About this file

This is a Request for Proposals (RFP) issued by the Maryland Department of the Environment (MDE) for PFAS firefighting foam concentrate pick-up and disposal services. The solicitation seeks qualified hazardous waste management companies to safely collect, transport, and dispose of PFAS-containing firefighting foam from fire departments statewide, in compliance with the George Walter Taylor Act. The RFP was issued on March 18, 2025, with a pre-proposal conference scheduled for April 3, 2025, and proposals due by April 24, 2025. The contract will be an indefinite quantity agreement with fixed unit prices, spanning two years with a one-year option for renewal. MDE intends to make a single award and will identify fire department locations and provide contractor access for foam concentrate pick-up.

The solicitation is designated as a Small Business Reserve Procurement, meaning only certified small businesses are eligible to compete. The contract includes a Minority Business Enterprise (MBE) subcontracting goal of 25%, with specific subgoals: 3% for Asian-American MBEs, 2% for Hispanic-American MBEs, and 10% for Woman-Owned MBEs. Contractors must follow strict regulatory requirements for transporting and disposing of PFAS-containing foam, including mandatory disposal outside of Maryland and compliance with federal and state hazardous waste transportation regulations. The contractor will be responsible for providing all necessary equipment, personal protective gear, and documentation for pick-up, transportation, and disposal. No federal funding is involved, and the total contract value is not explicitly stated in the document.

2 Contractor Requirements: Scope of Work

2.1 Summary Statement

2.1.1 This Request for Proposals (RFP) is issued to procure the goods or services, as specified in this Section 2, from a contract between the selected offeror and the State of Maryland (“State”). The Maryland Department of the Environment (“MDE” or “the Department”) is issuing this Request for Proposals (RFP) to implement a program to pick up, transport, and safely dispose of PFAS-containing firefighting foam concentrate used to extinguish certain types of fires from participating fire departments across the State of Maryland.

2.1.2 It is the State’s intention to obtain goods and services, as specified in this RFP, from a contract between the selected Offeror and the State.

2.1.3 MDE intends to make one award as a result of this RFP. See RFP Section 6.5 Selection Procedures for more Contract award information.

2.1.4 A Contract award does not ensure a Contractor will receive all or any State business under the Contract.

2.2 Background and Purpose

In 2022 the Maryland General Assembly passed the George “Walter” Taylor Act. The Act was passed in part to prohibit a person from using, manufacturing, or knowingly selling or distributing Class B fire-fighting foam that contains intentionally added PFAS chemicals in the State on or after January 1, 2024.

https://mgaleg.maryland.gov/mgawebsite/Legislation/Details/SB0273/?ys=2022rs

2.2.1 Project Goals

The overall goal of this RFP is to obtain qualified hazardous waste management companies to assist MDE with the safe pick-up, transport, and disposal of PFAS-containing fire-fighting foam concentrate from eligible and willing fire departments throughout the state, as identified by MDE and per the George Walter Taylor Act (Senate Bill 0273), Sections 6- 1603E and 6-1604 of the Environmental Article, Annotated Code of Maryland.

2.2.2 State Staff and Roles

In addition to the Procurement Officer and Contract Monitor, the State project team consists of the Director of the Land and Materials Administration, the Solid Waste Program Administrator, Program technical and administrative staff, and other State staff as needed.

2.2.3 Other State Responsibilities

MDE will identify the location and condition of the containers of PFAS-containing firefighting foam and provide contacts at the fire departments located across the state so that the Contractor can obtain access. Scheduling of pickups will be coordinated between MDE and the Contractor and may be subject to specific Work Orders.

The State will make available information to facilitate the Contractor’s performance and provide additional assistance and services specifically set forth in the RFP.

https://mgaleg.maryland.gov/mgawebsite/Legislation/Details/SB0273/?ys=2022rs

RFP for Maryland Department of the Environment Page 9 of 125

2.2.4 Existing Reporting

MDE possesses information concerning the location, means of storage, volume, and condition of the containers from fire departments across Maryland, which is available to Offerors as Appendix 3 in this RFP. This list may be updated and additional fire departments with stockpiles of PFAS-containing foam may be added to the list as information is received by MDE.

