specific threats). The technical information shall enhance lethality, survivability, and resiliency of a broad range of Weapon Systems;

Command, Control, Communications, Computers, Intelligence, Surveillance, and Reconnaissance (C4ISR)- enabled systems, Logistic and Sustainment capabilities, Strategic and Operational planning, and the provision of Force Protection for assigned, attached, and transiting forces as well as mission-critical infrastructure supporting multiple defense sectors in joint and coalition environments.

contractor, to include subcontracting requires prior approval of the GCA. Non-accountable COMSEC information, though not tracked in the COMSEC material control system, may still require a level of control within a document control system. Refer to NSA/CSS Manual 3-16, "Control of Communications Security Material," and the Committee on National Security Systems Instruction (CNSSI) 4001, "Control Cryptographic Items," for guidance. Contractors will follow the COMSEC security requirements of the host government activity.

Ref 10.e.(1): Contractors performing on this contract may require access to Sensitive Compartmented Information (SCI). Access to SCI will only occur at designated Government SCI Facilities (SCIFs) as determined by the host government activity. Access to SCI requires a final Top Secret U.S. Government security clearance, ICD-704 SCI eligibility, and SCI indoctrination. The host government activity will validate and approve the need-to-know before access to SCI is granted to a contractor. Prior approval from the GCA is required prior to subcontracting. See Addendum 2 for additional security requirements.

Ref 10.e.(2): Contractors performing on this contract may require access to Non-SCI intelligence information. The host government activity will validate and approve the need-to-know for contractors requiring this access. Contractors requiring this access requires a final Top Secret U.S. Government security clearance and are require to sign a non-disclosure agreement and will require access to ICD 710, “Classification and Control Marking System.” Prior approval from the GCA is required prior to subcontracting.

Ref 10.f.: Contractors performing on this contract may require access to Special Access Program (SAP) information. The host government activity will validate and approve the need-to-know for contractors requiring this access. Prior approval from the GCA is required prior to subcontracting. See Addendum 3 for additional security requirements.

Ref 10.g.: Contractors performing on this contract and who are granted access to SCI and requires access to JWICS or SIPRNet requires NATO Secret access. Access to NATO Secret requires a final U.S. Government clearance at the appropriate level and a NATO access briefing/debriefing. Addendum 6 to DD Form 254 Solicitation Contract Number: M95494-20-R-0008

ADDENDUM 6 - FOR OFFICIAL USE ONLY (FOUO)

1. General:

a. “FOR OFFICIAL USE ONLY” (FOUO) is a dissemination control marking applied by the Department of Defense (DoD) to unclassified information when disclosure to the public of that particular record, or portion thereof, would reasonably be expected to cause a foreseeable harm to an interest protected by one or more of the Freedom of Information Act (FOIA) Exemptions 2 through 9. FOUO is a category of Controlled Unclassified Information (CUI).

b. Use of the FOUO marking does not mean the information cannot be released to the public under a FOIA request, only that the Government must review the information prior to its release to determine whether a significant and legitimate government purpose is served by withholding the information or portions thereof.

c. It is the responsibility of the document’s originator to determine at origination whether the information may qualify for FOUO status and to ensure markings are applied, if required, at the time the documents are created to properly protect the information.

d. FOUO is not authorized as a means of protecting information that otherwise does not merit protection as classified for national security reasons.

2. Markings:

a. Unclassified Documents Containing FOUO:

(1) An unclassified document containing FOUO information will be marked “FOR OFFICIAL USE ONLY” at the bottom of the front cover (if there is one), the title page, the first page, and the outside of the back cover (if there is one). For consistency with classified systems, the document maybe be marked as “UNCLASSIFIED//FOR OFFICIAL USE ONLY.”

(2) Internal pages of the document that contains FOUO shall be marked “FOR OFFICIAL USE ONLY” at the bottom. For consistency with classified systems, internal pages may be marked “UNCLASSIFIED//FOR OFFICIAL USE ONLY” OR “UNCLASSIFIED//FOUO”; in such case internal pages shall be marked at both the top and bottom.

(3) Subjects, titles, and each section, part, paragraph, or similar portion of an FOUO document shall be marked to show that they contain information requiring protection. Use of the parenthetical notation “(FOUO)” or “(U//FOUO)” to identify information as FOUO for this purpose. Place this notation immediately before the text.

b. Classified Documents Containing FOUO:

(1) Information cannot be marked as classified and FOUO at the same time, because no individual element of information can be simultaneously classified and FOUO. Therefore classified documents containing FOUO information cannot bear an overall document marking of FOUO. However, portions or pages of a classified document that contain only FOUO information will be marked in a manner that identifies the FOUO content.

