SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS
The following have been modified:
INSTRUCTIONS TO OFFERORS
SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO OFFERORS
L-1 Special Notices to Offerors.
In accordance with FAR 52.215-1, Instructions to Offerors – Competitive Acquisition, the Government intends to evaluate proposals and award a contract without discussions with Offerors (except clarifications as described in FAR 15.306(a)). Therefore, the Offeror’s initial proposal should contain the Offeror’s best terms from a cost or price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposal. Offerors will be considered on the basis of their individual merit, compliance with the criteria set forth in the SMAW MK-153 Mod 2 solicitation, and the quality and completeness of the Offeror’s proposal relative to the evaluation factors identified in Section M.
L-1.1 Failure to Submit Requested Information.
Failure to submit all of the information requested by this solicitation may be cause for unfavorable consideration or the proposal dismissal. Any proposal, modification, or revision received at the Government office designated in this solicitation after the exact date and time specified for receipt of offers is late and will not be considered.
L-1.2 Proposal Receipt.
Upon receipt, all proposals are subject to the terms of DFARs Clause 252.227-7016 “Rights in Bid or Proposal Information.” The Government reserves the right to reject any proposal that is not in accordance with Section L-3.2, entitled “Proposal Volume Requirements.”
L-1.3 Notification of Potential Organizational Conflicts of Interest (OCI) The offeror is reminded that certain existing contractual arrangements may preclude, restrict or limit participation, in whole or in part, either as a subcontractor or as a prime Contractor under this competitive procurement. Of primary concern are those existing contractual arrangements in which a Contractor provides support to programs, operations or related activities for Marine Corps Systems Command. General guidance is in FAR 9.505; however, this guidance is not all-inclusive. The offeror’s attention is directed to the "Organizational Conflict of Interest" (or similar) requirement which may be contained in current or completed contract(s) which prohibits the prime or subcontractor from providing certain supplies or services to the Government as described above during the period of the current "support" contract(s) or for a period after completion of the "support" contract(s).
Notwithstanding the existence or non-existence of an Organizational Conflict of Interest (OCI) clause or similar requirement in current or completed contract(s), the offeror shall comply with FAR 9.5 and identify whether an OCI exists and not rely solely on the presence of an OCI requirement. Offerors should review their existing contractual arrangements to determine whether they believe a potential conflict of interest exists, at any tier. If an offeror believes a potential conflict of interest exists, the offeror is required to notify the Contracting Officer within seven
(7) calendar days of the date of this solicitation.
The offeror shall provide at this time: (1) the contract number and name and phone number of the Contracting Officer for the contract which gives rise to a potential organizational conflict of interest; (2) a copy of the requirement; (3) the statement of work (or technical instruction) from the existing contract; (4) a brief description of the type of work to be performed by each subcontractor under the competitive procurement; (5) a proposed mitigation plan; (6) and any additional information the Contracting Officer should consider in making a determination of whether a conflict of interest exists. The Government may independently verify the information received from the Contractor.
Notwithstanding the above, the Government reserves the right to determine whether a conflict of interest exists based on any information received from any source. Any offeror with an Organizational Conflict of Interest that cannot, in the Government’s opinion, be mitigated, is ineligible to participate in the current competition and will have their proposal rejected.
The Government will notify an offeror of any conflict of interest within fourteen (14) calendar days of receipt of all required information. Those offerors deemed to have a conflict of interest may be ineligible for award. Failure to provide the information in a timely manner does not waive the Government's rights to make a conflict of interest determination. Proposal preparation and any expenditure are at the Offeror’s own risk and are not reimbursable by the Government if it is determined that an organizational conflict of interest exists.
Any offeror that proposes a subcontractor later determined to have a conflict of interest and deemed ineligible to participate in the current competition, may not be granted the opportunity to revise its proposal to remove the ineligible subcontractor. The Government reserves the right to determine which offerors continue as part of the evaluation through the normal source selection process.
If the offeror determines that a potential organizational conflict of interest does not exist at any tier, the offeror shall include a statement to that effect in its cover letter in response to this solicitation.
L-1.4 Use Of Non-Government Administrative Assistance Offerors are advised that a representative from the following contractors may participate as non-Government assistants in the evaluation of proposals:
CACI, Inc.
Assistants from the above company will receive access to proposal data and discussion items to facilitate the source selection evaluation process administratively. The non-Government assistants will not determine strengths and weaknesses, establish initial or final assessments of risks, or rate or rank any offeror's proposals. Non-Government assistants will sign non-disclosure/conflict of interest documents before carrying out his or her responsibilities.
Offerors submitting any objection to the Government disclosing proposal information to CACI, Inc. for administrative purposes shall do so to the Contracting Officer in writing before the date set for receipt of proposals.
The objection shall include a detailed basis for the objection.

