PWS or
Contract Section Question Answer
Appendix A Regarding Appendix A ot the PWS, does Government intend to send FADECs to the contractor?
Two FADECs will be delivered with each
QECA.
Appendix D
Regarding Appendix D to the PWS, will NAVAIR require a standardization of configuration of QECA, considering the application of all Service Bulletins already approved by NAVAIR (Recommended SB included) or only mandatory?
The Contractor shall incorporate all service bulletins listed in PWS Appendix D.
Appendix D
Regarding Appendix D to the PWS, please define the cut-off SB number or date to be considered for inclusion in FFP proposal. Should any more recent
SBs already released by the OEM be considered in the initial FFP or will they be added after approval by NAVAIR?
The Contractor shall only incorporate service bulletins listed in PWS Appendix D.
Any additional service bulletins will be handled in accordance with the changes clause.
Appendix E, Item
2.1
Regarding Appendix E to the PWS, Item 2.1, considering that missing components were not considered in FFP, can missing components be classified as findings and be quoted in addition to FFP? Or will the
Government supply FOC replacement components.
Upon identification of missing LRUs, the
Government will be responsible for providing parts.
Clauses
Industry requests removal of FAR Clause 52.217-8, Option to Extend
Services.
The FAR clause does not speak to escalation. The Government does not intend to add any language to include escalation.
Questions and Answers Batch #2
Clauses
Industry requests removal of FAR Clause 52.215-21, Requirements for
Certified Cost or Pricing Data or Information Other than Certified Cost or
Pricing Data – Modifications (Oct 2010) Alt IV (Oct 2010).
According to FAR 15.408(m), this clause shall be inserted when “it is reasonably certain that cost or pricing data or data other than certified cost or pricing data will be required for modifications”. Certified or other than certified cost or pricing data may be necessary for any modifications after award that affect price, as modifications are by definition sole-source contract actions with no price competition.
Clauses
Industry requests removal of FAR Clause 52.215-20, Requirements for
Certified Cost or Pricing Data or Information
Other than Certified Cost or Pricing Data (Oct 2010) – Alt IV (Oct 2010).
The prescription for this provision at FAR
15.408(l) states that this clause shall be included "if it is reasonably certain that certified cost or pricing data or data other than certified cost or pricing data will be required". Since this is not the case (as adequate price competition is fully expected), the clause will be removed from the solicitation.
Clauses Industry requests removal of DFARS Clause 252.211-7003 Item Unique
Identification and Valuation (Dec 2013).
This clause has been removed from the solicitation.
Clauses Industry requests removal of DFARS Clause 252.223-7008 Prohibition of
Hexavalent Chromium.
This clause has been removed from the solicitation.
Overall
The RFP and PWS refer to "days", "working days", "business days", and
"calendar days". Can NAVAIR please specify "working/business days" or
"calendar days" for those instances where just "days" is used?
Any instances where only "days" is used shall be treated like calendar days unless otherwise specified.
PWS
In regards to the Depot PWS, can you tell me when NAVAIR would consider an asset Ready for Issue (RFI)? We are working through the Turn Around
Time requirements and would like to verify when the clock stops.
According to PWS Appendix C paragraph
2.1, "TAT ends when the Contractor provides copies of repair documentation and notifies the COR that the QECA is RFI and ready for shipment."
PWS 2.1
Industry asks whether NAVAIR will consider adding a note to PWS section 2.1 as follows: “Transport Canada Civil Aviation (TCCA) CAR 573 Approved
Maintenance Organization is an acceptable equivalent to 14 CFR Part 145”.
The PWS has been updated to include authorized equivalents to the Title 14 CFR
Part 145 Repair Station Requirement.
PWS 3.1 Industry asks whether NAVAIR will consider amending PWS section 3.1 to address equivalents to Title 14 CFR Part 145.
The PWS has been updated to include authorized equivalents to the Title 14 CFR
Part 145 Repair Station Requirement.
PWS 3.5
Regarding PWS section 3.5, how will transportation cost be reimbursed by the
Government to the Contractor based on the Transportation Account Codes
(TAC)?
Per PWS addition of paragraph 11, the
Contractor will not be using a TAC code for shipping.
PWS 3.5
Regarding PWS section 3.5, does Contractor coordinate and pay transportation for after receiving reimburse from Transportation Account
Codes (TAC) or the costs of principal transportation will be directly chargeable to the assigned TAC?
