ARCHITECTURAL AND ENGINEERING SERVICES FOR THE DESIGN FOR
THE CONSTRUCTION OF THE MIDSHIPMEN ACTIVITES CENTER
LOCATED AT THE
U.S. MERCHANT MARINE ACADEMY
SECTION 1 - INTRODUCTION
1.1 This statement of work describes the services of the Architect Engineer (hereafter referred to as A/E) for the investigation and design for the construction of a new facility for the Midshipmen Activities Center (MAC) located at the United States Merchant Marine Academy, Kings Point (hereafter referred to as the Academy or the Government). All architectural and engineering construction drawings and specifications shall be signed and sealed by licensed design professionals in New York State specializing in their respective field or trade such as electrical, architectural, mechanical, structural, civil, etc.
1.2 The Academy is in operation 365 days a year, 24 hours a day, and must continue to be in operation during all phases of the design and construction.
1.3 A complete engineering investigation is required resulting in the design and development of plans and specifications, including associated cost estimates of all trades involved in the work as outlined in this statement of work.
SECTION 2 - PURPOSE
2.1 The primary purpose of this statement of work is to investigate and design for the construction of the new MAC facility located at the U.S. Merchant Marine Academy.
2.2 Design and specifications shall be in accordance with all current local, state and federal regulations, building codes as applicable and authorities having jurisdiction. The New York State Building Code will primarily govern.
2.3 A proposal and schedule shall be submitted to the Academy for approval before any work shall commence.
SECTION 3 - INVESTIGATION AND PREPARATION OF THE DESIGN
3.1 The design shall consider the following but is not be necessarily limited to:
3.1.1 Investigate and review the existing conditions of the site. Currently, two facilities exist on the footprint that the new MAC will be placed. Both Land Hall and Melville Hall will be demolished. The A/E shall incorporate the demolition of these two facilities in conjunction with the construction of the new MAC. The design shall be fully coordinated with adjacent areas and associated existing conditions.
3.1.2 Investigate and review the programming requirements with the USMMA staff.
3.1.3 The A/E shall review, understand and verify the recent USMMA Space Utilization Report.
3.1.4 The A/E shall become familiar with all USMMA requirements for the MAC.
This will include but is not limited to a main entrance/lobby, game room area, video game rooms, student activities office, study rooms, computer lab, grab and go, café, pub, movie theater, large conference room, roof top deck and fitness center. Attached is the requirements document written by the program manager (see Exhibit A).
3.1.5 Construction design specifications shall use of the maximum practicable amount of recovered materials consistent with the performance requirements, availability, price reasonableness, and cost-effectiveness.
Energy conservation, pollution prevention, and waste reduction shall be considered to the maximum extent practicable in developing the construction design specifications.
3.1.6 Energy and water efficient products shall be considered to the maximum extent practicable in the construction design specifications.
3.1.7 To be considered for architect-engineer contracts, a firm must file with the appropriate office or board the Standard Form 330, “Architect-Engineer Qualifications,” Part II, and when applicable, SF 330, Part I, and provide that information with the proposal submission
SECTION 4 - SCOPE
4.1 The A/E firm shall perform all professional architectural and engineering services to accomplish the items in the sections above including but not limited to the following:
4.1.1 The A/E shall provide an onsite evaluation and design for the demolition and construction of the site for the new MAC.

4.1.2 The A/E will meet with USMMA management and staff to understand and identify the Academy’s mission, requirements and plan.
4.1.3 The A/E shall design for systems for mechanical, electrical and plumbing systems, information technology system, PA system, fire protection, etc.
4.1.4 The A/E design will include demolition drawings.
4.1.5 The new design and specifications will be based on the coordination of the constraints of the footprint including clearances, new facility components and systems.
4.1.6 The new design by the A/E will illustrate the coordination on the detailed plans and sections.
4.1.7 The A/E will perform a comprehensive, thorough and detailed in house, with sub-consultants if applicable, quality control and coordination review to ensure their new design will result in minimum change orders.
4.1.8 Prepare preliminary and final designs and specifications that meet the
USMMA programming and phasing requirements required to support the USMMA operational requirements.
4.1.9 Prepare detail estimates of probable construction and material costs for each design submission.
4.1.10 A/E shall provide to USMMA all necessary licenses and permits requirements required to perform the work. This shall include any environmental permits or permits required by the Town or Village.
4.1.11 The USMMA contains historic properties, which have been listed on the
National Register of Historic Places. USMMA, a federally owned and operated facility, plans to carry out this project subject to review under Section 106 of the National Historic Preservation Act (NHPA), 16 U.S.C. § 470f, and its implementing regulations, 36 C.F.R. § 800. A/E shall also ensure that all State Historic Preservation Office requirements are met for this project.
4.1.12 A/E shall ensure all National Environmental Policy Act requirements are met for this project. This includes compliance with all environmental laws and obtaining all approval and clearance documents from the USG.
4.1.13 A/E shall attend all conferences at the USMMA with USMMA personnel and contractors as required to support this project.
4.1.14 A/E shall provide technical consultations concerning interpretations of plans and specifications, and changes incidental thereto, and periodic site visits during the design phases.
