About this file

This is a Minority Business Enterprise (MBE) Participation Acknowledgment form issued by the Rhode Island Department of Administration's Division of Equity, Diversity and Inclusion Minority Business Enterprise Compliance Office for MPA 166 Gas Liquid Propane. The form serves as a pre-authorization compliance document for prime contractors bidding on state-funded procurement projects. Contractors must acknowledge their understanding of Rhode Island General Laws 37-14.1, which mandates that Minority Business Enterprises (MBE), Women Business Enterprises (WBE), and Veteran-Owned Business Enterprises (VBE) be included in all state-funded and state-directed public construction programs, projects, and purchases. The form requires contractors to identify their certification status and initial five separate acknowledgments confirming their understanding of compliance requirements, submission obligations, and potential sanctions for non-compliance.

The primary compliance requirements outlined in the acknowledgment include submitting executed agreements with all subcontractors utilized to meet participation goals, providing monthly reports and documentation to the MBE Compliance Office verifying payments to MBE subcontractors, and immediately notifying the office of any changes in vendors, subcontractors, suppliers, or change orders. Contractors must achieve a minimum of 15 percent of the dollar value of the entire procurement or project through certified MBE/WBE participation. Failure to comply with these conditions may result in a determination of non-compliance and sanctions under applicable Rhode Island General Laws. The authorized signatory for the prime contractor must affirm under penalty of perjury that all information provided is true and correct.
