About this file

This document is a Telecommunication Infrastructure Project Contract between Newport Utilities and an unnamed contractor, covering various federal and operational requirements for a telecommunications infrastructure project. The contract includes standard provisions related to insurance, indemnity, liability limitations, warranties, equal employment opportunity, and compliance with federal regulations such as the Clean Air Act, Federal Water Pollution Control Act, and domestic procurement preferences. While specific project details are not provided, the contract establishes comprehensive guidelines for the contractor's performance, including warranty terms of one year from substantial completion, with a maximum two-year warranty period.

The contract incorporates several key financial and operational protections, including a limitation of the contractor's aggregate liability to the compensation payable for a work order, with liquidated damages not to exceed 10% of that compensation. The document requires the contractor to comply with various federal regulations, including provisions for using recovered materials, giving preference to U.S.-produced goods, and adhering to anti-lobbying and suspension/debarment rules. The contract appears to be funded, at least in part, by Treasury ARP SLFRF (American Rescue Plan State and Local Fiscal Recovery Funds) financial assistance, which introduces additional compliance requirements related to federal spending guidelines.

The applicant agrees that it will assist and cooperate actively with the administering agency and the Secretary of Labor in obtaining the compliance of contractors and subcontractors with the equal opportunity clause and the rules, regulations, and relevant orders of the Secretary of Labor, that it will furnish the administering agency and the Secretary of Labor such information as they may require for the supervision of such compliance, and that it will otherwise assist the administering agency in the discharge of the agency's primary responsibility for securing compliance.
