NOTE A
The Contractor warrants and hereby certifies that its price for ITEMs 0001, 0004, 0007, 0010, 0013, 0016, and 0019 does not include any amount for the “ADDITIONAL LABOR REQUIREMENTS” under ORDER ITEMs 0002, 0005, 0008, 0011, 0014, 0017, and 0020 and/or “ADDITIONAL MATERIAL REQUIREMENTS” under ORDER ITEMs 0003, 0006, 0009, 0012, 0015, 0018, and 0021.
NOTE B
It is recognized that, should the Government elect to pursue the alternatives outlined in Section C.1.5.6, the presence of the Government or third party Contractors may delay, disrupt or otherwise adversely impact upon the performance of this Contract. Consequently, the Contractor's price for ITEMs 0001, 0004, 0007, 0010, 0013, 0016, and 0019 will be deemed to include all costs, if any, of supporting Government employees or third party Contractors at the work site in performance of “ADDITIONAL LABOR REQUIREMENTS,” should the Government elect to pursue such a course. Increased costs that may result from Government or third party Contractor presence as described above, may include, but are not limited to: insurance; physical plant security; utilities used aboard the vessels or in proximity of the vessels in support of the work; and similar requirements. The Government or third party Contractors will only perform the “ADDITIONAL LABOR REQUIREMENTS” or “ADDITIONAL MATERIAL REQUIREMENTS” work if the Contractor and the Government cannot agree upon a fair and reasonable price for efforts under ORDER ITEMs 0002, 0003, 0005, 0006, 0008, 0009, 0011, 0012, 0014, 0015, 0017, 0018, 0020, and 0021.

The Man-Hours and Labor Dollars listed below are ceiling amounts and do not represent a commitment that the Government will order any or all of these man hours or increase the contract amount. The Man-Hour rate shown is a fully loaded man-hour labor rate (including profit and all indirect costs). This rate shall be the rate used for pricing orders negotiated under C.1.5 entitled “ORDER ITEMS 0002, 0005, 0008, 0011, 0014, 0017, AND 0020 – ADDITIONAL LABOR REQUIREMENTS FOR ALL AWARDED LCACS.” Material costs shall not be included in the Fully Loaded Man-Hour Labor Rate. The Contractor agrees that its Fully Loaded Man-Hour Labor Rate includes the complete and full compensation to which it is entitled, including, but not limited to, compensation for all the direct labor costs, (e.g. straight time, overtime, premium time, shift differential, holiday time, standby time, etc.) for performing the Additional Labor Requirements, as well as compensation for acceleration, delays and disruptions and other impacts, if any, to the aforementioned work items, to work performed under any other Government contract and to any work in progress for the Government. As these efforts are to be accounted for as part of the overall craft availability schedule, the Contractor agrees that the number of man-hours included in its price proposal for such. Additional Requirements shall include only direct production (e.g. “trade labor”) and direct production subcontractor man-hours. Therefore, oversight hours, such as supervision, support functions, etc., which are level of effort estimates in the Contractor’s normal estimating methodology, shall not be allowable as additional hours for the pricing of any orders under these ITEMs.
