potential impaired objectivity OCI.
QUESTION:
Would subcontracting the scope of work referenced in Page 29; Section C.3.1, subsections 14.b. and 14.c., which require the contractor to review Condition Found Reports (CFRs) and Request for Contract Changes (RCCs); and Page 30; Section C.3.2, subsections 1.a., 1.b., and 1.e., which also require reviewing, processing, validating, etc.
RCCs and CFRs to an unrelated third-party entity satisfy the “separate entity” provision in Section L 4.4.4 Organizational Conflict of Interest (OCI) such that no impaired objectivity conflict of interest will arise for an offeror with respect to a future maintenance, repair, or modernization contract for a shic class covered by this solicitation?
ANSWER:
No. Subcontracting the scope of work referenced in page 29; Section C.3.1, subsections 14.b and 14.c and page 30;
Section C.3.2, subsections 1.a, 1.b, and 1.e to an unrelated third party entity does not satisfy the “separate entity” provision.
QUESTION:
Given that the specification and planning for ship modernization involves the development of new equipment and systems for the ship class, does the scope of work under this solicitation – excluding the scope referenced in Page 29; Section C.3.1, subsections 14.b. and 14.c., which require the contractor to review Condition Found Reports (CFRs) and Request for Contract Changes (RCCs); and Page 30; Section C.3.2, subsections 1.a., 1.b., and 1.e., which also require reviewing, processing, validating, etc. RCCs and CFRs – qualify as “development work” for purposes of FAR 9.505-2(a)(3) with respect to a future modernization contract for a ship class covered by the solicitation?
ANSWER:
No. The scope of work provided in Section C under the Performance Work Statement (PWS) does not qualify as “development work” for purposes of FAR 9.505-2(a)(3).
QUESTION:
Given that the planning activities under the solicitation will be performed under the supervision and control of the Navy, does the scope of work under this solicitation - excluding the scope referenced in Page 29; Section C.3.1, subsections 14.b. and 14.c., which require the contractor to review Condition Found Reports (CFRs) and Request for Contract Changes (RCCs); and Page 30; Section C.3.2, subsections 1.a., 1.b., and 1.e., which also require reviewing, processing, validating, etc. RCCs and CFRs – qualify as the preparation, refinement or coordination of specifications under the supervision and control of the Government, as provided in FAR 9.505-2(a)(1)(ii), with respect to a future maintenance, repair or modernization contract for a ship class covered by the solicitation?
ANSWER:
No. The scope of work provided in Section C under the Performance Work Statement (PWS) is defined under FAR 9.505-2(a)(1) and FAR 9.505-2(a)(2) and does not qualify under the exceptions listed under FAR 9.505-2(a)(1)(i) or 9.505-2(a)(1)(ii).
