Justification and Approval for Brand Name Specifications – Perforated Window Film

This document is a Justification and Approval (J&A) for the use of brand name or equal descriptions in a federal solicitation. The Regional Contracting Office – Parris Island (RCO-PI), supporting the United States Marine Corps Recruiting Command (MCRC) and six Marine Recruiting Districts (1st, 4th, 6th, 8th, 9th, and 12th), seeks approval to procure perforated window film with specific brand name specifications or approved equivalents. The requirement involves installing perforated window film across approximately 1,200 storefront locations at MCRC Single Service Recruiting facilities and Co-located Recruiting facilities, including Recruiting Stations, Recruiting Substations, Officer Selection Offices, and Permanent Contact Stations. Each facility averages 240 square feet of window coverage. The contractor must remove existing graphics, clean window surfaces, and install new perforated film with suite/office numbers included.

The specified product is 3M 8170-P40 4-mil opaque cast vinyl film with high gloss finish and 60/40 visual obscurity density, or equal; this must be laminated with 3M 8518 Gloss Overlaminate (or equal) for UV and debris protection, and sealed with 3M Edge Sealer Tape 8914 (or equal) at installation. The justification cites operational security, technical reliability, and durability requirements as rationale for these specifications, emphasizing the need for exact perforation patterns, high-definition through-vision, adhesive resistance in extreme climates, and uniform application across multiple mission sites. Market research identified multiple qualified vendors, with seven vendors expressing interest in the requirement and none objecting to brand name or equal descriptions. The Contracting Officer determined the anticipated cost to be fair and reasonable. Task Orders will be issued for actual quantities required and funded by MCRC with allocated fiscal year funds. The J&A is based on statutory authority under 10 U.S.C. 3204(a)(1) and implements brand name or equal competition under FAR 6.103-1(d) and DFARS 206.103-170(c).

JUSTIFICATION AND APPROVAL (J&A)

FOR USE OF BRAND NAME OR EQUAL DESCRIPTIONS, OR PROPRIETARY SPECIFICATIONS

AND STANDARDS, IN SOLICITATIONS

1. Contracting Activity.

The Regional Contracting Office – Parris Island (RCO-PI), located at Marine Corps Recruit Depot, Building 159 Corregidor St, Parris Island, South Carolina, is the Contracting Activity in support of the United States Marine Corps Recruiting Command (MCRC) and Marine Recruiting Districts (MCD) 1st, 4th, 6th, 8th, 9th, and 12th.

2. Description of the Action Being Approved.

This J&A seeks approval for the inclusion of a brand name or equal description in the solicitation for Perforated Film in support of the Marine Corps Recruiting Command (MCRC) and Marine Recruiting Districts (MCD) 1st, 4th, 6th, 8th, 9th, and 12th. This J&A seeks approval to procure specific brand name or equal from sellers or re-sellers of brand name perforated film.

3. Description of the Supplies/Services.

MCRC is taking steps to improve physical security of recruiting facilities. Perforated window film will allow for MCRC Branding Program success, while providing increased security for recruiting personnel and individuals visiting recruiting offices. As a part of this requirement, the current storefront glass graphics will be removed, and new perforated window film will be installed to span the entire glass window/door surface. Perforated window film will be installed on existing facilities that have no storefront graphics. Additionally, perforated film will be replaced on existing facilities as required. The graphics shall be installed at existing MCRC Single Service Recruiting facilities with glass front windows/doors and Co-located Recruiting facilities with separate entrance glass doors at each of the six (6) MCD. The contractor shall also be required to remove all current graphics and clean the window surfaces prior to installation of new perforated window wraps. This requirement entails approximately 1200 storefront locations with an estimated square footage of 240 square feet per facility. The Government will issue Task Orders for the quantities actually required. Recruiting facilities at each of the six (6) MCDs include but are not limited to Recruiting Stations (RSs), Recruiting Substations (RSSs), Officer Selection Offices (OSOs), and Permanent Contact Stations (PCSs). This requirement shall also incorporate any new recruiting facilities that are identified during the period of performance of this contract. The Delivery Orders will be funded by MCRC using allocated funds from the corresponding fiscal year.

Production of the perforated window film shall use 3M 8170-P40 4-mil or equal, opaque, cast vinyl film with a high gloss finish. Window Graphic Film will have a visual obscurity density of 60/40. The perforated film shall be laminated prior to installation with 3M 8518 Gloss Overlaminate or equal in order to protect the window film from UV rays and debris build up between the perforations. 3M Edge Sealer Tape 8914 or equal shall be applied at the time of installation to all edges of the perforated window film to help seal the film from the environment and prevent peeling. Storefront suite/office numbers shall be included in the perforated window film.

4. Statutory Authority Permitting Other Than Full and Open Competition.

Full and Open Competition after excluding sources will be utilized. This document meets the regulatory requirement at RFO DFARS 206.103-170(c) to execute the justification and approval addressed at FAR 6.103-1(d)o use brand name or equal descriptions. The statutory authority for this action is 10 U.S.C. 3204(a)(1).

5. Rationale Justifying Use of Cited Statutory Authority.

MCRC requires the brand specifications cited in Section 3 above, or their equivalent, to ensure the furnished perforated window film meets performance standards for Operational Security (OPSEC) and Technical Reliability. In Department of War (DoW) environments, window films are often utilized not just for aesthetics, but for critical privacy and light-control functions.1 The cited specifications will ensure that the film provides a specific, tested level of visibility and durability that generic alternatives may fail to replicate. The cited specifications ensure exact perforation patterns that have been validated for high-security privacy. It also guarantees high-definition through-vision for personnel inside the facility to maintain situational awareness. The cited specifications are more likely to use adhesive technologies (e.g., solvent-based acrylics) that resist peeling in extreme climates. Finally, the cited specifications facilitate uniform application across multiple mission sites, ensuring a consistent security profile. Generic brand patterns may vary, potentially compromising interior concealment from outside observation. Inferior materials can cause "ghosting" or distortion, hindering the ability to monitor surroundings. General adhesives may fail prematurely, leading to increased maintenance costs and security gaps. And finally, generic brand is more likely to experience inconsistency between batches or different manufacturers which may create a fragmented and unprofessional operational appearance. Therefore, MCRC requires the use of the cited specifications.

6. Description of Efforts Made to Solicit Offers from as Many Offerers as Practicable.

Market research was conducted in accordance with FAR Part 10 and revealed that there are multiple vendors in the commercial market capable of providing the required supplies. The proposed contract was synopsized on SAM.gov on 3 February 2026, which provided notice of the Government’s intent to utilize brand name or equal descriptions. Seven vendors expressed an interest in the requirement..

No vendors expressed any concern with the use of brand name or equal descriptions. No additional market research was conducted because it is not practicable or in the Government’s best interest, for the reasons discussed in section 5, for the Government to write its requirement without the use of brand name or equal descriptions.

1 This document refers to the Section 3 brand name specifications, or their equal or equivalent, collectively as “the cited specifications.”

7. Determination of Fair and Reasonable Cost. The Contracting Officer has determined that the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, the activity has no plans at this time to eliminate the use of brand name or equal descriptions from future solicitations for the types of supplies/services covered by this document; however, this will be reassessed during follow-on acquisition planning.
