About this file
This is a legal compliance memorandum issued by the law firm Balch & Bingham to the Mississippi Development Authority - Community Incentives Division (MDA-CID) dated April 14, 2026, regarding a Request for Qualifications (RFQ) for residential construction contractors. The RFQ seeks qualified contractors to perform housing rehabilitation and reconstruction services under the Homeowner Rehabilitation and Reconstruction Program (HRRP), which addresses housing needs for homeowners impacted by tornadoes and straight-line winds occurring in 2023 and 2024. The program is outlined in MDA-CID's Action Plan and funded through Community Development Block Grant Disaster Recovery (CDBG-DR) resources. The memorandum does not specify response deadlines, site visits, bidders' meetings, award dates, or contract terms.
The memorandum confirms that MDA-CID's RFQ complies with applicable federal and state procurement regulations, including 2 CFR Part 200, Mississippi Code Annotated sections 31-7-1 et seq. and 27-104-7, and the Department of Finance and Administration's Mississippi Procurement Manual. MDA-CID based its HRRP procurement process on a previously DFA-approved request for proposals issued for its Neighborhood Home Program in 2011, which addressed Hurricane Katrina-damaged homes. By utilizing the same procurement template and process that received prior DFA approval, MDA-CID has ensured compliance with all applicable state and federal procurement law. No pricing terms, set-asides, incumbent contractors, or specific funding amounts are detailed in this compliance opinion.

RE: Compliance of Request for Qualifications for Homeowner Rehabilitation and Reconstruction Program with Federal and State Law
Mississippi Development Authority – Community Incentives Division (“MDA-CID”) has issued a
Request for Qualifications for construction activities related to its Homeowner Rehabilitation and Reconstruction Program (“HRRP”). The program will address housing needs for homeowners impacted by tornadoes and straight-line winds in 2023 and 2024, as outlined in MDA-CID’s Action Plan.
The purpose of this memorandum is to opine that the Request for Qualifications for residential construction contractors is in compliance with both federal and state law. The Request for Qualifications complies with relevant state and federal statutes and regulations, including, but not limited to: the provisions found in 2 CFR Part 200, Miss. Code Ann. § 31-7-1, et seq., Miss. Code Ann. § 27-104-7, and the Department of Finance and Administration (“DFA”)’s Mississippi Procurement Manual.
In further support of the accuracy and validity of its HRRP Request for Qualifications, MDA-CID would note that it previously requested proposals for construction services through its Neighborhood Home Program, a repair, rehabilitation and reconstruction program for Hurricane Katrina-damaged homes in 2011. That request for proposals was evaluated and revised by DFA prior to final publication.
The procurement process outlined in said request was used as a template and reference for MDA-CID’s current Request for Qualifications for HRRP. Therefore, apart from program specific requirements, the procurement process for HRRP is the same as the previous DFA-approved procurement.
MDA-CID has complied with all applicable state and federal procurement law in the issuance of its Request for Qualifications for construction services.