Per PWS addition of paragraph 11, the
Contractor will not be using a TAC code for shipping.
PWS 3.5.1
Regarding PWS section 3.5.1, considering that transportation costs of the
QECAs, QECKs and PGB/GMADs between the Government site and the
Contractor’s facility are the responsibility of the Government and will be chargeable to the assigned Transportation Account Codes (TAC), could
Government define the INCOTERMS 2010 for each shipping direction?
Per PWS addition of paragraph 11, the
Contractor will not be using a TAC code for shipping.
PWS 3.8
Industry asks NAVAIR to verify the type of access required in PWS section
3.8. Industry asks whether NAVAIR is aware of any industry-equivalent qualification standard, and whether NAVAIR has an alternate process to request waivers for the US-citizenship requirement?
The PWS has been updated to clarify access criteria.
PWS 4.3.3
Industry recommends replacing the language included within Section 4.3.3 with, “The Contractor shall provide a copy of the FAA approved variance via the
WIS when the
Contractor deviates from the authorized configuration and or use of unauthorized parts or components.”
The PWS has been updated to change paragraph 4.3.3.
PWS 5.1
Regarding PWS section 5.1, will Government provide LRUs belonging to their own pool as GFE to be applied to CLINs 0X03 to 0X15? If yes, is there a planned pool size per Part Number?
No, the Government will not provide a pool of LRUs.
PWS 5.1
Regarding PWS section 5.1, LRU repair times might exceed TAT objective.
Does the government provide a rotable LRU pool or can the contractor use units from its own rotable LRU pool?
The Government will not provide a pool of
LRUs. The Contractor may use units from its own LRU pool.
PWS 5.1.2
Industry asks whether NAVAIR will consider adding “Contractor Certificate of
Conformance" to the list of acceptable return-to-service documents in PWS section 5.1.2.
Does this section conflict with Section E "Inspection and Acceptance" of the
Solicitation?
The PWS has been revised to consistently require a FAA Form 8130-3 or an equivalent Contractor Certificate of
Conformance (COC) and FAA Form 8110-3 or an equivalent Certificate of Release, Test, and Conformity. There is no conflict with
Section E as it just references a Certificate of Conformance.
PWS 5.1.2 and
5.1.5.1
Regarding PWS sections 5.1.2 and 5.1.5.1, contractor shall issue a FAA 8130-
3 after work performed. What if the contractor can only issue a certificate of conformity for military engines and cannot issue a FAA or an EASA Form 1?
Do you accept the certificate of conformity?
The updated PWS addresses acceptable equivalents to FAA and EASA documents.
PWS 5.1.2 and
5.1.5.1
Regarding PWS sections 5.1.2 and 5.1.5.1, contractor shall issue a FAA Form
8110-3 Statement of Compliance with Airworthiness Standards after work performed. What if the can only issue a certificate of conformity for military engines and cannot issue a FAA 8110-3? Do you accept the certificate of conformity?
The updated PWS addresses acceptable equivalents to FAA and EASA documents.
PWS 5.1.5
Industry asks whether NAVAIR will consider adding "or acceptable TCCA or
EASA equivalent" to PWS section 5.1.5.
The PWS has been updated to include authorized equivalents to requirements involving FAA certifications and documents.
PWS 5.1.5.1
Industry asks whether NAVAIR will consider adding “Contractor Certificate of
Conformance" to the list of acceptable return-to-service documents in the above clause.
Does this section conflict with Section E "Inspection and Acceptance" of the
Solicitation?
Yes, the PWS has been revised to consistently require a FAA Form 8130-3 or an equivalent Contractor Certificate of
Conformance (COC) and FAA Form 8110-3 or an equivalent Certificate of Release, Test, and Conformity. There is no conflict with
Section E as it just references a Certificate of Conformance.
PWS 6.1.1
According to PWS, item 6.1.1, ‘The Contractor shall perform a receiving inspection of the QECA and notify the COR of findings within three working days of receipt at the Contractor’s facility’ but the same document at
Appendix E, ITEM 2.1, states ‘the Contractor shall inspect the QECA for damage and missing components, review associated log books for completeness, and notify the COR of the “As Received Condition” within five working days of induction.’ How many days for Contractor perform receiving inspections and notify COR? 3 or 5 days?