2.2.4.1 It is understood that this contract may not be sufficient to pick up all PFAS-containing firefighting foam concentrate that exists in Maryland.

2.3 Contractor Responsibilities and Tasks

2.3.1 PFAS Foam Concentrate Pick-up. The Contractor(s) shall perform pick-up, transport, and disposal services of PFAS fire-fighting foam concentrate for eligible and willing fire departments throughout the state as directed by MDE through work orders. Maryland law prohibits the disposal of these materials in a landfill or incinerator in Maryland. Transportation and disposal must occur outside of Maryland.

2.3.2 MDE does not know whether additional fire departments have stockpiles of PFAS-containing foam as not all fire departments have responded. Additional departments or stockpiles may be added to the list as information is obtained.

2.3.3 Regulatory requirements. PFAS-containing firefighting foam concentrate will be picked up and transported following all regulatory requirements for the management of controlled hazardous substances to a permitted hazardous waste incinerator or other preferred method of disposal outside of Maryland. These include the Maryland regulations under COMAR 26.13 (see https://mde.maryland.gov/programs/Permits/Pages/ComarOnline.aspx ) and any U.S. Department of Transportation requirements for the interstate transport of these materials.

2.3.4 MDE requirement. The Contractor shall track and report expenditures, and coordinate pick-ups with the Contract Monitor so that the funds allocated are not exceeded.

2.3.5 Disposal Site Restrictions

2.3.4.1 PFAS-containing firefighting foam concentrate may not be disposed of at any landfill or incinerator located in Maryland.

2.3.4.2 If a disposal method that is not landfilling or incineration becomes available within the State of Maryland, the Contractor may request authorization to use the alternative facility or method, but it may be utilized only with the approval of MDE following review of data describing the process and documenting PFAS destruction efficiency to the satisfaction of MDE.

https://mde.maryland.gov/programs/Permits/Pages/ComarOnline.aspx

RFP for Maryland Department of the Environment Page 10 of 125

2.3.4.3 Any disposal facility located outside of Maryland must be authorized by the state, territory, or country in which the facility is located to accept PFAS foam concentrate.

2.3.4.4 Vehicle Certification. Any vehicle used to haul PFAS foam concentrate must have a current Maryland Controlled Hazardous Substance Vehicle Certification – see 2.17 CHS Hauler and Vehicle Certification.pdf (maryland.gov)

2.3.4.5 Scheduling of PFAS-containing Foam Concentrate. The Contractor shall coordinate the pick-up of PFAS-containing firefighting foam concentrate with the Contract Monitor. Pickups shall be made within ten (10) business days of notification by the Contract Monitor that containers of PFAS-containing foam at a specific location are ready to be picked up.

2.3.4.6 Transportation and Storage. Storage of picked-up PFAS-containing foam concentrate may not occur in Maryland for longer than 24 hours unless approved by MDE. The storage conditions during transportation must be the same as those for temporary stoppage during transport of controlled hazardous substances described in COMAR 26.13.04.01E (see Pages - 26.13.04.01.aspx (maryland.gov)) .

2.3.6 Contractor-Supplied Hardware, Software, and Materials

The Contractor shall supply all equipment needed to safely pick up and transport the PFAS-containing firefighting foam concentrate, including personal protective equipment; overpack containers for deteriorated containers; hand trucks, carts, or other manual transportation equipment; appropriate labels; spill containment and cleanup supplies; and any other necessary equipment.