(2) Classified documents and material, including those in electronic form that also contain FOUO information shall be properly marked as classified. For overall markings on a classified document the highest security classification of the information will be annotated. No additional special markings are required on the face of the document because it contains FOUO.

(3) Within a classified document, an individual page that contains both FOUO and classified information will be marked at the top and bottom with the highest security classification of information appearing on the page. If an individual portion contains FOUO information but no classified information, the portion marking will be marked as “(U//FOUO).”

(4) Pages that contain FOUO information but no classified information shall be marked as “UNCLASSIFIED//FOR OFFICIAL USE ONLY” or “UNCLASSIFIED//FOUO” at the top and bottom if the overall highest classification of the document is not used as the overall page marking.

(5) Portion markings of a classified document shall be marked with the classification as required.

If there are unclassified portions that contain FOUO information, use the parenthetical notation “(U//FOUO)” at the beginning of the portion. If a portion of a classified document contains both classified and FOUO information, the appropriate classification designation is sufficient to protect the information, and no additional marking shall be used to designate the FOUO content.

c. Other Marking Requirements:

(1) FOUO information disseminated outside the Department of Defense shall also bear a marking on the outside of the front cover, first page, or at the beginning of the text that states that the information may be exempt from mandatory disclosure in accordance with the FOIA. The following statement will be used: “This document contains information that may be exempt from mandatory disclosure under the Freedom of Information Act.”

(2) Technical documents that require a distribution statement restricting disclosure and/or an export control warning notice pursuant to DoDD 5230.24 will be marked as FOUO when appropriate, in addition to the required distribution statement.

d. Marking Other Types of Media: When FOUO information is contained in media or material (including hardware and equipment) not commonly thought of as documents (e.g., computer files and other electronic media, audiovisual media, charts, maps, films, sound recordings), the requirement remains to identify, as clearly as possible, the information that requires protection. The main concern is that holders and users of the material are clearly notified of the presence of FOUO information. Refer to DoDM 5200.01, Volume 4 for specific guidance for how different types of FOUO media should be marked and annotated.

3. Access to FOUO:

a. No person may have access to information designated as FOUO unless that person has been determined to have a valid need for such access in connection with the accomplishment of a lawful and authorized Government purpose. The final responsibility for determining whether an individual has a valid need for access to information designated as FOUO rests with the individual who has authorized possession, knowledge, or control of the information, not with the prospective recipient.

b. Information designated as FOUO may be disseminated within the DoD Components and between officials of DoD Components and DoD contractors, consultants, and grantees to conduct official business for the Department of Defense, provided that dissemination is consistent with any further controls imposed by a distribution statement.

c. FOUO information may be shared with State, local, or tribal government officials, provided a specific need to know has been established and the information is shared in furtherance of an official governmental purpose. In all cases, the recipient must agree to the stipulation that the information shall be withheld by the recipient from public release.

4. Dissemination:

a. FOUO may not be disseminated to representatives of foreign governments and international organizations unless approved by the appropriate Foreign Disclosure Office.

b. FOUO may not be released to the public without Government approval.

c. FOUO information and material may be mailed via first class mail, parcel post, or, for bulk shipments, via fourth class mail.

d. Transmission of FOUO by facsimile machine (fax) is permitted but the sender is responsible for determining that appropriate protection will be available at the receiving location prior to transmission (e.g., machine attended by a person authorized to receive FOUO; fax located in a controlled government environment).

e. Use of wireless telephones should be avoided when other options are available.

f. Electronic transmission of FOUO information (e.g., websites, e-mail, smartphones, etc.) shall be by approved secure communications systems or systems utilizing other protective measures such as Public Key Infrastructure (PKI) or transport layer security (e.g., https). When FOUO is transmitted via e-mail it must be encrypted. FOUO will not be posted to any websites accessible to the public.

5. Storage of FOUO: During working hours, reasonable steps shall be taken to minimize the risk of access by unauthorized personnel (e.g., not reading, discussing, or leaving FOUO information unattended where unauthorized personnel are present). After working hours, FOUO information may be stored in unlocked containers, desks, or cabinets if Government or Government-contract building security is provided. If such building security is not provided or is deemed inadequate, the information shall be stored in locked desks, file cabinets, bookcases, locked rooms, etc.

6. Destruction of FOUO: FOUO documents may be destroyed by any of the means approved for the destruction of classified information or by any other means that would make it difficult to recognize or reconstruct the information. Shredding it the most common method used to destroy FOUO documents.

7. Unauthorized Disclosure of FOUO: Unauthorized disclosures of FOUO information does not constitute a security violation however, appropriate management action shall be taken to fix responsibility for unauthorized disclosure of FOUO whenever feasible or required by other guidance.

