A new PIN shall be assigned when a part or assembly is changed in such a manner that any of the following conditions occur:

(a) When performance or durability is affected to such an extent that the previous versions must be discarded or modified for reasons of safety or malfunction. A new

PIN shall also be assigned to all subsequent higher assemblies up to the level at which interchangeability is reestablished.

(b) When the new version of an item is not interchangeable with the previous version.

(c) When a repair part within an item is changed so that it is no longer interchangeable with its previous version. A new PIN shall also be assigned to all subsequent higher assemblies up to the level at which interchangeability is reestablished (Either the original or the new item may be used in all units of all next higher assemblies.).

(d) When the previous version of an item is limited to use in specific articles or models of articles, and its new version is not so limited. A new PIN shall also be assigned to all subsequent higher assemblies up to the level at which interchangeability is reestablished.

The Contractor shall submit, in their own format, an Engineering Change Proposal with Notice(s) of Revision or a Request For Deviation which details the exact change being proposed. 52.211-17 DELIVERY OF EXCESS QUANTITIES (SEP 1989)

The Contractor is responsible for the delivery of each item quantity within allowable variations, if any. If the

Contractor delivers and the Government receives quantities of any item in excess of the quantity called for (after considering any allowable variation in quantity), such excess quantities will be treated as being delivered for the convenience of the Contractor. The Government may retain such excess quantities up to $250 in value without compensating the Contractor therefor, and the Contractor waives all right, title, or interests therein. Quantities in excess of $250 will, at the option of the Government, either be returned at the Contractor's expense or retained and paid for by the Government at the contract unit price.

L-1.0 Instructions, Conditions, and Notices

L-1.1 Introduction

a. The award will be made to the Offeror whose proposal represents the best value to the

Government, with appropriate consideration given to each of the three evaluation factors:

technical capability, past performance, and price. In making its determination, the Government will consider technical capability significantly more important than price. Past performance is more important than price but less important than technical capability. The importance of price as a factor in the final determination will increase with the degree of equality in the overall technical merit of the proposals.

b. A concise and comprehensive proposal is required. Organization, clarity, accuracy of information, relevance, and completeness are of prime importance. The proposal shall be complete and clear in all respects without the need for additional explanation or information.

The proposal shall be in sufficient detail and scope to permit the Government to evaluate it with respect to the evaluation factors specified in Section M of the solicitation.

c. Unnecessarily elaborate proposals beyond that sufficient to present a complete and effective proposal are not desired. Offerors shall confine their submission to essential matters, sufficient to define their offer, and provide an adequate basis for evaluation. Likewise, Offerors are cautioned against general, vague, or unsubstantiated statements, which prevent or render difficult the Government’s evaluation of the proposal. Statements such as "will comply," or "noted and understood" without supporting narrative to define compliance are not acceptable. Moreover, the Government will not assume that an Offeror possesses any capability, understanding, and/or commitment that is not specifically delineated and supported in its respective proposal.

d. The Offeror shall not include classified material in any proposal section.

e. All cost/price information shall be in U.S. dollars.

Period for Acceptance of Offers. The offeror agrees to hold the prices in its offer firm for 15 months from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation. Proposals submitted for consideration for award must address the full scope of the solicitation. Proposals which address only part of the solicitation or are not accompanied by four (4) bid samples will be considered unacceptable.

A ceiling on the number of pages in the proposal has been imposed, as indicated in the sections below. In the event that the offeror exceeds the maximum page limitations provided below, the

Government shall only evaluate the pages that comply with maximum number prescribed (starting with page one and continuing until the maximum number is reached) for the respective volume.

All pages, or any other material, in excess of the maximum number of pages stated shall not be evaluated.

As prescribed by FAR 52.215-1, the Government may award on the basis of initial offers received without discussion. Therefore, each initial offer shall contain the Offeror’s best terms from a business and technical standpoint.

Offeror’s are to provide four (4) Modular Stock bid samples for verification testing. All four bid samples shall be of the same configuration. The Offeror’s Modular Stock bid samples shall not require the use of bedding compound to install the M40 barreled action. Offerors’ bid samples that fail to meet this threshold requirement will not be assembled and, therefore, will not undergo

Government verification testing.

Offerors that intend to submit a 10-round magazine for consideration shall also provide five (5)

10-round magazines and five (5) magazine pouches with each of their bid samples.

Offerors shall not submit more than one (1) offer in response to this solicitation. The Government will test and evaluate only one (1) configuration of a Modular Stock per Offeror for the purpose of this effort. If an Offeror submits more than one (1) offer or more than one (1) configuration, the Government will randomly select one of the configurations for evaluation.

Offerors shall provide detailed assembly and repair instructions with the bid samples. The instructions shall include any critical metrics (e.g. torque values) and procedures related to the disassembly/assembly and maintenance of the Modular Stock. Instructions shall be printed in the

Offeror’s format and shall be included in either PDF or Microsoft Word format in the Offeror’s paper submission.

In addition, offerors are to provide sufficient spare/repair parts and any tools not in the Small

Arms Tool Kit required to maintain the Modular Stock during verification testing. All these items must be received no later than the date/time specified on page 1 (block 8) of the solicitation (NOTE: Quantico, VA will be on Eastern Standard Time during the closing date of this RFP). For planning purposes, offerors should provide enough spare/repair parts and special tools to support verification testing. If, during testing, the Government finds that the parts provided are insufficient to complete testing, the Government may contact the Offeror to request additional components. If notified of a part(s) insufficiency, the Offeror will provide the required part(s) within 1 business day. If the Offeror does not provide the required part, the bid sample will not undergo further testing, and will therefore be excluded from a potential award. The

Government reserves the right to award the contract(s) without holding discussions. If discussions are deemed necessary, the Government will evaluate proposals and make award after conducting discussions with offerors whose proposals have been determined to be within the competitive range. If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals (FAR 52.215-1).

With regards to this particular solicitation, due to pre-award testing budget constraints, the

Government shall accept no more than three (3) offerors into the competitive range. Therefore, an offeror's initial proposal should contain the offeror's best terms from a price and technical standpoint. An offeror’s proposal is presumed to represent his best efforts to respond to the solicitation. The Government reserves the right to reject any and all proposals, and to award to other than the lowest priced offerors. The Government also reserves the right to change any of the terms and conditions of this solicitation by amendment at any time prior to contract award and to allow offerors to revise their offers accordingly, as authorized by FAR 15.206.

Bid samples, spare parts, and tools shall be shipped using best commercial practices to facilitate immediate use/testing by the Government.