2.4 Deliverables

2.4.1 Deliverable Submission

2.4.1.2 Documentation of Shipment. The Contractor(s) shall report that a shipment has occurred via email to the Contract Monitor within one (1) business day of the date that the shipment has occurred. The notification shall include the date, time and location from which the shipment occurred; the amount of PFAS-containing firefighting foam concentrate shipped; if shipped via a motor vehicle, the vehicle certification number; the locations from which the foam concentrate was picked up; the identity and address of the facility to which the https://mde.maryland.gov/programs/permits/LandManagementPermits/Documents/2.17%20CHS%20Hauler%20and%20Vehicle%20Certification.pdf https://dsd.maryland.gov/regulations/Pages/26.13.04.01.aspx https://dsd.maryland.gov/regulations/Pages/26.13.04.01.aspx

2.4.1.4 Documentation of Final Disposal. If the date of final disposal is different than the date of delivery to the disposal site, the Contractor(s) shall obtain from the disposal site the date when the shipment was finally disposed of.

2.4.1.5 Monthly Summary. The Contractor(s) shall submit to MDE by the 10th day of each month a summary of the pick-ups, disposal deliveries, dates of final disposal, and costs that occurred during the preceding calendar month. Unless otherwise required by the Contract Monitor, these may be emailed to MDE.

2.4.1.6 Manifests. These notification requirements do not supersede the requirements for filing a hazardous waste manifest in accordance with State and federal regulations if the material being transported is a hazardous waste.

2.4.1.7 Document Format. Unless specified otherwise, written deliverables shall be compatible with Microsoft Office within two (2) versions of the current version. At the Contract Monitor’s discretion, the Contract Monitor may request one hard copy of a written deliverable.

2.4.1.8 Deliverable Review Cycle. A standard deliverable review cycle will be elaborated and agreed-upon between the State and the Contractor(s). This review process is entered into when the Contractor completes a deliverable.

2.4.1.9 Draft Versions Upon Request. For any written deliverable, the Contract

Monitor may request a draft version of the deliverable, to comply with the minimum deliverable quality criteria listed in Section 2.4.3 Minimum Deliverable Quality. Drafts of each final deliverable, except status reports, are required at least two (2) weeks in advance of when the final deliverables are due (with the exception of deliverables due at the beginning of the project where this lead time is not possible, or where draft delivery date is explicitly specified). The Contract Monitor is responsible for coordinating comments and input from various team members and stakeholders. The Contract Monitor is responsible for providing clear guidance and direction to the Contractor in the event of divergent feedback from various team members.

2.4.2.3 Notice of Acceptance. The Contract Monitor will issue to the Contractor a notice of acceptance or rejection of the deliverable in an email. Following the return of the deliverable indicating “Accepted” and signed by the Contract Monitor, the Contractor shall submit a proper invoice in accordance with the procedures in Section 3.3. The invoice must be accompanied by a copy of the acceptance email or payment may be withheld.

2.4.2.4 Deliverable Rejection. In the event of rejection, the Contract Monitor will formally communicate in writing any deliverable deficiencies or non-conformities to the Contractor, describing in those deficiencies what shall be corrected prior to acceptance of the deliverable in sufficient detail for the Contractor to address the deficiencies. The Contractor shall correct deficiencies and resubmit the corrected deliverable for acceptance within the agreed-upon time period for correction.

2.4.3 Minimum Deliverable Quality

However, if the Contract Monitor deems it necessary and in the State’s best interests to remove the Contractor Personnel with less than fifteen (15) days’ notice, the Contract Monitor may direct the removal in a timeframe of less than fifteen (15) days, including immediate removal.

6. In circumstances of directed removal, the Contractor shall, in accordance with paragraph 2.6.4.A.1 of this section, provide a suitable replacement for approval within fifteen (15) days of the notification of the need for removal, or the actual removal, whichever occurs first.

B. Key Personnel Replacement

1. To replace any Key Personnel in a circumstance other than as described in 2.6.4.A including transfers and promotions, the Contractor shall submit a substitution request as described in Section 2.6.3.B. to the Contract Monitor at least fifteen (15) days prior to the intended date of change.