4.2 The A/E shall be responsible for presenting their best efforts for phasing of the project in order to obtain maximum efficiency, cohesive design, and minimum adverse impact on the Academy.
4.3 A complete investigation is required resulting in the findings, recommendations, and cost estimates. All cost estimates shall be detailed enough to explain what is required to construct the prepare the site and construct the new facility.
4.4 The A/E shall furnish the Academy two (2) copies of the final report for the schematic report, design development and 100% construction documents as well as the electronic copy.
SECTION 5 - DESIGN/PRE-CONSTRUCTION STAGE
5.1 In addition to and /or further definition of the services noted in Section 4, the A/E shall provide the following:
5.1.1 Schematic Design Phase (30% Completion Stage)
5.1.1.1 Review of the program by meeting with Academy personnel to ascertain the requirements of the project and shall confirm such requirements in writing to the Contracting Officer and other attendees.
5.1.1.2 Based on the mutually agreed program the A/E shall prepare schematic design studies consisting of drawings and other documents illustrating the scale and relationship of program components for Academy approval.
5.1.1.3 A detailed Preliminary Statement of Probable Construction Costs.
5.1.2 Design Development Phase (60% Completion Stage)
5.1.2.1 Design Development Documents consisting of drawings and other documents to fix and describe the size and character of the project as to structural, materials and such other essentials as may be appropriate.
5.1.2.2 An updated, detailed Statement of Probable Construction Cost.
5.1.3 Development of Construction Documents Phase (100% Completion
Stage)
5.1.3.1 The contractor shall prepare construction design drawings and specifications, including the necessary bid information and required special and general conditions from approved Design Development Documents.
5.1.3.2 A final detailed Statement of Probable Costs.
5.1.3.3 The A/E shall assist, if requested, in the preparation of bid forms, unique conditions of the Contract, and the form of the Agreement between the Government and the Contractor.
5.1.3.4 The A/E shall promptly provide answers to all technical engineering questions from the Government.
5.1.3.5 During construction, the A/E shall provide standard construction phase services and shall review contractor operations and necessary inspections of the project along with his consultants and attend monthly job progress meetings.
5.2 The A/E shall accomplish the following in the design stages and provide additional data as indicated:
5.2.1 Planning and designing the project in accordance with applicable local, state and federal codes, Federal Specifications and Standards, Design Criteria, NYS Building Codes, Handbooks as authorized by the General Services Administration (GSA) and the Occupational Safety and Health Administration (OSHA).
SECTION 6 - CONSULTATIONS, REPORTS, DRAWINGS, DATA, ETC.
6.1 During the life of the project the A/E shall periodically formally consult with the Academy. During design the meetings will be biweekly or as required. The consultations/meetings may be requested by the A/E or established by the Contracting Officer.
6.1.1 The Academy shall establish an official committee with one individual designated as Chairman to provide authoritative decisions. The committee members may be rotated from time to time. Permanent members of the Committee are:
6.1.1.1 Director of CIP, Committee Chairman.
6.1.1.2 Contracting Officer, USMMA.
6.1.1.3 Capital Improvement Plan Officer, USMMA, Delegated authority of the Contracting Officer’s Representative (COR).
6.1.1.4 Department Head(s) as may be specified.
6.1.2 After each such meeting, the A/E shall prepare minutes of the meeting, noting such items as, items discussed, decisions reached, future plans, impact on costs, recommendations, schedules, etc. The report shall be forwarded to the Academy, Attention: Director of Capital Improvements, within five (5) working days of the meeting. Sufficient copies of the report shall be forwarded for the Contracting Officer’s Representative for distribution to the attendees.
6.1.3 The A/E shall be responsible for establishing formal design review with the
Academy at the 30%, 60% and 100% design phases. Scheduling of the design reviews shall be coordinated with the COR sufficiently in advance, no less than ten (10) working days, for the Academy to arrange for all Government attendees. Each design review shall be accompanied by a cost estimate within the Government funding levels.
6.2 The A/E shall prepare and furnish one (1) set of reproducible and then two (2) sets of drawings, specifications, etc., during all stages of the project that require Academy approval. The documents shall be appropriately identified as for example, Preliminary Review 1, 30% complete, etc.
6.3 Final 100% design submission by the A/E shall consist of two (2) complete, collated and bound sets of all contract drawings and bound specifications for this project. Electronic versions to the USMMA’s specifications will be provided of all specifications, drawings, and work products. The A/E will provide AUTOCAD drawings of the 100% construction bid set and of the final as-built drawings.
6.4 Drawings, specifications, etc. shall clearly define all architectural, structural, mechanical, equipment and other details of the project necessary to complete its design and construction including but not limited to floor plans, elevations, sections and details.
6.5 The A/E assumes complete responsibility for the correctness and accuracy of all the final drawings and specifications, in accordance with FAR 52.236-23 “Responsibility of the Architect-Engineer Contractor.” Sufficient copies of revised design drawings will be furnished by the A/E. The A/E shall not be held responsible for any additional construction costs resulting from incorrect assumptions made in connection with hidden conditions where confirmation cannot be obtained through standard professionally accepted inspection techniques.
