About this file
Amendment 1 to RFP U00R5600172 is issued by the Maryland Department of the Environment (MDE) for the pick-up, transport, and disposal of PFAS-containing firefighting foam concentrate. The preproposal conference was held on April 3, 2025, at MDE's lobby in Baltimore, Maryland, and the RFP is a Small Business Reserve (SBR) solicitation, meaning only certified SBR firms can be awarded the contract. The RFP involves collecting firefighting foam from eligible fire departments across Maryland, with MDE coordinating pickup and disposal logistics. Contractors must follow specific regulatory requirements, including transporting and disposing of materials outside Maryland within 24 hours, using vehicles with current Maryland Controlled Hazardous Substance Vehicle Certification, and reporting pick-up and shipment details to the Contract Monitor within one business day.
The solicitation includes an MBE participation goal, and contractors may subcontract regionally to MBE subcontractors. MDE does not reveal the budget to obtain the most advantageous pricing and acknowledges that the contract may not cover all PFAS-containing firefighting foam in Maryland. The contractor must supply all necessary equipment for safe pick-up and transport, including personal protective equipment, overpack containers, transportation equipment, labels, and spill containment supplies. Any disposal facility outside Maryland must be authorized to accept PFAS foam concentrate, and the storage of picked-up materials is strictly limited to 24 hours unless MDE provides written approval for an extension.

Amendment 1 to RFP U00R5600172 – Fire Fighting Foam Collection and Disposal
This Amendment 1 is being released to provide Preproposal Conference notes and Conference attendees. Amended pages of the RFP to correct errors are also included.
Preproposal Conference Notes:
The conference was held on April 3, 2025 at 9:30 am in MDE’s lobby at 1800 Washington Blvd., Baltimore Maryland.
This is a Small Business Reserve (SBR) only RFP. Award will be made to a certified SBR.
Contractors must be certified at the time of award.
There is an MBE participation goal on this RFP. See the key information sheet for details.
A Contractor may coordinate the overall SOW and subcontract regionally to MBE subcontractors.
MDE does not reveal budget information in order to obtain the most advantageous pricing for the State.
Coordination of pickup and disposal with the fire stations in Maryland will be assisted by
MDE.
MDE does not know the full extent of the materials stored by the fire stations. We anticipate it is stored in drums, buckets or other storage means.
MDE may share the volume of or quantities of materials stored.
MDE does not have a preference for the disposal method of the products. See section
2.3.5 for restrictions.
MDE may be able to allow flexibility for the 24 hour storage in Maryland requirement.
Section 2.3.5.6 Transportation states: Storage of picked-up PFAS-containing foam concentrate may not occur in Maryland for longer than 24 hours unless approved by MDE and amended to include “in writing”.
Attached to this document are the changes to the RFP highlighted in orange.

Q: We recently discovered that our firm is currently certified as a Small Business Enterprise (SBE) and Disadvantaged Business Enterprise (DBE) in Maryland, we are not listed as a Minority Business Enterprise (MBE). Given our DBE and SBE certifications, would our firm be considered as meeting the intent of the MBE participation goals for this solicitation?
A. Contractors must be a certified Small Business Reserve firm (SBR). Unfortunately, SBE and DBE are federal programs, and they do not meet State requirements.
Information about the SBR program is available at:
https://gomdsmallbiz.maryland.gov/Pages/sbr-Program.aspx
B. Certification may be done quickly, in some cases same day. SBR Certification can only be completed online through the vendor registration process on the state's eProcurement platform - eMaryland Marketplace Advantage (eMMA). Vendors must register for an eMMA account.
C. MBE Contractors must be certified with MDOT at the time of submission.
Offerors must acknowledge all amendments with your proposal.
As a reminder, questions must be submitted in writing to June Dwyer (June.dwyer1@maryland.gov) and will be answered publicly.
Amendment #2 shall be released as soon as possible with answers to questions.
Thank you, June Dwyer https://gomdsmallbiz.maryland.gov/Pages/sbr-Program.aspx mailto:June.dwyer1@maryland.gov

PFAS Firefighting Foam Concentrate Pick-up and Disposal
Solicitation #: U00R5600172 RFP Document
RFP for Maryland Department of the Environment Page 9 of 125
2.2.4 Existing Reporting
MDE possesses information concerning the location, means of storage, volume, and condition of the containers from fire departments across Maryland, which is available to Offerors as Appendix 3 in this RFP. This list may be updated and additional fire departments with stockpiles of PFAS-containing foam may be added to the list as information is received by MDE.
2.2.4.1 It is understood that this contract may not be sufficient to pick up all PFAS-containing firefighting foam concentrate that exists in Maryland.
2.3 Contractor Responsibilities and Tasks
2.3.1 PFAS Foam Concentrate Pick-up. The Contractor(s) shall perform pick-up, transport, and disposal services of PFAS fire-fighting foam concentrate for eligible and willing fire departments throughout the state as directed by MDE through work orders. Maryland law prohibits the disposal of these materials in a landfill or incinerator in Maryland. Transportation and disposal must occur outside of Maryland.
2.3.2 MDE does not know whether additional fire departments have stockpiles of PFAS-containing foam as not all fire departments have responded. Additional departments or stockpiles may be added to the list as information is obtained.
2.3.3 Regulatory requirements. PFAS-containing firefighting foam concentrate will be picked up and transported following all regulatory requirements for the management of controlled hazardous substances to a permitted hazardous waste incinerator or other preferred method of disposal outside of Maryland. These include the Maryland regulations under COMAR 26.13 (see https://mde.maryland.gov/programs/Permits/Pages/ComarOnline.aspx ) and any U.S. Department of Transportation requirements for the interstate transport of these materials.
2.3.4 MDE requirement. The Contractor shall track and report expenditures, and coordinate pick-ups with the Contract Monitor so that the funds allocated are not exceeded.
2.3.5 Disposal Site Restrictions
2.3.5.1 PFAS-containing firefighting foam concentrate may not be disposed of at any landfill or incinerator located in Maryland.
2.3.5.2 If a disposal method that is not landfilling or incineration becomes available within the State of Maryland, the Contractor may request authorization to use the alternative facility or method, but it may be utilized only with the approval of MDE following review of data describing the process and documenting PFAS destruction efficiency to the satisfaction of MDE.