Appropriate disciplinary action shall be taken against those responsible. Unauthorized disclosure of some FOUO, e.g., information protected by “The Privacy Act of 1974, as amended” or export-controlled technical data may also result in civil and criminal sanctions against responsible persons. All unauthorized disclosures of FOUO will be immediately reported to the Security Manager of the Government Agency sponsoring the contractor.

The Cognizant Senior Intelligence Official (SIO) has exclusive security responsibility for all Sensitive Compartmented Information (SCI) classified material released to or developed under the contract.

Access to SCI Intelligence material requires adherence to the requirements set forth in the following:

Department of Defense (DoD) Manual (DoDM) 5105.21, Volume 1, SCI Administrative Security Manual:

Administration of Information and Information Systems Security; DoDM 5105.21, Volume 2, SCI Administrative Security Manual: Administration of Physical Security, Visitor Control, and Technical Security; DoDM 5105.21, Volume 3, SCI Administrative Security Manual: Administration of Personnel Security, Industrial Security, and Special Activities; ICD 403, Foreign Disclosure and Release of Classified National Intelligence; ICD 701, Security Policy Directive for Unauthorized Disclosures of Classified Information; ICD 703 Protection of Classified National Intelligence Including Sensitive Compartmented Information; ICS 703-02, Reporting Requirements for Individuals with Access to Sensitive Compartmented Information; ICS 703-03, Protection of Classified National Intelligence Including SCI Shared with Entities Outside the Intelligence Community; ICS 703-04, Foreign Ownership, Control, or Influence (FOCI); ICD 710, Classification Management and Control Markings Systems; ICPG 710.1, Application of Dissemination Controls: Originator Control (ORCON); DoD 5220.22-M, Change 2, National Industrial Security Program Operating Manual (NISPOM); DoDM 5200.01, Volumes 1-4, DoD Information Security Program; and Security Executive Agent Directive (SEAD) 3, Reporting Requirements for Personnel with Access to Classified Information or who hold a Sensitive Position. Contractor’s will comply with all regulations/manuals/directives stated therein which provide the necessary security and classification guidance for personnel, information, physical, automated information security (AIS), and technical security measures and is a part of the SCI security specifications for the contract. Inquiries pertaining to SCI classification guidance or interpretations shall be directed to the Contracting Officer/Contracting Officer Representative (COR) identified on the attached DD Form 254.

1. Requirements for access to SCI:

a. All SCI will be handled in accordance with special security requirements, which will be furnished by the host government activity Special Security Officer (SSO).

b. SCI will not be released to contractor employees without specific release approval of the originator of the material as outlined in governing directives; based on prior approval and certification of "need-to-know" by the designated COR.

c. The contractor must restrict access to only those individuals who possess the necessary security clearance and who are actually providing services under the contract with a valid need-to-know. Further dissemination to other contractors, subcontractors, other government agencies, private individuals or organizations is prohibited unless authorized in writing by the originating agency through the COR.

d. Names of contractor personnel requiring access to SCI will be submitted to the COR for approval.

(The COR is identified on the DD Form 254). Upon receipt of written approval from the COR, the company security officer will submit request(s) for special background investigations, in accordance with the NISPOM, to the Defense Security Service (DSS).

e. SCI material must not be released to foreign nationals or immigrant aliens whether they are consultants, U.S. contractors, or employees of the contractor and regardless of the level of their security clearance, except with advance written permission from the originator. Requests for release to foreign nationals shall be initially forwarded to the COR and shall include:

(1) A copy of the proposed disclosure.

(2) Full justification reflecting the benefits to U.S. interests.

(3) Name, nationality, particulars of clearance, and current access authorization of each proposed foreign national recipient.

f. Contractor personnel must maintain accountability for all intelligence materials released to their custody.

g. SCI material will not be reproduced without prior approval of the originator of the material. All SCI material shall bear a prohibition against reproduction while in the contractor’s custody.

h. Inquiries pertaining to classification guidance on SCI will be directed through the CSSO to the responsible COR as indicated on the DD Form 254.

i. SCI released to cleared-DoD Contractors, all reproductions thereof, and all other information generated based on, or incorporating data from, in support of this contract, remains the property of the U.S. Government. Upon completion or cancellation of the contract, all SCI material furnished will be returned to the direct custody of the supporting SSO, or destroyed IAW instructions outlined by the

COR.

j. SCI will be stored and maintained only in properly accredited facilities meeting the physical security requirements in ICD 705, SCI Facilities and ICS 705, Technical Specifications for Construction and Management of SCI Facilities.