6.6 The final Statement of Probable Costs shall not exceed the amount approved unless authorized by the Government. In the event the bid of the lowest responsible bidder for the construction of the project is in excess of the approved final Statement of Probable Costs; the A/E shall revise all or any part of the design to bring the cost within the approved final estimate. To this extent, the A/E may establish alternate approaches.
SECTION 7 - CONSTRUCTION PHASE
7.1 The Construction Phase shall commence with the award of a construction contract(s) and shall terminate when a “punch list” of discrepancies has been rectified and a Certificate of Occupancy, if applicable, is issued.
7.2 The A/E shall have access to the work whenever it is in preparation or progress. The visits of the A/E shall be coordinated with the Director of Capital Improvements, U.S. Merchant Marine Academy.
7.3 The A/E shall make monthly periodic, 8-hour day, equivalent visits to the site.
The A/E shall also attend periodic, usually bi-weekly, job progress meetings.
Attendance at job meetings is credited to the required on-site visits. The A/E will review the work in progress and submit field observation reports weekly indicating discrepancies and required corrections to meet construction document requirements and building code compliance.
7.4 The A/E shall also arrange and provide for all on-site inspections by his consultants. The Consultant’s visits are not considered additional site visits.
7.5 For the purpose of ascertaining the amount properly payable on the Contractor’s Applications for Payment, the A/E may be requested to aid in determining the percentage completed based on observations or other techniques. The payment recommendations presented by the A/E comprises his best judgment that the work progressed to the point indicated and that to his best knowledge and belief, the quality of the work is in accordance with the Contract Documents.
7.6 The A/E shall be, in the first instance, the interpreter of the requirement of the technical plans and specifications.
7.6.1 The A/E shall make recommendations to the Government on all claims by the Contractor (or the Government) regarding the execution and progress of the work performed and any matters or questions relating thereto.
7.6.2 Visits to the Academy by the A/E necessitated by questions of interpretation or clarification of the plans/specifications are deemed normal A/E services and not part of 7.3 or 10.1.
7.7 The A/E shall promptly recommend to the Government rejection of work, which does not conform to the plans and specifications.
7.7.1 Whenever in the A/E’s opinion it is considered necessary or advisable for the proper implementation of the intent of the plans and specifications, the A/E shall recommend that the Government require special inspection or testing of any work in accordance with the provisions of the Contract Documents whether or not such work is fabricated, installed, or completed.
7.8 The A/E shall review and make appropriate notations, for example, no exception, acceptable as noted, resubmit required, etc., for all shop drawings, samples, catalogue cuts, “as-built” drawings, and other submissions of the Contractor.
7.8.1 The A/E shall advise the Contractor, in writing of A/E comments within fifteen (15) calendar days of receipt of such data. Copies of all such correspondence shall be directed to the Contracting Officer, Contracting Officer’s Representative (COR), and the Director of Capital Improvements, U. S. Merchant Marine Academy or his designee.
7.9 The A/E shall assist or aid, when requested, in the preparation of Change
Orders in accordance with Government Standards.
7.10 The A/E shall receive, review, assemble and list all written documents and guarantees received from the Contractor and present same to the Government.
SECTION 8 - DELIVERY SCHEDULE
8.1 The A/E shall provide final plans, drawings, and specifications not later than one hundred and eighty (180) days after Notice-to-Proceed. An earlier schedule is acceptable to the Academy.
8.2 The A/E shall prepare and submit a detailed milestone A/E Program
Schedule(s) for the Academy review within one (1) week after receipt of executed copy of the Contract or authorized Notice-to-Proceed, whichever is earlier.
8.3 The A/E shall apply for and obtain necessary variances from state agencies for the abatement of asbestos materials associated with this project prior to the completion of the final contract documents.
SECTION 9 - CONTRACT PRICE AND PAYMENT SCHEDULE
9.1 The Government shall pay the A/E on a percentage complete basis the total sum to be negotiated which shall constitute full compensation for all services, materials, expenses, indirect costs, and profit for the program detailed herein except as herein after identified.
9.2 Invoices from the A/E shall be submitted electronically to the following:
9.2.1.1 MaradObligations@faa.gov
9.2.2 1 original – Director of CIP, USMMA
9.2.3 1 copy – Contracting Officer
9.2.4 1 copy – Office of Academy Financial Management
9.3 The processing of the invoice for payment shall only commence after the COR or his designee has certified, in writing, that the invoice is correct and proper for payment.
SECTION 10 - ADDITIONAL SITE VISITS
10.1 Only when authorized by the Contracting Officer shall additional site visits be subject to reimbursement at a rate to be negotiated per day, including all expenses based on an approximated 8 hour day or equivalent segments adding up to a full day (i.e. – ½ day units).
SECTION 11 - ADDITIONAL A/E SERVICES
11.1 If the Government requires additional services beyond this Statement of Work, the compensation shall be negotiated and, in any event, shall not exceed the following:
11.1.1 Time for employee will be based on direct labor costs multiplied by an overhead rate to be negotiated, and profit on direct labor costs and overhead.
11.1.2 Time for principals will be based on a maximum total cost of an hourly rate to be negotiated.
