About this file
Amendment 4 is a question and answer document issued by the Maryland Department of the Environment (MDE) for RFP U00R5600172, a solicitation for PFAS Firefighting Foam Pickup and Disposal. The amendment addresses multiple vendor questions regarding the Request for Proposal, maintains the proposal due date of Friday, May 23, 2025 at 2 pm, and clarifies several key aspects of the procurement including container sizes, transportation logistics, and Minority Business Enterprise (MBE) participation requirements. The document provides specific guidance on administrative expectations, such as the need for offerors to acknowledge all amendments and make good-faith efforts to include MBE subcontractors.
The amendment highlights several critical procurement nuances, including that transportation of hazardous materials is limited to two certified MDE providers, and that MBE participation is required despite potential SBR (Small Business Reserve) designations. The document indicates that disposal will likely involve vacuum trucks or tankers making "milk runs" to collect waste from multiple locations, with pricing potentially based on per-gallon or certified weight measurements. Vendors are advised that waivers for MBE participation are not automatically granted and will require documented evidence of good-faith outreach efforts. Additionally, the amendment suggests complexity around waste characterization, specifically requesting clarification on whether the collected material will be rinsate or concentrate, which could significantly impact disposal costs.

Amendment 4
RFP U00R5600172 – PFAS Firefighting Foam Pickup and Disposal
This amendment is being released to answer additional questions. Based on the due date and time necessary to research the questions to provide answers, some questions may not be able to be answered.
Proposals are due on Friday, May 23, 2025 at 2 pm.
Looking at the bid form it was changed to remove the administrative cost, why?
The updated price form has a space to add Additional Pricing and explain what it is. It does not specify administrative costs.
Are you going to provide the sizes or range of these containers?
Pictures were provided with Amendment 3 showing the containers we are aware of.
Are these containers DOT approved for this waste?
Based on the sizes, will the Fire Departments be responsible for loading our trucks or are we to assume all containers are less then 55 gallons.
MDE cannot assume the Fire Departments will load trucks and MDE cannot assume that all are less than 55 gallons.
STI typically provides a vacuum truck or tanker to remove this materials. Providing “milk runs” to pick up wastes from several locations. Much more cost effective.
The disposal facilities typically provide per gallon price but shouldn’t be a problem to obtain a certified weight.
Typically a SBR Designation eliminates the need for MBE participation, so why have it.
An SBR designation does not eliminate the need for MBE participation. They are two separate and distinct state programs.
This work is simply pickup and transportation. No facilities are MBE owed, transportation by a Certified MDE in MD for hazardous materials is only two and STI is one of them. The other is not even listed. I don’t see any firm achieving your request goals.
Offerors must make every good-faith effort to reach out to MBE firms to subcontract the work. If after that due diligence has been completed the firm cannot find MBE subs, a waiver may be requested. Waivers are not automatically granted and Offerors must furnish documentation of their good faith efforts if they are selected for award of the Contract. That request is evaluated and a determination is made to grant or deny the request.
STI has removed this waste from Fire Houses and it requires triple rinsing of the Fire Engines, will this waste be rinsate or concentrate ? Big difference in disposal costs ?
Please review Amendment 3 Q&A.
Offerors must acknowledge all amendments when submitting their proposals.
Thank you.