k. The MARFORPAC SSO will recognize the above noted estimated completion date (ECD) as the completion date for the contract. The SSO will initiate action to debrief contractor personnel with access to this contract unless extensions or modifications to the contract are received by the SSO office no later than 30 days after the established completion date.

l. The contractor is governed by ICD 704, “Personnel Security Standards and Procedures Governing Eligibility for Access to Sensitive Compartmented Information (SCI) And Other Controlled Access Program Information” and may be supplemented by SSO Navy guidance. Contractor personnel, assigned to this contract, that are eligible for access to SCI or currently possess an SCI personnel security clearance with another non-DoD agency must have their SCI eligibility adjudicated by the DoD Consolidated Adjudications Facility (CAF) prior to having access to SCI information retained by MARFORPAC, unescorted access to MARFORPAC spaces, and receipt of an MARFORPAC issued contractor badge. The contractor will identify, in writing, contractor personnel assigned to this contract by NAME, SSN, Date and Place of Birth, and provide this documentation to the CO/COR identified on the DD 254. The CO/COR will identify the SCI caveats for the contract and forward a copy of this documentation to the SSO for processing. This documentation will be marked and protected under the Privacy Act of 1974.

m. Electronic processing of SCI must be accomplished on equipment accredited in accordance with DoDM 5105.21 Volumes 1- 3, ICD 503, Information Technology System Security Risk Management, Certification and Accreditation, and the DoDIIS Joint Security Implementation Guide (DJSIG), Appendix D.

n. SCI security management issues shall be directed to MARFORPAC SSO at (808) 477-8451.

o. In accordance with Director of National Intelligence Memorandum 5 May 2017, Access to North Atlantic Treaty Organization (NATO) Information by Intelligence Community (IC) Personnel and Naval Intelligence Security Policy Directive 17-008 Revision, Mandate for North Atlantic Treaty Organization (NATO) Information by Intelligence Community (IC) Personnel, all DoN Contractors with SCI access and access to JWICS or SIPRNet must be briefed into NATO Secret Information.

2. Additional security guidance specific to the SCI contract will be provided by the COR and the MARFORPAC SSO to identify security classification guides and program specific security guidance that define technical and safeguarding requirement identified in the SOW/PWS/SOO.

Addendum 3 to DD Form 254

ADDENDUM 3 – RELEASE OF SPECIAL ACCESS PROGRAM INFORMATION TO U.S. CONTRACTORS

1. If access to any Special Access Program (SAP) information is required for a contractor performing under this contract, it will only occur at the host government activity and not at any contractor facility.

2. Before access to any SAP information is provided to a contractor performing under this contract, they will be identified and nominated by the host government activity manager overseeing the performance of the contractor and then coordinated with the host government activity Program Security Officer (PSO) or Program Security Manager (PSM) for approval and indoctrination.

3. If SAP access is granted to a contractor performing under this contract the host government activity PSO or PSM will be responsible for all SAP related security education, training, reporting, and records retention.

4. If SAP access is required for a contractor performing under this contract, the contractor:

a. Must be a U.S. Citizen. Immigrant aliens or foreign nationals are not eligible for SAP access.

b. Must have been granted a final Top Secret U.S. Government security clearance. Contractors granted temporary (interim) security clearance are not eligible for SAP access.

c. Must have been granted final SCI – ICD 704 eligibility by a U.S. Government cognizant authority.

Contractors granted temporary (interim) SCI eligibility are not eligible for SAP access.

5. If SAP access is granted to a contractor performing under this contract, applicable SAP security classification guides will be provided by the host government activity PSO or PSM.

6. Contractors being nominated for SAP access under this contract must consent to random Counter-intelligence polygraphs.

7. The hand-carrying/couriering of any SAP material provided under this contract must be coordinated and approved by the host government activity PSO or PSM.

8. SAP information is not releasable to Defense Technical Information Center (DTIC).

9. Public release of any SAP information granted to a contractor under the performance of this contract is not authorized.

10. Access to any SAP information granted by the host government activity is governed by:

ADDENDUM 4 – ALTERNATIVE COMPENSATORY CONTROL MEASURES (ACCM)

1. Contractors may require access to Alternative Compensatory Control Measures (ACCM) information in the performance of the contract.

2. Access to and the protection of ACCM information is governed by CJCSM 3213.02D, “Joint Staff ACCM Program Manual” and DoD 5200.01 Volume 1-3, “DoD Information Security Program.”

3. Access to ACCM information will only occur “on-site” at the host government activity locations listed in item 8.a. No ACCM information or material will be stored, transferred, viewed, accessed, discussed, or processed at a contractor facility.

4. Access to ACCM information requires a current final U.S. Government clearance at the appropriate level.