These are two separate requirements. The receiving inspection should only identify any damage related to shipping.
PWS 8.0
LRU components are not specifically called out in PWS section 8.0, do these fall under ‘attaching components’?
Yes, all LRUs (repairable and consumable components and materials) are considered inclusive of the QEC, Power Section, and
PGB.
PWS 8.0
Government declared that Section 8.0 of the PWS would be revised to align with Appendix A, but Section 8.0 remains defining modules for the core engine as Power Section, Torque meter and Power Unit Accessory Drive.
Considering PWS states two difference descriptions, could Government define if Contractor will receive or not PGB/GMAD for performing CLINs 0X08 through 0X13?
Yes, PGB/GMAD will be shipping with
QECAs.
PWS 8.4
Regarding PWS section 8.4, a PGB will be required to perform the operational test, will a slave PGB be available?
No, QECAs will be shipped with the PGB installed. The Government may also ship
PGBs to the depot for repair as standalone units. PGBs shipped as standalone repairs will be shipped in a can.
PWS Repair
Section
Please clarify if it is NAVAIR’s expectation that all non-performance related
Power Section repairs included within CLINs 0X09 – Category 2, 0X10 –
Category 3, 0X11 – Category 4, 0X12 – Category 5, and 0X13 – Category 6
Repair shall include performance margin restoration in the workscope and price.
For example, a Metal in Oil repair under CLIN 0X09 in its basic form would require a much lighter workscope, and ultimately price, compared to a Metal in Oil repair that also has low power section performance issues. Those same repairs often require performance restoration within in the workscope. It’s been our experience that a large percent of these CLINs of non-performance margin include both. Should we be expected to price performance restoration in all CLINs? If not, what would be the contractual mechanism or performance threshold to move a Metal in Oil repair into the Performance
CLIN if they power section requires performance restoration?
Yes, the Contractor shall meet the performance margin requirement for every
QECA.
Section E
Industry asks NAVAIR to confirm a COC is the only documentation required to be provided as evidence all work required by the CLIN has been completed by the Contractor.
Section 5.1 states what documentation is required. Please note that the PWS will be revised to consistently require a FAA Form
8130-3 or an equivalent Contractor
Certificate of Conformance (COC) and FAA
Form 8110-3 or an equivalent Certificate of
Release, Test, and Conformity.
Section L
Section L states: ‘Identify individuals authorized to negotiate with the
Government and contractually bind the Offeror.’ Is there a policy describing the limitations or is this based on Offeror policy?
It is the Offeror's responsibility to identify who in its organization is authorized to negotiate with the Government. The
Government has no policy to govern this process.
Section L Does Section L Part B paragraph 4.0(b) apply to non-US bidders?
Yes, all parts of the solicitation apply to non-US bidders.
Section L Does Section L Part B paragraph 4.0(c) apply to non-US bidders?
Yes, all parts of the solicitation apply to non-US bidders.
Section L
Section L, Section 3.0, table G-1 Proposal Structure and 3.0 Volume 3 – Price, make reference to Section L, Attachment #1 – Price Summary. It does not appear to provided with the solicitation. Is the Price Summary to be in contractor format or will the Government provide a template for the Price
Summary?
A price summary template is provided with this amendment. The template shall be used by all Offerors.
Section L Item 3
Volume 3 Price
Regarding Section L, Item 3, Volume 3, could you confirm if the data provided by the Offeror shall be in accordance with FAR 52.212-20 or 52.212-2, because according to the FAR website, FAR 52.212 has –1 though –5. A –20 document does not exist.
This is an error. The clause number has been updated to DFARS 252.215-7008.
Section L, item 4.0
Regarding section L of the RFP, item 4.0, when you say that ‘the model contract that you expect to received shall include the form SF1449 and each amendment (including sections B-K and all applicable clause fill-ins)’, that means that you expect to receive the form SF1449 signed and the sections B-
K even when a section doesn’t have any field to fill (like section H for example)?
Yes, the model contract shall include all
Sections even if that section does not have a fill in field.
Tech Library Can NAVAIR provide the final ISOC scan results for all remaining RADCON engines / QECAs in the field?
The Government does not intend to provide
ISOC Scan results. ISOC scan reports are not indicative of parts to be quarantined.
File details come from the government source that posted it. Updated .