Subcontracted work should be classified under the NAICS code appropriate for the type of work (see FAR Part 19 for NAICS code size standards).
L-2 Confidential Information The Freedom of Information Act (FOIA) and its amendments have resulted in an increasing number of requests from outside the Government for copies of contractor qualifications and proposals submitted to federal agencies.
The Government may deny such requests if the information requested should be withheld under FOIA on the grounds that the Offeror’s proposal contain “trade secrets and commercial or financial information” [5 USC§552(b)(4)]. The Offeror should mark its submissions in the following manner:

L-3.1 General The Offeror shall submit documentation illustrating their approach in satisfying the requirements of this solicitation.
Proposals must be clear, coherent, and prepared in sufficient detail for effective evaluation of the Offeror’s proposal against the evaluation criteria. Also, this documentation shall cover all aspects of this solicitation and include the Offeror’s approach for integration and program management activities. Proposals must clearly demonstrate how the Offeror intends to accomplish the project and must include convincing rationale and substantiation of all claims.
Unnecessarily elaborate brochures or other presentations beyond those sufficiently required to present a complete effective response to the solicitation are not desired. The Offeror may use graphs, charts, diagrams, and/or narratives, in sufficient detail for the Government to understand and evaluate the nature of the Offeror’s approach.
During the evaluation process, the Government will consider the degree of substantiation of the Offeror’s proposed approach in the proposal volumes and responses to any discussions if held.
Each proposal shall sufficiently demonstrate an understanding of and the ability to comply with all the requirements referenced in the SMAW MK-153 Mod 2 Solicitation, including the SOW and all other exhibits and attachments in Section J. Clarity, completeness, and conciseness are essential and the quality of the proposal is indicative of the Offeror’s capability to perform the solicitation requirements. Information contained in the Offeror's proposal regarding the organization, staffing, manning levels, experience or education qualifications of personnel that are to be utilized in performance of this contract shall be incorporated into the resultant contract.
The Offeror shall demonstrate the ability, resources, and experience required to meet the requirements, to include detailed procedures, plans, and methods. Present all information in sufficient depth for the Government to make a comprehensive evaluation of the Offeror’s understanding of the solicitation requirements and of the Offeror’s capability for successful performance. The proposal should demonstrate this understanding and capability in a concise, logical manner and should not contain superfluous material not directly related to this solicitation. The Government reserves the right to request certifications, test data, or any other documentation supporting the proposal claims, as deemed appropriate. No bid samples are requested.

https://www.fbo.gov .
b. Offerors shall confine their submission to essential matters, sufficient to define their offer, and provide an adequate basis for evaluation. Likewise, offerors are cautioned against general, vague, or unsubstantiated statements, which prevent or render difficult the Government’s evaluation of the proposal. Statements such as "will comply," or "noted and understood" without supporting narrative to define compliance are not acceptable.
Moreover, the Government will not assume that an offeror possesses any capability, understanding, and/or commitment that is not specifically delineated and supported in its respective proposal.
c. Solicitation attachments not designated For Official Use Only (FOUO) will be included in the posted RFP.
FOUO solicitation attachments will be sent to offerors upon request to the contacts noted in section L-3 above after verification of active status in System for Award Management (SAM) database.

L–3.2.1 Page Limitations. The cover letter, title page, table of contents, table of figures, list of tables, glossary of abbreviations & acronyms do not count against page count limitations. Proposal contents that exceed the stated page limitations will be removed from the proposal by the Contracting Officer, prior to turning the proposal over to the Government evaluation team, and will not be considered in the evaluation.
L–3.2.2 Format Proposals shall be prepared in Microsoft Word using “Arial” or “Times New Roman” 12-point font style on 8 ½” x 11” white paper with not less than 1” margins. Offerors may use 11” x 17” sized fold-out pages for tables, charts, graphs, or pictures that are not legible on 8½” x 11” paper. An 11” x 17” is a two-sheet equivalent (with regards to the page count limitations). Number pages consecutively. A page printed on both sides is two pages. Submission as double-sided printing/copying on recycled paper is encouraged. Bolding, underlining, and italics can identify topic demarcations or points of emphasis. Graphic presentations, including tables, while not subject to the same font size and spacing requirements, shall have text no smaller than 8-point font.
Each volume in the proposal shall include a copy of the cover letter (letter of transmittal), title page, and table of contents. The table of contents shall list sections, subsections, and page numbers. Each volume shall also contain an executive summary briefly describing the overall technical approach. The executive summary should be limited to one page. Each volume shall also contain a glossary of all abbreviations and acronyms used. Spell out each acronym used in the text the first time it appears in each proposal volume.
In addition to the paper copies identified above, the Offeror shall submit all proposal information in electronic format on a total of one Compact Disc (CD) per volume. Text and graphics portions of the electronic copies shall be in a format readable by Microsoft (MS) Office 2010, and the most current version of Adobe Acrobat. In case of conflict between the paper copy and the electronic copy of the proposals submitted, the paper copy shall take precedence. Bind each volume separately in hard side three-ring binders. CDs shall be “read-only” formatted for Microsoft Windows. Offeror(s) are responsible for ensuring printed material accurately reflects the electronic data on the CD.
L–3.2.3 Cross Referencing To the greatest extent possible, write each volume on a stand-alone basis so that its content requires minimum of cross-referencing to other volumes of the proposal. Offerors may cross-reference within a proposal volume where its use would conserve space without impairing clarity. Information required for proposal evaluations, which is not found in its designated volume or cross-referenced, will be assumed omitted from the proposal.
L–3.3 Anticipated Award Date
The anticipated award date for this requirement is 29 October 2015. This information is provided for use as a basis for schedules and burden (overheads, G&A, etc.) mid-point calculations. The Government reserves the unilateral right to adjust the actual contract award date.
