About this file

This is a Questions and Answers document from Lawrence Berkeley National Laboratory (LBNL) responding to a clarification question regarding RFP MG-02122026.

The document addresses a potential conflict regarding whether quotations should include tariff costs or exclude them. LBNL clarifies that Section 3.6's tariff provision applies only to foreign-origin items. For items of foreign origin that incur tariff costs upon importation, LBNL wishes to be designated as the shipping importer of record and will seek tariff reimbursement through the U.S. Department of Commerce International Trade Administration and U.S. Customs and Border Protection. Conversely, for domestically produced or assembled items, all tariff costs must be included in the total pricing submitted by vendors. This clarification resolves the apparent inconsistency between the "inclusive" pricing requirement and the tariff handling provision.

LBNL Response to Question 01 Re: LBNL RFP MG-02122026 – 02/13/2025

1. In one part of the docs, it says the quotes are to be “inclusive” of all charges. But then in the “Request for Proposal (RFP) No.: MG- 02122026” Section 3.6 Tariffs, it says the university wishes to be the shipping importer of record.

Are the quotes to include tariffs or separate them?

LBNL Response: Section 3.6 states the following: “It should be noted that if the proposed item(s) are of foreign origin and incur tariff costs upon importation, the University wishes to be the shipping importer of record and will seek reimbursement for such tariff costs under the U.S. Department of Commerce International Trade Administration, U.S. Department of Homeland Security U.S. Customs and Border Protection…” That statement applies to foreign-produced/assembled items. It does not apply where the production/assembly process will be performed domestically. For domestically produced/assembled items, tariffs should be included in the total pricing.
