CLAUSES INCORPORATED BY FULL TEXT
52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Factor 1: Technical
Factor 2: Price
Responsibility Determination: Past Performance Information
A single, firm fixed price (FFP) contract resulting from this solicitation will be awarded to the responsible offeror whose offer is determined to have the lowest priced technically acceptable (LPTA) offer per FAR 15.101-2. This procurement will be conducted as a total small business set-aside under authority of FAR 19.502-2.
1. Technical:
The Government will evaluate the technical capabilities of the product proposed to determine if the offeror’s proposal clearly meets the minimum requirements as stated in the Statement of Work and the Performance
Specification for the SRS.
Factor 1 will be evaluated on an acceptable/unacceptable basis as noted below. A single unacceptable rating will render the proposal unawardable.
Technical Acceptable/Unacceptable Ratings
Rating Description
Acceptable Proposal clearly meets the minimum requirements of the solicitation
Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation
2. Price: The responsible Offeror meeting all the salient characteristics with the lowest price will be the awardee.
3. Responsibility Determination: Past Performance Information
Offerors shall not submit past performance information. Past Performance will be considered as part of the contractor’s responsibility determination under FAR 9.104-6(b), but will not be included as an evaluation factor.
The Government will seek relevant performance information on all responsive and otherwise Technically
Acceptable Offerors through sources such as DCMA offices, CPARS or PPIRS or other Government data bases and other sources that are available. The Government shall not be limited in its search for performance data.
(b) The Government will evaluate offers for award purposes by adding the total price for all ordering periods to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the outyear prices are significantly unbalanced.
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
