See FAR 15.001.
Deficiency
A material failure of a quote to meet a Government requirement or a combination of significant weaknesses in a quote that increases the risk of unsuccessful contract performance to an unacceptable level. See FAR 15.001.
Uncertainty Aspects of the quote that make it impossible to determine if a requirement will be met.
Risk
The potential for unsuccessful contract performance. The consideration of risk assesses the degree to which a Vendor’s quoted approach to achieving the technical factor or subfactor may involve risk of disruption of schedule, degredation of performance, the need for increased Government oversight, and the likelihood of unsuccessful contract performance.
(1) Factor 1: Technical Understanding and Personnel Qualifications. The Government will evaluate the following:
- The Vendor’s technical understanding and approach to performing the tasks identified in the PWS.
- The Vendor’s staffing plan which explains in detail how the Vendor will provide personnel that meet or exceed the qualifications specified in the PWS.
- The Vendor’s experience, if any, providing emergency medical services in a developmental testing or amphibious environment, including experience with related medical conditions and the demands of such environments.
- The Vendor’s ability and approach to providing the required services given the schedule fluctuations inherent in a developmental test environment.
(2) Factor 2: Management Approach. The Government will evaluate the following:
- The Vendor’s management approach in meeting the requirements of the PWS and how the company will oversee and manage the contract effort, maintain medical oversight, and communicate with the
Government.
- A Quality Control Plan that, at a minimum, explains how the vendor will maintain proper oversight over to the contract effort, ensure that staff maintain current certifications and licensure throughout performance of the contract, and ensure that EMT support is provided as ordered by the Government, addressing issues including, but not limited to employee turnover, absenteeism, and tardiness.
(3) Factor 3: Past Performance. The Government will evaluate past performance by reviewing each past performance reference or other source of past performance information to determine recency and relevancy. Recency and relevancy will be determined as follows:
Recency: Recency is assessed to ensure vendor past performance is considered based on information that is sufficiently current to allow for meaningful predictive value. References for contracts or task orders with at least 12 months of performance in the last 36 months will be considered to be recent.
Relevancy: Relevancy is assessed so that contract performance may be weighed in relation to its predictive value. To determine relevancy, the Government will consider the magnitude, scope, and complexity of each past performance reference.
Then the Government will weigh the quality of the performance on each effort in relation to the effort’s relevancy in order to determine a single rating for each Vendor from the Past Performance Acceptable/Unacceptable Rating
Method table below.
Table 4. Past Performance Acceptable/Unacceptable Rating Method
Adjectival Rating Description
Acceptable Based on the vendor’s performance record, the Government has a reasonable expectation that the vendor will successfully perform the required effort, or the vendor’s performance record is unknown.
Unacceptable Based on the vendor’s performance record, the Government does not have a reasonable expectation that the vendor will be able to successfully perform the required effort.
In the case of a vendor without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the vendor may not be evaluated favorably or unfavorably on past performance. Therefore, the vendor shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered “acceptable.”
(4) Factor 4: Price. The Government will evaluate the vendor’s price quote to determine fair and reasonableness using price analysis techniques and procedures. Price will be evaluated but not rated.
(b) Options. The Government will evaluate quotes for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that a quote is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
The resultant task order will include FAR 52.217-8. As part of the price evaluation, the Government will evaluate its option to extend services by adding a six month option period, calculated using half of the quantity in the final option year at the vendor’s final option period price, to the vendor’s total price. Accordingly, a separate evaluation for fair and reasonableness will be completed for this option and will be part of the above price evaluation.
(c) A written notice of award or acceptance of a quote, mailed or otherwise furnished to the successful vendor within the time for acceptance specified in the quote, shall result in a binding contract without further action by either party.
Before the vendor's specified expiration time, the Government may accept a quote (or part of a quote), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(d) Vendors must propose for all CLINs. Partial quotes will not be accepted.
